064-08AMENDMENT Action: PLANNING COMMISSION: June 4, 2008 - Recommended Approval BOARD OF SUPERVISORS: June 11, 2008 � APPROVED ❑DENIED AN AMENDMENT TO THE FREDERICK COUNTY 2007 COMPREHENSIVE POLICY PLAN CHAPTER 6, LAND USE WHEREAS, An amendment to The Frederick County 2007 Comprehensive Policy Plan, Chapter 6, Land Use, to modify the boundaries of the Urban Development Area (UDA) to more appropriately reflect the current land use designations ofthe Comprehensive Policy Plan and provide consistency with policy boundaries, resulting in an approximate reduction of 798 acres in the UDA, was considered. Also considered was an accompanying land use policy text modification. This amendment was reviewed by the Comprehensive Plans and Programs Subcommittee (CPPS), and the Planning Commission during their regularly scheduled meetings; and WHEREAS, The Comprehensive Plans and Programs Subcommittee (CPPS) recommended approval of this amendment on May 12, 2008; and WHEREAS, the Planning Commission held a public hearing on this Comprehensive Policy Plan amendment on June 4, 2008; and WHEREAS, the Board of Supervisors held a public hearing on this Comprehensive Policy Plan amendment on June 11, 2008; and WHEREAS, the Frederick County Board of Supervisors finds the adoption of this Comp *ehensive Policy Plan amendment to be in the best interest of the public health, safety, welfare, and in good planning practice; NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors that the Frederick County 2007 Comprehensive Policy Plan, Chapter 6, Land Use, is amended to modify the boundaries of the Urban Development Area (UDA) to more appropriately reflect the current land use designations of the Comprehensive Policy Plan, resulting in an approximate reduction of 798 acres in the UDA (maps attached). Ruddy, AICP�� Deputy Director RE: Public Hearing; Urban Development Area (UDA) Boundary Clarification at Stonewall lndustrial Park (resulting in a reduction in the UDA of 798 acres). This is an Amendment to the 2007 Comprehensive Policy Plan; Chapter 6, Land Use. DATE: June 04, 2008 The Board of Supervisors requested that the Comprehensive Plans and Programs Subcommittee and Planning Commission review, evaluate, and provide a recommendation on a clarification of the UDA Boundary in the area surrounding the Stonewall lndustrial Park. The CPPS provided a positive recommendation of this request at their May 12, 2008 meeting and the Planning Commission, following a Public Hearing, endorsed this modification at their June 4, 2008 meeting. Following the required public hearing, the Board of Supervisors may act on this modification to the UDA boundary of the Comprehensive Policy Plan. Back in September of 2006, the Board of Supervisors approved a series of modifications to the UDA (Urban Development Area) and SWSA (Sewer and Water Service Area) boundaries. The purpose of the modifications to the UDA and SWSA boundaries was to more appropriately reflect the current land use designations of the Comprehensive Policy Plan. At your Apri19, 2008 meeting, the Board of Supervisors requested that the UDA be adjusted to reflect the location identified in the accompanying map. It was the belief of members of the Board of Supervisors that this was the appropriate location of the UDA when considering the land use policies of the Comprehensive Plan and the existing and approved land uses in this area. The adjustment in the area of the UDA, as a result of this clarification, would be a reduction in the UDA of approximately 798 acres. There would be no change in the SWSA and there would be no implications for the existing land uses and approved proffered rezonings in this area, including the Russell- Glendobbin Subdivision. Such a clarification would be consistent with the intention of the original adjustment and in line with the thinking of the Board of Supervisors. It is important to reiterate that the existing land uses and zoning entitlements, including the land zoned and master planned as the Stonewall Industrial Park would not be impacted by the adjustment.
