At a Special meeting of the Board of Supervisors of Frederick County, Virginia,
held in the Supervisors'Room over the Clerk's Office on the 17th, day of March, 1959.

The purpose of this meeting was to fix the Levy for the fiscal year beginning
on the first day of July, 1959, and ending on the 30th day of June 1960.
Upon motion duly made and seconded, it is ordered that the 1959 -1960 Levy be,
and hereby is tentatively fixed as follows:

SPECIAL MEETING - BRUSH FIRES

At a Special Meeting of the Board of Supervisors of Frederick County, Virginia,
held in the Supervisors'Room over the Clerk's Office on the 26th day of March, 1959.

The Meeting was called for the purpose of suppressing Brush and Grass fires
in Frederick County. Representatives of the several Fire Companies were present and discussed
the matter with the Board; and upon motion duly made and seconded by B. 0. Brumback, the j•
following resolution was adopted.
WHEREAS, this has been an extremely dry spring season, following a very good
and heavy growing season of 1958, and there is a great amount of grass, brush, stubble, straw
and other substances capable of spreading fire upon the ground; and,
WHEREAS a great and excessive number of fires in fields, brush lands and woods
have been set and caused this spring; and,
WHEREAS, these fires spread rapidly out of control and endanger and jeopardize
not only the property and buildings of the land owners but of their neighbors, and also demands
the use of fire fighting equipment which leaves the homes, dwellings and other properties of
the citizens unprotected during these fires at this time of year; and,
WHEREAS, it is the desire of the Board of Supervisors to assist the State Fire
Wardens and local fire companies in reducing the number of fires and controlling those that
are burning; and,
WHEREAS, many of the citizens of Frederick County are setting fires to trash,
brush, grass and fields in a careless and negligent manner.
NOW, THEREFORE, BE IT RESOLVED: That the Board of Supervisors of Frederick
County, Virginia, hereby asks all citizens to refrain from burning, trash, woods, marshes,
stubble, brush, straw, grass or any other substance upon their land until the 15th day of April,
1959; and,
BE IT FURTHER RESOLVED: That the Board of Supervisors of Frederick County,

Virginia, urges all law enforcement officials and public spirited citizens to see to it that
Section 18-157 of the Code of Virginia is strictly enforced during this period of time by report -!
ing to all law enforcement officials and Fire Wardens all fires, and by preparing to be witnesses
in the prosecution of persons in violation of said Section, and to further assist by the swearing;
out of warrants against violators of said Section and the general intent of this resolution and
policy of the Board of Supervisors so established hereby.
Said Statute, for the information of the general public, reads as follows:
"Section.18 -157 of the Code of Virginia for 1950 - CARELESSLY DAMAGING PROPERTY
BY FIRE - If any person carelessly, negligently or intentionally set any woods or marshes on fuel,
or set fire to any stubble, brush, straw, or any other substance capable of spreading fire on
lands, whereby the property of another is damaged or jeopardized, he shall be fined not less than
ten nor more than one hundred dollars for each offense, and shall be liable for the full amount
of all expenses incurred in fighting the fire."

PLANNING COMMISSION - RE- APPOINTMENT
It appearing to the Board that the term of Clyde L. Heishman as a member
of the Frederick County Planning Commission expires on the 10th day of April 1959; it is ordered
that he be, and hereby is, re- appointed for the term of four years. Said term beginning on the
10th day of April, 1959.
CARNIVAL - VETERANS OF FOREIGN WARS Harry D. Lovett
On behalf of the Veterans of Foreign Wars /appeared
before the Board and requested that they be granted permission to hold a Carnival in Frederick
County, and upon motion duly made and seconded it is ordered that said request be, and hereby
is granted.
On motion by G. G. Teets and seconded by B. 0. Brumback that the Board
acknowledge receipt of the petition of B. P. Myers for a Variance in zoned Area A, and that the
petition be referred to the Planning Commission for a report to be submitted to the Board of
Supervisors at its Regular May meeting; May 11, 1959. The motion passed unanimously. The
following is a copy of said Petition.
The undersigned petitioner, Branson P. Myers, respectfully requests the

Board of Supervisors of Frederick County, Virginia to rezone, grant a variance or otherwise zone
his property described below so that it may be used for a retail antique and gift shop.
The property is a lot in Stonewall District, Frederick County, at the
intersection of U. S. Route 50 and Secondary Route 753, approximately 121 feet by 130 feet in
size and is improved by a modern brick commercial type building not suitable for residential
purposes.
The petitioner requests that the Board of Supervisors refer this petition
to the Frederick County Planning Commission for action, and asks that the Commission and the
Board act favorably on it.
HENKEL LAMP PLAT - SECTION ONE
On motion of B. 0. Brumback, Seconded by G. G. Teets and passed to
approve final Plat of Henkel Lamp - Section One Lamps Subdivision at Middletown, after providing
for through intersecting 50' street - to be signed by Chairman after approved by Resident
Engineer. The said Henkel Lamp to file a $4000.00 Bond for street for 1 year.
PLEASANT VALLEY SUBDIVISION - SECTION 3
On motion of C. E. Garber and seconded by G. G. Teets and passed to
approve section 3 of Pleasant Valley Subdivision of Goode and Truslow after signature of
Resident Engineer, to then be signed by the Chairman. Bond of $1000.00 is set for section 3.
BILLS PAYABLE
Accounts totaling $5748.49 were approved and ordered to be paid from
the General County Fund by warrants numbers 18976 to 19033 inclusive; and livestock claims,
Fowl claims and Earl Cather's salary totaling $223.75 were approved and ordered to be paid
from the Dog Fund by warrants- numbers 1835 to 1838 inclusive.

TAX LEVY - TENTATIVE
Upon motion of B. 0. Brumback and seconded by G. Grover Teets. According to an
advertisement published in the Winchester Evening Star, that on the 22nd day of April, 1959,
a public hearing would be held on the Levy as tentatively set for the fiscal year beginning
on the first day of July, 1959 and ending on the 30th day of June, 1960 inclusive. Two tax
only, appeared and objected to the increase as tentatively set at the Regular meeting
held on the 17th day of March 1959. Upon motion of B. 0. Brumback and seconded by G. Grover
Teets the said rate was confirmed as tentatively set. The following members voted for the
confirmation were; B 0. Brumback, C. E. Garber and G. Grover Teets. L. R. Omps voted against
confirming said rate.
