HomeMy WebLinkAboutAugust 17, 1989 Special Meeting360 A Special Meeting of the Frederick County Board of Super- visors was held on August 17, 1989, Twelve Noon, in the Board of Supervisors' Meeting Room, Frederick County Courthouse, Loudoun Street Mall, Winchester, Virginia. PRESENT Robert M. Rhodes, Vice - Chairman; Dudley H. Rinker; Roger L. Crosen and Charles W. Orndoff, Sr. Kenneth Y. Stiles and W. Harrington Smith, Jr. were absent. CALL TO ORDER Mr. Rhodes, Vice - Chairman, called the meeting to order. CAROLYN S. WILLIAMS APPOINTED TO THE BOARD OF EDUCATION AS AN AT -LARGE MEMBER Upon motion made by Roger L. Crosen, seconded by Dudley H. Rinker and passed unanimously, Carolyn S. Williams was appointed to the School Board as an At -Large member, said term to commence August 17, 1989 and expire on June 30, 1993. BOARD DISCUSSION OF TIRE STORAGE AT THE RHINEHART PROPERTY Mr. Crosen stated that it was his understanding that, based on the letter from Mr. Ambrogi, Commonwealth's Attorney, that the County cannot seek an injunction at this time against Mr. and Mrs. Rhinehart in order to prevent them from hauling any additional tires to their property as the County cannot prove what is being done with the tires once they are delivered to their property. Mr. Crosen asked if the County could prove that the tires are actually being stored at Mr. Rhinehart's farm, could they then take legal action. Mr. Ambrogi replied only if he is doing something against the law, if he was just using the tires to do work on the Dam, then he was not sure his office could do anything. Mr. Crosen asked why the injunction would not work. Mr. Ambrogi stated that due to the fire, the cause is no longer there. Mr. Crosen asked what if the County could get the evi- dence. Mr. Ambrogi replied that it would have to be solely for storage, that is the only way the County could do anything. 361 The question of where these tires could be stored was dis- cussed by the Board and the staff with no recommendation. Mr. Ambrogi explained that there are many areas that need to be addressed. Mr. Crosen asked if all of this could be accepted as history at this point and proceed from there. It was the consensus of the Board that the area dealing with storage and burning of tires be sent to the Code and Ordinance Committee and the recycling and shredding of tires would be forwarded to the Public Works Committee. Upon motion made by Roger L. Crosen, seconded by Dudley H. Rinker and passed unanimously, the above was approved. CASE EDWARDS TO RESUBMIT THEIR NEW BUILDING PLAN Mr. Riley stated that he had been contacted by Case Edwards and they now plan to build ninety single family detached units and their question to the Board is do they have to go through the process from the beginning. Mr. Rinker stated that he felt they should follow the pro- cess and wait. UPON MOTION DULY MADE, SECONDED AND PASSED UNANIMOUSLY, IT WA ORDERED THAT THE BOARD OF SUPERVISORS ADJOURN. r.
