HIGHWAY DEPT. - UNCOVERED DRAIN
A delegation with Paul Beables, Chairman; appeared before the Board and
protested that the Highway Department would not construct an uncovered drain to carry the water
across the land of Mrs. Ethel Pickeral Hoovey Johnson; said land being located on the north side
of Route #50, a short distance west of corporation line of the City of Winchester.
MILTON J�, AND WINIFRED O'REAR - RIGHT OF WAY DEED
Upon motion, duly seconded, it is ordered that the right, of way deed from
Milton J. O'Rear and Winifred O'Rear be and hereby is accepted as executed by said parties; and
the Clerk is ordered to notify Milton J. O'Rear and Winifred O'Rear of said acceptance.
BORROW MONEY - FREDERICK COUNTY SCHOOL BOARD
The following is a copy of a resolution, which was adopted by the Frederick
County School Board:

unanimously passed: IT IS RESOLVED, That Frederick County through this Board borrow the sum of

Ten Thousand Dollars ($10.000.00) with interest at the rate of two and one -half percent (2 * %)
per annum from the Middletown State Bank to be used to meet current expenses and borrowed in
anticipation of current revenue to be repaid in thirty five days from date. Said sum does not
exceed 25% of anticipated income from the .General County Levy; and power and authority is granted
to C. M. Rosenberger as Chairman of the Board and Lee N. Whitacre, its Clerk to execute a note of
the Board evidencing the above obligation.
PLANNING BOARD - P. E. LINE-BERG
WHEREAS, P. E. Lineberg has offered his resignation as a member of the
Frederick County Planning Board, it is ordered that.said resignation, be , and hereby is accepted.,

DELINQUENT TAX I
The County Treasurer, Harry L. McCann, presented to the Board the list of
of 1953,
delinquent personal property tax for the year /as of June 30, 1954, in the amount of $4284.04; and
also the delinquent real estate tax for the year of 1953 as of June 30, 1954, in the amount of j
$8298.72 the total being $12,582.76; which upon motion, duly seconded, was unanimously approved
as presented.
SCHOOL FUND
Upon motion of Paul Luttrell, and seconded by C. E. Garber, it is ordered
that the School Fund and the School Building Fund shall receive during the current year the full
amount of the School Levy. This will be accomplished by paying from the General County Fund to
the School Fund the amount of School Levy and placing the total tax income to the credit of the
General Fund; and the County Treasurer is ordered to transfer these funds as the money becomes
available.

BORROW MONEY - FREDERICK COUNTY SCHOOL BOARD
The following is a cony of a Resolution, which was adopted by the Frederick County
School Board: The Frederick County School Board is now building an
addition to the Stonewall School and an addition to the Gainesboro
School and is acting as its own contractor. These projects are to
be financed in full from State funds known as the State School
Construction Fund. However, since the Board is serving as its own
contractor and since State money will become available after the
completion of these projects, the School Board hereby requests
the Frederick County Board of Supervisors to grant it permission
to borrow an additional amount up to $25,000.00 on a 60 -day note
on or around October 1, 1954, in order to complete the financing
of said construction projects until State money is received. A
request to borrow an initial $25,000.00 was approved at the
August meeting of the Frederick County Board of Supervisors.
Upon motion of Grover Teets and seconded by B. 0. Brumback; it is ordered
that the above request be, and hereby is granted.
P INE SUB- DIVISION
Upon motion, duly seconded, the following resolution was unani-
mously passes:
BE IT RESOLVED, that certain streets in the Pine Sub- divison be I
taken over for maintenance. They have previously been brought up to the standards of the Highway
Department. These streets are as follows;

The section of Wilson Boulevard beginning on Route 622 - 0.3 mile
east of Int. Route 11 and extending in a southerly direction to the intersection of Taft Avenue,
a distance of 0.18 mile.
Also, the section of Roosevelt Boulevard from the Intersection of
Route 622, which is 0.16 mile west of the Intersection of Route 644, and extending in a southerly
direction to Taft Avenue, a distance of 0.19 mile.
ALSO, the section of Taft Avenue from Intersection of Route 644 to
the west side of Wilson Boulevard, a distance of 0.15 mile.
The above streets carry a 50 foot right.
These streets are shown in red on the attached map.

The purpose of the meeting was to open and examine the bids for painting the

exterior of the Frederick County Court House as advertised. Upon motion, duly seconded, it was
unanimously decided to accept the offer of Clarence Swisher of Winchester, Virginia; the con-
sideration being in the sum of Fourteen Hundred and Ninety -five ($1495.00) Dollars as per the
agreement as executed by Clarence Swisher and the Board of Supervisors.

SECONDARY ROADS - IMPROVEAIENT
Upon motion, duly seconded, the following resolution was passed:
WHEREAS, the Commonwealth of Virginia, through the Department of High-
ways has prepared and submitted plans to the Board for the construction or improvement of a
section of Route 600 of the State Secondary System, Project 1334 -07 in Frederick County, from
I
Shenandoah County Line to 0.06 Miles N. Int. Rt. 602 (S. of Route 55), approved September
1954; and
WHEREAS, it is the desire of this Board that said road be improved in
accordance with said plans.

NOW, THEREFORE, BE IT RESOLVED: That this Board hereby approved the
plans and requests the Department of Highways to proceed with construction in accordance with
these plans, and this Board hereby agrees to and does guarantee a 40 -foot unrestricted right
of way as indicated or noted on said plans, together with the right and easement to use the
additional areas shown as being required for the proper execution and maintenance of the work i
as indicated on plans, it being understood that incidental costs such as moving and resetting the '
existing fences, houses, structures, utilities, or other obstructions of such nature, are to be
i
paid from Secondary Funds allocated or to be allocated to Frederick County.
It is further understood and agreed that in the event one or more pro-
perty owners refuse to.execute a deed covering land required from their properties for right of
way purposes, this Board hereby authorizes the Commonwealth of Virginia, Department of Highways,)

to institute condemnation proceedings and agrees to pay from funds allocated or to be allocated
to Frederick County all costs in connection therewith including awards of commissioners.

motion, seconded, the Sheriff is granted permission to purchase said equipment provided
however, that the City of Winchester pay 50% of the purchase price.

ROADS - SINGHASS

that the Board of Supervisors notify Howard Grove, Superintendent of County Roads for the State
Department of Highways to remove the fence of Grover'Carper from the right -of -way of the Singhass
Road, and proceed with the project of grading, draining, and repairing the surface of said road.
EQUALIZATION BOARD
Upon motion, duly seconded, this Board unanimously directs that the
Judge of the Circuit Court of Frederick County, Virginia, appoint an equalization board to
review the reassessment land book of Frederick County; which were made by the land assessors
during the year of 1954 and equalize all assessments which they deem necessary.

expense account of the Commissioner of the Revenue, Salary $4000.00, Deputy, typist and extra

I BUDGET - WELFARE
The Superintendent and Board of Public Welfare appeared before the Board and
presented their tentative budget for the fiscal year of'19 %,, and 1955.
HEALTH UNIT
Dr. A. L. Lindall of the Winchester and Frederick County Health Unit appeared
before the Board and requested the Board increase their allocation of $3850.00 for the year of
1955 and 1956 to $4200.00 for the fiscal year of 1954 and 19.55 to $4200.00 for the fiscal year
of 1955 and 1956.
SCHOOLS
Upon motion of B. 0. Brumback and seconded by Paul Luttrell, the following
resolution was oassed: WHISREAS, The School Board for the County of Frederick, or City cf
, on the 10th day of January, 1955, presented to this Board or Council, an
application addressed to the State Board of Education of Virginia for the purpose of securing
State School Construction Funds in the amount of $4,908.97 for the new school building ( or for
adding to or improving the present school building ) at Gainesboro, Virginia.
RESOLVED, that the application of the County School Board to the State Board
of Education of Virginia for $4,908.97 from the School Const ruction Fund is hereby approved.
The Board of Supervisors for said County or Council of said City, has, or will
provide sufficient funds through cash appropriations and /or levy, to complete this project. If

Upon motion, duly seconded, the following resolution was passed,
RESOLVED: That this Board hereby approved the plans and requests the Depart-
went of Highways to proceed with construction in accordance with these plans, and this Board
hereby agrees to and does guarantee a 40 foot unrestricted right of way as indicated or noted
on said plans, together with the right and easement to use the additional areas shown as being
required for the proper execution and maintenance of the work as indicated on plans, it being
understood that incidental costs such.as moving and resetting existing fences, houses, structures,
utilities, or other obstructions of such nature, are to be paid from Secondary Funds allocated
or to be allocated to Frederick County.
It is further understood and agreed that in the event one or more property
owners refuse to execute a deed coyeringland required from their properties for right of way

purposes, this Board hereby authorizes the Commonwealth of Virginia, Department of Highways, to
institute condemnation proceedings and agrees to pay from funds allocated or to be allocated to

ROADS ABANDONED

BE IT RESOLVED: That notice having been posted and a hearing held
that the section of Route 626 extending from 0.35 mile south of the intersection of Route 738
to the present end of State maintenance, a distance of 0.35 mile be abandoned from the Secondary
System in accordance with Paragraph 33 -76.8 of the Code of Virginia.
ROAD - ADDITION
Upon motion, duly seconded, the following resolution was passed:
BE IT RESOLVED: That the Highway Department is hereby requested
to add the following sections of road to the Secondary Highway System:
1. That section of road beginning at a point on Rt. 639, approxi-

Upon motion, this Board takes pleasure in commending B. D. Fleenor,
Resident Road Engineer, who has requested disability insurance, for his cooperation and good
management of the Frederick County Roads during his administration.
SHENANDOAH COLLEGE AND CONSERVATORY OF MUSIC
Upon motion, the Clerk is ordered to mail a letter of''request
to the Shenandoah College and Conservatory of Music, Dayton, Virginia, in consideration of the
request of the Winchester - Frederick County Chamber of Commerce for the Board of Supervisors
to endorse and aid the Chamber in their endeavor to secure the location of the Shenandoah College
and Conservatory of Music within Frederick County.
The Board of Supervisors believes this move -would be of immeasurable
benefit to the College and to the people of Frederick County and endorses the activities of the
Chamber of Commerce in this regard. The Board requests that you and your trustees give earnest
consideration to locating in Frederick County and assures you of its full cooperation.
