PLANNING COAFMISSION - APPOINTMENT
It appearinc to the Board that a vacancy exists on the Planning Commission,
it is ordered that Clyde L. Heishman be, and hereby is appointed a member of said Commission for
the term beginning on the 10th day of April, 1958 and expiring on the 10th day of April, 1959.
ROADS - ROUTE 636 - YACEDONIA
A petition for improvements to Route 636 - Macedonia Road, which was
signed by a number of land owners located on said road was presented to the Board. The said peti.-
tion was delivered to Claude Coffman, Road Engineer.
JANITOR - SALARY
Upon motion duly made and seconded, it is ordered that the salary of
Wilbur P. Anderson, janitor, be increased from Two Hundred Dollars to Two Hundred and Fifty
Dollars per calendar month. Said increase to begin on the lst day of July, 1958.
ROADS - DISCONTINUED OLD ROUTE 50
Upon motion of Grover Teets and seconded by B. 0. Brumback, the following
resolution was adopted: BE IT RESOLVED, that Section 1 of the old location of Route 50, a
distance of 0.142 miles as shown on the attached sketch of Route 50, (Old) Project 1934 -10, (New)
Proj. 0050- 034 -010, be discontinued in accordance with Section 3376.1 of the 1950 Code of Vir-
ginia as amended, due to new construction of (Old) Project 1934 -10, (New) Proj. 0050 -034 -010.
ROADS - SPRAY
Upon motion of Grover Teets, seconded by L. R. Omps, the following reso-
lution was passed: BE IT RESOLVED, that this Board recommends that the Highway Department use
herbicides or chemical sprays for control of vegetation on the ro0 sides in Frederick County in
accordance with the Highway Department's policy as set forth in the Manual of Instructiona -

KIWANIS CLUB CARNIVAL
The Kiwanis Club of the City of Winchester, Virginia, requested that
they be granted permission to hold a carnival in Frederick County on the property of Charles A
Pine, near the City of Winchester; and on motion, duly seconded the said request was granted.
ROADS - ABANDONED
Upon motion, duly seconded, the following resolution was adopted:
RESOLVED: That the necessary prodedure be complied with and notices
osted to abandon the section of road as follows:
Upon the request of interested citizens owning property adjacent to
Rt. 677, that the section of this route extending from 0.48 Mi. west of the Int. of R.t 715 to
the end of maintenance, a distance of 0.32 M1., be abandoned, this Board hereby indicates its
intent to grant this request in accordance with Par. 33 -76.8 of the 1950 Code of Virginia, as
amended.
Anyone objecting to this proposed abandonment is requested to appear at
the regular meeting of this Board in the Court House in Winchester at 2:00 P.M., Monday, Septem-
ber 8, 1958, where they will be heard.
ROADS - ABANDONED - ADDITION
Upon motion, duly seconded the following resolution was adopted:
BE IT RESOLVED, that Sections 1, 2, 3, and 5 of old Route 600, as shown
on the attached sketch, a total distance of 0.32 miles, be abandoned from the Secondary System
of Highways in accordance with Section 33 -76.12 of the 1950 Code of Virginia as amended.
BE IT FURTHER RESOLVED, that Sections 6, 7 8, 9 10 and 11 of new con-
struction on Route 600 and connection Route 604, a total distance of 0.48 miles as shown on the
attached sketch be added to the Secondarytem of Highway.
PLAT - NORTHWESTERN HILLS
Upon motion, duly seconded, the plat "Northwestern Hills" was approved
conditioned first upon the building of a street and approval of the same by the Highway Department,
before recording of the plat and obtaining a building permit.
BORROW MONEY
Upon motion of Grover Teets, and seconded by L. R. Omps, and unanimously
passed: IT IS RESOLVED: That Frederick County, through this Board, borrow a sum not to exceed
$10,000.00 with interest at the rate of 3% per annumfrom the Middletown State Bank to be used
to meet current expenses and borrowed on anticipated income of current revenue. Said sum does
not exceed 25% of anticipated income frOL, the General County Levy, and power and authority is
granted to C. M. Rosenberger, Chairman of the Board; and Lee N. Whitacre, its Clerk, to execute
a note of the Board evidencing the above obligation.
DELINQUENT TAXES ON LAND OF L. ADOLPH RICHARDS
Upon motion, duly seconded, the Treasurer of Frederick County is hereby
ordered to charge off all taxes for 1955 1956, 1957, and 1958 on four tracts of land assessed
in the name of L. adolnh Richards; recently tran by deed to the County of Frederick and

The County Treasurer, Harry L. McCann, presented to the Board the list of

BORROW MONEY - SCHOOL BOARD FOR A NEW SCHOOL TO BE BUILT
ON U. S. HIGHWAY NO. 50, APPROXIMATELY J MILE WEST OF
WINCHESTER, VIRGINIA, AND ADJACENT TO THE JAMES WOOD HIGH
SCHOOL LOT JN THE WEST
Upon the motion of Grover Teets, and seconded by C. E. Garber, the
f
ing request was granted: WHEREAS, The School Board for the County of Frederick. on the 8th day
of September, 1958, presented to this Board, an application addressed to the State Board of
Education of Virginia for the purpose of borrowing from the Literary Fund $350,000.00 for the
new school building at Winchester, Virginia, to be paid in 5 annual installments, and the intere
thereon at 3 per cent paid annually, provided there are sufficient funds in the Literary Fund at
the time the money is called for by the School Board.
If, in the discretion of the State Board of Education, it appears advisable
to provide money for this loan through assignment to the Virginia Retirement System, the rare of
interest on this loan will be not less than two nor more than four per cent per annum.
RESOLVED, That the application of the County School Board to the State
Board of Education of Virginia for a loan of $350,000.00 from the Literary Fund is hereby appro
and authority is hereby granted the said County Board to borrow the said amount fl r the purpose
set out in said application.
The Board of Supervisors for said County will each year during the life
of this loan, at the time they fix the regular levies, fix a,rate of levy for schools or make a

cash appropriation sufficient for operation expenses and to pay this loan in annual installments
and the interest thereon, as required by law regulating loans from the Literary Fund.

SCHOOL FUND - TRANSFER

On motion of Grover Teets and seconded by Byron Brumback, it is ordered

that the School Fund and the School Building Fund shall receive during the current year the
full amount of School Levy. This will be accomplished by paying from the General County,Fund
to the School Fund the amount of School Levy and placing this total tax income to the credit of
the General Fund; and the Treasurer is ordered to transfer these funds as the money becomes
available.
PLEASANT VALLEY SUBDIVISION
On motion duly made and seconded it was resolved that the Pleasant Valley,,
Subdivision Section 2 of Richard U. Goode and Eli,er W. Truslow be, and the same is hereby given
final approval, subject to the final approval of the said Subdivision by the City Council for the
City of Winchester, Virginia; and it is further resolved that upon acceptance of the same by the
City Council of Winchester, Virginia, that the Chairman of the Board of Supervisors place his
signature upon the Plat after the signatures of the Winchester - Frederick Health Department and
the Highway Department.
TENTATIVE BUDGET
Upon motion of Grover Teets and seconded by B. 0. Brumback - according to
an advertisement published in the Winchester Evening Star that on the 8th day of September, 1958,
a public hearing would be held on the Budget for the fiscal year beginning on the lst of July,
1958, and ending on the 30th day of June, 1959, inclusive; there being no tax payeisappearing
before the Board;the Board hereby confirms said Budget as advertised.

On motion of Grover Teets and seconded by-". E. Garber, the following
resolution was unanimously adopted:

j WHEREAS, pursuant to Section 58 -944 of the Code of Virginia, 1950, as
antended, all such securities have been approved by the Frederick County Board of Supersivors
which approval, may in the Board's discretion be by general authorization to the depository to
make certain substitutions from time to time;
NOVI, THEREFORE, BE IT RESOLVED, that said depository be, and it hereby
is', authorized to substitute from time to time, (1) for any securities on deposit, securities
that are obligations of or guaranteed by the United States, or (2) for securities on deposit that
are obligations of or guaranteed by the State of Virginia or Virginia counties, cities, towns,
districts, or other public bodies, securities that are either obligations of or guaranteed by the
United States or obligations of or guaranteed by the State of Virginia or Virginia counties,
cities, towns, districts or other public bodies, provided that each security substituted shall
comply with the requirements of Section 2 -297 of the Code of Virginia, 1950, and, at the time of
substitution, shall be of market value at least equal to the market value of the security for
which substituted; and
RESOLVED FURTHER, that State- Planters Bank of Commerce and Trusts be,
and it hereby is, authorized to permit substitutions from time to time in accordance with the
foregoing.
ADDITIONS - SECONDARY ROADS
Upon motion, duly seconded, the following resolution was passed:
BL IT RESOLVED, that the following streets located in the A. Melvin Lewis
Subdivision be added to the Secondary Highway Systen, of Frederick County.
Country Club Drive,.Section #1, extending from Senseny Road, Rt. 657
beginning at a point 0.5 Mi. east of E. C. L. and extending in a northernly direction,
a total distance of 0.19 mile.

A 50 foot unrestricted right of way is guaranteed. This right of way is
on record in the Clerks Office in the County of Frederick in Deed Book No. 245, Page 519.
These streets have been constructed by the subdivider in accordance waith
county ordinance and Highway Department policy for subdivision streets. These streets have been
graded 26 feet wide, exclusive of side ditches, have been surfaced with at least 5 inches of
curshed stone and surface treated 20 feet wide.
ADDITION - SECONDARY ROADS
Upon motion, duly.seconded, the following resolution was passed:
BE IT RESOLVED, that Smithfield Avenue be added to the Secondary Highway
System for maintenance. This street has been built by the property owners and complies with
State Specifications and Standards, and no construction expenditure is necessary.
Smithfield Avenue extends from NCL Winchester to the intersection with
Route 11, 0.3 Mi. N.. of N. C. L. Winchester, a distance of 0.57 Mi. It is a street in an old
subdivision established prior to 1949, serves 7 houses and 8 commercial establishments.
The right of way width is 40 feet and property owners have graded this
street 26 ft. wide and surfaced it with 6" crushed stone and surface treated 20 feet wide. This
right of way is on Record in the Clerk's Office of the County of Frederick in Deed Book 254,
Page 35.

Amendment to an ordinance of Frederick County, Virginia, adopted by the
Board of Supervisors of Frederick County, Virginia, on the 6th day of May, 1952, adopting the
requirements of Section 15 -779 through Section 15-794.3 of the Code of Virginia for 1950, as
amended, providing for certain local requirements for subdivisions and approving penalties for
violations thereof.
This amendment providing for certain exceptions to said ordinance and sub-
division areas designated and defined as seasonal, recreational land development areas, and ex-
cepting therefrom certain requirements of the aforesaid ordinance and statutes of Virginia, and
revoking a previous amendment.
NOW, THEREFORE BE IT ENACTED:
1. That in all subdivisions presented for final approval by the Board of

Supervisors of Frederick County, wherein streets are platted and dedicated to the public and lot
owners, there shall be no reruirement for the surfacing of said streets with asphalt or other
treated black- topping material, and no approval of said streets and roadways shall be required
by the Resident Engineer of the Virginia Department of Highways for Frederick County, provided
said subdivisions are designated primarily for seasonal recreational purposes such as, lakes for
boating, big game hunting, game shooting preserves and skiing; and the type of dwellings erected
are designated for said seasonal recreational purposes; and provided further that covenants in
the deed of dedication shall state that neither the proprietors and owners of said subdivisions
or the purchasers of the said lots will request the Board of supervisors of Frederick County,
Virginia, or the Virginia Department of Highways that said streets be taken into the highway
system until the said lot owners and proprietors have brought streets up to the specifica-
tions of the Virginia Department of Highways of Frederick County, Virginia.

WHEREAS, Branson P. Myers, the owner of certain real estate in
Area A. in Frederick County, Virginia, known as the Steak House Property, petitioned the Board
of Supervisors and Planning Commission for a variance in the zoning laws of said Zoned Area A,
to permit the placing of a grocery store in the property known as the Steak House; and,
WHEREAS, it was ascertained at said public hearing that Branson P.
Myers had a petition for said grocery store signed by a considerable number of persons residing
in said area, and that there were in person before said Planning Commission certain persons
opposed to the granting of a grocery store to be placed upon said property; and,
WHEREAS, it appearing to the Planning Commission that the school
authorities of Frederick County, Virginia, have abolished the sale of candy and other sweets in
Frederick County schools, and that the placing of a grocery store in the Steak House Property,
across the dual lane highway known as Route No. 50 West, would be an attractive nuisance to the
children attending James Wood High School, located in said Zoned Area A, and any other schools
placed in said area, which attractive nuisance would create a dangerous situation for said school
children.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Branson P.
Myers, for a variance of Zoned Area A to permit a grocery store to be established in said area,
be, and the same is hereby denied; and this matter is hereby reported to the Board of Supervisors)
of Frederick County, Virginia, as required by law.
The aforesaid resolution was duly adopted unanimously by the Plann

COUNTY GARBAGE DUM
Upon motion duly made and seconded it is ordered that a gate be erected at the
entrance to the County Dump. Said gate to be operated and controled by the caretaker.
COUNTY SURVEYOR - Section 15 -527
Upon motion duly made and seconded it is ordered that Lee A. Ebert be, and he
hereby is appointed County Surveyor for Frederick County for the term beginning January 1, 1959,
ending on the 30th day of December, 1963. Section 15 -527.
B. P. MYERS - VARIANCE
Robert K. Woltz appeared before the Board as attorney for B. P. Myers and

Upon motion duly seconded the following Resolution was ps'ssed.
R E S O L U T I O N
Be it Resolved, that the Plat of "Shaw- nee -Land Section F" of Marjec, Inc
located about ten (10) miles West of Winchester, Virginia, in Back Creek District, Frederick
County, Virginia, be, and the same is hereby approved as to the size of lots and location of
streets, and the deed of dedication attached thereto, and that the same be recorded within sixty
(60) days from the date hereof by the Clerk of the Circuit Court of Frederick County, Virginia,
upon presentation of the same by Marjec, Incorporated, and upon compliance with all the direc
of the ordinances of the County of Frederick.
SCHOOL BOARD BUDGET
The Frederick County School Board appeared before the Board and presented a
tentative Budget for the fiscal year beginning on the first day of July, 1959, and ending on the
thirtieth day of June, 1960. A general discussion was had. No action was taken.
COUNTY BUDGET
Upon motion duly seconded, it is ordered that a Special Meeting be held on the 0
day of February 1959, for the purpose of preparing the County Budget for the year beginning on
the 1st day of July, 1959 and ending on the 30th day of June 1960.
ROADS - ADDITIONS AND IMPROVEMENTS
The Regular Board Meeting on requests for Secondary Roads and Additions will be
held on Monday March 9th, 1959 at ten o'clock A. M.
,SCHOOL FUND - TRANSFER
Upon motion of C. E. Garber and seconded by Grover Teets it is ordered that the
School Board be, and hereby is granted permission to transfer from existing funds to a building
fund for the purpose of building a bus shop at the James Wood County High School.
Accounts totaling $4,934.87 were approved and ordered to be paid from the
General County Fund by warrants numbers 18885 to 18931 inclusive; and livestock, Fowl claims and
Earl Cather's salary totaling $293.32 were approved and ordered to be paid from the Dog Fund by
warrants numbers 1825 to 1831 inclusive.
