023-01 RESOLUTION BY THE FREDERICK COUNTY BOARD OF SUPERVISORS The Board of Supervisors of Frederick County, in regular meeting on the 12th day of December 2001, adopted the following: WHEREAS, the streets described on the attached Additions Form SR-SA, fully incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the Circuit Court of Frederick County; and WHEREAS, the Resident Engineer of the Virginia Department of Transportation has advised this Board that the streets meet the requirements established by the Subdivision Street Reauirements of the Virginia Department of Transportation; and WHEREAS, the County and the Virginia Department of Transportation have entered into an agreement on June 9, 1993, for comprehensive stormwater detention which applies to this request for addition; and NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add the streets described n the attached Additions Form SR-5(A) to the secondary system of state highways, pursuant to 33.1-229, Code of Virginia, and the Department's Subdivision Street Reauirements;and BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-of-way, as described, and any necessary easements for cuts, fills and drainage; and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Resident Engineer for the Virginia Department of Transportation. By copy of this letter to Mr. Patrick Davenport, Frederick County Subdivision Administrator, we are providing him a legal description of these streets so the necessary Board of Supervisors resolution may be prepared. For your information the total length of the proposed addition is 0.57 mile. Once we receive the signed and executed Board resolution in this office, the actual addition date can be established. However, assuming a February 1, 2002 addition date can be accomplished there will be a maintenance fee of $375.00 and the surety amount will be $9,000.00. The surety instrument should be dated from February 1, 2002 to February 1, 2003. To meet the February 1, 2002 addition date, the required bond and maintenance fee will need to be in our office by January 1, 2002.
