REPORT OF PLANNING CO MMISSION - B. P. MYERS
The following report of the Planning Commission was presented;

The petition of B. P. Myers to operate an antique furniture store on
his property at the Northeastern corner of the intersection of Fox Drive and U. W. Highway No.
50, in Zoned Area A, was duly received and statements on behalf of the petitioner and on behalf
of the residents of that area were heard, and, after the public hearing, the Commission than
discussed generally the petition and the arguments for and against the same presented by the
petitioner and the public.
On motion duly made and seconded, it was resolved that the petition of
B. P. Myers to operate an antique furniture store on his property at the Northeastern corner
of the intersection of Fox Drive and U. S. Highway No. 50, in Zoned Area A, be denied on the
ground that it was a non - conforming business for Zoned Area A, which motion was unanimously
passed; and, upon motion duly made and seconded, said report was approved anG it was resolved

HOSPITAL - SHELTERING ARMS HOSPITAL
Upon "motion duly made and seconded•, it is ordered that one hundred dollars
be donated to the Sheltering Arms Hospital, Richmond, Virginia, for the current year of 1959 and
1960.
GAME WARDEN - EARL L. LATHER
Upon motion duly made and seconded and upon request of Earl L. Cather, it is
ordered that he be and hereby is released from further duty as Dog Warden of Frederick County.
DOG WARDEN - HENRY S. BURSEY
Upon motion, duly made and seconded, this Board requests the Judge of the
Circuit Court of Frederick County, Virginia, to appoint Henry S. Bursey Dog Warden for Frederick
County for the term beginning on the first day of July, 1959, and ending on the 30th day of June,l
1960.
SALARY - DOG WARDEN - HENRY S. BURSEY
Henry S. Bursey, having been appointed Dog 'Barden for the term beginning on
the lst day of July, 1959, and ending on the 30th day of June, 1960; it is ordered that his
salary be, and hereby is fixed at the sum of 6125.00 per calendar month.

There being evidence that the foot bridge over Babbs Run on Rt. 731 no
longer renders a public service it is proposed by.the Frederick County Board of Supervisors that
this footbridge be abandoned from the Secondary Road System of Frederick County in accordance
with Paragraph 33 -76.8 of the Code of Virginia
Anyone who has valid evidence that the above proposal is contrary to the
interest of the general public is invited to appear at the regular meeting of the Board of Super -,

be published in the Winchester Evening Star on two successive weeks:
There being evidence that the footbridge over Hogue Creek located on Px ivate
property south of the ford on Rt. 679 no longer renders a public service and since the property
owner has "No Trespassing" signs in place prohibiting the general public from using this bridge,
it is proposed by the Frederick County Board of Superfisors that this footbridge be abandoned
from the Secondary Road System of Frederick County in accordance with Paragraph 33 -76.8 of the
Code of Virginia.
Anyone who has valid evidence that the above proposal is contrary to the

ORDINANCE - COMPULSORY SCHOOL ATTENDANCE
Upon motion of Grover Teets and seconded by B. 0. Brumback, the following
ordinance passed its first and second readings:
Pursuant to, Section 15 -8 of the Code of Virginia the public is hereby
notified that the Board of Supervisors of Frederick County, Virginia, intend to pass an ordinance
at its regular meeting on August 10, 1959, which will provide for compulsory attendance in the
county schools of all children residents of the County who are seven years of age through four-
teen years of age. Said ordinance shall provide for certain exceptions and penalties for violation

There will be a public hearing on said ordinance from 10:00 A. M. to
12:00 Noon in the Board Room, in the County Office Building, on August 10, 1959, prior to passage
of the same.

ORDINANCE - SCHOOL ATTENDANCE LAW -
Upon motion, duly made and seconded, the following ordinance was adopted:
Be It Ordained that Article 4, Sections 22- 275.1 through Sections 22- 275.24
of the Code of Virginia, being part'lof Chapter 12 of Title 22 of the Code of Virginia for 1950,
be, and the same is hereby, adopted by the Board of Supervisors of Frederick County, Virginia,
as though set out herein in haec verba; and it is further ordained that the provisions for the
violation of this ordinance and the Code of Virginia shall be prosecuted by the Commonwealth's
Attorney for Frederick County, on behalf of the Commonwealth, and the punishment shall be.as set
forth in said Statuted, enacted by the General Assembly at its extra session of 1959.
Be It Further Ordained and enacted that said Sections of the Code of Vir-
ginii� shall apply to children who have reached the seventh birthday and have not passed the four-
teenth birthday.

WHEREAS: Members of this Board in company with the Resident Engineer of the I
Department of Highways having inspected certain footbridges listed below in their respective I
magisterial districts and whereas, proper notices of intent of abandonment having been published

for two (2) issues, in the Winchester Evening Star, also notices posted at the County Courthouse
in Winchester, and at each end of the said bridges and a public hearing having been held at which
time no objections to the proposed abandonments were offered; therefore, since these bridges no

Upon motion, duly made and seconded, it is ordered that Lee Garber install
a water fountain upstairs in the Court House for drinking purposes.

BORROW MONEY - STATE LITERARY FUND
R,..E. Aylor, Superintendant of the Frederick County Schools appeared befor�
the Board and made the following request:
The Frederick County School Board hereby requests that an application be
prepared and submitted to the State Board of Education in the amount of $30,000.00, requesting i
a loan from the State Literary Loan Fund. This money is to be used to construct the two -room
addition to the Stonewall School.
The School Board requests further that it be permitted to borrow locally
an amount not to exceed $30,000.00 to be used toward the Stonewall construction and the Gibson
School construction, said loan to be repaid upon release of Literary Loan Funds.

HERLAS, the proposed interstate highway construction near and at the inter-
change of interstate Routes 81 and 66 south of Middletown will isolate the residents of the
Bowman community of south western Warren County from U. S. 11 and reasonable access to Middletown.
Since Middletown is this area's Post Office, as well as banking and shopping point this cut off
will adversely affect the Middletown community and these residents of Warren County.
THER1_FORE, be it resolved that we request that the following changed be
given consideration:
1. That Route 612 be continued westerly across Route 611 and
proposed interstate 81 to U. S. 11 north of Cedar Creek.
2. That Route 611 be extended across 626 and proposed interstate 66 to Route

or provisional appointment, to become eligible, effective as of Jan„ 1 1960, to participate in
