HomeMy WebLinkAboutNovember 04, 1983 Special Meeting2T/ A Special Meeting of the Frederick County Board of Supervisors was held on November 4, 1983, at 9:30 P.M., in the Board of Supervisor's Meeting Room, 9 Court Square, Winchester, Virginia. PRESENT S. Roger Koontz, Chairman; Will L. Owings, Vice - Chairman; William H. Baker; Rhoda W. Maddox and Kenneth Y. Stiles. Absent: David L. Smith. The Chairman called the meeting to order and asked that everyone observe a moment of silence. Mr. Koontz stated that the primary reason for this meeting being called was due to the emergency of the tire fire on the Paul Rhinehart property. He further stated that the Board Members had been polled by phone for approval of the following resolution, however, it stated in the Code that they did have to meet publicly and approve this resolution, thus the need for this meeting. Mr. Riley read the following resolution. WHEREAS, the Frederick County Board of Supervisors does hereby find: That due to the fire involving an estimated 7 million used tires on the Paul Rhinehart property West of Route 608, the County of Frederick is facing dangerous conditions of fire spread and air and water pollution; and That due to the fire, a condition of extreme peril of life and property necessitates the proclamation of the existence of an emergency; NOW, THEREFORE, IT IS HEREBY PROCLAIMED that as of 10:49 A.M., on Tuesday, November 1, 1983, an emergency exists within said County; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said emergency the powers, functions and duties of the Director of Emergency Services and the Emergency Services Organization of the County of Frederick shall be those prescribed by State law and the ordinances, resolutions and approved plans of the County of Frederick in order to mitigate the effects of said emergency. /s/ S. Baker, seconded by Rhoda W. Maddox and passed unanimously, the above resolution was approved. At this time members of the press asked Mr. Koontz and members of the Board various questions concerning this tire fire and what the County's plans were as far as resolving the problem of discarded tires in Frederick County. 278 Mr. Koontz stated that he would like for the County to start next week setting up meetings in order to address this problem with the dealers within the County and other individuals involved within discarded tires within the County. Mr. Stiles asked what obligation the County had to see that these tires were disposed of. Mr. Riley stated that he felt that what the County had to do now was to go back and decide on the rational of this whole thing. Mr. Stiles asked if the County Landfill accepted tires at this time. Mr. Riley replied that only two or three from a residence and that was all. Mr. Koontz stated that the County needed to look at other Communities and see what methods they used to get rid of discarded tires. Mr. Riley stated that Mr. Massey, of the Environmental Protection Agency, had told him that a contract had been agreed upon between the EPA and the Fire Companies involved with this fire. Mr. Stiles asked if a date had been set as to when a decision would have to be made as to whether or not this fire would be put out, or at least an effort made to do so. Mr. Riley stated that it was his understanding that a decision would probably be reached sometime on November 6th. Mr. Koontz stated that he would like to thank the staff for all their efforts in helping out in this situation. Mr. Riley stated that he felt the Board should be very proud of their staff and that this had been a very long five days. Mr. Koontz stated that he would also like to thank the Fire Departments from the City for all their efforts in helping to contain this fire. He stated that he was not sure at this point but felt that something under $10,000 had been spent so far by the County in dealing with this fire. Mr. Riley stated that approximately $6,000 had been spent since Monday, October 31st, and that the bulk of this had been spent for gasoline for the fire trucks. Mr. Koontz stated that some of the Firemen's coats had been soaked with oil as well as other fire fighting equipment and he did not know at this point whose responsibility it would be to see that these items were replaced as they could no longer be used. 2791 UPON MOTION DULY MADE, SECONDED AND PASSED UNANIMOUSLY, IT WAS ORDERED THAT THE BOARD OF SUPERVISORS DO ADJOURN. 4 7, C l man, o rd of upery s' rs I �� Cl 7N , Board "of Super%�Ysors
