At the Regular Meeting of the Board of Supervisors of Frederick County,
Virginia, held in the Supervisors Room on the 9th day of February, 1970.
PRESENT: Thomas B. Rosenberger, Chairman; J. Robert Russell, Donald L.
Baughman, Thomas B. Brumback, and Raymond C. Sandy.
The minutes of the last meeting held on the 12th day of January, 1970,
were read and approved.
REPORTS: UPON MOTION duly made and seconded the reports of Harry L. McCann,
Treasurer; Esten 0. Rudolph, Commissioner of Revenue; Lacy H. Anderson, Sheriff of
County, E. Eugene Gunter, Commonwealth Attorney; Roberta A. James, Department of Welfare,
John Wolfe, Counly Agent and H. C. Crowder, Road Engineer were read and approved.
HOME DEMONSTRATION AGENT - PAULINE BACCARY
Robert Tudor appeared before the Board and introduced Mrs. Pauline Baccary
of Whittier Acres, Frederick County. Mr. Tudor explained to the Board that she had been
approved by the State office and was willing to start to work February 15, 1970.
Upon motion of Robert Russell and seconded by Raymond Sandy,
Be it Resolved, that Mrs. Pauline Baccary be approved Extension Agent in
Home Economics for Frederick County.

Joseph Palmer appeared before the Board with his written report and claims
to be presented for payment.

Be it Resolved, that the County build an adequate Dog Pound on County owned
property.

Be it Resolved, that the Board pay rent for present Dog Pound at the rate

Be it Resolved, that the Board approve the purchase of a larger live trap
to be used by the Dog Warden.

Robert Barbour, City Councilman appeared before the Board with a copy of the
Winchester Pornography Ordinance and asked the Board to consider the matter at this time.

H. C. Christianson and James Barnett appeared before the Board to request the
building of eight (8) Tennis Courts in Winchester Recreation Park as a project of Frederick
County at a cost of $27,500.00

BE IT RESOLVED, by the Board of Supervisors of Frederick County, Virginia ,
THAT WHEREAS, the majority of the School Board' members in the State of
Virginia are paid an annual salary ranging from sik hundred dollars to twelve hundred
and Whereas the salary paid ' School Board' . members shall not exceed the amount d
as a maximum annual salary (Virginia School Laws: 22- 67.2);
NOW BE IT RESOLVED, that the School Board' of Frederick County, Virginia,)
requests Delegate F. L. Largent, a member of the House of Delegates of the General Assembly
of Virginia, to seek approval of an annual salary not to exceed $600 to be paid the members
of the School Board' • of Frederick County, Virginia, beginning July 1, 1970.
BE IT FURTHER RESOLVED, that the Board of Supervisors of Frederick County,
Virginia, forward a copy of the above resolution to Delegate F. L. Largent.
This resolution shall take effect immediately.

A sizable delegation appeared before the board asking that Joseph Palmer,
Dog Warden be removed immediately from the office of Dog Warden.
No action was taken.

Mrs. Clevenger and several citizens appeared before the board
with suggestions for help with Dog Shelter. They noted that a regional office in
Waterford, Va. may be helpful. ._

At a regular meeting of the Frederick County Board of Supervisors on
Monday, February 9, 1970 the folowing resolution was moved by Donald Baughman;
seconded by J. Robert Russell; and unanimously passed:
BE IT RESOLVED that pursuant to an opinion of the Attorney General of
Virginia, in accordance with Section 15.1 - 9.1:1, and with a full complete and unanimous
vote of confidence as expressed previously by this Board and as expressed now; the
Frederick County Board of Supervisors does hereby officially appoin& E. Eugene Gunter,
Esquire as County Attorney and does fully and completely recognize that he has
served in that capacity since he asked to be relieved as Commonwealth's Attorney
of Frederick County, Virginia. The said Board does further provide that-the said
E. Eugene Gunter, Esquire shall be compensated at the rate of$$423.33 per month
and that such salary shall be retroactive to August 1, 1969. The said appointment
of E. Eugene Gunter, Esquire as County Attorney shall continue for so long as he
shall remain the duly elected Commonwealth's Attorney of Frederick County, Virginia
and shall further be on leave from performing his criminal duties as-Commonwealth's
Attorney of Frederick County on his own motion pending the disposition of certain
ethics charges filed against him.

it is sent to the State for approwal.

Be it resolved, that upon the application of Roy R. Boyce et al to amend the
Zoning Ordinance of Frederick County, Virginia, in reference to 46.6 acres of land lying
approximately one mile South of Rest Methodist Church between U.S. Route 11 and the
Martinsburg and Potomac Railroad in Stonewall Magisterial District, more particularly
described in .a plat and survey attached to the Petitions in this instance, from Agricultural
Limited, District A -2 to Industrial, Limited, District M -1•be approved after duly advertised
Public Hearing as presented in petition, which includes a 400 foot set -back on the property,
still remaining A -2.

Morris weighing scales at a quoted price of $2,500.00 from National Fruit Products Co.
to be used at the Frederick County Land -fill Dump.

On motion duly made and seconded and unanimously passed the amendment to Paragraph
6 of the Ordinance pertaining to the Frederick County- Winchester Landill Garbage Dump was
approved and passed on the first and second reading and the Public Hearing was set for Mond
March 9, 1970, at 11:00 A. M., at which time the third and final reading of the proposed
amendment will be had, and a final vote on the adoption or rejection of said amendment will
be held.
Accounts totaling $17.,630.35 were read and approved and ordered to be paid from
the General County Fund by Warrants No. 6015 and 6088 inclusive: Livestock, Fowl Claims and
Dog Warden's Salary totaling $533.97 were read and ordered to be paid from the Dog Fund by
Warrants No. 281 and 286 inclusive.

WHEREAS, Virginia is faced with the situation of providing for an increasingly

WHEREAS, the Commonwealth has offered, through legislation in previous sessions,

the opportunity to better provide for these retardates at the state, regional, and local
levels; and

WHEREAS, the legislative intent to provide community facilities and programs
through community mental health service boards, and through regional residential centers for
the mentally retarded, appear in the 1970 -1972 Governor's Budget Recommendations to be not
funded, or inadequately funded;
NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of Supervisors
requests the General Assembly to consider favorably and grant to the Department of Mental
Hygiene and Hospitals such appropriations as shall be adequate to satisfy the present needs
of the Department of Mental Hygiene and Hospitals, including appropriations for capital
outlay for the Northern Virginia Training School and such other programs of the Department c
Mental Hygiene and Hospitals as do presently exist and as are planned for the coming years.

Nicholas Googin, Manager of Plaza Theater presented a resume of the present
rating system for films and noted no need for a Pornography Ordinance at this time in
Frederick County, Virgins.

PARKING - HITCHING DOT

Be it Resolved, the Board does hereby request the Winchester Parking Authority
replace the County Meters on the Hitching Yard Parking Lot, as was the oral agreement
submitting statement for County's share of expenses for renovating the lot.
THISTLE CONTROL - VOLUNTARY
Upon motion of J. Robert Russell and seconded by Donald L. Baughman,
Be it Resolved, that the Board unanimously passed a resolution to ask County
citizens to cooperate with the local ASCS County Committee in voluntary control of Thistle
in Frederick County.
Upon motion of Raymond Sandy and seconded by Donald Baughman,
Be it Resolved, the Board passed a resolution to send the 2nd payment in the
amount of $37,418.42 to the Lord Fairfax Community College.

Also the Board recommended to the Planning Commission that they appoint Benjamin
M. Butler as Secretary to the Planning Commission in place of Joseph A. Massie, resigned.

PLANNING COMMISSION RESOLUTION
BE IT RESOLVED, that the Frederick County Board of Supervisors does hereby
express its sincere appreciation and thanks to D. K. Russell, Clinton L. Ritter, and
Joseph A. Massie, Jr., Esquire for their excellent past service on the Frederick County
Planning Commission.
The people of Frederick County and this governing body owe a great deal of
gratitude to these men for their devoted and loyal public service on the Frederick County
Planning Commission.
It is directed that a copy of this Resolution be forwarded by the Clerk of this
Board to D. K. Russell, Clinton L. Ritter, and Joseph A. Massie, Jr. and that the said

Doyle Atchley and L. C. Ellis appeared before the Board in opposition to W. S.
Company.using the County road at Clearbrook for heavy equipment crossing; the air pollution
of Lime Dust; and the notation that the W. S. Frey Company is not using a flagman at the
Penna. Railroad crossing.

Be it Resolved, that the Board request the State Highway Department, if possible,
to remove the heavy equipment road sign and erect a guard rail along side of the County road

3. The principal of and interest on said bonds shall be payable at United

at Farmers and Merchants National Bank,, Winchester, Virginia.
4. Said bonds shall be dated Aprilj, 1970; shall be in the denomination of
$5,000 each; shall be numbered from 1 to 80, inclusive; shall bear interest at the rate
of 5 3/4% per annum, payable semiannually October 1 and April 1, and shall mature in
numerical order $25,000 bonds on April 1, in each of the years, 1971 to 1986, inclusive.
5. Unless the executed bonds shall be delivered or tender of delivery shall be
made to the Virginia Supplemental Retirement System or its authorized agent within 60 days
from the date of this resolution. The Treasury Board shall have the privilege of wi

the week of April 20, 1970 to April 25, 1970, as Virginia Improved Environment Week, and
does further acknowledge its appreciation to the National Trust for Historic Preservation

with Belle Grove in Frederick County, Virginia.

FREDERICK COUNTY OFFICE BUILDINGS - FEASIBILITY STUDY
At a regular meeting of the Frederick County Board of Supervisors held on Monday,
April.13, 1970, it was duly moved by Donald J. Baughman and seconded by Thomas B. Brumback
and unanamiously passed as a resolution that:
BE IT RESOLVED, that WHEREAS.. the present office, court, and other facilities of
the County of Frederick are inadequate and, WHEREAS, such facilities are provided with
only over - crowded and inadequate parking facilities and, WHEREAS, the needs of the people
of Frederick County would be better served by all of offices, courts, and other facilitie
being located in the said County of Frederick proper;
The Frederick County Board of Supervisors does hereby authorize a survey and
feasibility study to be made by such qualified persons or consulting firms as may be
later employed by the said Board to study relocation, building costs, and traffic flow
in a desirable relocation area outside of the present city limits of the city of Winchester,
Virginia, and outside of the proposed annexation area. This shall include, but shall
not be limited to, the determination of the feasibility of providing spacd for court
facilities for the Frederick County Court, the Frederick County Circuit Court, and any'
other court servicing Frederick County and for Which Frederick County is responsible
for providing facilities, office space for all county officials and agencies, including
sheriff's facilities, a jail, radio rooms, and other facilities necessary to serve
such department. This study shall also cover the feasibility of possible future facilities
such as a civic center, library, auditorium, and any other public building or structure
that may promote the general and public welfare of the citizens of Frederick County.
This survey and study shall further determine what disposition can or may be made of the
court house, office building and other land
existing/and structures belonging to the County of Frederick now located within the City
of Winchester, Virginia.
Such survey and feasibility study shall be staffed, conducted, completed, and a
report made to the Frederick County Board of Supervisors within a reasonable time and
as soon as reasonably possible.

request the Virginia Department of Highways to remove the equipment crossing sign at W. S.
Frey Stone Quarry between Clearbrook and Brucetown, Virginia and to disallow the said W. S.
Frey Company to move heavy equipment across the said secondary route between Clearbrook and
Brucetown, Virginia, in that such equipment leaves dirt and mud on the road and creates a
dangerous situation in this respect and in many other respects for traffic travelling•on the
said public highway.
The Clerk is directed to send a copy of this Resolution to Mr. A. C. Crowder
Resident Engineer, Virginia Department of Highways, Edinburg, Virginia, and the said A. C.
Crowder is requested to make a report to the said Frederick County Board of Supervisors in

AIR POLLUTION - QUARRY - W. S. FREY CO. - RESOLUTION
At a regular meeting of the Frederick County Board of Supervisors on Monday,
April 13, 1970, the following Resolution was moved, seconded, and passed unanimously:
Be it Resolved, that the Frederick County Board of Supervisors does hereby
notify the W. S. Frey Company, Inc. that it is duly concerned with the pollution of the aLr
in the northern part of Frederick County caused by the operation of the said W. S. Frey
Company, Inc. and its stone quarry operation. It is therefore requested that the said W. S.
Frey Company, Inc. take such steps as are necessary to eliminate or appreciably cut the
amount of pollution of the air caused by its stone quarry operation. The said W. S. Frey
Company, Inc. is further advised that this Board has initiated and expects to cooperate with
the State Air Pollution Board in reference to the stated problem.
The Clerk is directed to send a copy of this Resolution to W. S. Frey Company,
Inc., Clearbrook, Virginia, and a copy to the State Air Pollution Control Board, Commonweal
of Virginia, Richmond, Virginia.

CLEARBROOK AREA - FLASHING SIGNAL ON PENNSYLVANIA RAILROAD
At a regular meeting of the Frederick County Board of Supervisors on Monday,
April 13, 1970, the following Resolution was moved, seconded, and unanimo passed.
Be it Resolved, that the Frederick County Board of Supervisors is of the
opinion that a- flashing light signal is necessary at the intersection of the spur line of
the Pennsylvania Railroad and State Secondary Route 672 between Clearbrook and Brucetown,
Virginia in Frederick County, Virginia, to insure the safety of the users of the said State
Route 672. In view of the above situation, the Frederick County Board of Supervisors does
hereby specifically and respectfully request the said Pennsylvania Railroad to immediately
install good and sufficient flashing signal lights at said intersection and to advise the
said Frederick County Board of Supervisors as to when such act will be accomplished.
The Clerk is hereby directed to send an attested copy of this Resolution to

At a regular meeting of the Frederick County Board of Supervisors on Monday,
May 11, 1970, the following Resolution was moved by Donald L. Baughman, seconded by
Raymond C. Sandy, and unanimously passed:
"BE IT RESOLVED that the Frederick County Board of Supervisors does hereby express
its concern over the objectionable situation existing as a result of the burning of residue
by the Henkel- Harris Company on Pleasant Valley Road in Frederick County, Virginia; such
situation having been brought to the attention of the said Board by a Petition containing
over 100 signatures.
BE IT FURTHER RESOLVED that the Henkel- Harris Company is hereby respectfully
requested to voluntarily correct the situation promptly and expeditiously.
BE IT FURTHER RESOLVED that a copy of this Resolution be sent to the said
Henkel- Harris Company, the State Health Department, and the State Air Pollution Control
Board."

Mile, Known as McFarlands Hollow Road, a total distance of .45 Miles, be, and hereby is,
added to the Secondary System =of State Highways, pursuant to Section 33 -141 of the Code
of Virginia of 1950 as amended.
A forty Foot (40 unrestricted right of way is guaranteed. This right of
way is recorded in Deed Book 363, page 4 59, Dated May 12, 1970.
And furthur, that the balance of new addition funds for the 1969 -70 fiscal
year be used for the improvement of this road, and additional funds from the 1970 -71
fiscal year be used to the extent necessary to complete this new addition.

transfers within the 1969 -70 school budget to provide for additional needed expenditures
in administration; evening; part -time; summer school; other instructional costs;
auxiliary agencies; operation of school plant; maintenance of school plant; capital outlay;
and building fund. The request is made on condition that the School Board's expenditures
for the year from county tax funds do not exceed the 1969 -70 appropriation of $1,773,416.00
for operation and capital outlay but will permit the School Board to use any additional
funds allocated from the state for operation and /or capital outlay as well as funds from
the approved Literary LoAN- Fund and the Virginia Supplemental Retirement System Funds
for school construction:

Be it Resolved, that the Frederick County Board of Supervisors does hereby
go on record as being absolutely and unconditionally opposed to the reissuance of any permit
to W. S. Frey Company, Inc. for a heavy equipment crossing in reference to State Secondary
Route 672 between Clearbrook and Brucetown, Virgina, in Frederick County. This resolution
is passed after a thorough and complete considergtion of the rights and interests of the
said W. S. Frey Company, Inc. and the rights and interests of the residents and citizens of
Frederick County, Virginia, using the said road and living in the said area. This Board
wants to make it quite clear that it is of the opinion that the safety of the public traveli
the said State Secondary Route 672 should not be sacrificed for the private convenience of
the said W. S. Frey Company, Inc. No amount of convenience to a corporate entity can justif
the endangering of the life of even one individual unnecessarily.
Be it further Resolved, that the Frederick County Board of Supervisors, in
the event that the Virginia Department of Highways should see fit not to follow the firm and
concrete position set forth- does hereby demand that the renewal of any new permit in
reference to the aforesaid crossing carry with it the following conditions:
1. Flagmen be required on each side of the said crossing during
the periods that the said crossing is in use.
2. The said Secondary Route 672 and the pavement thereof be
strengthened, if necessary.
3. Dust palllatives or pavement be used for at least 50 feet on each side
of the said equipment crossing to prohibit dust.
4. The said W. S. Frey Company, Inc. be required to take such action as
is necessary to prohibit the tracing of mud or any other foreign
substance on the roadway.
5. A guardrail be placed between the north siQe of State Route 672 and th
quarry pit of the said W. S. Frey Compan (and norther type of barrier

ADMU1ENT OF MINUTES OF SUPERVISORS OF FREDERICK COUNTY,
VIRGINIA ON JUNE 8, 1970.
LARD FAIRFAX PLANNING DISTRICT COMMISSION
Whereas, the Virginia Area Development Act (Title 15.1, Chapter 34,
Section 15.1 -1400, et seq., Code of Virginia (1950), as amended), authorizes the orger
of a Planning District Commission by written Charter Agreement; and
WHEREAS, pursuant to Title 2.1, Chapter 6.1, Section 2.1 -63.5 of the
Code of Virginia (1950) as amended, geographic boundaries of a Planning District have been
established; and
WHEREAS, the governing bodies of the governmental subdivisions embracing
the majority of the population within said Planning District desire to organize a Planning
District Commission by written Charter Agreement; and
WHEREAS, the Board of Supervisors of the County of Frederick, Virginia,
desires to join in organizing such a Commission so that the County of Frederick will become
a party to such Charter Agreement and be represented in the composition of the membership
of such Commission;
THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF
FREDERICK, VIRGINIA:
1. That on the 8th day of June, it hereby adopts the CHARTER AGREEMENT 0
LARD FAIRFAX PLANNING DISTRICT COMMISSION, a copy of which is attached hereto and made a
part of this resolution.
2. That E. Eugene Gunter, County Attorney, of the County of Frederick
be and hereby is authorized and directed to sign and execute, on behalf of the County of
Frederick, the CHARTER AGREEMENT OF LARD FAIRFAX.PLANNING DISTRICT COMMISSION, a copy of
which Charter Agreement is attached to this resolution.
3. That George B. Whitacre, Clerk be and hereby is authorizec*hd directe
to witness the signature of said E. Eugene Gunter, County Attorney, and to affix the officio
seal of the County of Frederick on said CHARTER AGREEMENT OF LARD FAIRFAX PLANNING DISTRICT

PLANNING DISTRICT COMMISSION
This Charter Agreement to organize a Planning District Commission made this
10th day of May, by and between the undersigned govermental subdivisions as authorized
by the Virginia Area Development Act (Title 15.1, Chapter 34, Sections 15.1 -1400, et seq.,
' Code of Virginia (1950), as amended):
NOW THEREFORE it is agreed that:
ARTICLE 1
Name, Location, Authority, Purpose
Section.l. The name of this organization shall be the Lord Fairfax Planning District
' hereinafter called the "COMMISSION ".
Section 2. The principal office of the COMMISSION shall be in Front Royal, Virginia.
The location of the principal office may be changed by the concurrence of 3/4 the of the
COMMISSION members present at a regular meeting, provided that the clerk of the governing
body of each member govermental subdivision has been notified of the contemplated relocation
in writing at least thirty days before such meeting.
Section 3 . The COMMISSION shall be a public body corporate and politic with all the pavers
and duties granted to it by the Virginia Area Development Act.
Section 4. The purpose of the COMMISSION shall be to promote the orderly and efficient
development of the physical, social and economic elementssof the Planning Districe by planni
and encouraging and assisting governmental subdivisions to plan for the future.
ARTICLE II
' Membership
Section 1. COMMISSION members shall be appointed by the respective governing bodies of
those political subdivisions which are parties of this Charter Agreement provided, however
that at least a majority, of the COMMISSION's members shall be elected officials of the
governing bodies of the governmental subdivisions within the Planning District with each
participating county, city and town of more than 3,500 population having at least one repres-
entative, and the other members beipg qualified voters and residents of the District,
who hold no office elected by the people.
Section 2. Governmental subdivisions which are parties to this Charter Agreement shall
appoint members to the COMMISSION on the following basis:

Forleach 10,000 increment of population in excess of 30,000, a member govermental subdivision

shall be elected officials.
Section 3. Vacancies on the COMMISSION shall be filled for the unexpired term in the same
manner as the original appointment was made.
Section 4. Any member of the COMMISSION shall be eligible for reappointment but may be
moved for cause by the governing body which appointed him.

ARTICLE III
Terms of Office and Voting Rights
Section 1. The terms of office of COMMISSION members who are also members of governing
bodies shall be coincident with their elected terms of office or such shorter
term as their governing bodies shall determine. The terms of dffice of the
citizen members shall be three years.
Initial appointments of citizen members shall be made on the following basis:
The first, second and third political subdivisions in alphabetical order shall'
appoint their citizen members for one -year terms. The fourth, fifth and sixth political
subdivisions in alphabetical order shall appoint their citizen members for two -year terms.
The seventh and eighth political subdivisions in alphabetical order shall appoint their
citizen members for three -year terms. All subsequent terms of appointment shall be for
three -year terms.
Section 2, Each member of the Commission shall have one equal vote in all matters before
the COMMISSION
ARTICLE IV
Officers
Section 1. Officers of the COMMISSION shall consist of a Chairmen and Vice - Chairman who
shall be elected by the membership of the COMMISSION. The Commission may
elect other officers as it deems necessary
Section 2. The Chairman and Vice- Ohairman shall be elected for terms of one year or until
their succdssors are elected.

ARTICLE V
Addition or Withdrawal of Members
Section 1. Any governmental subdivision with in Planning Districe Number 7 which is not
a party to this Charter Agreement at the effective date thereof may thereafter
Join the COMMISSION provided that such governmental subdivision is eligible
for membership and that it adopts and executes this agreement.
Section 2. Any governmental subdivision may withdraw from the COMMISSION by submitting to
the COMMISSION in writing, at least 90 days before the end of the COMMISSION'S=
then current fiscal year, a notice of intent to withdraw. Such withdrawal shall
not become effective until the COMMISSION'S fiscal year has ended.
ARTICLE VI
Appointment of an Executive Committee and Adoption of By -Laws
Section 1. The COMMISSION may designate an Executive Committee and delegate to it such powers
as the COMMISSION may determine, provided that these powers are not inconsistent
with provisions of the Virginia Area Development Act.
Section 2. The COMMISSION may adopt Be -Laws and such other rules as it deems necessary to
govern its operations.
ARTICLE VII
Meetings
Sectionl. The COMMISSION shall hold regular meetings on a schedule which will be determined
by the membership.
Section 2. Meetings of the COMMISSION shall be open to the public, however, the COMMISSION
may hold executive meetings
ARTICLE VIII
Amendments
Section 1. This Charter Agreement may be amended, supplemented or superseded only by
concurring resolutions from a majority df the member g overnmental subdivisions.

Date of Organization
Section 1. The organization of the Lord Fairfax Planning District Commission shall be
effective on the 10th day of May or at such time after this date when the Charter
Agreement' has been adopted and signed by that governmental subdivision whose
population when added to the aggregate population of those who have already
adopted and signed that Charter Agreement embraces the majority of the population
within Planning District Number 7.

acres of land owned by E. B. Orndorff and located in Opequon Magisterial District, Frederi
County, Virginia, just south of Middletown, from Agricultural to M -2.

WILLIAMSBURG HEIGHTS CO. - REZONING - FINAL APPROVAL
Upon motion of Thomas B. Brumback and seconded by Donald L. Baughman,
Be it Resolved, that upon the application of Williamsburg Heights Company to
rezone 99.2891 acres of land owned by the Petitioner and known as Cedar Hill, located in
Back Creek Magisterial District, Frederick County, Virginia, adjacent to the City of Winches
from R -1 to R -2 be rezoned and after a duly advertised Public Hearing is hereby given final

a permit as provided for in Section 59 -215 of the Code of Virginia for 1950 for a display
of fireworks at the locations listed below and on the following dates, under his discretion
and supervision and by his employees only:
Wonderland Gift Shop, Tom Rosenberger, Shawnee -Land ; Wards Plaza; Winchester
Drive -In Theater; William Dalke, Dalke's Drive -In Theater; Lake St. Clair; J. G. PLACE,

legislation recently passed by the state, a Public Hearing was set on the said proposed
ordinance at 11:00 a.m. on August 10, 1970, after the giving of due notice according to law.

against the approved funds of the Virginia Literary Fund and the Federal Government. The
requested are to provide working capital to meet current construction costs and cost of p
equipment for the Dowell J. Howard Vocational School, Winchester, Virginia.
BE IT FURTHER RESOLVED that the interest on this loan shall not exceed six and one
quarter per cent (6j%) and that the loan shall be made for a period not to exceed twelve
months. The said purpose of this loand is to provide funds to pay monthly construction and

equipment costs until reimbursement is received /the Virginia Literary Fund and the Federal
Government. Therefore, the Board of Supervisors of Frederick County herewith authorizesd the

BE IT RESOLVED, that the Frederick County Board of Supervisors is vigorously
and unalterably opposed to the issuance of any ABC banquet license to allow the sale of beer
or any other alcoholic beverages at race tracks of any kind or description or at any other
slnilar event.
The said Frederick County Board of Supervisors is of the opinion that the
issuance of any such license to any individual, corporation, or other entity in Frederick
County, Virginia, would be against the general health and public welfare of the people of
Frederick County. It would cause a definite law enforcement problem and be a source of great
difficulty in many other respects.

Pursuant to the enabling legislation contained in Section 46.1 -170 of the
Code of Virginia and in connection with other Sections of said Code governing the age limits
for drivers, it is hereby provided by the governing boLty of the County of Frederick, Virginia

COUNTY TAG ORDINANCE - ADOPTED

Be it resolved, That after a duly advertised Public Hearing the following
Ordinance was adopted:
An Ordinance to empower the County of Frederick, Virginia, to levy and assess
taxes and charge license fees upon motor vehicles, trailers, and semitrailers; limitations
of amount; disposition of revenue; requiring evidence of payment of personal property taxes;
prohibiting display of tags after expiration ; punishment for violation; in accordance with
the provisions set forth in section 46.1 -65 of the Code of Virginia, 1950, as amended.
BE IT RESOLVED THAT: Frederick County, Virginia by its govening body be em-
powered to levy, assess, charge and collect license fees upon motor vehicles, trailers and
semitrailers located in Frederick County, to the full extent that such motor vehicles, trail
or semitrailers may be sul?ject to such tax and license fee under Section 46.1 -65 and 46.1 -66
of the Code of Virginia, 1950, as amended, in accordance with Section 46.1 -65 of the Code
of Virginia, 1950, as amended.
SECTION 1: The following words and phrases when used in this ordinance
shall, for the purpose of this ordinance, have the meanings respectively ascribed to them
in this ordinance except in those intances where the context clearly indicates a different
the deadline for the payment of the license tax for the license year 1971 shall be the
1st day of May, 1971; and in subsequent years the collection and issuance by said Treasurer
meaning:
(a) MOTOR VEHICLE: Every Vehicle as herein defined which is self - propelled
of designed for self - propulsion, except devices moved by human or animal power and devices
used exclusively upon stationery rails or tracks and vehicles used in this State but not
required to be licensed by the State.
(b) OWNER A person who holds legal title to a vehicle.
(c) SEMITRAILER Every vehicle of the trailer type so designed and used
in conjunction with a motor vehicle that some part of its own weight and that of its own
load rests upon or is carried by another vehicle.
(d) TOWN An incorporated town.
(e) TRAILER Every vehicle without motor power designed for carrying property
or passengers wholly on its own structure and for being drawn by a motor vehicle.
(f) CAR TRAILER One or two wheel trailer of a cradle, flat bed or open
pick -up type which has a body width not greater than the width of the motor vehicle to which
it is attached at any time of operation, which is pulled or towed by a passenger car or
station wagon or a pick -up or panel truck having an actual gross vehicle weight not exceeding
5000 pounds and which is used for carrying property not exceeding 1500 pounds at any one time.
(g) TRACTOR TRUCK Every motor vehicle designed and used primarily for
drawing other vehicles and not so constructed as to carry a load other than a part of the load
and weight of the vehicle attached thereto.
SECTION 2: The said tax and license fee upon motor vehicles, trailers, and
semitrailers, in Frederick County, shall be collectible from the owner of such motor vehicle,
trailer, and semitrailer and license tags issued by the Office of the Treasurer of Frederick
County, and all fees collected for the license tags issued finder this ordinance shall be
deposited by the Treasurer in the same manner as that prescirbed for other County monies: The
Treasurer shall begin collection and issuance of tags d.n the 15th day of March, 1971, and
the deadline for the payment of the license tax for the license year 1971 shall be the
1st day of May, 1971; and in subsequent years the collection and issuance by said Treasurer

11 of said tax and tags shall begin on the 15th day of March of each year and the deadline for
yment shall be the 1st day of May of each subsequent license year beginning in the license
ar 1972; the said 1st day of May of each subsequent year being designated the expiration
to of such license for the previous license year, and provided that in the license year 1971
d in subsequent license years after 1971 the said tax and license fee shall be subject to
ration for fractional periods df years as set forth by the guide lines of the Code of
inia, 1950, as amended, in Section 46.1 -165. The revenue derived from all county taxes
license fees imposed upon motor vehicles, trailers, or semitrailers, shall be applied
general county purposes.
The terms "tag" and "Plates" as set forth in this ordinance may also be inter-
eted to mean "sticker "; the county having the option of requiring either metal tags or
windshield type sticker for the purposes of meeting the requirements of display as set forth
rein. Any sticker license issued under this ordinance shall be affixed on the windshield
the motor vehicle in accordance with Virginia State Law Regulations. Such sticker should
displayed on any motor vehicle, trailer, and semitrailer in open and obvious view insofar
allowed by the laws of the Commonwealth.
SECTION 3: The tax and license fee upon motor vehicles, trailers, and semi-
railers in Frederick County shall be as-'follows:
(a) The annual Motor vehicle, trailer and semitrailer license taxes levied are:
1. Passenger cars not used for hire: $10.00
2. Convertible use (Conv.) vehicle: $10.00
3. Car Trailer: $3.50
4. House Trailer, designed for use as living quarters for human beings: $7.50
5. Private school bus: $ .25 per hundred pounds of weight or major fractio
hereof; except in no event shall any tax or license fee be greater than $10.00.
6. Taxicab: $ .50 per:huddred pounds of weight or major fraction thereof;
xcept in no event shall any tax or license fee for such vehicle be greater than $10.00
7. Motorcycle, with or without side car: $3.00.
8. Truck as a single unit, truck- trailer combination, tractor or truck

SECTION 5: (a) Transfer of license tags shall be made from one vehicle of
design to another (as Passenger to passenger); provided, that the vehicle on which the
is to be used is registered in the same name for which it was originally issued.
(b) A fee of $ .50 shall be charged for each transfer.
(c). Substitutes for lost or mutilated license tags required by this ordinance

entitled thereto upon furnishing satisfactory information
and the payment

SECTION 6: If there be any incorporated town within Frederick County imposing
like fees and taxes upon vehicles of owners resident in such town, the owner of any vehicle
' subject to such fees or taxes shall be entitled, upon such owner displaying evidence that
he has paid the amount of such fees or taxes, to receive a credit on the fees or taxes imposed
1 by the county to the extent of the fees or taxes he has paid to such town.
SECTION 7: It shall be required that, after the deadline dates as hereinbefore
set forth, such county motor vehidle tag be properly displayed upon such motor vehicle, trailer
or semitrailer subject to this ordinance. Failure to properly display such tag upon such
motor vehicle, trailer or.semitrailer.shall result upon violation therefore, inra fine,
not to exceed $25.00 or imprisonment in the county ,jail for a period of time not to exceed
10 days, or both. Such proceedings for enforcement of this ordinance shall be before the Judge
of the County Court in like manner and with like right of appeal as if such violation were
SECTION 8: It is further provided that it shall be unlawful for any owner of
a motor vehicle, trailer or semitrailer to display upon such motor vehicle, trailer or semi-
' trailer any license plate of the county after the expiration date of such license plate. A
violation under this paragraph shall constitute a misdemeanor and be punishable by a fine
not exceeding ,$20.00
It is hereby declared to be the intention of the County Board that the section,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional
or invalid by the valid Judgment or decree of a Court of competent Jurisdiction, such L.
unconstitutionality or invalidity shall not effect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance.
The above proposed ordinance shall be available for public reading at the front
door of the Frederick County Court House in Winchester, Virginia, and at each Post Office
in the County of Frederick, Virginia, and at the Office of The Clerk of the Circuit Court

Corporation tract and proceeding westwardly with its boundary line to the right of way of
the Baltimore and Ohio Railroad; thence northwardly with said right of way to its intersection
with the boundary line of Himelright; thence eastwardly with said Himelright boundary line
to its 'intersection with the boundary line of U. S. Highway No. 11; thence southwardly with
said boundary7.line to the point of beginning, including Echo Village Restaurant and Schenck
Food Company warehouse and offices.
The above resolution was dul adopted by the Board of Supervisors pursuant
to statutes thereby provided this 10th day of August, 1970.

AMENDMENT TO MINUTES
ABANDONMENT OF ROUTE 624 - APPROVED
;4 At a regular meeting of the Board of Supervisors of Frederick County held
this 10th day of August, 1970, it was duly moved and seconded that:
WHEREAS, on the 11th day of May, 1970 the Board gave notice of the intention
to abandon Secondary Route 624, from the B & 0 Railroad Crossing (And including said
crossing) to .30 mile•South (End of maintenance), a distance of .30 miles, pursuant
to Section 33 -76.8 of the Code of Virginia of 1950, as amended; and
WHEREAS, on the 10th day of August, 1970, (after due consideration) the
Board has determined that no public necessity exists for continuance of the said section
of Secondary road as a public road and that the welfare of the public will be served
best be abandoning such section of road.
NOW, THEREFORE, BE IT RESOLVED: That Secondary Route 624, from the B & 0
Railroad Crossing (And including said crossing) to .30 miles South (End of Maintenance)
a distance of .30 miles, be, and the same hereby is, abandoned as a public road pursuant
to Section 33 -76.8 of the Code of Virginia of 1950, as amended.

of land situete the ease side of U. S. Route 522 and the south side of U. S. Route 50,
just east of the City of Winchester, Virginia, in Shawnee District from R -1 to B=2.

- Leroy Armstrong and Herbert Shackelford presented petitions and voiced opposition
to the rezoning bf Herbert E. Ratliff Truck Service Center.
A motion was made by Donald Baughman and seconded by Raymand Sandy to deny
petition.'
A recorded vote was taken: Raymond Sandy and Donald L. Bsighman, for; and
Thomas B. Rosenberger, Thomas B. Brumback, and J. Robert Russell, against.
Upon motion of J. Robert Russell and seconded by T. B. Brumback,
Be it resolved, That after a duly advertised Public Hearing the Board approved
the application of Herbert E. Ratliff, to rezone a certain tract of land containing 4.5913
acres, situate on the East side of Virginia Highway NHS. 642 and South and East of the
Kernstown I -81 Interchange, in Shawnee District of Frederick County, Virginia, from A -1
to B-2.
After a recorded vote of T. B. Rosenberger, J. Robert Russell, T. B. Brumback,
for,and Raymond Sandy and Donald L. Baughman, against, the rezoning was passed by majority
vote.

Be it resolved, The board does hereby approve the action of the Committee in
