NUISANCE ORDINANCE - AMENDED
The amended Nuisance Ordinance which passed its first and second
reading at the May Meeting, and was advertised for a public hearing on June 14, 1954; no tax payer
having appeared to protest the adoption of said ordinance upon its third and final reading; upon
motion, duly seconded, was unanimously adopted. The Clerk is ordered to have said ordinance
published in the Winchester Evening Star.
SCHOOLS - ADDITIONS
Upon motion of Grover Teets and seconded by Paul Luttrell the follow-
ing resolution was passed: RESOLVED: That the School Board be granted authority to make the
proposed additions to the Stonewall School and Gainesboro School, and use funds from the School
Board Budget until it is necessary to borrow additional funds from a bank or banks for completion
of said additions. Said funds to be replaced with Battle Fund money upon completion of these I
projects.
RELIEF
Upon motion of Paul Luttrell and seconded by B. 0. Brumback, it is
ordered that a warrant in the amount of Fifty Dollars be drawn in favor of Mrs. Myrtle Holliday
for temporary relief of herself and children.

Upon motion, duly seconded, the following resolution was passed:
RESOLVED: - That this Board hereby approved the 1954 and 1955 tentative road budget as submitted
by B. D. Fleenor, Resident Engineer.
ROAD VIEWERS REPORT
The report of the Road Viewers on the 14th. day of May, 1954
establishing a new location beginning at a point on Route 739 approximately .18 miles south of
the intersection of Route 522 and extending in a southernly direction to a point - on - Route No. 50
near the James Wood School a distance approximately 1.2 miles; upotL motion, duly seconded, was
approved by the Board.
DUMP - GARBAGE
Mr. E. B. Lee, a member of the Clarke County Board of Supervisors
appeared before the Board and requested that the citizens of Clarke County be permitted to use i
the Public Dump, located on the 'Sulphur Spring Road in Shawnee District; and upon motion, duly
seconded, leave "is hereby granted without charge until the first day of January, 1955.
After January 1 1955, a nominal rent will be charged per year; the
amount to be agreed upon at a later date by the said Board.

Upon motion of Grover Teets and seconded by C. E. Garber,
the following resolution
was passed: RESOLVED: That the Board of Supervisors of Frederick County, Virginia, offer to
Milton J. O'Rear and Winifred O'Rear the sum of $200.00 for a right of way over, along and through
their land adjoining Walker McC.. � nd, Fabnestock, and others for the purpose of constructing and
maintaining a public highway of the Department of Highways of the Commonwealth of Virginia; said
right of way to be 50 feet wide between station 219 and station 34x95 for a distance of approxl-
mately one thousand three hundred and twenty -six feet, as shown on a plat of the Department of
Highways of the Commonwealth of Virginia, showing the proposed extension of Virginia State Route
#739.
PURCHASE OF LAND - WALKER McC. BOND AND WIFE
Upon motion, duly seconded, It is ordered that a warrant be drawn payble to
Walker McC. Bond in the amount of $575.00 in payment for right of way through his land as pro-
posed in survey for Route 739; said warrant to be delivered to the said Walker McC. Bond upon the,.
execution of a Deed signed by the said Walker McC. Bond and Carrie L. Bond, his wife.
BUDGET - TENTATIVE
Upon motion, duly seconded, the tentative budget as prepared for the year beginning
on the first day of July, 1954, was unanimously approved-and the Clerk of this Board is ordered
and authorized to have the same published in the Winchester Evening Star as required by law; and
a public hearing thereof bhall-be held on the 2 7 day of July, 19540
WELFARE BUDGE
Upon motion, duly seconded, the Welfare Budget for the fiscal year beginning on
the 1st. day of July, 1954 and ending on the 30th day of June, 1955, was approved in the amount
of $97471.00 3of which amount this Board has allocated $16000.00.
ORDINANCE - PROHIBITING CARNIVALS
An ordinance prohibiting carnivals except those approved and sponsored by the fire
companies and other charitable institutions located in Frederick County, Virginia, passed its
first and second readings; and will be considered on the third and final readinkyby the Board
of Supervisors of Frederick County at the Regular Meeting which is to be held on the 12th. day
of July, 1954.
ROADS
Upon motion, duly seconded, the following resolution was passed: BE IT RESOLVED,
that a new location beginning at a point on Route 739 - 0.18 Mi. south of the Int. of Route 522
and extending in a southerly direction to a point on Route 50, just west of the James Wood School,
a distance of 1.2 Mi., which carries a 50 foot unrestricted right of way, be added to the
secondary system.
CONTRACTS - HOSPITALS
The Winchester Memorial Hospital's contract with the Board of Supervisors for the

day; and the Medical College of Virginia for the term beginning on the first day of July, 1954,

TAX ON BANKS LOCATED•IN FREDERICK COUNTY
Upon motion of Paul Luttrell, and seconded by C. E. Garber,the fol-
lowing resolution was passed: RESOLVED THAT In conformity with Section 58 -478 1. The Treasures
of Frederick County is hereby directed to apply to the State Tax Commissioner for 80% of the
amount of taxes paid by the Western Frederick Bank on it's shares of stock.
CARNIVALS - ORDINANCE
AN ORDINANCE PROHIBITING CARNIVALS _
Upon motion, duly seconded, the - following oridnance did not pass
its third and final reading and was continued until the August, 1954 Meeting,.
ROADS
Upon motion duly seconded, the following resolutions were passe,
BE IT RESOLVED, that Section #1 of Rt. 600, Project 1334 -05, of they
old road between Station 23720 and Station 24160 a distance of 0.088 mile be discontinued, j !
but is to be kept open to provide egress ingress for the land owners.
BE IT FURTHER RESOLVED, that Section 11 2 of the old road between station 29300
and Station 296 70 a distance of 0.074 mile be discontinued, but is to be kept open to;pkovide
egress and ingress for the property owners. Notice has been posted and a public hearing held in
accordance with the Code of Virginia.
BE IT ALSO RESOLVED, that Section #3 of new location between Station 23720 and
Station 241/60 laying on the West side of the old road, a distance of 0.083 mile be added to the ~
Secondary System.
BE IT FURTHER RESOLVED, that Section #4 of new location between Station 29300
and Station 29670 a distance of 0.07 mile, be added to the Secondary System
ZONE AREA 13 - ENLARGING
Upon motion, duly seconded, the following resolution was passed:
RESOLVED that the proposal for enlarging Zone Area B. which covers the Hunter M.
Stine lots Numbers 1 through 31, be referredto the Planning Commission for a report to the Board
of Supervisors within 30 days from this date.

R. E. Aylor, Superintendent of Schools, appeared before the Board in behalf of
new school bus from additional funds received from the State Minimum Education Fund beyond those
anticipate diin the Budget for the 1953 -54 School Year.
RIGHT OF WAY - MILTON J O'REAR AND WINIFRED O'REAR
Milton J. O'Rear and 19inifred O'Rear, having accepted the Board's offer of Two
Hundred Dollars a right of way over their land for the proposed road leading from Route 522
to James Wood School as surveyed; it is ordered that a warrant be drawn for said amount and that
the same be delivered to them upon the execution by them of a good and sufficient deed for said
right of way.
NUISANCE ORDINANCE - AMENDED
The following is a copy of the Nuisance Ordinance amended which passed its third
and final reading and wa(s adopted at the Regular Meeting of the Board of Supervisors, held on
the 14th. day of June, 1954:
SECTIONS OF THE NUISANCE ORDINANCE MW3XK= OF FREDERICK COUNTY AS
AMENDED AND ADDITIONS MADE BY THE BOARD OF SUPERVISORS OF FREDERICK
COUNTY ON JUNE 14th 1954.
ARTICLE II
Section 1.
It shall be unlawful for any person to permit, deposit, store or hold any noxious
or offensive matter, either to health or to comfort, on any premises or place or in any building
or structure unless such matter is so treated, screened, covered or.placed as not to create a
nuisance. All containers for the storage of such matter shall completely confine the matter, shall
be rodent and.insect proof, and shall be kept in an inoffensive and sanitary condition.
ARTICLE III
Section 1.
It shall be unlawful to operate any slaughterhouse, abattoir, rendering plant or
establishment where animals or fowls dead or alive are processed, or where food or feed is
manufactured or processed unless such place or establishment is maintained and operated in a
clean.and sanitary manner at all times.

ARTICLE VIII
Section 1.
Any person who shall cause or maintain a public nuisance not otherwise pro-
vided for in the ordinances of the county shall be punished as provided herein.
ARTICLE LX
Section 1.
Upon complaint of any person, filed in writing with the Trial Justice of
Frederick County, that any nuisance or health hazard as set forth in this ordinance
or any public nuisance not otherwise provided for in the oridnances of the county,
is in existence or is being committed by any person, firm or corporation, it shall
be lawful for the Trial Justice of Frederick County to issue, in the name of the
county, a summons wherein the nature of the nuisance or health hazard shall be
specifically stated, requiring the owner or the occupant of the premises to appear
within twenty -four hours before him to answer such complaint and show cause why the
thing complained of should not be abated. Said summons may be served by the Sheriff
or any police officer having jurisdiction in the County of Frederick, and if
upon a full hearing the Trial Justice shall judge the thing complained of, be a
nuisance or a health hazard, or both, he shall give judgment forthwith, requiring
the owner or accupant of said premises to remove such cause of nuisance or health
hazard within twenty -four hours thereafter, (unless some other time not exceeding
ten days shall in such order be prescribed), and to pay all cost of such examination!
and If the owner or occupant of the premises shall neglect or refuse to
abate any such nuisance in the time so specified, he shall be punished as otherwise
provided in this ordinance.
ARTICLE IX
Section 2.
Like summons may be issued and proceedings be had upon the complaint of the
Sheriff or Health Officer, each of whom in addition to his other duties is hereby
specifically charged with the enforcement of the provisions of this ordinance.
ARTICLE X
Section 1.
If the owner or occupant of any premises who shall have been found guilty by,
the Trial Justice Court or other competent gourt of jurisdiction, neglect to remove
or abate any nuisance or health hazard within five days after the same shall have
been adjudged a nuisance or health hazard, the Board of Supervisors shall proceed,
by resolution, or ordinance, to abate such nuisance summarily, and at the expense of
the owner or occupant of the premises upon which such nuisance or health hazard is
maintained, or it may apply such other remedy as to it may appear proper. Th4xpens
of any such abatement may be collected from such owner or occupant by warrant or
other proper proceeding issued in the name of the county.
ARTICLE XI
Section 1.
Anyone found guilty of the violation of any of the sections of this ordinanc
shall be punished by a fine of not less than $5.00 nor more than $50.00, and failure
to abide by the order of said court to abate said nuisance or health hazard shall be
deemed a separate offence for each day thereafter that the nuisance or health hazard
is permitted to exist.
