August 20, 1982 Special Meeting619 A Special Fleeting of the Frederick County Board of Supervisors was held on August 20, 1982, at 7:00 P.M., in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia. PRESENT S. Roger Koontz, Chairman; Will L. Owings, Vice - Chairman; William H. Baker and Rhoda W. Maddox. Mr. David Smith and Mr. Kenneth Stiles were not present at this time. CALL TO ORDER The Chairman called the meeting to order and asked that everyone observe a moment of silence. REQUEST FOR APPROPRIATION TRANSFER /BUDGET ADJUSTMENT/ CARRY FORWARD FUND FOR ASAP - APPROVED The Finance Director presented the following requests: Budget Adjustment - Request within the Detox Budget in the amount of $55.00. No local funds required. Upon motion made by William H. Baker, seconded by Will L. Owings and passed unanimously, the above was approved. Carry Forward Funds - Request to carry forward grant funds remaining at June 30, 1982 in accordance with grant regulations. Approval has been received from the Department of Corrections. No local funds are involved. Upon motion made by William H. Baker, seconded by Will L. Owings and passed unanimously, the above was approved. Appropriation Transfers - Request to transfer within the Division of Court Services Administration budget: $128.75 from 5401 -00 Office Supplies to 3010 -00 Other Contractual Services. Request to transfer within the Community Corrections Facility budget ( Work Release Center) : $150.00 from 5890 -00 Operational Transfers to 7002 -00 Furniture and Fixtures and $920.00 from 7002 -00 Furniture and Fixtures to 5413 -00 Other Operating Supplies. Request to transfer $75.00 from Capital Transfers to the Treasurer's account 7007 -00 A.D.P. Equipment to compensate for a miscalculation of cost at the time the original transfer was requested for terminals. Upon motion made by William H. Baker, seconded by Will L. Owings and passed unanimously, the above was approved. REQUEST FROM PARKS AND RECREATION FOR FUNDS TRANSFER FOR REPAIRS TO SHERANDO DAM EMBANKMENT - APPROVED k1r. Cheely stated that at the August 11, 1982 Board of Supervisors' Meeting it was discussed that the following transfers be carried forward 620 into line item 7110 -7900 in order to complete repairs to existing Sherando Dam. Professional Services - 7101 - 3002 -00 $ 6,414.00 Capital Projects (Improvements Other than Buildings) - 7110 - 7900 -00 $ 5,718.27 $12,132.27 Upon motion made by William H. Baker, seconded by Rhoda W. Maddox and passed unanimously, the above was approved. REQUEST FOR PURCHASE OF INFORMATION FROM DATA PROCESSING DEPARTMENT This is to be discussed in Executive Session. Mr. Stiles arrived at this time. BOARD RETIRES INTO EXECUTIVE SESSION Upon motion made by Kenneth Y. Stiles, seconded by William H. Baker and passed unanimously, the Board retired into Executive Session in accordance with Section 2.1 -344, Subsections (A) 1 and (A) 6 for discussion of personnel and legal matters. Mr. Smith arrived at this time, (7:20). BOARD WITHDRAWS FROM EXECUTIVE SESSION Upon motion made by Will L. Owings, seconded by Rhoda W. Maddox and passed unanimously, the Board withdrew from Executive Session. BOARD RECONVENES INTO REGULAR SESSION Upon motion made by Rhoda W. Maddox, seconded by William H. Baker and passed unanimously, the Board reconvened into Regular Session. RESOLUTION WITH REFERENCE TO THE AVAILABILITY OF COUNTY RECORDS -APPROVED Upon motion made by Kenneth Y. Stiles, seconded by William H. Baker and passed unanimously, the following resolution was approved: BE IT RESOLVED, That the Board establish as their policy that any records of Frederick County are available to the public as provided for by State Law, provided that the records do not leave the office where they are housed. BE IT FURTHER RESOLVED, That the policy further states that the County will not provide or make available or sell copies of these records. MCGUIRE, WOODS AND BATTLE TO BE RETAINED AS LEGAL COUNSEL FO THE COUNTY IN THE COMPLAINT FILED BY JEANNETTE STULTZ - Upon motion made by William H. Baker, seconded by David L. Smith and passed unanimously, that the law firm of McGuire, Woods and Battle, from 621 Richmond, Virginia, be retained to represent the County in the complaint filed against the County by Jeannette Stultz. DIRECTOR OF PUBLIC SERVICES DIRECTED TO LET BIDS FOR THE HAULING OF TRASH WITHIN THE COUNTY - APPROVED Upon motion made by William H. Baker, seconded by David L. Smith and passed unanimously, that Robert Harriman, Public Services Director, be directed to let bids for the hauling of trash within the County. Mr. Harriman asked if this is for three years or five years. The Board instructed Mr. Harriman to get bids for both three and five years.
