BOARD OF SUPERVISORS
A RESOLUTION AGREEING TO BE APPLICANT AND FISCAL AGENT
FOR
AN AMERICAN BATTLEFIELD PROTECTION GRANT TO PURCHASE
EASEMENTS ON PORTIONS OF THE SECOND AND THIRD
WINCHESTER BATTLEFIELDS
WHEREAS, the Frederick County Board of Supervisors supports the development of
heritage tourism based upon the historic and scenic resources of Frederick County as an economic
engine for the area; and,
WHEREAS, the Frederick County Board of Supervisors supports efforts ofthe Shenandoah
Battlefield Foundation to protect, through fair-market purchase in fee simple or through acquisition
of easements, portions of the core battlefield of the Second and Third Battles of Winchester; and,
WHEREAS, the National Park Service's American Battlefield Protection Program (ABPP)
offers grant funds for Battlefield acquisition,
NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of
Supervisors does hereby agree to apply for and be fiscal agent on an ABPP grant application to be
prepared by the Shenandoah VaHey Battlefields Foundation.

Attached please find copies of a memo requesting that Frederick County act as the
applicant and fiscal agent for an American Battlefield Protection Program (ABPP)
grant.
As we have discussed, the project wiII require no monetary commitment from
Frederick County.
Per our discussion, please include this item on the agenda for the 14 May meeting
of the Frederick County Board of Supervisors and distribute the enclosed memo
to the board.

The Shenandoah Valley Battlefields Foundation (SVBF) asks that Frederick County
support a battlefield protection project by acting as the applicant and fiscal agent for an
American Battlefield Protection Program (ABPP) grant.
SUMMARY:
The National Park Service's (NPS) ABPP administers grants from the Land and Water
Conservation Fund to help states, localities, and non-profit organizations acquire Civil
War battlefield land.
Two county landowners in the core areas of the Second and Third Winchester battlefields
have offered to sell easement to SVBP using ABPP funds.
D Stephenson Associates is offering to donate to SVBF an easement on 108 acres of
land it owns fronting both sides of Milburn Road. The property to be protected under
easement encompasses all the core battlefield land owned by Stephenson Associates
in the Milburn Road area.
D The McCann family is offering to sell an easement on 98 acres it owns fronting on
US Route 11, adjacent to and west of the Stephenson Associates property. The
donation of an easement by Stephenson Associates will provide the match needed to
secure ABPP funds to purchase the McCann easement.
D A third landowner, adjacent to the properties above, is also interested in exploring the
sale of an easement to SVBF on an additional 98 acres of land. If this third owner
decides to participate, more than 300 acres ofland along Milburn Road in the core
area of the Second and Third Winchester battlefields will be protected under
easement in the project.
SVBF asks that Frederick County support this effort by acting as the applicant to the
ABPP and the fiscal agent for the project.
FREDERICK COUNTY PLANS:
Protection of the properties under easement will help implement the Frederick County
Comprehensive Policy Plan and the county's Third Winchester (Opequon) Battlefield
Preservation Plan and Battlefield Network Plan.
ELLIGIBLE APPLICANTS:
Non-profit organizations seeking funds must have a locality or state agency apply to
ABPP. The locality may then re-grant the funds to the non-profit.
MATCIDNG FUNDS
A dollar-for-dollar non-federal match must be provided in cash or interest in land.
UPCOMING DEADLINES:
Applications for the next round of funding must be submitted by I June 2003.
Notification of awards will be made within 45 days.
COST TO FREDERICK COUNTY:
Frederick County's participation in the project will be purely administrative. No county
funds will be spent in the project.
