RESOLUTION OF SUPPORT
"REVENUE SHARING PROGRAM" FOR REGENCY HEIGHTS
SUBDIVISION STREETS; AIRPORT ROAD RELOCATION;
AND MILL WOOD PIKE CROSSOVER
WHEREAS, the County of Frederick desires to submit an application for an allocation of funds
of up to $500,000 for improvements to Regency Lake Drive, Lake Wisdom Drive, Lake Sever Drive,
Chelean Place, Great Pond Way, Geneva Place and Winnipeg Place; and for the relocation and
improvements to Airport Road; and to develop a crossover with signalization on Millwood Pike to
align with Inverlee Way through the Virginia Department of Transportation "Revenue Sharing
Program"; and,
WHEREAS, the improvement to Regency Lakes Drive, Lake Wisdom Drive, Lake Sever Drive,
Chelean Place, Great Pond Way, Geneva Place and Winnipeg Place will allow for these subdivision
streets to qualify for acceptance into the state secondary road system; and,
WHEREAS, the relocation and improvements to Airport Road will remove an obstruction from
the Winchester Regional Airport approach area and the runway protection zone, and implement a
project identified on the Frederick County Capital lmprovements Plan; and,
WHEREAS, the development of a crossover with signalization on Millwood Pike to align with
Inverlee Way will promote safe and efficient traffic movement for the Inverlee Way major collector
road connection between Millwood Pike and Senseny Road; and,
WHEREAS, the County of Frederick will apply for funding through the "Revenue Sharing
Program" annually until the project cost is achieved for each improvement identified in the FY 02-03
Revenue Sharing Application;
NOW, THEREFORE, BE IT ORDAINED that the Frederick County Board of
Supervisors supports the application for an allocation of up to $500,000 for improvements to
Regency Lake Drive, Lake Wisdom Drive, Lake Sever Drive, Chelean Place, Great Pond Way,
Geneva Place and Winnipeg Place as their first priority; and for the relocation and improvements to
Airport Road as their second priority; and for the development of a crossover with signalization on
Millwood Pike to align with lnverlee Way through the Virginia Department of Transportation
"Revenue Sharing Program."

Frederick County has received notice of the opportunity to apply for an allocation through the
Virginia Department of Transportation (VDOT) FY 2002-2003 Revenue Sharing Program. The
Revenue Sharing Program provides state dollars which are matching funds for local dollars on a one-
to-one basis. Staff has met with VDOT to determine which road improvement projects within
Frederick County may be eligible for funding-through this program. Two projects which would be
eligible include the residential streets serving the Regency Height subdivision and the relocation of
Airport Road (Route 645).
Three options exist for the Board of Supervisors consideration of this matter. The first option is to
adopt a resolution which requests funding for both projects; the second option is to adopt a resolution
which requests funding for the Regency Heights subdivision streets only; while the third option is
to not endorse a Revenue Sharing Program proposal for the ensuing fiscal year. Please find attached
information pertaining to the first and second option. Staff requests that the Board of Supervisors
consider this information for fmal determination during the March 13,2002 meeting. Staff will work
with the Edinburg Residency to ensure that all required materials are complete by the March 30,
2002-deadline.

This option involves two separate Revenue Sharing Program projects within Frederick County,
which include upgrades to streets within the Regency Heights subdivision and the relocation and
construction of a portion of Airport Road between Aviation Drive (Route 990) and Victory Road
(Route 728). These projects are described as follows:
Prioritv #1
Rellency Hei~hts Subdivision Streets
. This project involves improvements to Regency Lakes Drive from Berryville Pike (Route 7)
to the single family subdivision including a slurry seal overlay and the installation of
guardrail. Improvements to the various streets within the single family subdivision include
slurry seal overlay, asphalt overlay and drainage improvements.
. Completion ofthese improvements will enable VDOT to accept Regency Lakes Drive, Lake
Wisdom Drive, Lake Sever Drive, Chelean Place, Great Pond Way, Geneva Place and
Winnipeg Place into the state secondary road system.
. The anticipated project cost for these improvements is $120,000 of which $60,000 is
Revenue Sharing Program funds and $60,000 is local funds.
Priority #2 Airport Road Relocation
. This project involves the relocation and construction of a segment of Airport Road between
Aviation Drive and Victory Road which will eliminate an obstruction from the Winchester
Regional Airport approach area and the runway protection zone.
. This improvement project is programmed in the Frederick County Capital Improvements
Plan.
. The anticipated project cost for these improvements is $2,300,000 of which $1,000,000 are
Revenue Sharing Program funds, $450,000 are Federal Aviation Administration Entitlement
funds, $840,000 are Virginia Department of Aviation funds, and $210,000 are local funds.
. The Winchester Regional Airport Authority has submitted a copy of a legal opinion from
Mark K. Flynn, dated March 5, 2002, which advises that the Federal Aviation Administration
and Virginia Department of Aviation funds can be utilized to offset the local match
requirement for this project.

IN RE: FUNDING FOR AIRPORT ROAD RELOCATION
This letter is written in tesponse to your question as to whether the Airport
Authority may use airport funds for Frederick County's share of the cost of relocating
airport road for VDoT's industrial road access program.
In order to answer the question, I have spoken with two VDoT officials, Ms. Julie
Brown, who is in charge of industrial road projects and with James Givens, the engineer
over all such projects. Both confirmed that a county's local match for industrial road
projects may come from any source. Therefore, the Airport Authority could fund the local
share, according to both VDoT officials. '
