RESOLUTION IN SUPPORT OF FREDERICK COIINTY
ASSIGN -A- HIGHWAY PROGRAM
WHEREAS, the Frederick County Board of Supervisors has made it a priority to rid Frederick County's
roadways, highways and streets of unsightly litter through its litter initiative, Frederick County Clean Sweep;
WHEREAS, Frederick County believes that expanding the initiative to include the Assign -A- Highway
Program will enhance the natural beauty of the region; protect the health, safety and welfare of the cifizens; and
improve tourism and economic development;
WHEREAS, the Frederick County Circuit Court, based upon its constitutional and statutory powers and
authorities may assign criminal defendants and probationers to collect litter along roadways, streets and private lands
as part of the court's probation powers;
WHEREAS, the Frederick County Board of Supervisors believes that the Frederick County Litter Control
Officer, working in conjunction with the Circuit Court of the County of Frederick, can develop an effective program
to abate litter on Frederick County's highways, streets and roads.
NOW THEREFORE BE IT RESOLVED that the Frederick County Board of Supervisors hereby
establishes Frederick County's Assign -A- Highway Program as outlined in a court order to be entered by the
Frederick County Circuit Court.
BE IT FURTHER RESOLVED, that the Assign -A- Highway Program shall be modeled and authorized
pursuant to the prospective court order and that the prospective court order shall be incorporated in the resolution by
reference.

Ms. Gloria Puffinburger, solid waste manager, presented the Assign — A —
Highway program which has been adopted in 29 counties in Virginia as an economical
method of controlling litter. The attached memorandum dated January 25, 2008,
describes this program in detail. In essence, the program relies on probationer labor to
pickup litter on state maintained roadways. Frederick County would need to employ a
litter coordinator to manage the program including coordinating and reviewing the road
assignments with the probationers.
After listening to the presentation and discussing the difference between
probationers and parolees, the committee unanimously recommended that the Assign — A
— Highway program be forwarded to the board of supervisors for their review and
endorsement. A possible resolution has been attached for the board's consideration.

I would like to request the committee's consideration and support of the Assign -A- Highway
(AAH) Program, a litter cleanup initiative first instituted in 2003 in Southwest Virginia. Now
successfully implemented in 29 counties and the City of Norton, AAH provides sustained litter
removal along roadways at very little cost to localities. (Clarke County and the City of Winchester
are also pursuing AAH.) Criminal probationers —not prison parolees —are assigned to pick up
litter year -round along specific sections of roadways as part of their probation terms. Assigned
areas are periodically monitored by a litter control officer or warden, and if the assigned area is
littered, the responsible probationer is taken into court to face revocation of probation.
Utilizing nearly 9,500 probationers, the program removed 3,000 tons of debris from 6,700 miles
of roadways during fiscal year 06/07. This resulted in a savings of over $308,000 local dollars, at
a rate of $5.15 per hour. (See attached.) Obviously, the cost savings per hour would be
considerably more in Frederick County_ Through the program, some probationers are assigned to
stream cleanups, illegal dumps, or landfill or recycling center duties. Generally, the Virginia
Department of Transportation participates by collecting filled bags and providing supplies.
(Through AAH, VDOT avoids the $150 per road mile that it expends through contract services
for litter cleanup.)
In order to move forward, this department requires the support of this committee and the Board
of Supervisors prior to approaching the circuit court judges and probation officers. The judge
must be on board with starting the program, because he can refuse to sign an order implementing
a local AAH program. (Letter from Buchanan County Circuit Court Judge Keary R. Williams is
attached.)

AAH Program
For its part, Frederick County must be willing to hire a litter control officer to administer the
program. The litter control officer or warden would prepare reports and statistics; promote and
supervise the AAH program; organize cleanup projects; implement a surveillance program
for illegal dumps; investigate illegal dump activities and develop documentation for prosecution;
respond to citizen inquiries and complaints; and coordinate dumping area cleanup efforts with
offenders and landowners. (Projected costs: $42,500 with benefits; plus the cost of fuel, office
supplies and a cell phone.)
Funds are not currently included for this position in the FY 08/09 budget. Despite current budget
constraints, this department would like to implement AAH in July of 2008. An investment of
approximately $50,000, gains Frederick County a permanent, proven effective and ]ow -cost
remedy to unsightly roadside litter and illegal dumps. Aside from a clean community which
improves quality of life and boosts tourism, the Assign -A- Highway Program will elicit goodwill
from area residents by putting probationers to work cleaning up the community.

During Tuesday's Public Works Conunittee meeting, there were basically two concerns expressed
by the group about the proposed Assign -A- Highway Program. The first concerned the definition
of "probationer ". Whether an individual is subject to supervised or unsupervised probation, the
litter control officer will be responsible for determining if that offender will be assigned to work
along the roadside or better suited for a litter crew. For instance, someone convicted of breaking
and entering would be confined to a road crew supervised by the officer and not left on his own.
Generally, those working the roads of Frederick County will be those individuals who. have been
convicted in Frederick County. If the City of Winchester develops a program, it may make sense
at times to assign a county offender to city streets and vice versa. This will be decided on a case -
by -case basis by the litter control officers.
Regarding the second concern, liability, � 8.09 -226.8 Code of Vi�inia provides for civil
immunity for public officials and private volunteers participating in roadway litter pick -up
program for probationers. Therefore, if a probationer is unable to clean his section of roadway
and a friend or relative substitutes for him, the county is still relieved of all liability.

1. Coordnrate with the probation office to assign criminal defendants to specific sections of highways, streets and
roads throughout and appear at least four (4) times annually before the Court with
the probation officcr(s) when the Court reviews the Probation Docket on the first day of each term of the year,
for the purposes) of informing the Court as to each assigned probationer's compliance or lack thereof;
2. Prepare a road assignment map of , to be kept current with the names, telephone
numbers and dates of assignments for each section to be cleaned by such criminal defendant; and
3. Monitor each assigned section of road on a periodical basis (at least bi- weekly) to assure compliance with
the assignments and to report to the probation officer any failure by a criminal defendant to keep his or her
assigned section free of litter on a continuous basis, having first contacted the defendant by telephone or in
person to ascertain the defendant's reasons, if any, for non - compliance, which shall be made part of the
report.
The litter control officers designated by this ORDER shall report and refer to the probation office any
matters that arise with the criminal defendants prior to taking any independent enforcement action other than that
authorized herein or informing the Cour[ on term day as herein specified.
All probationers who have been assigned the duty of picking up litter as set forth in their respective cases
shall forthwith begin working the assigned area upon being contacted by his or her probation officer and shall timely
and truthfully respond to any inquires by the litter control officers relative to this program. Failure of any
probationers) to respond effectively within the judgment of the litter control officer and the responsible probation
officers) shall, with the proper findings of the Court, be grounds for revocation of probation.
The Clerk is directed to record this order in the current order book and send copies to the county probation
and litter control officer.
