March 1977A Regular Meeting of the Board'of Supervisors of the County of Frederick, Virginia was held on March 23, 1977, in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia.. PRESENT: S. Roger Koontz, Chairman; Thomas B. Rosenberger, Vice Chairman; Dr. Raymond L. Fish; Will L. Owings; R. Thomas Malcolm; and Dennis T. Cole. The Chairman called the meeting to order. APPROVAL OF MINUTES Upon motion made by Dennis T. Cole and seconded by Will L. Owings, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick, • Virginia does herein approve the minutes of the Regular Meeting of this Board held on March 9, 1977, the Adjourned Meeting held on March 10, 1977, the Special Meeting held on March 15, 1977 and the Special Meeting held on March 16, 1977 as submitted. SITE PLAN - BRADY T. ELLIS, SR. - CARRIED FORWARD Mr. Berg presented the site plan of Brady T. Ellis, Sr. and described the location and proposed use of the property. He stated that at this time the site plan'as presented will not meet Health Department requirements. Mr.. Rosenberger Stated. that the Planning Commission had passed this site plan on to the Board of Supervisors with no recommendation inasmuch as there appeared to be a discrepancy as to how many employees the sanitary facilities would accomodate in the new plan. Mr. Ellis appeared before the Board in support of his site plan and stated that the original plan had provided for one centrally located bathroom facility. He further advised that the building inspector had told him the bathroom must. be in the building where the personnel will be working. He then requested approval of one building for warehousing with no sanitary facilities, and one building for office personnel with bathroom facilities. There followed a lengthy discussion regarding the proposed uses of the various buildings on the property and the number of employees the sewer system could adequately 'serve. Mr. Berg advised that the Health Department would approve the sanitary system for no more than seven (7) employees and that this would be almost impossible for the County to enforce. It was disclosed during the discussions that several buildings on the property • had been renovated and construction accomplished without the owner obtaining building permits for said work. Mr. Rosenberger then moved to approve the site plan for only seven (7) employees as approved by the Health Department. Mr. Cole seconded this motion. Following a brief discussion regarding the Health Department approval for It , only seven employees, several Supervisors expressed concern relative to approving this site plan without further study. Therefore, Mr. Cole withdrew his secondtto Mr. Rosenberger's previous motion and Mr. Rosenberger subsequently withdrew his motion, stating that he would do so in order to provide more time for study by the Supervisors and the Board could act on this request at their special meeting on March'24, 1977. The Board agreed with this recommendation. YJ ANNUAL ROAD HEARING Mr. R. C. King, Assistant Resident Engineer, and Mr. J. A. Copp, Maintenance Supervisor of the Virginia Department of Highways, appeared before the Board and Mr. King explained hbriefly' the purpose of the Annual Road Hearing.-Mr. King advised that a great deal of the roads in-the County had been damaged by the extreme cold weather and would be repaired by the Highway Department as soon as; possible. Upon motion made by R. Thomas Malcolm and seconded by Will L. Owings, BE IT RESOLVED, That the Board of Supervisors of the County of Frederick, Virginia, does herein approve the plat of Opequon Estates, Section II containing 31 lots located on Route 664 in Stonewall Magisterial District with individual wells and septic systems as approved by the Health Department.
