HomeMy WebLinkAbout003-98 At a regular meeting of the Board of Supervisors of Frederick County, Virginia, held on the 8th day of July, 1998, at the time and place established by the Board for such meetings, at which the following members were present and absent: PRESENT: James L. Longerbeam. Chairman; Richard C. Shickle. Vice-Chairman; w. Harrington Smith. Jr.; Robert M. Sager; Margaret B. Douglas; and Charles W. Orndoff. Sr. ABSENT No one. the following resolution was adopted by the affirmative roll-call vote of a majority of all members of the Board, the ayes and nays being recorded in the minutes of the meeting as shown below: MEMBER VOTE James L. Sr. Aye RESOLUTION EXTENDING THE TERM OF THE FREDERICK COUNTY SANITATION AUTHORITY WHEREAS, the Board of Supervisors (the "Board") of Frederick County, Virginia (the "County"), adopted a resolution on April 17 , 1967, creating the Frederick County Sanitation Authority (The "Authority"); and WHEREAS, on April 25, 1977, the Board adopted a resolution extending the term of the Authority for 50 years from the date of such adoption; and WHEREAS, the Authority desires to acquire, construct and equip improvements to its water system, including the acquisition, construction and equipping of water transmission lines and a water storage tank; WHEREAS, the Authority expects to finance such capital improvements with a loan from the Virginia Resources Authority, the term of which is expected to extend for a period longer than the present life of the Authority; BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF FREDERICK COUNTY, VIRGINIA: 1. In accordance with Section 15.2-5144 of the Code of Virginia of 1950, as amended, the term of the Frederick County Sanitation Authority is hereby extended for a period of 31 years from the date of the adoption of this resolution. 2. This resolution shall take effect immediately. 3. The Clerk of the Board of Supervisors is hereby directed to send a certified copy of this resolution to the State Corporation Commission of Virginia. The undersigned Clerk of the Board of Supervisors of Frederick County, Virginia, certifies that the foregoing constitutes a true and correct extract from the minutes of a regular meeting of the Board on the 8th day ofJuly, 1998, and of the whole thereof so far as applicable to the matters referred to in such extract.
