At a special meeting of the Board of Supervisors of Frederick
County Virginia held at the Court House thereof on Friday Marchn22, 1935.
Present: C. I. Brumback, Chairman, P. H. Gold, W. H. Branner, E. W.
Adams, C. M. Rosenberger and G. P. Bozel, Resident Engineer.
WORK ON ROADS IN THE SECONDARY SYSTEM
G. P. Bozel, Resident Engineer appeared before the Board in ref
to having work done on certain secondary roads the coming ,year.
IMPROVEMENT OF ROADS
A large delegation of County people appeared before the Board aski
for certain roads to be improved.
ROAD BEGINNING AT 671 AND RUNNING TO ROUTE 600
A number of tax payers appeared before the Board requesting that a
road beginning at 671 at Joe Taylor's property running to No. 600 a distance of about
one mile be taken in the secondary system, and on motion the same is unanimously re-
commended.
J ONES ROAD
On motion it, is unanimously recommended that a road known as the
Jones road - number 650 leading from 'Route 622 by the Jones property to Route 628 at the
Blackburn property a distance of about 2 1 /10 miles be improved widened., graded. and.
covered with loose stone.

leading from U. S. Route No. 11 for one mile east be surfaced treated.
WRIGHT ROAD
It is unanimously recommended that the Wright road for 1 8/10
miles be rocked with loose stone.

from Route 703 to Route 705 be taken off the secondary highway system.
ROUTE 661
On motion it is unanimously recommended. that the Hill road No. 706
On motion it is unanimously recommended that Route 661 1 1/5 miles
from Route 671 to Route 669 be hard surfaced.
B RIDGE OVER SLEEPY CREEK
On motion it is unanimously recommended that a bridge be built over
Sleepy Creek on Route 698 near the intersection of Route No. 7.
B ITE ROAD
On motion it is unanimously recommended that the Hite road No. 625

be widened, graded, and covered with loose stone from Route 628 to Route 627.
B RIDGE OVER TRIPLETTS RUN, BOWMANS RJJN, FOREMANS RUN AND POOLS FORD.
On motion it is unanimously recommended that a bridge be con-
structed over Tripletts Run and Bowmans Run on Route 600; Also over Foremans Run on
Route 623 and Poole Ford Route No. 704 and that Route 608 in front of the Arthur Smith
property be widened.
WIDENING OF ROUTE 651
On motion it is unanimously recommended that Route 651. be widened,
graded and covered with loose stone 1 9/10 miles.
ROUTE 701
recommended
On motion it is unanimously /that the road leading from Route 7
No. 701 through Whitacre to West Virginia line be widened, drained and covered.
E AHNESTOCK ROAD
On motion it is unanimously recommended that the Fahnestock road
rights of ways be attained as soon as possible so that the State can take the same into
a secondary system, and-if the citizens do not give tine deeds to the State for land to
make a thirty foot right of way no_road can be had.
ROUTE62S
On motion it is recommneded that Route 622 from Route 649 to Route
629 be surfaced and treated.
ROUTE 672
On motion it is unanimously recommended �hat672 be covered with
local material, from Route 677 to Route 654.
ROUTE 666
On motion it is unanimously recommended that Route No. 666 be
improved.
ROUTE 606
On motion it is unanimously recommended that road 606 from 608 to
Cedar Creek be improved.
ROUTE 703 BRIDGE
On motion it is unanimously recommended that a bridge be con-
structed over Isaac's Creek on Route 703..

PRIMARY HIGHWAYS
On motion the following resolution was unanimously adopted.
Whereas, Virginia State Highway No. 7, leading from Winchester
northwest through Ga.inesboro, Cross .Junction and to the West Virginia line, was taken
into the State Highway system of Virginia several years ago and the route to be followed
and the point at which said road was to connect with a West Virginia Highway was agreed
upon between properly constituted authorities of the State Highway Commission and like
authorities of the State of West Virginia, and in a similar manner the road leading from
Route No. 50 at the point west of Gore, Frederick County, Virginia, in a southernly
direction to meet the road from Wardensville, West Virginia, was taken into the Highway
system of Virginia and the point at which said road would connect with a West Virginia
Highway was in like manner agreed upon, and
Whereas, it was certainly the tacit understanding, if not an actual
agreement., that Virginia would build State Highways to connect with like Highways to be
constructed by the State of West Virginia „ and
Whereas, the State of West, Virginia has filly complied with said
tacit agreement and has built a first class Highway from Berkeley Springs in Morgan
County, West Virginia, to the Virginia state line at the point agreed upon at which it
was to intersect with Route No. 7, and in like manner has built a first class Highway
from Wardensville, West Virginia, to the point on the Virginia line at which it was to
meet a similar Highway to be constructed by the State of Virginia from Route No. 50 to
said point, and
Whereas, the State of Virginia has wholly failed to comply with said
tacit understanding and has not built either Route No. 7 or the road leading south from
Route No. 50 to connect with the roads which have been constructed by the State of West
Virginia, and
Whereas, the State of Virginia has included Route No. 55 from Stras-
burg to the West Virginia line as a Class One road and has hard. surfaced said road from
Strasburg to Cedar Creek and has graded- the said road from Cedar Creek across Frederick
County to the West Virginia line, but has not hard surfaced said road, and
Whereas, this Board has been advised. that a legislative committee
was created by the General assembly of Virginia at its session in 1934 and thatfthere wil
be a meeting of said committee at Culpeper, Virginia, on Monday, March 25, 1935, to hear
a discussion of road projects for the territory comprising Frederick County;
Now, therefore, be it resolved: That this Board requests Mr. C. I.
Brumback, it s Chairman, and T. Russell Cather, member of the State Senate from the Twent
sixth Senatorial district, to attend the meeting of said legislative committee and to
upon said committee the importance of the completion of these road projects, not only as
matter of fairness to be State of West Virginia, which has fully complied with its under-
taking, but also as a means of making accessible to a very large area served by said
Highways a suitable route of transoortation into the St7te of Virginia, The said C. I.
Brumback and T. Russell Cather are fully authorized to, represent this Board in urging

upon said legislative committee the desirability and the urgency for the very early
completion of Highways.

of a sanitary toilet for the County Home are directed to proceed with the construction of
said toilet for the County Home.

of Supervisors appropiate the sum of $25.00 to be supplemented by a certain amount from the
City of Winchester to procure a certain instrument for developing fingerprints in connectic
with the running down of criminals in the County of Frederick and City of Winchester and. is
hereby authorized by,the Board of Supervisors that said amount be allowed for this purpose
and a warrant be drawn payable to the Sheriff for said amount.

INTEREST ON DELINQUENT TAXES

on delinquent taxes be transferred from the General Credit Fund to the General County

NOTES IN MIDDLETOWN STATE BANK
On motion the following resolution was unanimously adopted, "
as the Board of Supervisors for Frederick County, Virginia, has from time to time ob-
tained loans from the Middletown State Bank, in various amounts and whereas Frederick
County is now indebted to said Bank in the total amount of $3500.00 representing one not
of $2.500.00 and one note of $1000.00 and whereas the said Middletown State Bank has re-
quested a resolution by the Board of Supervisors confirming Frederick County's indebtedn
to the said Bank. Therefore be it resolved that the Board of Supervisors of Frederick
County unanimously confirm said indebtedness to sai�? Middleton State Bank."

Supt. of the Winchester Memorial Hospital, appeared before.the Board and appealed for an
allowance of $500.00 for Frederick County Hospital patients for the past.year.
Mr. Gold moved that $300.00 allowance be made. Said motion
was seconded by Mr. Rosenberger, but the motion was lost,
On motion of Mr. Branner seconded by Mr. Adams,.$500.00 is
#ereby appropiated for said Hospital.
WARRANT SYSTEM
On motion the Clerk is ordered to install a warrant system
as recommended by the State Auditor.
GARDEN SEED
On motion the Clerk is ordered to draw a warrant payable
the V. E. R. A. for $15.00 for garden seed for indigent families in Frederick County.
ROAD INTERSECTING W. VA. ROUTE NEAR GLENGERY W. VA. AND BLOOMERY W, VA.
On motion the following rescintion was unanimously approved,
"Whereas there has been delay in the State °ighway Commission in designating the entrance
and exit of an east to west road entering Virginia, from West Virginia running through
the north west section of Virginia, neither has the Virginia Commission stated definetly
whether or not it would designate a s tate Route through this section of the State, and it
further appearing to the Board from a letter from the Chamber of Commerce of kartinsburg,
West Virginia to Mr. Bige Whitacre of 6iler, Va.,.that unless Virginia Highway Commissior
at once, state whether or not the above route will be designated as a State Road and if
so unless said entrance and exit is at once designated Virginia will lose this valuable
road, theeefore be it resolved that the Highway Commission is requested to at once in-

form this Board whther or not the Commission will designate said route as aState Road
and if so the said entrance and exit be designated at once, and the Clerk of this Board
is directed to send a copy of this resolution to the State Highway Commission and the
letter of the Chamber of Commerce of Martinsburg, W. Va.
COMMITTEE FOR WELFARE WORK
On motion it_is ordered that a committee be appointed con-
sisting of C. I. Bramback, Chairman, B. P. narrison, Commonwealth's Attmey and Phil H.
Gold,to employ some person to debrmine help for the unemployable of Frederick County,
and said committee is empowered to act.
RESOLUTION TO BORROW MONEY
On motion the following resolution was unanimously adopted
"Resolved that C. I. Brumback, Chairman, and C. C. Brannon, Clerk, are directed to bo
$6000.00 to meet current expenses, according to section 2727 of the Code of Virginia as
amended. Said loan shall be placed to the credit of the general county fund, by the

MINUTES OF THE PREVIOUS MEFfINu
The minutes of the previous meeting were read'and approved,
except the minute in reference to the borrowing of $6,000.00, and on motion the follow-
ing resolution was unanimously adopted; "Whereas, the County of Frederick having no
bonded indebtedness is in need of the sum of $7,000.00 for the purpose of meeting casual
deficits in the revenue, and in anticipation of regular taxable income; Whereupon be it
resolved that C. I. Brumback, Chairman, and C. C. Brannon, Clerk, are- authorized to
execute and deliver to the Commercial and Savings Bank of Winchester, a note of the Boar
of Supervisors payable December 15, 1935 in the principal sum of $7,000.00 bearing interl
at the rate of 4 per centum; be it further.resolved, that this note is less than one -
fourth (4) of the taxable income of the general County fund and according to the Code of
Virginia the said Board has a right to borrow said amount and to be paid out of the
current years taxes ".
COUNTY WELN'AKE
The committee appointed to employ some one for the Welfare
Work in Frederick County reported that they had employed Mrs. Fulalia Nalley at the pric

of Eighty (W PO) Dollars, per month, shento furnish her own traveling expenses, pro-

viding the distance traveled is not over Two Hundred (200) miles per month, and on
motion the action of the committee is unanimously approved and the warrant shall be is
monthly for her salary. The first warrant to be issued at the July 1935 meeting.
RED CROSS AND DISTRICT NURSE ASSOCIATION
On motion the following resolution was unanimously adopted:

"Whereas, the County has employed a full time Welfare Worker, and whereas it is the opinii
of the Board that the appropriation heretofore made to the Red Cross and the District
Nurse Association should be and the same is hereby discontinued.
STATE HIGHWAY FUNDS
On motion the State Highway Department is requested to transfer
Six Thousand Three Hundred ($6,300.00) Dollars from the Construction Fund to the Mai
Fund.

PUBLIC HEALTH SERVICE
Dr. Smith and Dr. Tilson appeared before the Board requesting
the County to appropriate sufficient funds to install a public health unit in the County
and upon consideration the Board declined to,consider.the matter at this time.
PRIMAKY FEES OF CANDIDATES
On motion it is ordered that those candidates for office who

have no opposition, that their primary fees be refunded by the Treasurer.
OVER HEAD BRIDGE WNNECTIN RUU'TE 7 AND 11
On motion of Mr. Gold, seconded by Mr. Adams the following
resolution was unanimously adopted; " Resolved, That the State Highway Department be re-
quested to erect and construct a road joining Route 7 and Route 11 by way of Loudoun Mano
Addition and tbEt an over head bridge be constructed over the Cumberland Valley Rail Road.
Thos is especially necessary because of the fact that a public school near the Camberland
Valley Rail Road where it crosses Route No.7. It is requested that the State Highway
Department endeavor to finance this project with funds for the purpose from the Federal
Government and the clerk is directed to mail a copy of this resolution to the State
Highway Commission.
PAY WARRANT FOR HOSPITAL
On motion the Clerk is ordered to draw a warrant for $500.00
payable to the Winchester Memorial Hospital.
LIGHT BETWEEN CLERK'S OFFICE AND COURT ROOM
On motion R. S. Smith, and P. H. Gold are ordered to have a
light placed between the Clerk's Office and the Court Room and to have toilets and cell
door to Court House repaired.

JANITOR'S SALARY
Lewis Crismore, Janitor, appeared before the Board and asked
that his salary be increased Five (85.00) Dollars per month stating that on account of
the increase in work, and on motion the same was unanimously granted to take effect
July 1, 1935.

ROAD LEADING FROM ROUTE 7 TO ROUTE 10
On motion of Mr. Adams, seconded by Mr. Gold the following re-
solution was unanimously.adopted, " Whereas a petition signed by twenty -six land owners
of Gainesboro Magisterial District was presented to the Board requesting that a former
county road leading from Route 7 via the Brown, Fout, DeHaven, Strother and Braithwaite
property to route 10 at Nelson Chapel be placed in the secondary Highway system, now t
fore be it resolved, that the State Highway Commission is hereby requested to put said
road'in the Secondary Highway System, and the Clerk is ordered to mail a copy of this
resolution to the State Highway Commissioner ".
TABLES FOR uOUNTY MARKET
On motion Mr. Gold and Mr. Rosenberger are appointed a commit
to install tables in the County Market.

WIDENING WATER STREET
Mr erthyr rield, City Manager, and "erman cable of the City
Council, appeared before the Board in reference to eleven feet from the north side of
the hitching year for the purpose of widening Water otreet from Market atreet Eastwardly
to Kent Street.
REPAIRING SIDE WALK ON WATER STREET
ON motion the Lity Manager was directed to mend depressions in
the side walk on Water Street at a cost of not more than 2U per square foot, or not more
than $50.00 for the j ob.

"Resolved, That the Board of Supervisors do and do hereby make application to the Works
Progress Administration for the sum of Eight Thousand ($8,000.00) Dollars to be used for
cutting and eradicating cedars in Frederick County, Virginia, beginning by December 1, 1
and continuing for a period of six months."
APPLICATION TO PUBLIC WORKS ADMINISTRATION
On motion the following resolution was unanimously adopted.
"Resolved, That application be filed withethe Public Works Administration for $26,000.00
of which the Public Works Administration is to furnish 45% per cent of said sum and
Frederick County to furnish 55% per cent for the purpose of enlarging the Frederick Coun
Clerk's Office and erecting a County laarket House and store room attached on the Frederi

RESOLUTION BY THE COMMON COUNCIL OF THE TOWN OF STEPHEI CITY
'he following resolution was received from the Common
Council of the Town of Stephens City.
At a special meeting of the common council of the 'Town
of "tephens City of Frederick.County, ° irginia, Present Mayor �. E. Gardner had
five (5) of the Six (6) Louncilmen where present namely, W. D. Parker, Holmes Yeakle,
John Hartley, J. A. Bean, and S. A. Sargent. H. R. Evans unable to be present.
Resolved that where as the State Highway Department of
Virginia in reconstructing Rout 11 through the Town of Stephens Uity, did so change
the grade and drainage of said highway to the extent that the drainage is such as to
dam up and run water in the Private Dwelings and Property in such a manner as to cause
a considerable damage to Private Property and a Menace to the helath of many of out
Citizens, and We the council of the Town of otephens 'ity appeal to the Highway
Department for a correction of errors in the R. construction of said highway within
the corporate limits of this Town.
On motion the same is unanimously approved by this lloard,
and the Clerk is directed to send a copy of this ofder to the State Highway Uommission
ROCKINGHAM MEMORIAL HOSPITAL LABRATORY WORK
Mr Alhizer, Superintendant of the Rockingham Memorial
Hospital appeared before the board in reference to an appropropiation to the hospital
for Labratory work done for the citizen and tax payers of rrederick county. Mr Alhizer,
explained that on account of the close proximity of Frederick County to the hospital
practically all of the specimens for labhratory work is being sent to the Rockingham
Memorial Hospital instead of the Richmond, and that the State Doard of Public Welfare
in no longer making an appropriation for this work which has increased to such an
extend that it requires additional help. rafter due consideration the board is of the
opinion that an appropriation should be made for this work which the hospital has
heretofore been doing free, therefore on motion X150.00 is hereby ordered
appropriated to the Rockingham Memorial Hospital for the Calander year of 1936, for
Labratory work. Said appropriation to be deducted from any appropiation made in 1936
to the Hinchester Memorial Hospital.
PER MISSION FOR THE SCHOOL BOARD TO BORROW $15,000.00
This day was presented to the Board a resolution of the
County School aboard requesting the approval of the "oard of "upervisors for the
borrowing of $15,000.00 by the School hoard as a temporary loan to be repaid
within one year and make in anticipation of current revenue, and not exceeding one half
of the amount produced by the County Jchool levy laid in this county for the year
of 1935.

On motion the borrowing of said amount is hereby approved
in accordance with the said resolution of the School Board.

ing yard.

Winchester in reference to the sale of a strip of land eleven feet wide off the north s

At a meeting of the Board of Supervisors of Frederick County,
Virginia, held on the 9th day of November, 1935, in the courthouse of the said County, it
being a special meeting, and all members of the said Board being present and voting, the
following resolution was adopted:-
WHEREAS, this County owns in fee simple a valuable tract of
land in the City of Winchester, located at the intersection of Boscawen and Cameron Stre
and known and designated as the hitching yard, and,
WHEREAS, this property in former years was used by the people
of the County as a place to hitch their horses, and,
WHEREAS, for many yaars the property has not been used for
purposes but is standing idle and not inuring to the benefit of the people of the County,
and,
WHEREAS, there is need for a suitable market place where the
people of the County may sell and dispose of their produce to the people of the City of
Winchester, and,
WHEREAS, the United States Government will under certain statti-
tek heretofore enacted and out of certain appropriations heretofore approved, donate fo
five per cent of the cost of the erection of a market building and store room, and,
WHEREAS, this Board. has determined, and does by this resolu-
tion, determine that it is advisable to contract of debt for the said project, to borrow
money not in excess of Fifteen Thousand ($15,000.00) Dollars therefor and issue negotiabl(
bonds of Frederick County to finance said project, and,
WHEREAS, the County does not have power to contract said debt
for the said project, to borrow money therefor, or to issue its negotiable bonds to financ
the same, unless the qualified voters of the said County shall approve by a majority vote
of the qualified voters, voting in an election, the contraction of the debt, the borrow-
ing of the money, and the issuance of the bonds, and,
WHEREAS, the said election must be ordered and a date
fixed by the Judge of the Circuit Court of Frederick County, after resolution of this
Board that it is advisable to contract the debt for said project, to borrow the money
therefor, and to issue negotiable bonds of the County to finance the same, has been cert-
ified to him,
NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of
Frederick County, in special meeting assembled, all members being present and voting:-
(1) It is advisable to contract a debt for the building and
erection of a market house and store room, upon the property hereinabove described, des-
ignated the hitching ,yard, which said debt should be in a sum not exceeding Fifteen
Thousand ($15,000.00) Dollars; to borrow the said sum not exceeding Fifteen Thousand
($15,000.00) Dollars for the said project; and to issue negotiable bonds of the County

of Frederick a sum not exceeding Fifteen Thousand ($15,000.00) Dollars to finance the
same.
(2) The Clerk is directed forthwith to certify this resolu-
tion to the Honorable Philip Williams, Judge of the Circuit Court of Frederick County,
Virginia.
The above resolution being put before the Board of Superviso
of Frederick County, Virginia, was passed by a vote of 5 to 0; Messrs. Brumback, Adams,
Branner, Gold and Rosenberger voting in favor thereof,; none voting against the same.
I hereby certify that the foregoing is a true and exact copy
of a resolution adopted by the Boar' of Supervisors of Frederick County, Virginia,

ROCKINGHAM T- EMORIAL HOSPITAL APPROPRIATION RECINDED
On motion the following resolution was unanimously
adopted, "Whereas on October 14th, 1935, this Board appropiated $150.00 to the Rockingham
Memorial Hospital for labratory work for the citizens of Frederick County, and whereas
at that time it was the understanding o f this Board that the nearest point to Winchester
that labratory work of the nature done by the Rockingham Memorial Hospital was
Harrisonburg, Virginia, and whereas the Board has this day been informed that the Winches
Memorial Hospital, at Winchester, Frederick County, Virginia, is equpiied to do the same

kind of work as the Rockingham Memorial Hospital and whereas the said order recites that
the said $150.00 shall be deducted from the 1936 appropriation to the Winchester Memorial
Hospital, therefore, be it..resolved that the said order of Oct. 14, 1935, making the
allowance to the Rockingham Memorial Hospital for the calandar year of 1936,.is hereby
recinded and declared null and void, and the Clerk is ordered to mail a copy of this re -`

PEANUT STAND IN F OF COURT HO _
Whereas the Board of Supervisors learn with sorrow of
the death of George Purcell, who for many years has operated a peanut stand upon the
Court House property and whose cheerful and -sunny disposition was known and apprecaiated
by Frederick County people for a generation, and
Whereas, his..sister has requested that the Board permit
the stand. to be operated until January 10, therefore
Be it resolved (1) That permission is granted to Miss
Nan Purcell to operate the peanut stand until January 10, 1936. (2) Inasmuch as this
privilege has been given to the late Mr. Purcell entirely in deference to the high
in which he was held, it is ordered that after January 10, 1936, no private business may
be conducted upon this property.
DISPOSITION OF $4754.97 A. B. C. FUND
. Motion by Mr. Branner that the fund of $4754.97 received
from the A. B. C. Board be-transferred to the General County Fund. After considerable
discussion the motion was seconded.by Mr..Gold; and upon being put to a vote was passed,
Messrs. Brumback, Gold, Branner and Rosenberger voting aye Mr. Adams not voting.
Mr. Rosenberger moved• that the sum just transferred to
General County Fund, to -wit the sum of $4754.97 be applied upon the District Road Debts,
in proportion it bears to the assessed value of the Districts.;.seconded bypMr. Adams.
After discussion, upon avote the motion was put and c
Messrs. Rosenberger, Adam /and Gold voting aye.and Messrs. Brumback and Branner voting
no.
B. P. Harrison, Commonwealth's Attorney, announced in hi
opinion that the appropriation was legal but that he understood that the attorney gen
had expressed the opinion that the action of the Board was illegal. Therefore, there
being a doubt as to the legality of the Board's action, the Commonwealth's Attorney w
appeal to the Circuit Court of Frederick County, Virginia, and would meanwhile seek a
fommal opinion from Attorney General Staples.
JONES ROAD
On motion the Highway Department is asked to spend the
money that is allocated tothe Jones Road beginning at the Cedar Creek Grade into a point
where the Bob Glass road leads off, then start at the Middle Road at South end of the
Jones Road and build north as far as the funds allocated for this road will permit.
It is ordered that the Board do now adjourn.
