It appearing to the Board that Boyd Ramey's term as a member of the

on the 10th. day of April, 1958. The Clerk is ordered to notify Mr. Franks of his appointment.

It appearing to the Board that it is necessary to have road viewers

Robert Ritter appeared before the Board and requested that the Senseny

Upon motion, duly seconded, it is ordered that the Clerk notify Mr. E.B.
Lee to appear before the Board on the 14th day of May, 1956, in regard to the use of the Frederick
- County Garbage Dump by citizens of Clarke County.
JANITOR' - LADIES' REST ROOM
Upon motion, duly seconded, it is ordered that Mrs. Ruth Jennings,
janitress of the ladies' rest room, be paid ten dollars ($10.00) for services at the rest room
on Thursday and Friday nights during the Apple Blossom Festival; find also,pay $10:00 to William
Shanholt z_for Thursday and Friday nights for the'ca$e of the mens" room.

that if C. W. Webber presents a plat approved by the Resident Engineer and Health Department
of Frederick County, Virginia, of two lots on Jordon Springs Road; the Chairman of the Board

Upon motion, duly seconded; the following resolution was adopted:
BE IT RESOLVED, that certain streets in the Marvin Weaver sub - division be
{ added to the Secondary Highway System. These streets have been constructed by the sub - divider
in accordance with oridnance and Highway Department policy for sub - division streets. The streets,
are as follows: i
Baldwin Street beginning with its intersection with Rt. 644 1.1 Mi. S. of
the intersection of Rt. 652 and extending in a northernly direction to the intersection of Long-
view Avenue, a distance 0.15 mile.
Also Longview Avenue extending from Baldwin Street to Dead End, a distance
of 0.15 mile.
Also Broadview Street extending from Longview Avenue to its intersection
with Rt. 644, a distance of 0.17 mile.

ORDINANCE TO ABOLISH THE FINANCE BOARD j
The Ordinance to abolish the Finance Board, havinng passed its first,
second, and thirdrreadings; and notice of a public hearing thereon having been published in the
Winchester Evening Star; upon motion, duly seconded, said ordinance is approved -and adopted and
further, the Clerk is ordered to have a copy published one time in the Winchester Evening Star.
The following is a copy of said ordinances
WHEREAS the General Assembly of the Commonwealth of Virginia adopted
certain statutes establishing a County Finance Board for each County of the Commonwealth, and
found in the Acts of the General Assembly for 1932, at page 832; for 1933, page 64; for 1936,,
page 26; and for 1940, page 321; and
WHEREAS, the said Board has not functioned in Frederick County for
sometime and yet is an item of annual expense to the County; and
WHEREAS, by the Act of the General Assembly of 1954, Chapter 587; also
cumulative supplement 1954 58 -940, provision has been made permitting the governing body of
any county which has a County Finance Board to abolish the same and thereby cause all authority,
powers, and duties of said board to rest in the governing body of said county;-
NOW THEREFORE, be it ordained that from the effective date of this

ordinance as prescribed by law, the County Finance Board of Frederick County shall be, and the
same hereby is declared abolished and all appointments of members to said board shall be and are
now declared to be null and void; and that no compensation is now due the members of said Board,
nor is any to be paid henceforth.
And be it further ordained that all the authority, powers and duties of
the County Finance Board shall henceforth be and the same are hereby vested in the Board of
Supervisors of Frederick County, Virginia.
Upon motion, duly seconded, the following resolution was passed:
BE IT RESOLVED, that this Board hereby approves the 1956 -57 Tentative
Secondary Road Budget as submitted by C. H. Coffman, Resident Engineer.

RESOLVED: That the Board of Supervisors unanimously oppose the placing
of parking meters on the county parking lot, located on Boscawen Street.
ROADS - ADDITIONS
Upon motion of C. F. Garber, duly seconded by Grover Teets, the follow-1
ing resolution was passed:
BE IT RESOLVED, that the Highway Department is hereby'requested to add
the following sections of road to the Secondary Highway System of Frederick County.

1. That section of road extending from the present end of maintenance
on Rt. 613 to its intersection with Rt. 600, a distance of 0.50 mile.

2. That section of road known as "Featherbed Lane" extending from the
present end of maintenance on Rt. 763 to Rt. 50, a distance of 0.31 mile.
3.. That section of road extending from Rt.. 718 in an easternly direction
to the property line of Ashworth Brothers, a distance of 0.01 mile.
A thirty foot unrestricted right of way, plus any additional width needed
for cut and fill slopes is guaranteed.
Upon motion, duly seconded, the following resolution was passed:
BE IT RESOLVED, That the resolution adopted on May 14, 1956, requesting
the addition of certain streets in the Marvin Weaver Sub - division be hereby rescinded and the
following resolution in regard to these streets be adopted.
BE IT RESOLVED, that the following streets in the Marvin Weaver Sub-
division be added to the Secondary Highway System.
Baldwin Street beginning with its intersection with Rt. 644, 1.1 M1. S. of
the intersection of Rt. 652 and extending in a northernly direction to the intersection of Long-

BRIDGE - HOGUE CREEK ON RT, 614
Upon motion, duly seconded, the following resolution was adopted:
BE IT RESOLVED, THat this Bbard hereby recommends to the Highway Depart-
ment that the present narrow steel truss bridge over Hogue Creek on Rt. 614, be replaced with a
structure of adequate width and that this recommended replacement be accomplished with Secondary
Federal Aid Funds anticipated through the year 1958 -59.
It is the desire of this Board that the recommended improvement of Rt.732,
if approved by the Department of Highways, have precedence over the recommendation to replace
bridge on Rt. 614.
ROAD ADDITION - ROUTE 732
Upon motion, duly seconded, the following resolution was adopted:

the Secondary Federal Aid System in Frederick County.

A Number of citizens from Belleview Avenue appeared before the Board and made
the following request: We, the residents of Belleview Avenue, respectfully request that action
be taken in order to protect the interests of our community by passing an ordinance prohibiting
the erection of any building other than a residence, and said residence to cost not less than
$10,000.00.
PETITION- O'SULLIVAN AND AMERICAN BRAKE SHOE CO.
A petition, signed by a number of citizens in Shawnee District requesting that
legislative action be taken against O'Sullivan Rubber Company and the American Brake Shoe Company
to alleviate, minimize the emission or issuance of dire smoke, cinders, soot, fly ash, noxious
acids, fumes, etc. No action was taken .

Earl Cather, Game warden, appeared before the Board and requested that his
salary be set at $90.00.per month and mileage - 500 miles @ seven cents per mile or $35.00,

DELINQUENT TAX
The County Treasurer, Harry L. McCann, presented to the Board the list of
delinquent personal property tax for the year of 1955 as of June 30, 1956, in the amount of
$5189.75; and also, the delinquent real estate tax for the year of 1955, as of June 30, 1956;
in the amount of $4153.22, the total being $9342.97; which, upon motion of Grover Teets and
seconded by C. E. Garber, was unanimously approved as presented.
ABANDONMENTS AND ADDITIONS TO SECONDARYHIGHWAYS
Upon motion of L.. R. Omps, and seconded by Grover Teets, the following reso-
lution was adopted;
BE IT RESOLVED, that the following numbered sections of the old locations
shown on sketch of Project 1334 -06, Route 600 and 692 be abandoned from the Secondary System of
Highways in accordance with Section 33 -76.12 of the Code of Virginia.

SUBDIVISION STREETS - TOWNS OF LESS THAN 1500 PERSONS
Upon motion of B. 0. Brumback and seconded by C. E. Garber, the following resolution was passed:
It was tlie• unanimous opinion of the Board that subdivision streets within the
towns should be treated the same as rural subdivision streets. This Board strongly recommends
to the several Town Councils the adoption of a subdivision ordinance similar to the county
ordinance, copy of which is attached.
The practice of many real estate developers of laying out a subdivision but
providing no adequate improvement for the streets has for many years posed a vexing problem. It
is a problem of growing seriousness. The Board makes the recommendation above in an effort to
J bring this situation under control within the towns in the County.
The definition of a subdivision as set forth in Chapter 88 Section 1, Acts
of the General Assembly, 1934 defines a subdivision as "The division of a lot, tract, or parcel
of land into two or more lots, plats, sites or other division of land for the purpose, whether
immediate or future, of sale or of building development ". .
In view of the facts set forth above, this Board resolved unanimously not to
recommend to the Highway Department the expenditure of any County Secondary Road Funds for the
imrpovement of subdivision streets within the several incorporated towns, under 3500 population,
within the county. This, of course, applies only to those towns who have part of their street

system in the Secondary Highway System. Such streets are maintained and improved by the Virginial
Department of Highways with funds from.the County Secondary Road Allocation.
, LAND - ROBINSON MEMORIAL.SCHOOL
R. E. Aylor, Superintendent of the Public Schools of Frederick
'County, Virginia, appeared before the Board and requested that the School Board of Frederick County
be permitted to purchase from Ed Molden three lots adjoining the Robinson Memorial School lot at
'a purchase price of $4000.00; and on motion, duly seconded, the request was unanimously approved.
OFFICE FIXTURES FOR SHERIFF
Robert L. DeHaveny Sheriff of Frederick County, Virginia, appeared
before the Board and requested that he be permitted to purchase for his office the following itemsz
'three five - drawer metal filing cabinets at $105.00 each, total $315.00; and one two- drawer file
at $22.00. Upon motion, duly seconded, the above request was granted.
! ORDINANCE - LAND SUBDIVISION - ADDED AMENDMENTS
The Land Subdivision Ordinance added amendments, which passed its
first and second reading at the July, 1956, meeting and which was ordered to be published one

time in two successive weeks; the public hearing was set for September 10th, 1956. Having been
incorrectly advertised, it did not pass its third and final reading and was not adopted.
BILLS PAYABLE
Accounts totaling $4662.51 were approved and ordered to be paid
from the General County Fund by warrants numbers 17059 to 17102 inclusive; livestock, fowl claims
and Earl Cather's salary and mileage totaling $299.41 were approved and ordered to be paid from
the Dog Fund by warrants numbers 1620 to 1625 inclusive. t

Upon motion of Grover Teets, seconded by B. 0. Brumback- according
to an advertisement published in the Winchester Evening Star that on the 13th day of August, 1956,
a public hearing would be held on the Budget for the fiscal year beginning on the 1st day of July,
1956, and ending on the 30th day of June, 1957, inclusive; there being no taxpayer appearing
before the Board the Board hereby confirms said Budget advertised.
