nESOLUTION SUPPORTING AN AERIAL BREAK IN ACCESS
ON INTERSTATE 81 LOCATED IN FREDERICK COUNTY, VIRGINIA
WHEREAS, the Commonwealth Transportation Boazd (CTB) is authorized to consider requests
for breaks in access on State -owned limited access highways such as Interstate 81 in Frederick County,
Virginia; and,
WHEREAS, a request for an aerial break in access on Interstate 81 has been made to the CTB by
the developers of Russell 150 Project lying on the east side of Route Interstate 81 in Shawnee Magisterial
District, Frederick County, Virginia; and,
WHEREAS, the Russell 150 Project entails the construction of a fly -over bridge connecting the
City of Winchester and the County of Frederick through the street known as East Tevis Street; and,
WHEREAS, the alignment proposed by the developer is consistent with the recently adopted
Winchester - Frederick MPO Long -Range Transportation Plan as well as the Frederick County Eastern
Road Plan; and,
WHEREAS, the Frederick County Board of Supervisors, at its meeting on July 25, 2007,
considered a Resolution of Support for the aerial break in access for this project.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of
Frederick, Virginia, hereby support the requested aerial break in access for Interstate 81 to permit a fly-
over bridge constructed at the location for East Tevis Street as shown on the adopted transportation plans
and as officially requested of the Commonwealth Transportation Board (CTB) by the Frederick County
Board of Supervisors on behalf of Russell 150, LC, the developer.

County, Virginia.
The letter resolution needs to be addressed to Mr. Garret Moore, District Administrator,
Virginia Department of Transportation, c/o Mr. Scott Alexander, 14031 Old Valley Pike,
Edinburg, Virginia 22824, -once the County passes the resolution in support of the aerial break in
the I -81 limited access road.
I understand from the e -mail from Scott Alexander, a copy of which is attached hereto,
that the fly -over bridge is reflected in the MPO 2030 Transportation Plan and the Frederick
Eastern Road Plan.

Note in this instance that, in addiiion to the CDA approval, the bridge is reflacted in the MPO 2(130 Transporta8on

As a follow up to my letter of February 23, 2006 regarding the above topic, please be
advised that the Frederick County Board of Supervisors, at its February 22, 2006 R.egulaa
Meeting, unanimously voted to endorse /support a break in access on Route 37 West at
the location of the future extension of Jubal Early Drive. With regard to the County
serving as requestor for said change in limited access; Frederick County will serve as
requestor solely to seek a waiver of'the expenses associated wish VDOT's posting of a
WiIlingness for Public Comment notice to allow public input to be collected concerning
this request prior to CTB action, as noted in Section 24 VAC 30- 400- 20C(3)(a), As a
further point of'clazification, the applicant!developer will be responsible for completing
the remaining application requirements for this proposed change in limited access
control, to include.the global traffic analysis and environmental analysis required under
Section 24 VAC 30- 400- 20C(2)(a} & (b).

Re: Route 37/ Jubal Early Drive Future Interchange
Dear Mr. Moore,
Willow Run is a community that will be located on the east side of Route 37 in Frederick County
and has a common boundary with the City of Winchester. As a condition of the rezoning of the
property, the land owners have been requested to construct 3ubal Early Drive, a designated major
collector highway, across the property and connect This highway with an interchange on Route
37. The above mentioned interchange is the Topic of this letter.
We, along with our development partner, Greystone Properties LLC requests that VDOT accept
this application for a Break in Access that will allow the construction of the interchange and the
necessary four ramps to serve the southbound and northbound traffic. Dubai Eazly Drive -and the
interchange have been endorsed by the Fredenck County Board of Supervisors, anti the Common
Council of the City of Winchester. This mayor collector and interchange has been predominately
displayed on the 1998 Winchester Area Transportation Study (WAYS} and the 2005 Winchester -
Frederick Metropolitan Planning Organization 2030 Transportation Plan (MPO).
Much work nos been accomplished through the cooperation and guidance of the Edinburg and
Staunton VDOT offices to supply the Commonwealth Transportation Board with the analysis
necessary to conclude that the new interchange is essential for the east -west traffic flow through
the City. We ask for the support of your office to expedite ibis request and for your personal
encouragement to the CTB to grant the Break in Access at the next Board Meeting.
