ZONING - AREA " A " - AMENDMENT An ordinance to amend Zoned Area "A to increase the size and ,costs of residences to be constructed and erected thereon, shall be 900 square feet on the main floor and shall cost not less than $10.000.00; passed its first and second reading and it is ordered that the public hearing be held at 2:00 P.M. in the Supervisors' Room in the Frederick r County Office Building on the 31st. day of December, 1955, for its third and final consideration and adoption. ROADS - ABANDONED AND ADDED MILEAGE Upon motion of Grover Teets and seconded by C. E. The following is a report of the Zoning and Planning Commission: December 10, 1955 The Zoning and Planning Commission of Frederick County met December 10, 1955 at 1:00 P.M., with Earl Shade, Chairman, Grover Teets and James W. Golladay for the purpose of hearing a petition of property owners in zoned Area "A", requesting that value of new dwellings be increased to a minimum of $10,000.00. Upon motion of Earl Shade, Seconded by Jas:. W. Golladay, that request be granted, and upon vote we unanimously voted that Board of Supervisors grant this petition. E. EARL SHADE JAS. W. GOLLADAY GROVER TEETS Accounts totaling $5364.15 were approved and ordered to be paid from the General County Fund by warrants numbers 16443 to 16485 inclusive; livestock, fowl claims and 1 Cather's salary totaling $510.56 were approved and ordered to be paid from the Dog Fund by is numbers 1549 to 1557 inclusive. ORDINANCE - ZONING AREA A - AMENDMENT The ordinance Zoning Area A Amendment which had passed its first and second reading and advertised for its third and final reading, on this day was deferred until January 27, 1956,. at 2 :00 P.M. for further consideration. JANITOR - APPLICANTS Upon motion, duly seconded, the Clerk is ordered to advertise in the Winchester Evening Star one time each week for three successive weeks for applicants for for a janitor to fill the vacancy caused by the resignation of Lorenzo J. BOARD MEETING DATE Upon motion, duly seconded, it was unanimously decided and ordered that the Regular Meeting of the Board be held on the second Monday in each month. }UPERVISION OF BUILDINGS AND GROUNDS The members of the entire Board were appointed by the Chairman as a committee to supervise the public buildings and grounds. AUTHORIZING AGENT FOR THE STATE AND LOCAL HOSPITALIZATION OF MEDICAL INDIGENT PATIENTS Upon motion of Grover Teets and seconded by L. 0. Omps, C. E. Garber was designated as authorization agent for hospital indigent patients. COMPENSATION OF THE CLERK OF THE BOARD Upon motion, duly seconded, it is ordered that the Clerk shall per year receive One Hundred and Fifteen Dollars ($115.00)/ as Clerk of the Board; and that said salary be paid quarterly. i 125 COMPENSATION OF THE CLERK OF THE CIRCUIT'COURT Upon motion, duly seconded, it is ordered that the salary of the Clerk of the Circuit Court shall be Seven Hundred Dollars ($700.00) per year and that said salary be paid quarterly, c.; JANITORS SALARY It is ordered that the salary of the janitor for the County Office Building and the Court House be fixed at One Hundred and Fifty Dollars ($150.00) per calendar month. JANITORS SALARY COLORED REST ROOMS Upon motion, it is ordered that the salary of the janitor of the colored rest room be fixed at Twenty Eight Dollars ($28.00) per calendar months. JANITOR SALARY - LADIES REST ROOM Upon motion, duly seconded, it is ordered that the salary of the ladies 0 rest room be fixed at Forty Dollars ($40.00) per calendar month. GAME WARDEN - SALARY Upon motion, duly seconded, it is ordered that the salary of the Game Warden be fixed at One Hundred and Twenty -five Dollars ($125.00) per calendar mont). COMPENSATION OF THE BOARD OF1SUPERVISORS a Beginning on the 1st. day of January, 1956; by agreement of the members of this Board, each member \ shall receive $19.25 plus mileage for their attendance at regular meeting, based on twelve meetings per year; except the Chairman, who shall receive $3.50 addi- tional plus mileage for signing the warrants. SALARIES AND EXPENSE ACCOUNTS APPROVED TREASURER, COIMISSIONER OF THE REVENUE, SHERIFF, COMMONWEALTH'S ATTORNEY, AND THEIR DEPUTIES I Upon motion of Grover Teetsj and seconded by L. R. Omps, the salary and. expense account for the year beginning on the first day of January, 1956, of the Treasurer; salary $5100.00, Deputies, office assistants $4520.00 and other expenses $582.50, total $10,202.50. The salary and expense account of the Commissioner of the Revenue; salary, $4200.00 deputy, typist and extra help, $6020.00, other expenses $555.50, total $10,775.50. The salary of the Commonwelath' Attorney; salary, $3480.00, secretary, $1020.00, total $4500.00. And the salary of the Sheriff $4020.00; Deputies, matron, clerk and jail cook, $9480.00; and other expenses $165.00, total $13,665.00, were approved as fixed by the Compensation Board. ORD INANCE - DEER Upon motion, duly seconded, the following oridnance passed its third and — final reading and was enacted: WHEREAS N umerous persons have been illegally hunting deer at night in Frederick County by the use of artificial light and such acts have resulted in losses of poultry by the property owners of Frederick County. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Frederick County, Virginia, approve and adopt the following ordinance: It shall be unlawful for any person or groups of persons to throw or cast the rays of a flash light, spot light, head lights, or other artificial lights in any manner so as to shine directly upon or illuminate any field, forest, woodland, poultry range, or building. 126 The foregoing provision shall not apply to the headlights of any motor vehicle being operated on a public roadway, street, or alley in the usual and ordinary manner of travel; nor shall it apply to land owners, their invitees, agents, employees,. or persons under their control. Any person who violates any provision of this ordinance shall be punished by a fine of not less than $10.00 nor more than$300.00 or by imprisonment for not.less than 30 days in jail or by both such fine and imprisonment. This ordinance shall be enforced by the Sheriff and all other police officers and game wardens of Frederick County and the Trial Justice Court of Frederick County shall have original jurisdiction. On motid of Grover Teets, seconded by C. E. Garber, the above ordi- nance was duly possed upon third and final readings of the Board of Supervisors of Frederick County, Virginia, at its regular meeting January 9, 1956, after proper notice of its intention to consider and adopt the same at a public hearing this day. ROADS - REQUESTS FOR ADDITION. AND IMPROVEMENTS TO THE SECONDARY ROADS Upon motion, duly seconded, the Clerk is ordered to have published in 1 the Winchest r Evening Star the following notice: In accordance with the law, the Frederick County Board IoT Supervisors will hold their Regular Meeting for requests for secondary road improvements and additions on Monday, March 12, 1956. BUDGET - WELFARE The Superintendent of Public Welfare appeared before the Board and i presented its 1956 and 1957 tentative budget which was approved with the exception of the local appropriation, which was approved in the amount of $25000.00. BILLS PAYABLE Accounts totaling $4025.21 were approved and ordered to be paid from the General County Levy by warrants numbers 16487 to 16528 inclusive; and livestock, fowl claims. and Earl Cather's salary totaling $774.97 were approved and ordered to be paid from the Dog Fund by warrants numbers 1558 to 1571 inclusive. Garber and seconded by Grover Teets, the Board approved the contract with the Winchester Memorial Hospital, Winchester, Virginia, at the rate of $15.42 per day for hospitalization and treatment of medically indigent patients for the year beginning on the first day of July, 1955, to July i 1956; and the Chairman is ordered to endorse the same. 127 i S ALARIES OF BOARD 3 Upon motion, duly seconded, it is unanimously resolved to request Senator H. F. Byrd, Jr., and Delegate E. Blackburn Moore, to introduce a bill in the General Assembly to increase the salaries of the members of the Board of Supervisors to $500.00 each per annum, payable monthly and $60.00 per annum extra for the Chairman of the Board. AMENDMENT TO ZONED AREA "A" As advertised a Public Hearing on the Amendment to Zoned Area "A" was held. A number of taxpayers appeared before the Board and expressed their - views for and against the said amendment. The following persons requested that the amendment be adopted as advertised: John Pickeral, J. P. Arthur, Paul Beable, Mrs. Ethel Johnson, Charles E. Bass, Robert E. Aylor, Kenneth Robinson, Dr. Miller', C. W. Franks, Mrs. Richard Lewis and Mrs. Sam Hurst and requests against the adoption were made by J. Edward Thoma and William Sullivan. The following ordinance passed its third and final reading and the Clerk is ordered to have published the same in the Winchester Evening Star one time in two consecutive weeks• AMENDMENT TO ZONED AREA " A " i SECTION 8 of that zoning ordinance adopted by the Board of Supervisors of - Frederick County, Virginia and which became effective on July 8, 1950. (1) Section 8,of the zoning ordinance for the Zoned Area "A" adopted by the Board of Supervisors of .Frederick County, Virginia on the 30 day of June, 1950 and becoming effective on July 8, 1950 is hereby repealed. (2) The ordinance for the zoning of Area " A " in Frederick County, Virginia for Section 8 thereof shall read as follows: "The size of the residences to be constructed and erected in,Zoned Area " A " shall be 900 sq. feet in foundation area excluding porches and garages and shall cost not less then Ten Thousand Dollars, ($10,000.00) for labor and materials." Upon motion duly made by Grover Teets and seconded by C. E. Garber, this ordi- nance was duly approved and adopted by the Board of Supervisors of Frederick County, Virginia, this 21st. day of January, 1956, at a meeting specially called for that purpose and after a public hearing for same.
