July 12, 1972239 MINUTES MEETING - JULY 12, 1972 ' At the Regular Meeting of the Board of Supervisors of the County of Frederick, Virginia, held in the Supervisors' Room on the 12th day of July, 1972. PRESENT: Raymond C. Sandy, Chairman; J. Robert ?.Russell, Vice - Chairman; Richard F. Madigan; Donald R. Hodgson; and Dennis T. Cole. The meeting was called to order by Chairman Sandy. The minutes of the Regular Meeting held on the 14th day of June, 1972, and the Regular Night Meeting held on the 28th day of June, 1972, were read and approved upon motion made by Richard F. Madigan and seconded by Donald R. Hodgson. MR. POMEROY, VIETERANS' CLAIMS AGEN REQUESTS ADDITIONAL SPACE Mr. Pomeroy appeared before the Board stating that he served six counties and each county provided him with adequate space to conduct his interviews. He requested additional space in Frederick Coutrty stating that the facilities he was presently.using were not adequate. He agave a brief report pointing out the amount of claims secured for veterans in Winchester and Frederick County. Mr. Alderman asked Mr. Pomeroy if the City of Winchester paid any of his expenses and Mr. Pomeroy said that the City paid his telephone bill. Mr. Alderman then asked what the breakdown was between city and county veterans. Mr. Pomeroy stated that he could not give an exact figure but would estimate 658 from ' County and 358 from Winchester. Mr. Alderman stated that the problem created by this request was the Mr. Pomeroy was asking for office space for one day a week and at the present time the county has overcrowded conditions for permanent personnel. . Mr. Sandy stated that the Board would try to coordinate the office space now used by Mr. Pomeroy and the Forest Ranger and thanked Mr. Pomeroy for coming before the Board. ACCOUNTS PAYABLE - APPROVED Mr. Boyd presented the accounts payable and stated a change in the Potomac Edison Account from 99.97 to $217.65 and in the Treasurer, City of Winchester Account from $168.13 to $557.73. Therefore accounts totaling $31,384.59 were read and approved and ordered to be paid from the Fund by Warrants #00767 through #00875 inclusive and Warrants #00880 through #00882 inclusive. The accounts payable were approved upon motion made by Dennis T. Cole and seconded by Richard F. JUNE PAYROLL - APPROVED Payrolls totaling $14,135.84 paid from the General County Fund by Warrants #00712 through #00758 J 1 inclusive; and payroll.totaling $561.00 to Samuel Thomas, Sr, by Warrants #00703 to #00710 and Warrants #00759 to 00766 were read and approved upon motion made by Dennis T. Cole and seconded by Richard F. Madigan. PARKS AND RECREATION - ACCOUNTS AND PAYROLL - APPROVED Mr. Boyd stated a dhange in the Creative Hands Account of $40.00 making the total Parks and Accounts $1,770.34. Therefore accounts totaling $1,770.34 for Parks and Recreation , paid by Warrants #05172 to #05190 read and approved upon motion made by Dennis T. Cole and seconded by Richard F. Madigan. 240 0 Payrolls in the amount of $2,993.33, paid from the Parks and Recreation, Fund by Warrants #05151 to #05171 were read and approved upon motion made by Dennis T. Cole and seconded by Richard F. Madigan. APPROPRIATION REQUESTS - APPROVED Repairs for Flood Damage - Approved In order that repairs might be made to various facilities that were damaged during the recent flood, general authorization was requested by the County Administrator to make the necessary repairs. Mr. Alderman stated that due to the nature of the damage, cost figures are not available at this time, therefore, an open appropriation is requested, to repair the following damaged facilities: Road to Dog Pound Roof of Court House Ceiling in Court House Armel and Highview Schools - water damage in basements Upon motion made by Richard F. Madigan and seconded by J. Robert Russell, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein authorize repairs to facilities damaged in the recent flood; and, BE IT FUTHER RESOLVED, That the County Administrator shall report back to the Board the cost of such repairs. The above resolution was passed unanimously. Increased Dues - Virginia Association of Counties - Approved Mr. Alderman stated that the Executive Board of the Virginia Association of Counties had requested an amendment to the Association's By -Laws which would increase membership dues from 3(� to 4C per capita and recommended the acceptance of said amendment. Upon motion made by Richard F. Madigan and seconded by Donald R. Hodgson, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein accept the recommendation of the Executive Board of the Virginia Association of Counties and does therefore cast an affirmative vote in favor of said recommended amendment to the Association's By -Laws. The above resolution was passed unanimously. Building Inspector - Change Fund - App roved . Upon motion made by Dennis T. Cole and seconded by Donald R. Hodgson, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein authorize the Director of Accounting to establish a twenty -five dollar ($25.00) petty cash fund for the Director of Inspections to be used for making change. The above resolution was passed unanimously. Repairs - Armel School Community Center - Approved The County Administrator stated that bids had been received on the repairs desired for Armel School Community Center and recommended that the Board approve these repairs. Upon motion made by Donald R. Hodgson and seconded by J. Robert Russell, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein authorize repairs to Armel Community Center in an amount not to exceed two thousand dollars ($2,000.00). The above resolution was passed unanimously. 241 APPOINTMENTS Board of Zoning Appeals Upon motion made by Richard F. Madigan and seconded by J. Robert Russell, BE IT RESOLVED, That the Board of Supervisiors of the County of Frederick does herein recommend the following individuals to the Circuit Court for consideration for appointment to the Board of Zoning Appeals: Back Creek - Frank Brumback Henry Brumback Stonewall - Margaret E. Starliper William C. Ellis The above resolution was passed unanimously. ` Welfare Board - Increase Membership of Board - Denied Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan for discussio the following resolution was presented. BE IT RESOLVED, By the Board of Supervisors of the County of Frederick that in E accordance with Section 63.1 -40, Code of Virginia (1950) as amended, the Frederick County Board of Public Welfare is herein increased from membership of three (3) to a membership of five (5) persons; and, BE IT FURTHER RESOLVED, That the above membership shall be assigned according to magisterial district. Mr. Cole stated that he had heard several complaints against the Frederick County Welfare Department and thought it would be in the best interest of the citizens of Frederick County to have one person from each district to serve on the Welfare Board. Mr. Cole said that he would like for any member of the Board of Supervisors to speak now 'if there was any reason why he felt this was not proper. Mr. Colestated that membership from each district was provided for by the State and that on various other boards of the County, there was a member from each district. The following statement was presented by Mr. Cole: I have had complaints against the Frederick County Welfare Department and think it would be in the best interest of the citizens of Frederick County to have one person from each magisterial district to serve on this Welfare Board. At the present time we have only three. L What is the reason that we shouldn't have five members on the Frederick County Welfare Board, one from each magisterial district when this is permitted by state law. On the Planning Commission, Sanitation Authority, Recreation Department and the Board of Zoning Appeals,' we have one person or more from each district to serve-on these committees. We were selected to serve the people of Frederick County and I think that if we don't put one person from each district on the Welfare Board, that we are letting the people of Frederick County down. Mr. Russell stated that he felt the Board was operating efficiently now and he would like to see the membership remain at three. He stated that he had had no serious complaints concerning the Welfare Board. Mr. Sandy asked if the workload carried by the three members was satisfactory and Mr. Russell said that it was. Mr. Hodgson stated that he had no comments at this time but felt that he needed more time to think about an increase to the Board. He said he felt it was:not necessary to increase it now, but that'this could be done at any time it became necessary. Mr. Madigan had no comment. Mr. Sandy stated that he respected Mr,.Russell's views because he was on the Board and that if he felt that communication with the people could be improved, and that there was 242 dire need to improve this communication, he would vote to increase the membership, but under the circumstances he would vote no. Mr. Cole called for a question. By recorded vote with Dennis T. Cole voting "for" and Raymond C. Sandy, J. Robert Russe Richard F. Madigan and Donald R. Hodgson voting "against" the above resolution was rejected. Appointment - Welfare Board Richard F. Madigan placed the name of Charles Orndor£f in nomination to fill the on the Welfare Board. Dennis T. Cole place the name of Mary Jolliffe in nomination to fill said vacancy.. Mr. Madigan moved that nominations be closed and Mr. Hodgson seconded the motion. By recorded vote with J. Robert Russell, Richard F. Madigan, Donald R. Hodgson and Raymond C. Sandy casting their votes for Charles Orndoff and Dennis T. Cole casting his vote for Mary Jolliffe, Charles Orndoff was elected to fill the vacancy on the Welfare Board. Upon motion made by Richard F. Madigan, and seconded by Donald R. Hodgson, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein appoint Charles Orndoff to the Frederick County Board of Public Welfare for a term of four years, beginning July 1, 1972 and ending June 30, 1976. The above resolution was passed unanimously. REPAIRS REQUESTED - ROUTE #612 Mr. Raymond Stelzl appeared before the Board and requested that repairs be made to the damage caused by the recent flood on Route #612. He stated that the road had been graveled but was still in very poor condition and the residents in the area were having quite a problem getting in and out. He stated that there was stagnet water lying there now and the pipe to carry off the water was a 36 inch pipe and just was not large enough. Mr. Sandy stated that he would relay this information to Mr. King of the Highway Department. CABANISS SUBDIVISION PLAT - APPROVED Mr:.Bass presented the plat of Cabaniss Subdivision for approval. Upon motion made by Richard F. Madigan and seconded by J. Robert Russell, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein approve the plat of Cabaniss Subdivision - Route 608 located in Back Creek District. The above resolution was passed unanimously. DOG WARDEN REPORT Mr. Harold Whitacre, Frederick County Dog Warden, appeared before the Board and gave hi: report for the month of June. Mr. Whitacre presented a claim from M. B. Ritenour for $15.00 for one ewe killed on June 25, 1972, and recommended that payment be denied because it could not be determined that the ewe was in fact killed by dogs. Upon motion made by Richard F. Madigan and seconded by J. Robert Russell, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein deny payment in the amount of $15.00 to M. B. Ritenour for one ewe kill on June 25, 1972, in that it has not been determined that the ewe was in fact killed by dogs. The above resolution was passed unanimously. n 243 TRAILER PERMITS - APPROVED Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan, BE:.IT RESOLVED, That the Board of Supervisors of the County of Frederick does herei approve the following trailer permits: ' 1. Tolbert T. Ashby - Route 636 2. Spaid - Route 259 • TRAILER PERMIT - T. G. ADAMS - DENIED Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan, BE IT RESOLVED ,.That the Board of Supervisors of the County of Frederick does herein deny a trailer permit to T. G. Adams -in that said trailer is located in R -2 Zone. The above resolution was passed unanimously. REPORT BUILDING INSPECTOR Mr. Blair Webber,Frederick County Building Inspector, appeared before the Board and presented the following report covering the period from June 14, 1972 through July 12, 1972: ' Building Permits Issued ; 36 Amount of Permits Issued $340,423.40 Fees from Permits Issued $ 905.00 Number of Inspections Made 49 REPORT - HIGHWAY DEPARTMENT - MR. KING Mr. King of the Highway Department appeared before the Board and gave his monthly report. Various roads were discussed and Mr. Sandy referred the request of Mr. Stelzl for repairs to Route #612 to Mr. King. REFUSE COLLECTION POINT SYSTEM - APPROVED Mr. Alderman stated that the Collection Point System was being used in many throughout Virginia (some 20 or 30 counties). He explained it was a rural type system. Mr. Russell stated that he was in favor of the system but would like to see the containers emptied as- required and not necessarily on a regular schedule. There was discussion as to the cost factor with Mr. Cole and Mr. Madigan stating that a six year cost factor would be more feasible than a 10 year cost factor. The Board I I agreed. Upon motion made by Richard F.•Madigan and seconded by Dennis T. Cole, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does hereit authorize the County Administrator to obtain bids for the establishment and operation of a refuse collection point system for Frederick County; and, BE IT FURTHER RESOLVED, That these bids shall be as follows: 1. Contract Operation of the complete collection system. 2. County Purchase or Rent of Equipment with County Operation, and, BE IT FURTHER RESOLVED, That based upon the lowest possible cost factor for a six .(6) year period, the proposed system shall be- established. 244 The above resolution was passed unanimously. CODE ADMINISTRATION - APPROVED Mr. Alderman stated that due to the problems encountered with the building permits bei in one place and the zoning administrator in another and because of the workload carried by Mr. Rudolph, it was recommended that the administration of zoning and the trailer ordinance, be transferred from the Office of the Commissioner of the Revenue to the Office of the County Administrator. Mr. Rudolph requested that he be given a report of such actions and the Board agreed. Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein ' transfer the administration of the zoning and trailer ordinances from the Office of the Commissioner of the Revenue to the Office of the County Administrator; and, BE IT FURTHER RESOLVED, That the County Administrator is herein authorized to assign duties of Code Administrator to the proper staff agency or person. The above resolution was passed unanimously. EMERGENCY FLOOD CONTROL ORDINANCE - APPROVED Mr. Alderman stated that due to the heavy „rains and the recent flood, it has been pointed out the need for control of construction and flood control regulations. Upon motion made by Dennis T. Cole and seconded by J. Robert Russell, BE IT RESOLVED, By the Board of Supervisors of the County of Frederick that the Flood Control Ordinance is herein.adopted on an emergency basis in accordance with the provisions of the Code of Virginia as amended; and, BE IT FURTHER RESOLVED, That this action is being taken in light of the recent flood situation which occurred in Frederick County in order that the citizens of this county will be 1protected from undue loss of property and life. AN ORDINANCE ESTABLISHING FLOOD CONTROL DISTRICTS AND BUILDING AND DEVELOPMENT REGULATIONS WITHIN THOSE DISTRICTS. The above resolution was passed unanimously. The meeting was recessed for fifteen minutes and subsequently reconvened by Chairman Sandy. BOARD PRESENTS CHECK TO FREDERICK COUNTY FAIR ASSOCIATION Mr: Raymond Sandy, on behalf of the Frederick County Board of Supervisors, presented a check in the amount of $1,000.00 to the Frederick County Fat Association. Hodgson, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein approve on third and final reading the following ordinance: AN ORDINANCE TO AMEND AN ORDINANCE PASSED ON JUNE 28 1971, TO PROVIDE FOR.PRECINCTS, ESTABLISH BOUNDARY LINES FOR PRECINCTS, TO NAME EACH PRECINCT, AND TO ESTABLISH A PLACE FOR EACH DISTRICT. Cole voting "for” the above resolution was passed unanimously. 245 TAX REIMBURSEMENTS - APPROVED Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick, in accordance with the recommendation of Eston A. Rudolph, Jr., Commissioner of Revenue does herein.approve the reimbursement in the amount of $71.40 to Pansy B. Estep for taxes paid erroneously for the year 1971. The above resoulution was passed unanimously. Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick, in accordance with the recommendation of Eston A. Rudolph, Jr., Commissioner of Revenue, does herein approve the reimbursement in the amount of $142.40 to George W. and Barbara Monk for taxes paid erroneously for the years 1969, 1970, 1971. The above resolution was passed unanimously. . REQUEST TO BROADCAST MEETINGS - WHPL - DENIED A.request was presented to the Board from Shenval Broadcasting Corporation, WHPL, to broadcast the Board meetings. Mr. Sandy stated that the Board had discussed this request and felt there were too many breaks in the regular meetings and therefore they would be unsuitable for broadcast. He stated that Public Hearings would be more conducive to broadcast but that permission would have to be granted first. FINANCIAL REPORT FOR FREDERICK COUNTY PRESENTED Mr,.Alderman gave a brief report the financial standing of Frederick County at the end of Fiscal Year 1971 -72, stating that the County had started the year with an operational balance of $866,000.00 and a projected deficit of $228,000.00; whereas at the end of FY 1911 - 72,Frederick County had an operational balance of $1,202,000.00 in its general operating fund and approximately $400,000.00 in operational balances in other funds. The County Administrator further stated that instead of the $228,000.00 projected deficit, which never materialized, the County at the end of the fiscal year, had a surplus of approximately $100,000.00. Mr. Alderman stated that the County had experienced a great change during the past ri fiscal year and that the figures clearly show what the Board is trying to do. He stated that he felt the County should see where we stand after a supposed disasterous year of spending ourselves into bankruptcy. Mr. Alderman pointed out that the balance left in the school fund would go into the school building fund. ELECTRICAL CODE ORDINANCE THIRD AND FINAL READING - APPROVED Mr. Alderman read the Electrical Code: in full. Mr. Sandy asked if there was any discussion. There was none. Upon motion made by Donald R. Hodgson and seconded by J. Robert Russell, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein approve on.third and final reading the following ordinance. AN ORDINANCE ADOPTING THE "NATIONAL ELECTRIAL CODE" AS THE ELECTRICAL CODE FOR FREDERICK COUNTY, VIRGINIA AND THE PROVISION FOR AN ELECTRICAL INSPECTOR. 246 ( O R D I N A N C E )(See Pages 245A and 245B.) Mr. James DeHaven, Supervisor of Electrical Inspections for the Middle Department of F Underwriters, appeared before the Board concerning the position of Electrical inspector. He stated that he felt his organization could do the work better and at much less cost. He said he serviced a five state area and that they had access to information necessary to perform th services. He stated that they had lost several areas but when the difficulties arose concern finding a qualified inspector, most of the areas returned for their services. Upon motion made by Dennis T. Cole and seconded by Richard F. Madigan, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick does herein designate the Fire Underwriters as the Official Inspection Agency until August 31, 1972; and, BE IT FURTHER RESOLVED, That upon September 1, 1972, the County of Frederick shall assume all electrical inspections. FLOOD DAMAGE ASSISTANCE RESOLUTIONS - APPROVED . In accordance with the provisions of paragraph 12, b (5) of the Basic Plan of the Commonwealth of Virginia Natural Disaster Assistance Relief Plan, which became law on May 5, 1972, the following resolution is adopted: Upon motion made by Richard F. Madigan and seconded by Donald R. Hodgson, BE IT RESOLVED, That as a result of severe flooding of many areas of Frederick County during the passage of Hurricane Agnes during June 20, 1972, the Board of Supervisors declare that an emergency existed in the County of Frederick for the period from about June 20, 1972 until approximately June 21, 1972. BE IT FURTHER RESOLVED, That the Director of Civil Defense is hereby authorized and directed to take such action, and to make such applications that may be necessary, to insure that maximum assistance is rendered to the inhabitants of the County of Frederick by County Agencies. , The above resolution was passed unanimously. COUNTY ADMINISTRATOR APPOINTED AGENT - FLOOD DISASTER ASSISTANCE Upon motion made by Richard F. Madigan and seconded by Donald R. Hodgson, BE IT RESOLVED, By the Frederick County Board of Supervisors of the County of Frederick, Virginia, that Roger H. Alderman, County Administrator, be and is hereby authorized to execute for and in behalf of Frederick County, Virginia, a public entity established under the laws of the State of Virginia, this application and to file it in the appropriate State Office for the purpose of obtaining certain Federal financial assistance under the Federal Disaster Act (Public Law 606, 91st Congress) The above resolution was passed unanimously. Adoption of National Electrical Code. All of the provisions of the National Electrical Code 1971 edition, known and desig- nated as NFPA No. 70 -1971 are hereby adopted as the standard for electrical work in Frederick County, Virginia. ' Section 2. When and Where Copies of the National Electrical Code May Be Obtained. Copies of the National Electrical Code, NFPA No. 70 -1971 adopted by reference as provided in Section 1 may be obtained at the office of the County Building Inspector, during regular business hours. Section 3.. Conformity with approved standards; materials, etc. enumerated by ' Underwriters Laboratories, Inc. No electric wiring for light, heat, power or other purposes shall be installed here- after in any building or structure or for any outdoor electrical display or sign, nor shall any alteration or extension of any existing electrical wiring system be made except in con- formity with approved electrical standards. Where no specific standards are prescribed by this Chapter, or.any amendment hereof or addition hereto, then conformity with the latest edition of the National Electrical Code, including supplements thereto, shall be prima facie evidence of conformity with approved standards. The materials, fittings and devices enumerated in the list of inspected electrical materials of Underwriters Laboratories, Inc. or its successor, as revised from time to time shall be acceptable as suitable for use under this chapter. Section 4. Refusal of electrical service when installation does not conform to National Electrical'.-Code. The company, firm or corporation furnishing electric service to the County shall refuse electrical service to any installation when notified by the electrical inspector that ' such= _wdrk not being installed in conformity with the National Electrical Code, adopted by reference in Section 1. Section 5. Exception of Minor repair work, etc. from application of Chapter. The provisions of this Chapter shall not apply to minor repair work, such as re- placing flush tiand�snap'switches,.kep1-aciing fuses,. changing. lamp sockets, taping bare joints, and replacing drop cords, nor to temporary electrical home displays. Section 6. Exception to maintenance, etc. on premises of employer of electrician, etc, from Chapter. This Chapter shall not apply to maintenance and repairs on the premises of a person regularly employing electricians for that purpose, nor to installation,.construction, main- tenance or repairs of public utility companies for the transmission of electricity from the source of supply to the service entrance on the premises where it is to be used, nor to the installation and maintenance of telephone and telegraph plants and equipment. Section 7. Creation of position;_ Position of Electrical Inspector for the Middle ' Department Association of Fire Underwriters. There is hereby created the position of electrical inspector for Frederick County, Virginia. The electrical inspector for the Middle Department Association of Fire Underwriters shall be the electrical inspector for the County, until otherwise directed by the.'Board of Supervisors. He shall hold such position without additional compensation from the County. ' Section 8'. Duties generally; reports: The electrical inspector shall make all inspections and reinspectibns required in this chapter and which may, necessary from time to time. He shall perform the duties specified in this Chapter and file reports of all electrical work inspected with the County Inspector. Section 9. Application for inspection of wiring, etc. It shall be the duty of any person installing wires, conduits, apparatus, fixtures or other appliancesr for the use or transmission of electricity for light, heat, power or :�1�.1•: biNF b? i;H.Nl other purposes falling within the provisions of this Chapter, first to file application for electrical inspection upon the forms furnished by the Middle Department Association of Fire Underwriters, which forms may be obtained from the electrical inspector or the Office of the County Inspector. It shall be unlawful for any person to make new installations of electrical wiring, alterations or additions to the existing wiring of any building, or to wire any building for the placing therein of any electric lights, motors, heating devices or other apparatus for the use or transmission of electricity without first making application for the inspection of such work. Section 10. Concealing electrical work prior to inspection and approval. It shall be unlawful for any person to conceal electric wiring in any building or wall until it has been inspected and approved. Section 11. Inspection and Reiinspection of electric wiring generally. The electrical inspector shall, within a reasonable time after receiving the appli- cation for inspection of electric wiring installed or altered, make an inspection of such work and such tests as may be necessary to determine whether it conforms with the provisions of the National Electrical Code, adopted as provided in Section 1, and shall make a reinspection of electrical wiring installations whenever he deems it necessary in the, interest of public safety. Section 12. Notice to correct defects found in electric wiring. Upon finding defects in electric wiring, upon inspection under Section 11, it shall be the duty of the electrical inspector to notify the person installing such wiring of such defect and to further notify such person, firm or corporation that such work must be remedied within thirty days from date of notification. Section 13. Failure to correct reported defective wiring. It shall be unlawful for any person installing electric wiring to fail or refuse to correct any defective wiring reported to him as provided in Section 12, within thirty days from the date of notification thereof, or within any extension of time granted by the electri- cal inspector to remedy such defects. The penalty will be a fine not less than $10.00 nor more than $250.00 and /or confinement in jail not longer than 30 days. Section 14. Right of entry. The electrical inspector shall have the right, during reasonable hours, to enter any building in the discharge of his official duties or for the purpose of making any inspection, reinspection or test of the electrical equipment, or its installation. Section 15. Emergency disconnection of electric equipment. In cases of emergency where necessary for safety to persons or property, or where electrical equipment may interfere with the work of the fire department, the electrical inspector may cause the immediate disconnection of any electrical equipment. Section 16. Appeal by person aggrieved by action or decision. Any person aggrieved by any action or decision of the electrical inspector under this Chapter may appeal to the Board of Supervisors within thirty days from the date of the action or decision in question. Section 17. Should any section or provision of this ordinance be decided to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of any other section and provision of this ordinance. Section 18. This ordinance shall be in full force and effect upon its adoption nt by the Board of Supervisors of Frederick County, Virginia.
