December 17, 1980 Joint Meeting with Planning Commission166 A Joint Meeting of the Frederick County Board of Supervisors and the Frederick County Planning Commission was held on December 17, 1980 at 7:30 P.M. in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia. PRESENT: Board of Supervisors S. Roger Koontz, Chairman; Will L. Owings Vice - Chairman; William H. Baker; Rhoda W. Maddox; R. Thomas Malcolm and Kenneth Y. Stiles. Planning Commission C. Langdon Gordon, Chairman; Frank Brum- back, Vice - Chairman; W. French Kirk; James Golladay, Jr. and Manuel DeHaven. CALL TO ORDER Chairman Koontz called the meeting to order. DECEMBER 24th BOARD OF SUPERVISORS MEETING CANCELLED Upon motion made by Kenneth Y. Stiles, seconded by William H. Baker and passed unanimously, the second scheduled Board of Super- visors meeting for December (24th) is hereby cancelled. DISCUSSION - LARGE LOT SUBDIVISIONS Mr. Gordon stated that the Planning Commission was concerned about the large lot subdivisions inasmuch as the current requirements are not working properly. He stated tht the Planning Commission would like some direction from the Board as to what their ideas were on how this problem might be resolved. Discussion followed concerning the problems facing the county on large lot subdivisions and it was decided that this was a serious situation, but not an emergency one and that it was not necessary to impose a moratorium at this time. Mr. Koontz asked if there were many 5 acre lots being put to record at this time. Mr. Stiles stated that it was not the rate that they were being put to record that was the concern, but rather the way they were being done. He added that many have no provisions for roads and that this was his main concern. Mr. White asked if the present 5 acre minimum lot size was too low and if maybe it should be raised to either 10 or 15 acres. 161! Discussion followed concerning this proposal and it was decided to leave it at the present 5 acres. Mr. Stiles asked Mr. Sluder if a person could be required to have Health Department approval before the deed is transferred. He added that Clarke County had been doing this for years. Discussion followed as to how the Office of Planning and Development could be made aware of all subdivisions that were put to record and Mr. Horne stated that certain surveyors would bring this information in to the office and others would not. Mr. Malcolm stated that he was not anxious to be involved in emergency legislation again and that he felt that the two areas that needed to be addressed were road and Health Department standards. He further stated that he was not in favor of temporary legislation. Mr. Riley read the section in the County Code concerning sub- divisions. This section of the code was discussed and it was decided that all large lot subdivisions would meet Health Department and road standards before being put to record. Mr. Koontz asked Mr. Riley when this would be ready to come before the Board and Mr. Riley replied, January 14, 1981. Mrs. Maddox stated that she was concerned about rezoning re- quests that come in prior to study of the Comprehensive Plan. Mr. Riley stated that this would be a transition period for a- while and that this could not be helped. HEALTH DEPARTMENT DIRECTOR INTRODUCED Mr. Sluder of the Health Department introduced the new director Dr. Paul Lee Pederson.
