RAIL PRESERVATION APPLICATION
WINCHESTER & WESTERN RAILROAD
RESOLUTION
WHEREAS, the WINCHESTER & WESTERN RR desires to file an application with
the VIRGINIA DEPARTMENT OF RAIL AND PUBLIC TRANSPORTATION for safety
and improvement projects; and
and
WHEREAS, the identified improvement projects are estimated to cost $8,872,503.00;
WHEREAS, the 2003 General Assembly has approved funding for the acquisition, lease
or improvement of railways within the Rail Preservation Program budget; and
WHEREAS, the WINCHESTER & WESTERN RR is an important element of the
WINCHESTER/FREDERICK COUNTY transportation system; and
WHEREAS, the WINCHESTER & WESTERN RR is instrumental in the economic
development of the WINCHESTER/FREDERICK COUNTY area, and provides relief to the
highway system by transporting freight, and provides an alternate means of transporting
commodities; and
WHEREAS, THE COUNTY OF FREDERICK supports the project and the retention
of rail service; and
WHEREAS, the COMMONWEALTH TRANSPORTATION BOARD has
established procedures for all allocation and distribution of the funds approved by the 2003
General Assembly.
NOW, THEREFORE, BE IT RESOLVED that THE COUNTY OF FREDERICK
does hereby request the VIRGINIA DEPARTMENT OF RAIL AND PUBLIC
TRANSPORTATION to give priority consideration to the projects proposed by the
WINCHESTER & WESTERN RR totaling $8,872,503.00 in THE COUNTY OF
FREDERICK and THE CITY OF WINCHESTER.
At a Regular Meeting of the Board of Supervisors for the County of Frederick, Virginia,
held on May 14,2003, upon motion made by W. Harrington Smith, Jr., and seconded by Lynda
J. Tyler, the above resolution was approved by the following recorded vote:

Honorable Ladies and Gentlemen:
The WINCHESTER & WESTERN Railroad, serving Winchester and Frederick
county as a common carrier public utility, has made application to the Commonwealth of
Virginia Department of Rail & Public Transportation for Financial Assistance for
Rehabilitation of certain local rail lines, requesting $8,872,503.00 to improve both public
safety and the physical condition of the railroad
The proposed improvements will take place in both City and County; therefore,
the Department has requested a Resolution from both governing bodies, indicating their
support of the project(s). A proposed Resolution, in the format suggested by DOT
personnel, is forwarded as Enclosure 1. The original letter of application provides
additional information: a copy is attached as Include. 2.
The WINCHESTER & WESTERN Railroad respectfully requests introduction

Dear Mrs. Rae:
The purpose of this letter is to forward and respectfully request favorable consideration for our
application for financial assistance utilizing Rail Preservation Program funds that are available
for the 2004 fiscal year. The proposed scope of work is as set forth in the attached pages. This
work continues the program designed to upgrade the Winchester & Western Railroad Company
Virginia Division to Class I standards: therefore, the previously submitted justification and
evaluation documents remain in effect.
The W&W employs 16 people on the Virginia Division, and handled over 4100 carloads of
freight in 2002. We do expect a modest increase in traffic in 2003.
I hereby certify that the Winchester & Western Railroad Company (W&W) is a common
carrier; that the W&W provides continuous maintenance, and assumes liability for the track and
facilities involved; and that the W&W guarantees the right-of-way for the project(s) identified.
Resolutions of sUPflrt, to be included in this application, are on the agenda for the regularly
scheduled May 14 meeting of the Common Council of the City of Winchester and for the
regularly scheduled May 15th meeting of the Board of Supervisors of Frederick County. Draft
resolutions for these bodies are enclosed. Properly certified copies of these resolutions will be
forwarded as soon as they are received
