006-064~G~ CDG~ W `` BOARD OF SUPERVISORS ,,~,~, ,,, RESOLUTION IN SUPPORT OF FREDERICK-WINCHESTER SERVICE AUTHORITY WASTELOAD ALLOCATION PETITION WHEREAS, the waste water generated in Frederick. County is reclaimed by the Opequon Water Reclamation Facility owned by the Frederick-Winchester Service Authority; WHEREAS, Frederick County is a partner in the Frederick-Winchester Service Authority and has made significant capital improvements in the Opequon Water Reclamation Facility; WHEREAS, Frederick County, through their appointments to the Frederick-Winchester Service Authority Board, which has promoted the removal of nutrients from its receiving streams through past upgrades and expansions of the Opequon Water Reclamation Facility; WHEREAS, the Frederick-Winchester Service Authority, acting on behalf of the County _ has constructed a facility and the Department of Environmental Quality has permitted that facility with a seasonal tiered permit, which should warrant additional wasteload allocations for the facility. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Frederick, Virginia does hereby support and endorse the Frederick-Winchester Service Authority's petitioning of the State Water Control Board for consideration of additional wasteload allocation, based on the nutrient removal capabilities and hydraulic capacity of the facility presently in place. MOFFETT -EXECUTIVE DIRECTOR FREDERICK-WINCHESTER SERVICE AUTHO SUBJECT: WASTELOAD ALLOCATION PETITION OPEQUON WATER RECLAMATION FACILTTY The Frederick-Winchester Service Authority has, for some time, been pursuing with the Department of Environmental Quality, an increase in the nutrient wasteload allocations given to the Opequon Water Reclamation Facility, under the new Bay Regulations. The Service Authority still strongly believes that, from its technical review of the facility, which was constructed with nutrient removal capabilities and placed online in 2002, along with a tiered flow pemat under which the facility has operated, that the Opequon should be allocated higher nutrient caps than adopted in these regulations. In an attempt to obtain additional allocations, the Frederick-Winchester Service Authority is preparing to submit a petition to the State Water Control Boazd for fiuther consideration of the present allocations. It would be helpful to our efforts if we could receive resolutions of support for this effort from the Frederick County Board Of Supervisors and the City Council of the City of Winchester to include in our petition. I have provided a draft from which a final resolution may be constructed.
