048-99 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF FREDERICK, VIRGINIA May 12, 1999 At a regular meeting of the Board of Supervisors of the County of Frederick, Virginia, held on May 12, 1999, the following resolution was adopted by a majority of the members of the Board of Supervisors by the following roll call vote, as recorded in the minutes of the meeting: MEMBER VOTE James L. Sr. Nay RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF FREDERICK, VIRGINIA REQUESTING THE CIRCUIT COURT TO ORDER A SPECIAL ELECTION ON THE QUESTION OF ISSUING A MAXIMUM AMOUNT OF $4,500,000 GENERAL OBLIGATION BONDS OF THE COUNTY OF FREDERICK, VIRGINIA TO FINANCE CERTAIN LIBRARY IMPROVEMENTS WHEREAS, the Board of Supervisors ("Board") of the County of Frederick, Virginia ("County") has determined that it is advisable to contract a debt and to issue general obligation bonds of the County in the maximum amount of $4,500,000 (the "Bonds") for the purpose of financing certain library facilities, consisting primarily of the acquisition, construction, equipping and furnishing of a new library in the County (the "Project"); WHEREAS, pursuant to the authority granted by the Public Finance Act of 1991, Chapter 26, Title 5.2, Code of Virginia of 1950, as amended ("Act") the Board proposes to call a special election to take the sense of the qualified voters of the County on the following question regarding the issuance of the Bonds; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF FREDERICK, VIRGINIA: I. The Board hereby determines that it is advisable to contract a debt and to issue general obligation bonds of the County in the amount and for the purposes set forth below. 2. The Board hereby requests the Circuit Court of Frederick County, Virginia to order a special election on November 2, 1999 on the following question pursuant to Sections 15.2-2610 and 15.2-2611 of the Act, provided that such date is at least sixty (60) days after the date on which the Court enters its order. The question on the ballot shall be in substantially the following form: SPECIAL ELECTION November 2, 1999 QUESTION: Shall Frederick County, Virginia contract a debt and issue its general obligation bonds in the maximum amount of Four Million Five Hundred Thousand Dollars ($4,500,000) for the purpose of paying the costs, in whole or in part, of certain library improvements, consisting primarily of the acquisition, construction, equipping and furnishing of a new library in the County? ( ) YES ( ) NO 3. The County Administrator is instructed to file a certified copy of this Resolution with the Circuit Court of Frederick County, Virginia. 4. The Board has determined that in the event the issuance of the Bonds is approved by the voters it may be necessary or desirable to advance money to pay the cost of the Project and the Board adopts this declaration of official intent under Treasury Regulations Section 1.150-2. The Board reasonably expects to reimburse advances made or to be made by the County to pay the costs of the Project from the proceeds of a financing. The maximum amount of financing expected to be issued for the Project is $4,500,000. 5. This Resolution shall take effect immediately. The undersigned Clerk of the Board of Supervisors of the County of Frederick, Virginia, hereby certifies that the foregoing constitutes a true and correct copy of a resolution adopted by the Board of Supervisors of the County of Frederick, Virginia at a regular meeting held on May 12, 1999.
