SUBDIVISION - HENKEL LAMP Upon motion, duly made and seconded, the Henkel Lamp Subdivision Plat at Middletown was approved; subject, however, to reservation of Lot #10 to be held for a pro- f posed street for a period of ten years. i BECKMAN - SUBDIVISION Upon motion, duly made and seconded, the Beckman Subdivision, located on Route #522 (Front Royal Road) was tentatively approved. i S UBDIVISION - BURNING KNOLLS Upon motion, duly made and seconded, the subdivision (Burning Knolls) i Section C. was tentatively approved. SUBDIVISION - SHAW -NEE -LAND Upon motion, duly made and seconded, the following resolution was passed Be It Resolved, that the preliminary plat of Shaw- hee- Lande, Sections 1 L, M, N, 0, and P, of Marjec, Incorporated, located about ten (10) miles West of Winchester, in Back Creek District, Frederick County, Virginia, be, and the same is hereby, received by the Board of Supervisors of Frederick County for consideration for the next thirty (30) days. REPORT OF PLANNING CO MMISSION - B. P. MYERS The following report of the Planning Commission was presented; i The petition of B. P. Myers to operate an antique furniture store on his property at the Northeastern corner of the intersection of Fox Drive and U. W. Highway No. 50, in Zoned Area A, was duly received and statements on behalf of the petitioner and on behalf of the residents of that area were heard, and, after the public hearing, the Commission than discussed generally the petition and the arguments for and against the same presented by the petitioner and the public. On motion duly made and seconded, it was resolved that the petition of B. P. Myers to operate an antique furniture store on his property at the Northeastern corner of the intersection of Fox Drive and U. S. Highway No. 50, in Zoned Area A, be denied on the ground that it was a non - conforming business for Zoned Area A, which motion was unanimously passed; and, upon motion duly made and seconded, said report was approved anG it was resolved _ I by this that B. GAME WARDEN - EARL L. LATHER Upon motion duly made and seconded and upon request of Earl L. Cather, it is ordered that he be and hereby is released from further duty as Dog Warden of Frederick County. DOG WARDEN - HENRY S. BURSEY Upon motion, duly made and seconded, this Board requests the Judge of the Circuit Court of Frederick County, Virginia, to appoint Henry S. Bursey Dog Warden for Frederick County for the term beginning on the first day of July, 1959, and ending on the 30th day of June,l 1960. SALARY - DOG WARDEN - HENRY S. BURSEY Henry S. Bursey, having been appointed Dog 'Barden for the term beginning on the lst day of July, 1959, and ending on the 30th day of June, 1960; it is ordered that his salary be, and hereby is fixed at the sum of 6125.00 per calendar month. FOOTBRIDGE - HOGUE CREEK - ROUTE 679 i Upon motion, duly made and seconded, it is ordered that the following notice be published in the Winchester Evening Star on two successive weeks: There being evidence that the footbridge over Hogue Creek located on Px ivate property south of the ford on Rt. 679 no longer renders a public service and since the property owner has "No Trespassing" signs in place prohibiting the general public from using this bridge, it is proposed by the Frederick County Board of Superfisors that this footbridge be abandoned from the Secondary Road System of Frederick County in accordance with Paragraph 33 -76.8 of the Code of Virginia. ORDINANCE - COMPULSORY SCHOOL ATTENDANCE Upon motion of Grover Teets and seconded by B. 0. Brumback, the following ordinance passed its first and second readings: Pursuant to, Section 15 -8 of the Code of Virginia the public is hereby notified that the Board of Supervisors of Frederick County, Virginia, intend to pass an ordinance at its regular meeting on August 10, 1959, which will provide for compulsory attendance in the county schools of all children residents of the County who are seven years of age through four- teen years of age. Said ordinance shall provide for certain exceptions and penalties for violation i There will be a public hearing on said ordinance from 10:00 A. M. to 12:00 Noon in the Board Room, in the County Office Building, on August 10, 1959, prior to passage of the same. ORDINANCE - SCHOOL ATTENDANCE LAW - Upon motion, duly made and seconded, the following ordinance was adopted: Be It Ordained that Article 4, Sections 22- 275.1 through Sections 22- 275.24 of the Code of Virginia, being part'lof Chapter 12 of Title 22 of the Code of Virginia for 1950, be, and the same is hereby, adopted by the Board of Supervisors of Frederick County, Virginia, as though set out herein in haec verba; and it is further ordained that the provisions for the violation of this ordinance and the Code of Virginia shall be prosecuted by the Commonwealth's Attorney for Frederick County, on behalf of the Commonwealth, and the punishment shall be.as set forth in said Statuted, enacted by the General Assembly at its extra session of 1959. ADOLPH RICHAR LAND - ROUND HILL On motion, duly made and seconded, the following resolution was unanimously I adopted: WHEREAS, by deed dated the 17th day of May, 1958, L. Adolph Richards, single, without the approval of the Commonwealth's Attorney for Frederick County, did purport and attempt' to convey to Frederick County, Virginia, certain real estate lying and being situate along the slopes of Round Hill; and, , 228 WHEREAS, said deed recorded in the Cler Deed Book 252, page 283; and, WHL',REAS , WHEREAS, never accepted said conveyance the said L. No action P ROPOSALS Several members of the Frederick County Farm Bureau appeared before the Board of Supervisors and presented the following proposals: i First: To make study of law enforcement in Frederick County. Second: To suppor the Board of Supervisors in securing a map of Frederick County, Virginia. Third: Made suggestion uring the Board to employ outside assiatance in making the 1960 real estate re- evaluation to secure a more equal assessment. Fourth HIGHWAY BUDGET FOR 1959 Urging a closed season of all doe deer in Frederick County, Virginia Upon motion, duly made and seconded, the following resolution was adopted: BE IT RESOLVED, that this Board hereby approves the 1959 -1960 final Secondary I Road Budget for Frederick County, as submitted by C. H. Coffman, Resident Engineer. That it will process all police calls made by The County units which can be handled by Radio or Police Teletype without additional cost to The City. 2. That it will provide dispatchers service for The County units includii the logging of all calls. 3. That The County may use the teletype service available in Winchester and The City will provide the necessary operators to send and receive all messages for'The'Count�. 4. That it will provide all the necessary personnel to operate and main- tain its Radio Station and teletype service for The County on a twenty -four hour a'day seven da; a week basis. The County covenants: 1. That it will pay The City the annual sum of $998 for the services i rendered which figure is subject to change dependeing on the cost of operating and maintaining the Winchester Police Station and the number of radio units using its services. The cost to The County being based on a par unit user of said station. 2. That it will have four units using the Winchester station at present;) 1 3. That it will be responsible for the care and maintenance of its radio equipment. 4. That it will provide its own trained personnel for the operation of its unit and be responsible for their conduct. 5. That it has complied and will continue to comply with all necessary F. C. C. S. 11 and reasonable access to Middletown. Since Middletown is this area's Post Office, as well as banking and shopping point this cut off will adversely affect the Middletown community and these residents of Warren County.
