ORDINANCE - DOGS
An Ordinance to provide for the regulation of dogs in Frederick County, Virginia
providing for the license of such dogs, providing for disposition of dogs killing or injuring
livestock and poultry and for prescribing penalties.for violations thereof.
The above Ordinance having been advertised in the iiinchester Evening Star once a week
for two successive weeks for a public hearing on its adoption, which said meeting was held
on the above date and on motion duly made and seconded the following Ordinance passed its first,
second, and final reading and the said Ordinance is adopted and shall be in full force and effect'
on the first day of July, 1962.
AN ORDINANCE OT PROVIDE FOR THE dEGULATION
OF DOGS IN FREDERICK COUNTY, VIRGINIA, AND TO PRESCRIBE
PENALTIES FOR VIOLATIONS
BE IT ORDAINED by the Board of Supervisors of Frederick County, Virginia as follows:
I
S66tion 1. Authority Permit the Creation of the Position of Dog Warden Pursuant
to the authority contained in Section 15 -8 and Section 29- 184.2 Code of Virginia (1950., as
Amended) the position of Dog Warden for Frederick County, Virginia is hereby created and
established, and the licensing and regulation of dogs within Frederick County, Virginia, is
hereby required. The dog Warden shall discharge the duties and responsibilities of the position
of Dog Warden as set forth in Sections 29- 184.2; 29- 184.3; 29 184.4, Code of Virginia (1950, As
Amended); and such other duties as may be required by the Board of Supervisors from time to time.!
Section 2. Definitions Generally For the purpsoe of this Ordinance, and unless
otherwise required by the context.
(a) " Livestock " includes horses, mules, ponies, cattle, sheep, goats, swine, and
enclosed domesticated rabbits or hares.
(b)
" Poultry "
includes
all domestic
fowl and game
birds
raised in captivity. --
(c)
"Own" and
"Owner
includes any
person having a
right
of property in a dog; any
person who keeps or harbors a dog or has it in his care, or who acts as its custodian; and any
person who permits a dog to remain on or about any premises occupied by him.
(d) " Kennel " means an enclosure wherein dogs are kept and from which they cannot
escape. l
(e) " Dog Warden means zany Dog Warden and /or ahy Deputy Dog Wardens appointed under
:this�:•Ordinance and in accordance with Section 29 -184.2 of the Code of Virginia (1950), As Amended.
(f) " Other Law Enforcement Officer includes all other persons enployed or elected
by the people of Virginia or by any municipality,)county or incorporated town thereof whose
duty it is to preserve the peace, to make arrests, or to enforce the law within the jurisdiction
of the respective offices to which elected or in which enployed.
(g) " Treasurer" includes the Treasurer of Frederick County or other officer designated
by law to collect taxes in this County.
Section 3. Amount of License. It shall be unlawful for any person to own or harbor
a dog four months old or over in Frederick County unless such dog is licensed, as required by
the provisions of this Ordinance. Dog licenses taxes shall be paid for the calendar year, namely,
from January 1 to Decenber 31, inclusive, and the license tax shall be payable at the Office of

Male For a male dog, $1.00. T
Unsexed Female. For an unsexed (successfully spayed) female dog, $1.00.
Female. For a female dog, $3.00.
Kennel, For Twenty Dogs. For a kennel of twenty dogs, $25.00.
Kennel, For Fifty Dogs For a kennel of fifty dogs, $50.00.
Section 4 . When License Tax Payable The license tax on dogs shall be I
due and payable as follows:
(a) On or before January 1 and not later than January 31 of each year,
the owner of any dog four months old or older shall pay a license tax as prescribed in the t
preceding section.
(b) If a dog shall become four months of age or if a dog over four months,
of age unlicensed by this County shall come into the possession of any person residing in this
County between January 1 and October 31 of any year, a license tax for the current calendar
year shall be paid by the owner forthwith.
(c) If a dog shall become four months of age or if a dog over four months
of age unlicensed by this County shall come into the possession of any person in this County
between November 1 and December 31 of any year, the license tax for the succeeding calendar
year shall be paid forthwith by the owner and such license shall protect the dog form the date
of payment of the license tax to the end of the succeeding calendar year.
Section 5. Payment of License Tak Subsequent to Summons. Payment of the
license tax subsequent to a summons to appear before the judge of the County court or other court
for failure to have done so within the time permitted by this Ordinance shall not operate to
relieve such owner from the penalties provided:'for violation of the provisions of this Ordinance.
Section 6 . Status of D� Not Wear License jqg. Any dog inspected and j
found not to be wearing a collar to which is attached a license tag issued for the current
calendar year shall be considered, prima facie an unlicensed dog, and in any proceedings under
this Ordinance, the burden of proof of the fact that the dog has been licensed or is otherwise
not required to wear a license tag at the time shall be upon the owner of the dog.
Section 7. How to Obtain License Any resident of this County may
obtain a dog license by making oral or written application to the Treasurer, and by paying the
amount of the license tax. The Treasurer shall have authority to license only digs of owners
or custodians who reside withing the boundary limits of Frederick County and may require information
to establish the location of the residence of any applicant. Upon receipt of proper application,
the Treasurer shall issue a license receipt on which he shall record the name and address of the
owner or custodian, the amount of the license tax paid, the date of payment, the year for which
issued, the serial number of the tag, whether male, unsexed female, female or kennel, and shall
deliver the metal license tags or plates to the applicant forthwith.
Section 8. What Dog Licenses Shall Consist Of A dog license shall consist
of a license receipt and a metal tag in the style and design adopted by the County Board of
Supervisors. The tag shall be stamped or otherwise permanently marked to show the sex of dog,
the calendar year for which issued and shall bear a serial number. The license tag for a kennel
shall show the number of dogs authorized to be kept under such license and shall have attached
thereto a metal identification plate for each of such dogs numbered to correspond with the serial!!
number of the license tag.
Section 9 . Duplicate License Tags If a dog license tag shall become lost,

destroyed or stolen, the owner or custodian shall immediately present the original license
receipt to the Treasurer and make application for a duplicate license tag. Upon application of
the owner or custodian to the Treasurer that the original license tag has been lost, destroyed,

or stolen, the Treasurer shall issue a duplicate license tag which the owner or= custodian shall
immediately affix to the collar of the dog. The Treasurer shall endorse the number of the duplicat-
tag and the date issued on the face df the original license receipt. The fee for the issuance of
a duplicate tag shall be twenty -five cents.
Section 10. Displaying Receipts Dogs to Wear Tags A dog license receipt
shall be carefully preserved by the owner or custodian of the dog and exhibited promptly on
request for inspection by any Dog Warden or other law enforcement officer. A dog license tag
shall be securely fastened to a substantial collar by the owner or custodian and worn by such
dog at all times. It shall be unlawful for the owner to permit any licensed dog four months old
or over to run or roam at large at any time without a license tag, except that the collar and
license tag may be removed temporarily when engaged in lawful hunting in open season and when
accompanied by the owner or custodian.
Section 11. Regulating Kennel Dogs The owner of a kennel shall securely
fasten the license tag to the kennel enclosure in full view and keep one of the identification
plates provided therewith attached to the collar of each dog authorized to be kept enclosed in
the kennel. Any identification plates not so in use must be kept by the owner or custodian
and promptly shown to any Dog Warden or other law enforcement officer upon request. A kennel dog
shall not be permitted to stray beyond the limits of the kennel enclosure but this restriction
shall not operate to prohibit dogs being temporarily removed from the kennel while under the
:ontrol of the owner or custodian to exercise, hunt, breed, show or to engage in field trials. A
kennel shall not be operated in any manner to defraud the County of the license tax payable on
dogs which cannot be legally considered as kennel dogs or in any manner to violate other provisions
of this Ordinance.
Section 12 Licensed .Dogs Deemed Personal Property All dogs in this
County which are licensed, and all dogs under four months of age, shall be deemed to be personal
property and may be the subject of larceny and malicious or unlawful trespass, and the owners
thereof may maintain any action for killing of any such dogs, for injury thereto for unlawful
detention or for use thereof as in the case of other personal property. It shall be unlawful
for any person except the owner or his authorized agent to administer poison to any such dog,
to expose poison where it may be taken by any such dog or to injure, disfigure, disable, or kill
any dog except as otherwise provided in this Ordiance.' -The owner of ally dog on which the current
license tax has been paid or any dog under four months of age which is injured or killed contrary;
to the provisions of this Ordinance or any other law shall be entitled to recover the value there
of or the damage done thereto in an appropriate action at law. A Dog Warden or other law
enforcement officer finding a stolen dog or a dog held or detained contrary to lair shall have
authority to seize and hold such dog pending action before the County or other court. If no such
action is instituted within five days the Dog Warden or other officer shall deliver the dog to its
owner. The presence of a dog on the premises of a person other than its legal owner shall raise
no presumption of theft against the owner of occupant of such premises,but it shall be his duty
to notify the Dog Warden immediately and the Dog Warden shall take such dog in charge and notify
its legal owner to remove the dog. The legal owner of the dog shall pay a reasonable charge for
the keep of such dog while in the possession of the Dog Warden.
Section Dogs Killing or Injuring Sheep or Other Livestock or Poultry
It shall be the duty of any Dog Warden who may find a dog in the act of killing, injuring, worry
l ing or chasing sheep, or killing or injuring other livestock, to kill such dog forthwith whether '
such
dog
is wearing a
tag
or not; or
any person finding
a dog committing
any of
the
aforementioned
acts
and
depredations
set
forth shall
have the right to
kill such dog on
sight.
The
County Court
Dr any other court shall have the power to order the Dog Warden or other law enforcement officer

to kill any dog known to be a confirmed poultry killer. Any dog observed killing fowls for the
third time shall be considered a confirmed poultry killer. Any Dog Warden or other. person who
has reason to believe that any dog is killing livestock or committing any of the aforementioned
acts and depredations set forth in this section shall apply to a justice of the peace of the Cou
who shall issue a warrant requiring the owner or custodian, if known, to appear before the judge
of the County court at the time and place named therein at which time evidence shall be heard,
and if it shall appear that such a dog is a livestock killer, or has committed any of the afore-
mentioned acts and depredations set forth in this section, the dog shall be ordered to be killed
immediately by the Dog Warden or other officer designated by the judge of the County court.
Section 14 . Killing Unlicensed Dogs It shall be the duty of the Dog
Warden to take in charge any dog of unknown ownership found running at large on which the license
tax has not been paid, and to hold such dog for a period of five days during which time the Dog
Warden shall attempt to establish the ownership of such dog. If after five days the ownership
has not been established nor the dog claimed and the license tax paid, the Dog Warden shall kill
such dog; provided, that the Dog Warden may deliver such dog to any person in this County who
will pay the required license tax on such dog. Should the legal owner thereafter claim the dog
and prove his ownership, he may recover such dog by paying to the person to whom the dog was
delivered by the Dog Warden, the amount of the license tax paid by him and a reasonable charge for
the keep of the dog while in his possession. Any.person, Dog Warden, or other law enforcement
officer killing a dog under this Ordinance shall bury the same.
Section Disposal of Dead Dogs The owner of any dog which
has died from disease or other cause shall forthwith bury such dead dog. If he fails to do so
or leaves the dead dog on the county dump or other place, the judge of the County Court, after
I
notice to such owner, shall order such dead dog to be buried by such person as he may designate
and shall require the owner to pay the person so designated not exceeding the sum of $2.50, free
'f rom all encumberances. If the owner of any such dead dog is not known, the person designated shall
be entitled to recover the sum from the Dog Fund.
Section 16. Other Unlawful Acts The following acts shall be
deemed misdemeanors and enforced by proceedings before a judge of the County Court:
i
(1) Diseased Dog. For the owner of any dog with a known conta61
ious or infectious disease to permit such dog to stray from his premises. I
(2) Female Dog
in Season
For the
owner
of any female dog to
permit such dog to stray from his premises while
such.dog is
known to
be in
season.
(3) Removing Collar and Tag. For any person, except the owner
or custodian, to remove a legally acquired license tag from a dog.
(4) Concealing a Dom. For any person to conceal or harbor any
dog on which the license tax has not been paid, or to conceal a mad dog to keep the dog from being
killed.
Section 1y. Penalties for Violation of the D Ordinance
(a) Any person who shall make a false statement in order to
secure a dog license to which he is not entitled, shall be fined not less than $5.00 nor more i
than $100.00.
(b) Any person convicted of failure to pay the license tax
prior to February 1 of any year, or as otherwise provided in this Ordinance, on any dog owned
by him, shall be fined not less than the amount of the license tax required by law to be paid on
such dog, nor more than $3.00; shall be required to pay the license tax forthwith, and unless the
fine and license tax are immediately paid, the County court shall order the dog killed by the Dog
Warden or some other law enforcement officer, but the killing of such dog shall not relieve its
owner of the payment of the fine and license tax levied and accrued.

(c) If a dog is found to be running and roaming at large at any time of
the year in violation of the provisions of this Ordinance, the owner upon conviction shall
pay a fine of not less than $5.00 for the first offense, and $10.00 for each offense there-
after; and, if it is a kennel dog, the license may be revoked if it appears to the trial court
that the provisions of this Ordinance have been violated by reason of carelessness or negligence
on the part of the owner; such owner shall thereupon be required to pay an individual license
tax on each dog.

(d) Any other violations of this Ordinance for which spechfic penalty
i
is not provided, shall be punishable by a fine of not more than $300 and imprisonment of not
more than thirty days in the County jail, or both and shall be enforced by proceedings before
a judge of the County court in like manner and with like right of appeal as if such violations
were misdemeanors.
(e) All fines collected from any person for violating any provisions of
revenue
this Ordinance, upon conviction thereof, shall be credited to the general /fund of the County
and deposited by the County Treasurer in the same manner as that prescribed for other county
monies.
Section 18. Separability of Provisions Should any section or provision
of this Ordinance be decided to be.invalid or unconstitutional, such decision shall not effect
the validity or constitutionality of any other section or provision of this Ordiance.
Section 19. When Effective This Ordinance shall be in full force and
effect upon its adoption and enactment by the Board of Supervisors of Frederick County.

SUMMARY
This ordinance, passed 5/14/62 sets forth the provisions for the regulation
of dogs in the County of Frederick, Virginia, Regulations are prescribed for the County:
That the effect of payment of license tax subsequent to summons; that
the burden of proof that a dog is licensed is upon the owner; that the license can be obtained
in writing or in person from the county treasurer; that the license shall consist of a
license receipt and a medal tag; that duplicate tags may be issued; that kennels must displayl
kennel tags in view; that licensed dogs are deemed personal property and subject to the
pvovisions of law concerning same; that dogs killing livestock or poultry may be killed if
caught in the act of if determined by the Board of Supervisors or any court to be a livestock or
poultry killer; that the dog warden shall kill any dog of unknown ownership found running at
large; that dead dogs must be disposed of; that penalties are prescribed for the violation

Be it ordained and enacted by the Board of Supervisors of the
County of Frederick, State of Virginia, and it is hereby ordained and enacted by the authority
df the same.
SECTION_L DEFINITIONS. Parking Meter: A mechanical device
I
located upon a public street or sidewalk in a place regularly designated as a parking meter
i
zone hereafter defined, which device shall record a certain number of minutes by the use of a
clock mechanism determining the period of time for which parking privileges may be extended to
the person depositing a coin therein.
Parking Meter Zone: A certain designated and marked section of an
area of the Court Housx7lollg "The Plaza" within marked boundaries where a vehicle may be
temporarily parked and allowed to remain under the terms and conditions hereinafter set forth.
SECTION II. PARKING METER ZONES: Parking meter zones shall be
such as may from time to time be established by ordinance or resolution of the Board of Superviso
SECTION III. PARKING RULES: It shall be unlawful to park any
vehicle, or to permit a vehicle to remain parked, in any parking meter zone for a period longer
than designated on such parking meter or set forth by this ordinance or amendments thereto,
between the hours of 9:00 A. M. and 5:00 P.M. Eastern Standard Time, except where said time is
changed to Daylight Savings Time by legal authority. Said regulation as to time shall apply on
all days except Sunday, New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving
Day and Christmas Day.
It shall be unlawful to park a vehicle in any such parking zone
without paying the fee hereinafter provided for and in the manner herein designated, or to permit
a vehicle to remain parked longer in any such zone than for the period for which the fee was
paid, or to improperly park a vehicle in more than one zone or in such a manner as to interfere
with the proper use of more than one zone.
It shall be unlawful for any person to park any vehicle in any
such parking meter zone for a period longer than two hours in any three hour period on any day
to•which these provisions apply.
SECTION IV. PLACING METERS: Parking meters shall be installed
in the parking meter zones as established and provided for by this ordinance and shall be placed'
upon what would be considered the curb immediately adjacent to the individual parking places

hereinafter described. Each parking meter shall be placed or set in such manner as to show or
display by a signal whether or not the parking space adjacent to such meter is legally in use.
SECTION V. MARKING PLACES: The Sheriff of Frederick County,
Virginia, shall have markings painted or placed upon the surface of the plaza adjacent to each
parking meter for the purpose of designating the parking meter space and the angle at which
vehicles are to be parked. Each vehicle parking within any parking meter zone shall park within
the line or markings so established.
SECTION VI. PLACING COINS IN METERS: Any person desiring to park
any vehicle within such parking meter space shall deposit the proper coins for the time desired
as follows:

One cent for each 12 minutes of time desired; Five cents or one
nickel for each hour of time desired, not to exceed two nickels or one dime; One dime for two
hours of time desired.

If such vehicle shall remain parked in any such parking space
for such length of time that the meter shall indicate by a proper signal that the
lawful parking period has expired, such vehicle shall be considered as parking
overtime, and the parking of a vehicle overtime shall be a violation of this ordin c
SECTION VII: TAMPERING WITH METERS: It shall be unlawful for
any person not authorized by the Board of Supervisors to deface, injure, tamper
with, open or wilfully break, destroy or impair the usefulness of any parking meter
installed under the provisions of this article.
It shall be unlawful to place any slug, device or metallic or
other substitute for any cent, penny, nickel or dims in any parking meter.
Any person, firm or corporation violating the provisions of
this ordinance, or aiding, abetting or assisting in the violation of said provision ,
shall, upon conviction before the proper officials of the County of Frederick, be
sentenced to pay a fine of not less than One Dollar ($1.00) nor more than Three
Hundred Dollars ($300.00), or sentenced to jail for not less than one (1) nor more
than thirty (30) days or both and pay the cost of prosecution for each offense.
SECTION VIII. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional by a court of competent
jurisdiction, such adjudication shall not affect the validity of the ordinance as
a whole, or of any section, provision or part thereof, not adjudged invalid or
unconstitutional.
SECTION IX. All fines and fees collected from any person,
firm or corporation for the violation of any provisions of this Ordinance or
collected from parking meters or revenues shall be credited to the General Fund
of the County and deposited by the County Treasurer in the same mariner-as - 'that
prescribed for other County monies.
SECTION X. This Ordinance shall be in full force and effect
commencing July 1, 1962.
ORDINANCE - PARKING METERS - COUNTY PLAZA (NOTICE
Upon motion duly made and seconded the Clerk is ordered to
have published in the Winchester Evening Star once a week for two successive weeks,
the following notice, to -wit:
The Board of Supervisors of Frederick County, Virginia a.+ the
regular meeting on June 11, 1962, proposes to adopt a parking meter Ordinance. All
persons interested in the same should appear before the Board at said meeting bet -
ween'the hours of 10:00 A. M. and 4:00 P. M. in the Board room in the County Office
Building on said date for its third and final reading and adoption.

At a regular meting of the Board of Supervisors of Frederick
County held at the Court House in Winchester, Virginia, on May 14, 1962, the

BE IT RESOLVED, Whereas our County, with its expanding economy
and population is largely dependent on its network for the safe and efficient move-
rant of people and goods; and
Whereas the start of the:Department of Highways' Construction
and maintenance program at this time of year offers a timely opportunity to reflect
on the scope and objectives of this undertaking; and
Whereas we continually need to examine progress in the develc
rant of an adequate highway system and to study our long range needs and problems;

A RESOLUTION recommending to the Virginia Alcoholic Beverage Control
Board an amendment to said Board's regulations relating to the sale and consumption of wine and/ I
or beer, and /or beverages in the County of Frederick.
WHEREAS, the Virginia Alcoholic Beverage Control Board has heretofore,
pursuant to authority vested in said Board by general law, prescribed by regulation, subject
to numerous local exceptions not applicable to the County of Frederic k,certain hours during which
persons licensed to sell trine and /or beer, and /or beverages shall refrain from selling the same, ,

licensees' in the County.of. Frederick. being,.at- - present,'_prohibited from selling the same, or
permitting the consumption of same, upon the licensed premises during the hours 11:00 p. m., and
16:00 a. m of the next ensuing day; and
WHEREAS, this Board is of the opinion that said Board's regula-
tions in the premises should be amended to the extent hereinafter indicated.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Frederick County that said Board doth recommend to the Virginia Alcoholic Control Board that said
Board's regulations relating to the sale and consumption of wine and /or beer, and /or beverages
in the County of Frederick be amended so as to permit such sale and consumption upon licensed
premises in the County of Frederick other than during the hours between 12:00 o'clock, midnight
and 6:00 o'clock a. m. next ensuing.

HIGHWAY # 7 - HARRY FLOOD BYRD PARKWAY

WHEREAS, Virginia State Highway No. 7, a main thoroughfare
'through Frederick County, has not been given a name by the State Highway Commission in Virginia;
WHEREAS, said highway extends from a point in Fairfax County
through Loudoun County, Clarke County and part of Frederick County to Winchester, Vin - ginia; and
WHEREAS, there are plans to widen and improve State Highway

,No. 7, and this Board is advised that The Little Garden Club of Winchester, Virginia, plans to
,initiate a movement by a certain garden clubs in Northern Virginia for the beautification of
Virginia State Highway No. 7, so that it will become one of the scenic drives in the State; and
WHEREAS, "Rosemont ", the home of Harry Flood Byrd, Sr., Senior
Senator from Virginia, fronts on said State Highway No. 7; and
WHEREAS, Senator Byrd has contributed greatly to the establish-
ment, development and growth of the excellent Highway System in Virginia; and
WHEREAS, it is deemed appropriate that Virginia State Highway

of the intention to abandon Secondary Route 613, from 0.10 Mi. North of Int. Rt. 600 to 0.20 Mi.
Northwest of North Int. Rt. 600, a distance of 1.40 miles, pursuant to Section 33 - 76.8 of the
Code of Virginia of 1950, as amended; and
WHEREAS, after a public hearing was held on the 11th day of
June, 1962, the Board has determined that no public necessity exists for continuance of the said
section of Secondary road as a public road and that the welfare of the public will be served best
by abandoning such section of road.

Be it resolved that the Sheriff of Frederick County shall
issue a summons to all violators of the parking regulations on the Plaza setting forth the time
and date issued, the offense alleged,to have been committed, the model of vehicle involved and its

Be it further resolved that the summons provide that the same
may be returned in person or by mail to the Sheriff's Office within five days with the remittance
of $1.00, otherwise a warrant shall be caused to be issued against the owner of said vehicle,
each summons to bear a different number in consecutive order and a stub to be retained by the
issuing officer.
-Be it further resolved`that the Sheriff upon receipt of the
summons and $1.00 remittance, shall issue a receipt to the offender or person submitting the
same, keeping a copy and remit all collection then to the Treasurer of the County within one
month from receipt of the same together with the receipts and summons,. and all stubs.
PLANNING COMMISSION — RESOLUTION ADOPTION OF PROGRAM
BE IT RESOLVED, that the Planning Commission of Frederick County,
Virginia, does hereby adopt - the program presented by the Department of Conservation and Economic
Development, Division of Industrial Development and Planning, Local Planning Section, for the
orderly and effective method of procedure in gathering information and presenting the program
for the adoption of an ordinanceproviding for a general plan for Frederick County, a copy, of
which program has been presented to this Commission.
BE IT FURTHER RESOLVED, that the Frederick County Planning
Commission urge the said State Department to forthwith proceed with their program for the plann-
ing of Frederick County, as adopted by the B'o,ard of Supervisors and approved by this Commission.

the following Resolution was unanimously adopted.
RES6LUTION
WHEREAS, the City of Winchester, Virginia, was chartered in 1752,
and its primary streets have changed very little, if any, since that time and consequently are
narrow, crooked and none of the streets go directly through the City from one end to the other
as primary arteries of traffic; and, -- - --
WHEREAS, the City of Winchester today has a population in excess
0 '5,000; and,

WHEREAS, the County of Frederick has a population of approximately
22;000 and has seven primary highways through said County entering into the City of Winchester;
and,
,
WHEREAS, the Virginia Department of Highways and the Federal Bureau of
Highways are now in the process of constructing Interstate Route 81 through Frederick County
Along the eastern side of the City of Winchester; and,
WHEREAS, all of said construction and population growth in theCity of
Winchester and County of Frederick is causing now a tremendous increase in the flow of motor
vehicular traffic through said County and into said City, and that the same will increase as
WHEREAS, the Virginia Department of Highways has constructed U. S.
Highway 50 west from Winchester into a four primary highway and is perparing to construct
U. S. Highway No. 522 northwestwardly from Winchester into a four -lane highway, with construction
starting in the latter part of 1962, and within the next four years to construct U. S. Highway
No. 7 east from Winchester into a four -lane highway: and
the roads are improved and the population increases;
WHEREAS, all of the aforesaid matters are now causing a terrible bottle-
neck and traffic jam of motor vehicular traffic on the outskirts and in the City of Winchester;
NOW, THEREFORE, BE 1°P RESOLVED: That the Board of Supervisors of
Frederick County, Virginia, the Common Council of the City of Winchester, Virginia, and the
Winchester - Frederick County Chamber of Commerce do hereby jointly request the Virginia Depart-
ment of Highways to forthwith commence an engineering study and layout of a bypass around the
western side of the City of Winchester, connecting U. S. Highway No. 11 on the north with
U. S. Highway No. 11 on the south; and,
BE IT FURTHER RESOLVED: That construction of said bypass commence as
soon as possible; and,
BE IT FURTHER RESOLVED: That a copy of this resolution be forwarded to I
Senator Harry F. Byrd, Jr. and Delegate E. Blackburn Moore.
Adopted by resolution of the Board of Supervisors of Frederick County,
Virginia, on the 8th day of October, 1962.
CITIES SERVICE OIL COMPANY - FREDERICK COUNTY VIRGINIA
Upon motion of Grover Teets and seconded by W. Hurl Himelright the
following resolution was passed.
BE IT RESLOVED that the Board of Supervisors of Frederick County, Virginia,
does approve the renewal of the contract with the Cities Service Oil Company effective October
15, 1962 through October 14, 1967 at the rate set forth in the Contract, and that a copy of this
Resolution be sent to the tenant.
An explanation of the above effective date is filed with original

contract which is in the Deed file, Deed Book 230, page 352•
MARJEC INC. - DEED OF DEDICATION- SECTION 1
Upon motion duly made and seconded the following resolution was passed.
BE IT RESOLVED that the Deed of Dedication and plat of Marjec, Inc., for
Shawnee Land Subdivision Lots 16 -29 addition to Section 1 be ratified and approved for recordation
and the chairman of the Board of Supervisors be authorized to sign the plat after the same has
approved on its face by the Health Department.

LEAGUE OF VIRGINIA COUNTIES
Upon motion duly made and seconded the following resolution was
passed.
RESOLUTION
WHEREAS it would appear desirable that the newly elected officers
of the Lague of Virginia Counties assume their respective offices as soon as possible after the
League's Annual Meeting.
NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors of
Frederick County, Virginia, petition the Recording Secretary of the League of Virginia Counties
to circulate to allsnembers not less than thirty days before the 1962 Annual Meeting of said
Lague a proposal to amend Article IV (c) of the Constitution of the League of Virginia Counties
as follows:
Delete all of Article IV (c) of the donstitution of the League of
Virginia Counties which reads; "The officers elected at the Annual Meeting shall assume office as
of the first day of December following their election and shall hold office until their successors
are elcted."
Substituting therefor the following: "The officers elected at the
Annual Meeting shall be installed and assume office as of the date of their installation at the
Annual Meeting, and they shall hold office until their successors are elcted and installed."

Sheriff appeared before the Board and requested that he be permitted
to purchase one unit new Transister at $835.00 and on motion duly made and seconded the above
request was approved.

RABIES, VACCINATION OF DOGS
By the Board it was decided;and: ordered and -on motion of W. Hurl
Himelright and seconded by Paul Luttrell that no ordinance be passed for the following:
A number of persons appeared before the Board and requested that
an ordinance for the Control of Rabies be passed. Dr. Hartmut Doerwaltd presented a petition
signed by a number of Frederick County citizens requesting that a County Ordinance for Compulsory
Vaccination of dogs against rabies be passed. He also spoke in behalf of Compulsory Vaccination
of dogs, Dr. L. 0. Fears, County Health Officer said the Health Department was favor of a

L abies Control Program and Compulsory Vaccination should be a part of the program.
A representative of the Frederick County Council of the Parent- Teachers
Association appeared on its support. Mrs. C. T. Lofton and Mr. Brown were apposed of its
p assage and after due consideration by the Board it was decided and ordered and on motion of
Hurl Himelright and seconded by Paul Luttrell that no Ordinance be passed.
Accounts totaling 5,197.64 were approved and ordered to be paid from the
1 County Funds by Warrants 21807 and 21855 inclusive: Livestock, Fowl Claims and Henry

ARY - ORDINANCE - WIDTH OF STREETS INCREASED
Upon motion duly made and seconded the Clerk is ordered to have published in
the Winchester Star once a week for two successive weeks the following summary of the Ordinancd
to amend County Subdivision Act to (a) require a 60 foot right of way from property line to
property line and (b) to require all subdividers of new or additions to all subdivision. To
place street name signs at all intersections and that they come on for final approval at the
December 1962 meeting.
The above Ordinance passed its first and second reading and the Clerk is
Ordered to have the same advertised one time in each week for two successive weeks and the public
hearing will be heard on the 10th day of December 1962 in the Frederick County Supervisors -Room.

Upon motion duly made and seconded the following resolution was passed.
WHEREAS, The School Board for the County of Frederick, on the 12th day of
November, 1962, presented to this Board an application addressed to the State Board of Education
of Virginia for the purpose of borrowing from the Literary $125,000 for the new school
building (or for adding to or improving the present school lding)at Winchester, Va. to be
paid in 10 annual installments, and the interest thereon at 3 r cent paid annually.
RESOLVED, That the application of the Coun School Board to the State Board
of Education of Virginia for a loan of $125,000 from the Literary Fund is hereby approved, and-
authority is hereby granted the said County Board to borrow the said amount for the purpose set
out in said application.
The Board of Supervisors for said County will each year during the life of this
loan, at the time they fix the regular levies, fix a rate of levy for schools or make a cash
appropriation sufficient for operation expenses and to pay this loan in annual installments and
the interest thereon, as required by law regulating loans from the Literary Fund.

PURCHASE OF LAND - ROLLING FIELDS SUBDIVISIONS - GRAVEL SPRINGS SCHOOL HOUSE

On motion of Grover Teets and seconded by.Charles Garber, the
Board approved a request from the.Frederick County School Board for the purchase by the School
Board of ten acres of land located in the Rolling Fields Subdivision andbordering on the Senseny
Road east of Winchester at $800.00 per acre. At the same time, the Board gave the School Board
permission to adjust its October 1 - December 31, 1962, Quarterly Budget by adding a $2,000.00
item entitled Building Fund in this budget, in order to make the purchase possible. In addition,
,the Board agreed to place the proceeds from the sale of the Gravel Springs School property in the
Building Fund when the sale of said property is completed.
HEALTH DEPARTMENT - NEW BUILDING
Douglas Butler appeared before the Board and discussed the plans
for a new building for the use of Winchester Public Health Department.
Upon motion duly made and seconded it is ordered that the Maple
Tree located at the north East corner of the Frederick County Clerk's Office be removed.
Upon motion duly made and seconded and by the request of the
Frederick County Treasurer, the Treasurer is ordered to transfer the sum of Twenty Five Thousand
,Dollars from the General Revenue Fund to the School Building Fund.
PINE SUBDMSION - ADDITION
Upon motion duly made and seconded the.following resolution was
pasted.
BE IT RESOLVED: That Roosevelt Boulevard, in the Pine Subdivision,
be added to the Secondary Highway System of Frederick County as follows:
Roosevelt Boulevard: From the Intersection of Route 755 and Route
1756, South 0.10 Mil to Robinson School. length: 0.10 Mile.
An unrestricted right of way of 50 feet in width is guaranteed. This right of way is recorded
in the Clerk's Office of Frederick County in Deed Book Page 547, dated September 9, 1953•
This street has been constructed by the subdivider in accordance
with the county ordinance and the Highway Department Policy for subdivision streets. It has been
graded to a roadway width of 28 feet, exclusive of ditches and has a crushed stone base 5" in

ORDINANCE
WHEREAS, there is a difference in requirements in the ordinances of the County
of Frederick and the City of Winchester,.Virginia, for the width of streets in subdivisions; and,
WHEREAS, it is the desire of the Board of Supervisors of Frederick County, �
Virginia, to conform with the requirements of the City of Winchester, Virginia, as well as the
requirements of the Department of Highways; and,
WHEREAS, the Department of Highways has requested a change in the ordinances
of the County of Frederick, Virginia; and,
WHEREAS, it becomes necessary to change the requirements for electric and
telephone utility poles and rights of way when the width of said streets is changed;
NOW, THEREFORE, BE IT RESOLVED, that Article 2, Section 5 -A and Section 12 of
the Land Subdivision Ordinance of Frederick County, Virginia, adopted by the Board of Supervisors
of Frederic County, Virginia be, and-the same are hereby amended to read as follows:
SECTION 5 -A: The owner or proprietor of any tract of land which is being sub-
divided Ll provide in the plat a necessary easement or right of way on, over along all lots r
or in the front of said lots, inside the curb lines or property lines, for utility poles carrying
,electric and telephone wires, and said easements or rights of way shall be clearly marked on said
plat before final approval of said plats by the Board of :Supervisors of Frederick County, Virginiaj.
Utility poles may be placed in any area designated on said plat between the curb lines and property
lines or inside the property lines. The deed of, dedication must provide ingress to and egress
from said easements or rights of way.
SECTION 12: Al Alleys "6hall, wherever practicable, parallel all streets,
and there shalllbe intersecting streets at least every 528 feet along every street unless other- 1
wise permitted by.the Board of Supervisors df Frederick County, Virginia, and all streets must
be a uniform width of 60 feet from property line to property line, and 40 feet from curb line to
curb line, with the exception that streets which are a continuation or extension of existing

streets or streets already marked in approved subdivisions recorded in the Clerk's Office as I
proposed streets may be of the same width in new sections of existing subdivisions as the existing
streets in old sections of subdivisions or as may be otherwise approved by special permission of
the Board'of Supervisors, having passed its first and seconded reading and was advertised on the
'9th day of November, 1962 and on the 16th day of November, 1962 in the Winchester Evening Star
and further the Public hearing was had on the 10th day of December, 1962 as advertised, and said

Lee A. Ebert be, and hereby are appointed to make a study of the Frederick County Subdivision
Ordinance and its Amendments and attempt to compile the same in one booklet.

BE IT RESOLVED that the Highway Department is hereby requested to add the
following section of road to the Secondary System of Frederick County.
The road leaving Route 671, 0.90 mile west of Route 11, and extending in
a northerly direction, a distance of 0 .35 mile to a point 0.10 mile south of the entrance to the
William Reuter property. Length: 0.35 Mi.
A forty foot (401) unrestricted right of way is guaranteed, this right of
way was recorded in the Clerk's Office of Frederick County in Deed Book No. 284, Page 377, on
December 13, 1962.
WHITTIER AVENUE - SECTION 2- STONEWALL DISTRICT
A Preliminary Plat of Whittier Avenue Section 2 was presented to the Board

BALTIMORE AND OHIO RAILROAD COMPANY - NOTICE
The Baltimore and Ohio Railroad Company hereby gives notice that it has
filed with the State Corporation Commission of Virginia, Case No. 16171, in the matter of the
application-for authority to discontinue the freight agent at Middletown, Frederick County,
Virginia; make said point a pre -pay station for carload freight only and abandon and remove the
station building at Middletown, Virginia.
The State Corporation Commission will hold a public hAaring on said
application in its Courtroom in the Blanton'Building in the City of Richmond, Virginia, at
10:00 A. M. on January 30, 1963. All persons having an interest in the matter should appear
before the Commission at said time and place and present any pertinent testimony.

Supervisor's of Frederick County, Vir g inia at the request of the citizens of Frederick County
do hereby notify the State Corporation Commission that they are opposed to the closing down and
removal of the Railroad Station and Agency at Middletown, Fredipric2 County, Virginia.
And that the said Railroad Company be required to continue to maintain
said agency and said station as the Middletown area of Frederick County, Virginia is a growing
area in which two of the largest steel Companies in the United States have mineral interests

APPLE BLOSSOM COMMITTEE - PLAZA
Upon request of J. P. Arthur 1 of.the Apple Blossom Committee that they be
granted permission to use the plaza.for Amusements Wednesday, Thursday, and Friday, May 1 -2 -3
to be used as in former years. All equipment to be removed by early Saturday morning.
Upon motion duly seconded, it was unamiously decided to grant the above
requested permission; subject however, to the following restrictions; that no bricks be damaged,
all damage to meters to be paid, no stakes to be driven,no wires to be used; and further it is
not to be used for living quarters. Bond is to be posted if declared necessary by said Board.
PLANNING COMMISSION - LAND USE MAP
Upon motion duly made and seconded the following resolution was approved.
Be it Resolved, that the P lanning Commission of Frederick County recommend
to the Board of Supervisors that the Land Use Map be placed on some type of backing from which
it can be easily removed and be hung in the meeting room of the Board of Supervisors, available
to the public, and kept up to date by the Commissioner of Revenue when he issues building permits,
and that the map be sent back to the Local Planning Section of the Department of Conservation
and Economic Development, Division of Industrial Development and Planning, once a year or
more often, if necessary, to be broughtup -to- date and returned to the Planning Commission.

j Upon motion of Grover Teets and seconded by W. Hurl Himelright the
following resolution was approved.
Mr. D. H. Gaulden, Jr., Resident Engineer, Virginia Department of
Highways, appeared before this Board regarding the plans for Interstate Route 81 - Project
0081 - 034 -001, R/W 203, G -306, B -631, with regard to closing Secondary Route 671 during construction
at its intersection with Route 81, and that traffic be detoured over Routes 661, 669 and 672.
Upon completion of the construction of the proposed Rt. 671 overpass structure and approaches,
traffic will be rerouted over same.
WHEREAS: after due consideration, discussion and reviewing Sheet
#11 -C of the plans, with the explanation of the Resident Engineer, NOW THEREFORE BE IT RESOLVED:
That this Board of Supervisors approves the closing of Rt. 671 during
construction, and detouring traffic over Rts. 661, 669, 672 in reference to Interstate Project
0081- 034 -001, R/W 203, G -306, B -631.

Upon motion of Grover Teets and duly seconded the following Resolution
was unanimously adopted.
WHEREAS, on the 11th day of February, 1963, the Board gave notice of
its intention to abandon that portion of the bridge at Cedar Creek on State Secondary Route 624
which is situate in Opequon Magisterial District, Frederick County, Virginia, and to approve
the abandonment by Shenandoah County of the re maining portion of said bridge together with that
section of Route 624 immediately adjacent thereto which is situate in Davis Magisterial District,',
Shenandoah County, Virginia, and which extends from said bridge in a generally Northwesterly
direction through the lands of Chemstone Corporation to the point on said road where the land of
Chemstone intersects with the land now or formerly owned by S. E. Stickley, a distance of 0.73
mile, said notice being given pursuant to the requirements of 033 -76.8 of the Code of Virginia
of 1950, as amended; and
WHEREAS, after a public hearing pursuant thereto was duly held on the 8th
day of April, 1963 the Board has determined that no public necessity exists for continuance
of the said section of Secondary Route 624 as a public road and that the welfare of the public
will be served best by abandoning such section of said road.
NOW, THEREFORE., BE IT RESOLVED: That the portion of the bridge at Cedar
Creek on State Secondary Route 624 which is situate in Opequon Magisterial District, Frederick
County, Virginia, be and the same hereby is, abandoned as a public road pursuant to 933 -76 .8 of
the Code of Virginia of 1950, as amended; and
BE IT FURTHER RESOLVED: That the Board does agree to the abandonment of
that portion of Secondary Route 624 lying in Davis Magisterial District, Shenandoah County,
Virginia, which extends from the Frederick/Shendandoah County line at Cedar Creek in a generally
direction through the lands of Chemstone Corporation to the point on said road
where the land of Chemstone intersects with the land now or formerly owned by S. E. Stickley,

C hairman Brumback stated that he had received a letter from J. Alvin Racey,
Ja resident of the Massie Subdivision,'in which he requested the Boards's approval of a proposed
!connection to the sewage disposal system planned for the Tam of Stephens City. The letter was in

conformity with Title 15 - 739.7 of the
Cumulative Supplement of the Code of Virginia.
Mr. Racey also appeared before the Board in person and showed the
Board, a copy of the engineer's drawings for the sewerage facilities for Stephens City and the
extension of the line to provide sewerage for the Massie Subdivision. He also produced a copy of
the various contract documents for the sewerage facilities prepared by John McNair & Associates,
'consulting engineers, of Waynesboro, Va., for the Board to examine.

$4000.00. Ninety occupied dwellings- length 0.42 Mile. This road will serve the most dwellings
and can be-bofistructed with funds available.
(2) Buckhorn Lane - From Route 633 to 627 East of Middletown - Cost $12,000.00 =
4 dwellings - length 0.85 mile .- insufficient funds.
(3) Extend Route 754 - 1.30 Mile - Cost $15,000.00 - Serve only one dwelling does -
not meet requirements.
After due consideration it is the .sense of this Board that number Three does not meet'
the requirements and that number Two has insufficient funds and..
Upon motion duly made and seconded number One is approved.
BUDGET - SUPPLEMENTARY SCHOOL BUDGET
Robert E. Aylor, Superintendent of Schools of Frederick County appeared before the
Board and requested that they be permitted to use $3000.00 Capital Outlay for the purchase of
equipment. The Frederick County School Board will be reimbursed 100% for this item by the State
Board of Education.
Upon motion duly made and seconded the above request was approved.
Beginning May 1, 1963 it was ordered by the Board of Supervisors of Frederick County,
that Henry Bursey, Dog Warden, be paid mileage at the rate of seven cents per mile traveled in
the Execution of this Office.

AMENDMENT TO ORDINANCE REQUIRING A BUILDING PERMIT Aee J ` f S b
WHEREAS.. there is continuous and rapid erection, construction, moving, alt ration,
and demolishing of buildings in Frederick County, Virginia, to such an extent that the Commissioner
of Revenue is unable to immediately and accurately assess the property owners for their improve-
ments; and,
WHEREAS, the County of Frederick, in the State of Virginia, is thus losing money due
to the lack of proper and immediate assessments, and it has become necessary to correct this
mattwer by the requirement of building permits;
NOW BE IT RESOLVED, that before the excavation or the erection or construction of any �
building, wall or structure, or any part thereof, by any person, firm or corporation, shall be
started or before any building or structure shall be moved, alterated, or demolished, where the
total value of such building or structure will be in excess of $500.00, an application for a
permit for such erection, construction, moving, alteration, or demolition of any building, wall,
or structure, or any part thereof, shall be made to the Commissioner of Revenue by the owner
or his authorized agent. It shall be unlawful for any person to begin the excavation or the
erection, construction, alteration, moving, or demolition of any building, wall or structure, or
part thereof, until the proper permit has been issued therefor.
The application for the permit required by Section 1. shall be made on forms furnished
by the Commissioner of Revenue and which shall contain such information with reasonable certainty'
as to the kind and character of the work to be done and the estimated cost thereof`.
The owner of any land upon which he seeks to obtain a building permit from the
Commissioner of Revenue, shall first obtain from the Director and Sanitation Officer of The

' Frederick County Health Department a certificate stating (a) the location of the building and
!(b) the location of the water supply and sewer system as shown on the plans submitted to said
Health Department by the owner or his agent for the proposed construction meets the requirements
of said Health Department. This certificate shall be written upon the plans of the owner of the
iproposed building.
Neither the owner of said land seeking said building permit nor his successor in
title thereafter shall vary from said plans the location of the proposed building, water supply
f or sewer system after the building permit has been granted by the Commissioner of Revenue, with -
l out first obtaining the consent of the said Health Department.
Anyone starting the excavation or erection, construction, alteration, moving or
demolition of any building, wall or structure, or any part thereof, within the County without
first obtaining a permit for the same shall be punished by a fine of $25.00 for any such offense.
The enactment of the above Ordinance was postponed until the July Meeting.

An unrestricted right of way of 30 feet is guaranteed. This right of way is
recorded in the Clerk's Office of the County of Frederick in Deed Book 154, Page 503 dated June
9, 1926 and Deed Book 218, Page 465 dated April 20, 1951.
This street has been constructed by the property owners. It has been graded to a
roadway width of 24 feet, exclusive of ditches and has a crushed stone base 5" in depth.

' PLAINFIELD DRIVE - SECTION 1 - PLAINFIELD HEIGHTS SUBDIVISION - ADDITION
Upon motion duly made and seconded the following resolution was adopted:
BE IT RESOLVED: that Plainfield Drive in Section #1 of Plainfield Heights Sub -
j division be added to the secondary highway system of Frederick County as follows:
Plainfield Drive: From Rte. 11 to 0.12 Mi. Southwest of Rte. 11 to the line
between Lots 5 and 6 Length 0.12 Mi.
An unrestricted right of way of 50 feet in width is guaranteed. This right of way
was recorded in the Clerk's Office of the County of Frederick in Deed Book 241 Page 384 dated
May 1 9,1956.
This street has been constructed by the subdivider in accordance with the County
ordinance and the Highway Policy for subdivision streets. It has been graded to a roadway width
of 28 feet, exclusive of ditches and has a crushed stone base 5" in dbpth and is bituminous
surface treated 20 ft, in width.

FAY STREET - SECTION 1 - ECHO VILLAGE SUBDIVISION - ADDITION
Upon motion duly made and seconded the following resolution was adopted:
BE IT RESOLVED: that Fay Street in Section 1 of the Echo Village Subdivision be
added to the Secondary System of Frederick County as follows:
"Fay Street" - From Route 11, West 0.15 Mile. Length 0.15 Mile.
An unrestricted right of way of 50' in width is guaranteed, this right of way is
recorded in the Clerk's Office of the County of Frederick in Deed Book Page on

This street has been constructed by the subdivider in accordance with the County

COOL WATERS FARM TATS - PLAT
A preliminapy Plat of Cool Waters Farm Lots was presented to the Board by Lee Ebert
and on motion said plat was approved tentatively.
TENTATIVE SECONDARY MAINTENANCE & CONSTRUCTION BUDGET
Upon motion duly made and seconded the following resolution was adopted:
BE IT RESOLVED, that his Board hereby approves the 1963 -1964 Tentative Secondary
Maintenance and Construction Budget for Frederick County, as sumbitted by D. H. Gaulden, Resident
Engineer. f t
This approval is given with the understanding that this budget is subject to review
and possible changes Dy the State Secondary Roads Engineer.
Upon motion duly made & seconded the following request was approved:
'The Frederick County School Board represented by Robert E. Aylor, Superintendent of
Schools, requested that the teacher payroll normally paid on July 1 be paid on June 30 of this
year and submitted a supplementary budget in the amount.of $65,218.00 for the period April 1
thu June 30, 1963. The School Board plans to date future payrolls on the last day of the month
in order to bring expenditures for the quarter in line with quarterly reports.
The Board on motion of Grover Teets and seconded by approved the
request as well as the supplementary budget authorizing the appropriation of $65,218.00 to in-
clude the approved June 30 teacher payroll within present quarterly expenditures.

TWO' Zoning
Variance's
Two zoning variances were ap-
proved Monday by the Frederick
County Board of Supervisors. The
Board took no action on a request
for an additional deputy sheriff.
The first variance granted was
that requested in the petition of
Dr. Walter D. Myers permitting
the conversion of the 'property'
known as the Steak House into a
multiple dwelling property. This
was approved by resoultiun on a
motion by Paul Luttrell, seconded
by Charles Carber. I .
A petition of Winchester Con-
crete Products Co. for a variance
to construct an office building on
its property within 350 feet of Rt.
11 was also approved by resolu-
tion. The action was on a motion
by Grover Teets, seconded by Air.
Garber.
Mr. Teets moved that another
deputy sheriff be hired but there
was no second to the motion and
the request was in effect denied.
Sheriff Robert L. DeHaven had u
requested the additional deputy.
The cost of another officer, it
was revealed, would be approxi-
mately $3,600 per year. The state
would pay two thirds of the'
anlenllt and the county would pay
the other one third, or $1,200.
The board approved a resolution
accepting the deed of dedication
and 20 pages of plats of Wilde
Acres, Inc., for 30, days inspec-
tion and consideration by the
health department and —the board.
This action-was taken on a mo-
lion by Hurl Himelright, second-
ed by Mr. Teets. I

SPECIAL MEETING
Upon motion duly made and seconded it is ordered that a Special Meeting be
held in the near future subject to the call of the Chairman of the Board of Supervisors for
the purpose of discussing the matter of the establishment of a 500 KV Electric Transmission
Line through the southern portion of Frederick County. `
500 KV ELECTRIC TRANSMISSION LINE
A delegation composed by Robert E. O'Neal, Charles E. Bass, Joe Sharp and
others appeared before the Board and requested the Board to pass the following resolution:.
WHEREAS, it has been proposed that a 500 KV electric transmission line be
established through Frederick County, and
WHEREAS, it is believed that the establishment of such line would adversely
affect the extensive tourist trade in the County, would mar the beauty of theShenandoah Valley
without providing any service in the County which is already provided with adequate electric
power, would adversely affect the development of suburban residential properties as well as farm
properties in the County, and would eventually result in a substantial loss of tax revenue to
the County:
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Frederick
County objects to the establishment of a 500 KV electric line in Frederick County by Virginia
Electric and Power Company, and
BE IT FURTHER RESOLVED, that the Board of Supervisors intervene in the proceedings
now pending before the State Corporation Commission of Virginia for the purpose of opposing
the location of said transmission line in Frederick County, and the Attorney for the Common-
wealth is requested to prepare and file the necessary petition of intervention on behalf of the i
Board of Supervisors and to proceed with the presentation of the Boards' opposition to said

Virginia, has petitioned the Board of Supervisors for a permit as provided for in Section

That William E. Sine be, and he is hereby granted permission for a display of
fireworks at Winchester Drive -In- Theater in Stonewall District, Frederick County, Virginia on
the evening of July 4 1963 under his control and direction and by his employees only, and
provided further that his customers and guest be no closer than 200 feet to said display of
fireworks.

Accounts totaling $9,022.39 were approved and ordered to be paid from the General
County Funds by Warrants 22385 and 22427 inclusive: Livestock, Fowl Claim & Henry Bursey's
Salary totaling $507.82 were read and ordered to be paid from the Dog Fund by Warrants 2118 and
2123 inclusive.
