039-03 BOARD OF SUPERVISORS A RESOLUTION IN SUPPORT OF SENATE BILL 1279 RAIL TRANSPORTATION DEVELOPMENT AUTHORITY WHEREAS, Senate Bill 1279 creates a Rail Transportation Development Authority, and WHEREAS, the Frederick County Board of Supervisors has supported initiatives to create more opportunities for rail transportation alternatives, and WHEREAS, a rail authority would provide additional opportunities to focus on rail transportation initiatives, NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Frederick, Virginia, does hereby support SB 1279. BE IT FURTHER RESOL VED that a true copy ofthis resolution be mailed to Frederick County's delegation in the General Assembly. Be it enacted by the General Assembly of Virginia: 1, That the Code of Virginia is amended by adding in Title 33.1 a chapter nwnbered 10,2, consisting of sections numbered 33. !-3..2.LQ through 33.1-391.9, as foUows: CHA.FTER 10.2. l:lA.ll- TRANSPORTATION DEYELOPMENT AUTHORITY. S 33.1-391.6. Short tit/e. This chapter sooll be known and may /)e cited as the Rail Transporfation Development Authority Act. S 33. 1-391. 7. Authority created; purpose. There is hereby created the Rail Transportation Development Authority, hereinafter in this chapter known as the Authority. The purpose of the Authority shall be to finance or assist in the finoncing of the construction, repair, renovation, restoration, acquisition, and extension ofrai/lines, equipment, andfad/iries in the Commonwealth, including rolling stocle, shops, terminals, lIridges, tunnels, and any other passenger rail or freight rail facilities, eqllipment, or infra$lrUcrure, upon a determination by the Authority that $uch actio" is in the public interest. S 33.1-39/.8. COMpOsitlolf of Authority; chail'ma" and vice-chairman; quorum. The Autlwrity shall consist of 7 voting members appointed by the (}Qvenror. All members shall serve for terms of 4 year$ and m<<y be reappointed for 1 addifiona/term. For the initial appointments only, 3 of the appointments may lie for terms of 2 years so as to allow for staggered terms. Such in/tiall-year terms shall '101 count against the term limitation. V aca~ies shall be filled for the unexpired term. The A uthority shall elect from its membership a chairman and vice-chairman, who shall continue to hold such office until their respective successors are elected. Four memoers of the authority shall constitute a quorum. S 33.1-391.9. Powers of Authority. The Authority shall have the folloWing powers together with all powers incidental thereto or necessary for the performance of those hereinafter staled: J. To sue and be sued ~ to prosecute and defend, at law or in equity, in afV' CllUrt having jurisdiction of the subject maner and of the parties; 2. To borrow money and to lKcept contributions, grants, and other financial assistance from the United States of America and agencies or instru",emalities thereof, the Commonwealth, or any political subdivision, agency, or public instrumentality of the Commonwealth; 6. To issue borrd.v in accordance with applicable law, including the iS3flQnce of bonds and ()ther evidences of debt, in order to finan<< or assist in the fintmcing of rai/ transportation projects undertaken under the Puhlic-Private Transportation Act of 1995 (S 56-556 et seq.) or any other rail tra11Sportation project in the Com",omvealth determined by the Authority to be in the public interest; 7. To malre loans or grants for purposes that are consistent with this chapter and otherwise to receiw aNI expend moneys on behdf of the Awhority; and 8. To acquire land or any interest therein by purchose, lease, gift, or otherwise, and to hold, encumber, sell, or otherwise dispose of such land or interest, for purposes consistent with this chapter. II 2. That the provisions of this act shaD become eflCctiYe 00 July I, 2004.
