At a Special Meeting of the Board of Supervisors of
County, Virginia, held at the Court House thereof, on Saturday, June 25, 1938.
PRESENT: C. I. Brumback, Chairman, C. M. Rosenberger, P. H.
Gold, B. P. Harrison, Commonwealth's Attorney, and W. C. Poston, State Highway Engineer.
COMPLETION AND TRAFFIC CONDITIONS ON ROUTE #7
On motion of Mr. Gold, seconded by Mr. Rosenberger, the
following resolution was adopted.
The Board notes commendable progress by the Highway Depart-
ment in completing Route #7 from W. Virginia to Winchester. The grading and widening is
completed to Bryarly School, less than three (3) miles from Winchester. Greatly increa
traffic is reported over said road, particularly by trucks hauling apples from the cold
storages in Winchester, as well as through traffic to and from Pennsylvania.
The traffic congestion on Route #7, at the intersection of
Fairmont Ave. with the Penn. R. R., opposite the canning plans of the National Fruit Pro-
duct Co. and the Shenandoah Valley Apple Cider and Vinegar Co., presents a serious pro
particularly during the fall and fruit harvest months.
The proposed County High School, a short distance north of
canning plants, will add to the seriousness of the traffic congestion. In view of the
conditions herein recited, the Board of Supervisors of Frederick County petition the Sate
Highway Commission and The Penn. R. R. to build a bridge over the Penn. R. R. at the
curve and to connect Route #7 with Route #11.
Resolved, also that the above resolution together with the
resolution of June 10, be certified by the Clerk to the State Highway Department.
Resolved, it is ordered that the Clerk be instructed to make
an engagement with the Highway Commission for a hearing for a committee from this Board
to present this matter to the Department for its early consideration.
PETITION OF SCHOOL BOARD TO BORROW MONEY
The following resolution was received from the County.School
Board.
" Whereas, it is necessary to secure a temporary loan of
$10,000.00, the proceeds of the loaa to be used on the erection of the school building at
Gore and in payment of current bills.
Therefore, be it resolved, that the School Board of
County apply to the Board of Supervisors for permission to borrow $10,000.00 temporarily,
the proceeds to be used on the Gore building and in payment of current bills, the note to
be paid out of the funds as they come in from the Board of Supervisors and collected

Resolved, that to enable it to meet casual deficit and in
anticipation of current revenue, the School Board is authorized to borrow $10,000.00 to

COMPENSATION OF SHERIFF'S WIDOW
The matter of the compensation of the Sheriff's widow was dis-
cussed at this meeting but action thereon was deferred until a later date.
REPORT OF MISS BLAIR -
Miss Madeline Blair, Home Demonstration Agent, presented her
report and the same was unanimously approved.
REPORT OF MRS. VALLEY
Mrs. Nalley, Superintendnet of Public Welfare, presented her
report and the same was unanimously approved.
DO TIE LAW AND DAMAGE CLAIMS
It is ordered by the Board of Supervisors that the dog tie law
as set up in Section 68A, Chapter 247, of the Code of Virginia is hereby adopted and for
the purpose of this act, a dog shall be deemed to run at large while roaming, running or
self - hunting off' the property of its owner or custodian and not under its owner's or custo
dian's immediate control. Any person who permits his dog or dogs.to run at large there-
after shall be deemed to have violated the provisions of this act and shall be liable to a
fine not less than five nor more than twenty five dgllars for each violation. This law to
be effective July 18, 192.8, until otherwise rescnded. It is hereby ordered that a copy of
this resolution be sent to F. W. Pingley, Game Warden, A. J. Tavenner, Trial Justice and
the Commission of Game and Inland fisheries, Richmond, Virginia.
It is further ordered that after July 18, 1928, all claims for
damages done by dogs for killing or injuring sheep or other livestock or poultry, be forth
with immediately reported to the Game Warden, Telephone No. 1721W3 who will, upon investi-
gation appraise such damages and make such recommendation to the Board of Supervisors for

such claims presented for such damages. It is further ordered that the enforcement of
these regulations be the responsibility of the Game Warden and for such services rendere
pertaining to this, he shall be compensated from the Dog Fund, $20.00 per month for the
next six months.
The public'is requested by the Board of Supervisors to
cooperate with the Game Wayden in the enforcement of these act and particularly in runni g
down the dogs that have done the damages to sheep, livestock or paitry.
RE SOLUTION OF PARTICIPA IN STATE PUBLIC ASSISTANCE PROGRAM
Be it resolved by the Board of Supervisors of the County of
Frederic:, that need of state assistance existing in the county of Frederick to provide
for destitute persons in need of public relief, application is herewith made to the Com-
missioner of Public Welfare, pursuant to provision of Chapter 223, Acts of Assembly,'19,2 ,
and Chapter 379, Acts of Assembly, 1938, for participation in the state relief' appropria-
tion subject to the provision of the said Act and Rules and Regulations, which have been
adopted or may hereafter be adopted by the Governor or the State Board of Public Welfare
pursuant to the provisions of the said Act, which it is herewith agreed will be complied
with in the administration of said funds. It appearing under the said Act that said
county of Frederick is entitled to the sum of $724.90 for two mo. of the year beginning
July 1, 1938, provided the said county of Frederick appropriates the sum of $434.94 to
match said state allowance, be, it, therei.ore resolved that application is hereby made
for State funds, in the amount of $724.90 and that the sum of $434.94 is hereby appro-
priated to match the state allowance, which is 60% of the ttal state amount applied for;
and the same is to be segregated and expended in the manner provided by said Act and
the Rules and Regulations adopted pursuant thereto.
RESOULTION TO BORROW MONEY
On motion.of Mr. Gold, seconded by Mr. Branner, it is unan-
imously ordered that the Chairman and Clerk of the Board be autnorized to borrow
$2500.00 for four months at 4% to meet current expenses in anticipation of the collect
of revenue.
1934 DELINQUENT PERSONAL PROPER TAXES
It is ordered by the Board that $47.8`0, 1934 Delinquent Per-
sonal Property Tax collected by Harry L. McCann, Treasurer, be placed in the General
County Fund and it is further ordered that Treasurer Harry L. McCann be relieved from
further effort to collect the balance of 1934 Delinquent Personal Property tax.
COUNTY HOMECOMMITTEE
On motion,.Mr. C. M. Rosenberger is appointed committee for
the County Home to serve with the present committee W. H. Branner and E. W. Adams.

The minutes of the last regular meeting of the Board of Super-
visors were read and unanimously approved.
TRANSFER OF FUNDS
On motion it is ordered.that $:91.45 be transferred from the
General County Fund to the Public Assistance Fund.
IMRROVEMENT OF ROAD C 671
Whereas, the (, ommonwealth of Virginia through the Department
of Highways has prepared and submitted plans to this Board for the improvement of a sec
of the State Secondary System of Roads No. C 671, approved August 1, 1938, and
Whereas, it is the desire of this Boatel that said road be
improved in accordance with said plans.
Now therefore, be it resolved, that this Board hereby approve
the above mentioned plans and requests the said Department of Highways to proceed vdh
said construction in accordance with these plans, and the said Board further hereby agree
to and does guarantee a 30 foot right of way, 15'feet lying on either side of and adjacent
to the centerline as shown on said plans, in addition to the additional widths required
for cuts, fills and channel changes which may be required.
It is further understood, however, that the said Department
of Highway3, at its expense, will move and relocate any existing fences, or fence the
of way on any new location through property which may now be under fence, and will also
remove any obstructions which may be within the said right of way.

RESIGNATION OF CLERK OF TRIAL JUSTICE COURT
Catharine G. Van (deter, Clerk of the Trial Justice Court,
tendered her resignation as said Clerk to become effective September 1, 1938 and the same
is hereby accepted.

DELINQUENT LISTS
Harry L. McCann, County Treasurer, presented to the Board
of Supervisors the delinquent personal property list for the year of 1935 totaling $541.
also the delinquent list of 1936 both personal and real, totaling $4373.33 and for the
year 1937 both personal and real estate totaling $11,739.12 said lists are accepted
by the Board of Supervisors.
Bills totaling $2,446.40 were approved and ordered to be
paid from the General County Fund by Checks Nos. 3113 to 3156, inclusive.
Bills totaling $557.21 were approved and ordered to be paid
from the Virginia Public Assistance Fund by Checks Nos. 965 to 1008, inclusive.

PAYMENT OF NOTE
Whereas, a Shawnee Road note for $200.00 was due to the Middle
town State Bank on the 18th day of August, 1938, it is authorized by the Board of Super-
visors that said note be paid from General County Funds and all Shawnee District Road
taxes and cash balance in the Treasurer's hands shall be transferred to the General Coun
Fund to re- imburse the General County Fund for the amount of the said note.
BIDS FOR BUILDING ON HITCHING YARD
Blue prints and specifications being in hand for the erection
of a store room on the County hitching yard, it is ordered that an advertisement be plac
in the Winchester Evening Star and the Northern Virginia Daily for bids on the same which
are as follows:
BIDS FOR CONSTRUCTING A STOREROOM ON COUNTY PROPERTY IN WINCHESTER,
VIRGINIA
1. Sealed proposals will be received by The Frederick County
Board of Supervisors at the office of the Clerk of Frederick County, Winchester, Virginia
not later than ten o'clock Sept. 7th, 1938 and there publicly opened and read immediately
thereafter, for the construction of the following project.
2. A store room located in Winchester, Virginia, according to
plans and specifications on file at the office of the County Clerk in Winchester, Virginia
3. Said plans, specifications and forms of proposals may be
obtained at the office of the Clerk of Frederick County, Winchester, Virginia, upon de-
posit at the said office of $25.00 of which $20.00 will be refunded upon return of same
in good condition within ten days after the opening of bids.
4. All proposals shall conform to specifications supplied by
an architect, sealed and plainly marked. All bids must be accompanied by a certified
check or acceptable bidder's bond in the amount of 5% of the total bid, made payable to
The Clerk of Frederick County Circuit Court. Said check or bond will be returned to the
unsuccessful bidders within ten days after opening of bids.
5. The successful bidder shall furnish a bond in the amount of
the contract price, issued bya responsible surety approved by The Frederick County Board
of Supervisors. Should the successful bidder fail to furnish said bond and execute the
contract within twenty days after notice of acceptance of his proposal, the 516 bid check
or bidder's bond will be forfeited to The Frederick County Board of Supervisors as liquid-
ated damages. Public Liability and Workmen's Compensation Insurance satisfactory to the
said Board of Supervisors in accordance with Virginia State Law.
6. After bid opening no bidder may withdraw his bid for
of thirty days.
7. The Board of Supervisors reserves the right to reject any
and all bids.
Burr P. Harrison, Commonwealth's Attorney and the Chairman of
the Board are to see that advertisements are made at once.

SCHOOL BOARD LOAN
On motion of Mr. Rosenberger, seconded by Mr. Branner, it
is unanimously ordered that a loan of $25,000.00 by the School Board of Frederick County
from the Literary Fund for completing the Gore School and certain other improvements to
other School buildings, be and the sameis hereby approved, with this proviso, that the
School Board will only borrow as much of this loan as is necessary to complete these
projects.

TRANSFER OF MONEY FROM THE GENERAL COUNTY FUND TO THE SCHOOL FUN
On motion, it was ordered that $ 7,500.00 be transferred from the
General County Fund to the Frederick County School Fund, asset up in the budget.

REPORT OF W. C. POSTON, RESIDLNT HIGHWAY ENGINEER
W. C. Poston, Resident Highway Engineer, appeared before the
Board of Supervisors requesting a resolution from the Board whereas, in constructing
Route 7 from the West Virginia line to Back Creek under certain locations of the new road
in taking out curves, straightening the mainroad, leaving a number of parcels of land
amounting to approximately 9:96 miles of the old road bed; be it resolved that this Board
authorizes that said parcels of land be abandoned as a public road.
REPORT OF MRS. NALLEY
The report of Mrs. Eulalia S. Nalley, Superintendent of Public
Welfare presented her report and the same was unanimously approved.

FRED HIETT
Fred Hiett appeared before the Board, making an objection to the
construction of Route 7 just beyond the northern limit of the corporation of Winchester
around his property, stating that in constructing Route 7 they are doing considerable
damage to his property. After due consideration and statements made by Mr. Hiatt and
Resident Engineer, W. C. Poston, it appeared that Mr.'Hiett had signed an agreement with
the Highway Department through Engineer W. C. Poston; therefore, it appeared that the
Board of Supervisors has no jurisdiction to intercede in the construction of said highway,
and the matter is entirely up to said Mr. Hiatt and the Highway Department.
TRANSFER OF FUNDS
On motion, the following resolution was unanimously adopted:
"Resolved that the Board of Supervisors of Frederick County do, out of the General Fund
of Frederick County, loan to the Virginia Public Assistance Fund of Frederick County the
sum of $ 1,100.00; said loan to be used as a working fund for carrying out the provisions
of the Virginia Public Assistance Act of 1938, according to Section 64 of said Act; and
the Treasurer of Frederick County is hereby authorized and directed to transfer said amou
from the General Fund of Frederick County to the Virginia Public Assistance Fund of Freda
ick County to be used for said purposes of a working fund until further order of this
Board."
TRANSFER OF FUNDS
On motion it was unanimously ordered that the Treasurer of
Frederick County transfer monthly from the General County Fund to the Virginia.Public
the Coul!Share of the expenditures the Virginia Public Assistance
Assistance Fund /during the month. The total amount of such tbansfers during the fiscal
year is not to exceed the appropriations by the County for the year, and the portion of
the appropriations by the state for general relief to be used for administrative expenses
and credited to the General County Fund.

On motion, it was unanimously ordered that a check for $ 5.00 be
drawn in favor of J. L. Borden, Warehouse Manager of W.P.A., Front Royal, Virginia, as per
letter of August 12, 1938, and filed with the Board of Supervisors
BUDGET OF WELFARE BOARD
On motion, it was unanimously ordered that the budget of the Board
of Public Welfare, Frederick County, be and is hereby approved subject to the State
Welfare Boards approval.
SALARY OF FREDERICK COUNTY WELFARE BOARD
On motion of Mr. Brenner, seconded by Mr. Gold, it was unanimously
ordered that the members of the Frederick County Welfare Board receive a salary of $ 100.
per year, payable quarterly. �J�

KILLING OF DOGS
On motion, it was unanimously ordered that the Game Warden kill
or have killed all dogs found to be confirmed poultry killers.
Bills totaling $ 2,265.36 were approved and ordered to be paid
from the General County Fund by warrants Nos. 3157 to 3206,inclusive.
Sheep Claims totaling $128.60 were approved and ordered to be
paid from the Dog Fund by warrants Nos. 268 to 277, inclusive.
Bills totaling $507.98 were approved and ordered to be paid from
the Public Assistance Fund by warrants Nos. 1009 to 1049, inclusive.
Warrant.# 3207-amounting to "$20.00 was ordered paid to Walter C.
Hicks on September 16, 1938 out*of the General County Fund, for refund on the plans of
County Hitching Yard Property.

REPORT OF W. C. POSTON
It is requested by Resident Highway Engineer, W. C. Poston, that this
Board of Supervisors approve the abandonment of .575 miles on Route 11 due to straighten-
ing curves on said route, and it is ordered by.this Board that the request of Resident
Highway Engineer, W. C. Poston is approved.

REPORT OF MISS BLAIR
Miss Madeline Blair, Home Demonstration Agent, came before the Board
and made her report vdiich was accepted, and Miss Blair reported to the Board that her
secretary vAiich is now being paid through P.W.A. Funds will shortly be discontinued. On
motion, it is ordered that her secretary be continued and paid from the General County
Fund not to exceed $50.00 per month until January 1, 1939. Said motion was carried by
Vote - -- voting "Yes ", Phil H. Gold, W. H. Branner, and C. I. Brumback; "No ", C. M.
Rosenberger and E. W. Adams.
RETURN OF CERTIFIED BOND CHECK OF PAUL W. RUDACILL
The certified bond check given by Paul W. Rudacill which accompanied his
bid on the Sanitary Grocery Building is ordered returned, he not being the low bidder.
WARRANTS TO BOARD L'IEMBERS
It is ordered by the Board that whereas the Supervisors have not drawn
the full amount of their salary for the fiscal year beginning July 1, 1937 and ending June
30 1939, in the amount of $496.00; the Clerk is authorized to draw warrants to each
member of the Board for this balance, representing $99.20 per member.
TRANSFER OF FUNS
It is ordered by the Board that the Treasurer transfer $125.00 from the
General County Fund to the Frederick County School Fund for Dental Clinic as per former
resolution of February 7, 1938.
TEMPORARY LOAN
On motion,the following resolution was unanimously adopted: Resolved
that whereas Frederick County has no bonded indebtedness but does have a temporary loan
of $2500.00 in the Commercial and Savings Bank, and whereas they need additional funds to
meet current expenses; the Chairman of the Board and County Clerk are authorized to borrow
the sum of $5000.00 at 4%, and from the proceeds of same pay off the $2500.00 now in the
Commercial and Savings Bank; and the balance is to be placed to the credit of the General
County Fund. The chairman of the Board and Clerk of the Court are authorized to execute
a note for this loan to be paid off within 60 days.
Bill totaling $5,211.3$ were approved and ordered to be paid from
the General County Fund by Checks Nos.3208 to 3280, inclusive.
