RESOLUTION
BY THE
FREDERICK COUNTY BOARD OF SUPERVISORS
The Board of Supervisors of Frederick County, in regular meeting on the 22th day of May 2002, adopted
the following:
A PROJECT ENDORSEMENT RESOLUTION FOR THE APPLICATION TO THE
SHENANDOAH VALLEY BATTLEFIELDS FOUNDATION FOR FUNDING UNDER THE
IMPLEMENTATION PROJECT GRANT FOR THE INSTALLATION OF PERIMETER
FENCING AT THE KERNSTOWN BATTLEFIELD ASSOCIATION'S PROPERTY
WHEREAS, in accordance with the funding allocation procedures of Frederick County, it is
necessary that a request by resolution be received from this Board in order that Frederick County may
provide matching funds if awarded the Shenandoah Valley Battlefields Foundation Implementation Grant
is awarded to the Kemstown Battlefield Association.
WHEREAS, the Frederick County Board of Supervisors supports the desire of landowners to
acknowledge the history of their property and its role in the Civil War.
WHEREAS, the Frederick County Board of Supervisors supports the development of heritage
tourism based upon the historic and scenic resources of Frederick County as an economic engine for that
area.
NOW, THEREFORE, BE IT RESOLVED, That the Frederick County Board of Supervisors
requests the Shenandoah Valley Battlefields Foundation to grant approval of the Kemstown Battlefield
Association's Perimeter Fencing Project for the protection ofthe historic resources associated with the First
and Second Battle of Kerns town from unauthorized access and enabling use of the property for compatible
agricultural purposes.
BE IT FURTHER RESOLVED, That Frederick County hereby agrees to provide $1,000 towards
the 20 percent matching funds for the project, as required by the Shenandoah Valley Battlefields Foundation
Implementation Grant program.

The Kemstown Battlefield Association (KBA) is submitting a grant application to the Shenandoah
Valley Battlefields Foundations' (SVBF) Shenandoah Valley Battlefields National Historic District
Implementation Proiect Grant Program seeking funding to erect perimeter fencing on the KBA's
property. The KBA has requested that County consider endorsement of the grant application, as well
as provide a portion of the matching funds necessary for the grant program. The program's deadline
for grant applications is May 31, 2002.
Staff had approached the KBA inviting them to participate in a grant application the county was
submitting to secure funding for Virginia Civil War Trails (V ACWT) signs. The KBA informed staff
that an individual had already offered to provide the KBA with the necessary funds to acquire such
a sign. The KBA did express interest in utilizing the matching funds the county would have provided
for the V ACWT signs, redirected for use in the KBA's grant application for the perimeter fencing.
The KBA is seeking a grant from the SVBF for $10,000. This grant program requires that the
applicant provide a minimum of20 percent ($2,000) matching funds. KBA has requested that the
County provide $1,000 towards the required 20 percent match.
The Planning Commission reviewed this request during their May 15, 2002 meeting, and
recommended approval of the request.

5. Project Summary: Briefly summarize your project in the space provided.
The KBA intends to construct approximately 7400 lineal feet of perimeter fence to separate its property from
neighboring residential subdivisions. This project will be done by a professional fencing contractor that will
be selected through a competitive bid process. The investment in this fence will protect the resource from
unauthorized access and allow the KBA to fully utilize its land for compatible agricultural purposes.

Commission Report.
First Kemstown was rated a Priority One site.

One of the first recommendations of the 1996 Kemstown Resource Management Plan, funded by the National
Park Service, was to:
"Control unauthorized access into the area from adjacent roads and properties. Identify the park property with
signs. Construct fencing along the property boundaries at Middle and Apple Valley Roads."
The KBA has already upgraded two out of three road entrances and identified the property with signage.
Some existing perimeter fencing has been deemed sufficient for the time being. The subdivision ofthe Grim
Farm after 1996 has left the Valley A venue and Middle Road property lines without any fences whatsoever.
Since acquiring the property in 2000, the KBA's prime focus has been on the service and retirement of its
$840,000. purchase mortgage. Consequently, only limited private funds are available for this important security
investment.
~riterion C - Preservation Opportunity
Please refer to Application Guidelines; Criterion C (page 2) for guidance in answering this section. Be sure to address how this
project addresses your organization's mission in relation to the Civil War site.
Any property owner of 315 acres would hold the establishment of a perimeter fence as a very high priority.
The fact that this property isa nationally-significant historic landmark, scene of numerous actions and two Civil
War battles, and home to several fragile historic structures, makes the construction of tills perimeter fencing a
crucial element in the preservation and protection of this resource.
The investment in this long term asset is an appropriate action that will provide many benefits:
1. Resource protection-Without a fence, the KBA is almost encouraging casual trespass by the general
public. Unfortunate acts of vandalism have already occurred at the Grim Farm, including a malicious
burning of an 18th century log cabin. .
2. Reduction ofKBA Liability-A perimeter fence will direct visitor access to those areas and at such
times that are under the control of the KBA. Unauthorized visitors, and their children, put themselves at
risk from various hazards present in an agricultural area, including groundhog holes, open water
features, etc.
3. Continuation of Farming-One ofthe KBA's long range goals is to continue the 250 year old tradition
of fanning the property. The KBA enjoys a good relationship with a tenet fanner and the construction
of a quality fence will enhance the value of the property to him. Also, new fence will require
considerably less maintenance hours by him or KBA personnel.

The KBA purchased the Grim Farm in September, 2000, and has been responsible for the rehabilitation and
maintenance of the 315 acre working farm. Much progress has been made in stabilizing the historic structures
and groWlds through the efforts ofKBA volunteers and donated materials. The agricultural operation continues
through a beneficial tenant relationship with a neighboring cattle farmer.
Since the fencing project will be contracted out to a professional company, the KEA's duty will be to perform a
competitive bid process and project oversight. KBA Officers and Committee Chairs have a wide range of
managerial, professional and practical skills which will ensure that the KBA receives full value for the money
expended.
