June 25, 1986 Special Meeting365 A Special Meeting of the Frederick County Board of Supervisors was held on June 25, 1986, at 1 :30 P.M., in the Board of Supervisor's Meeting Room, Frederick County Courthouse, Winchester, Virginia. PRESENT Will L. Owings, Vice - Chairman; Robert M. Rhodes; Rhoda W. Maddox; Thomas B. Throckmorton and C. William Orndoff, Jr. Kenneth Y. Stiles was absent. CALL TO ORDER Mr. Owings, Vice - Chairman, called the meeting to order and asked Mr. Riley to explain why this special meeting had been called. Mr. Riley stated that at the last Board meeting the Board authorized him, in conjunction with the Finance Director, to open bids and secure coverage for the insurance program for the County. He further stated that when these quotations were opened nothing was submitted for general liabili- ty or automobile insurance. He stated that the Virginia Municipal League, working in conjunction with Alexander and Alexander, advised the County that a pool was being formed with other localities and in order for this Board to participate in this pool the following resolution must be approved: WHEREAS, the County of Frederick, Virginia, wishes to join with other political subdivisions to establish the Virginia Municipal Self- Insurance Association ( "Association ") to create pools to jointly and cooperatively self - insure and to pool the separate risks and liabilities of the individual members pursuant to the terms of Chapter 11.1 of Title 15.1 of the Code of Virginia; and WHEREAS, through such Association, Frederick County wishes to join with other political subdivisions to create the Virginia Municipal Liability Pool ( "Pool ") whereby members can jointly pool funds to provide the necessary anticipated financing for comprehensive general liability, automobile liability, and automobile physical damage; and WHEREAS, such Pool must be, and is anticipated to be, licensed by the Bureau of Insurance of the State Corporation Commission ( "Commission ") prior to operating; and WHEREAS, the anticipated responsibilities of the members of the Pool and the amount and terms of the coverage to be provided are set forth in the Member Agreement which is attached hereto; NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Frederick County in a meeting assembled on the 25th day of June, 1986: 1. Frederick County certifies its intention to become a member of such Pool for three years beginning July 1, 1986 or as soon thereafter as the Pool becomes operational; 2. Such membership is contingent upon: a. Certification of the Pool by the Commission, b. Final approval by the Association's Members' Supervisory Board of the Member Agreement attached hereto and of the membership of Frederick County, 366 c. Payment of $207,815 for the first year contribution to the Pool pursuant to the quotation submitted to Frederick County or such final amount as mutually agreed upon by the member and the Association or their respective designees. 3. It is recognized that members of the Pool may be required to pay additional assessments to the Pool and that in the event the Pool is in a deficit position which is not corrected, a member will be liable for any and all unpaid claims against such member. 4. John R. Riley, Jr. is authorized to do all things necessary to enable Frederick County to become a member of the Association and the Pool including but not limited to execution of the member agreement. Arthur $249,514 Grand Total Mr. Bryan Yoho, of Alexander and Alexander, was present to answer any questions the Board might have. Mr. Owings stated that the County is currently not a member of the Municipal League, was this correct. Mr. Riley replied that was correct but it is not compulsory that the County be a member in order to participate in this pool. Mrs. Barbara Ratcliff, Finance Director, stated that the County is currently paying $122,716 for total coverage. Mr. Throckmorton asked if the County received a quote on Workmen's Compensation for this year and if so how much was it. Mr. Riley replied approximately $55,000. He stated that he felt these rates were outrageous considering that three years ago the County was paying ii $55,000 for everything but he felt the County will be more in control of their own program and premium rates if they participate in this pool. Mr. Throckmorton asked how much was budgeted in this year's Budget. Mr. Riley replied approximately $150,000 less than is needed. 367 Mr. Orndoff asked if the Virginia Municipal League had the required $3,000,000 at this point. Mr. Yoho replied that they had approximately 90 %. Upon motion made by Robert M. Rhodes, seconded by Thomas B. Throck- morton and passed unanimously, the agreement for the County of Frederick to become a member of the Virginia Municipal Liability Pool and Virginia Municipal Self Insurance Association was approved. Upon motion made by Thomas B. Throckmorton, seconded by C. William Orndoff, Jr. and passed unanimously, the above resolution authorizing the County of Frederick's membership in the Virginia Municipal Liability Pool was approved. Upon motion made by C. William Orndoff, Jr., seconded by Thomas B. Throckmorton and passed unanimously, approximately $150,000 was appropriated to cover this expenditure in order that the County might have complete insurance coverage.
