070-07GRANTING THE EXTENSION OF SEWER AND WATER SERVICE OUTSIDE
OF THE UDA AND SWSA TO SERVE A PROPOSED CHURCH ON A FIVE
ACRE PARCEL
(JUSTES DRIVE LDS CHURCH)
WHEREAS, The LDS Church wishes to construct a new facility on a five acre
parcel along Justes Drive. The Church is seeking the use of public sewer and water for
this planned facility. The property is located on the south side of Justes Drive, in close
proximity of the Admiral Byrd Middle School, on land presently owned by Daryl R.
Russell et als Co-Trustees, and is identified by Property Identification Number 76-A-5, in
the Shawnee Magisterial District; and,
WHEREAS, The request for consideration of this extension of sewer and water
service would only serve the proposed LDS Church; and,
WHEREAS, This extension of service outside of the SWSA and UDA request
was sponsored and presented to the Board of Supervisors by the Shawnee Magisterial
District Supervisor on June 13, 2007; and,
NOW, THEREFORE, BE IT ORDAINED that the Board of Supervisors
authorize the extension of water and sewer service outside of the SWSA and the UDA for
the proposed five a re church property.

SUBJECT: Extension of Water and Sewer Service Outside of Policy Boundaries
Proposed Justes Drive LDS Church
DATE: June 6, 2007
Supervisor Fisher has been approached to sponsor a Comprehensive Policy Plan
Amendment request which would enable a proposed church to access the County's public
water and sewer system; the proposed church site is located outside of the SWSA. The
applicant has requested that the rights to water and sewer be processed as a Board of
Supervisors' directed special exception, rather than proceed through the annual
Comprehensive Policy Plan Amendment process. Through the special exception process,
the Board directs the Comprehensive Plans and Programs Subcommittee (CPPS) to study
the request, and report back to the Board with a recommendation.
The proposed church site would be located on Justes Drive, adjacent to Admiral Byrd
Middle School. This proposed church site is zoned RA Rural Areas Zoning District -
churches are by-right permitted uses in the RA Zoning District. The proposed site is
located outside of the Urban Development Area (UDA) and the Sewer and Water Service
Area (SWSA). Therefore, current County policy would prohibit the proposed church
from utilizing the public water and sewer services. Private on-site health systems are
generally expected in the RA Zoning District.
The proposed church site is identified in the 2003 Comprehensive Policy Plan as planned
industrial use. With the recent construction of the Admiral Byrd Middle School and the
Evendale Elementary School in this area, it may be appropriate for the County to
undertake a land use study of this area to ascertain the most appropriate land uses, as well
as provisions for public water and sewer service, and an enhanced transportation network,
prior to granting additional water and sewer rights.
Via the adoption of the attached resolution, the Board would be directing staff to present
the request to the Comprehensive Plans and Programs Subcommittee (CPPS), and
process this Comprehensive Policy Plan ("Policy") special exception.

Dear John:
The purpose of this letter is to request to be included on the next available Board of
Supervisors agenda to discuss the referenced request. Specifically, this request is to
allow water and sewer service to a proposed 5.02±-acre site that is currently zoned RA,
Rural Areas District located on the south side of Justes Drive. The proposed land use for
this site will be for a new LDS Church that will not include day care. A 12-inch water
line and an 8-inch sewer line were designed and approved by FCSA as an improvement
associated with the development of the public schools, which have been stubbed out on
the proposed 5.02±-acre site.
Please find attached information for the Board of Supervisors agenda including an Aerial
Overview Map, a SWSA and UDA Location Map, a Water and Sewer Map Exhibit for
the requested area, an illustrative of the Traditional Heritage church model that is
proposed for construction, a Minor Rural Subdivision Plat for the proposed 5.02±-acre
site, and information that has been considered favorably by FCSA. Please review this
