A Regular Meeting of the Frederick County Board of Super-
visors was held on March 14, 1990, at 7:15 P.M., in the Board of
Supervisor's Meeting Room, Frederick County Courthouse, Loudoun
Street Mall, Winchester, Virginia.
PRESENT Kenneth Y. Stiles, Chairman; Robert M. Rhodes,
Vice - Chairman; Dudley H. Rinker; Roger L. Crosen and Charles W.
Orndoff, Sr. Mr. Stiles was not present at the beginning of the
meeting. W. Harrington Smith, Jr. was absent.
CALL TO ORDER
Mr. Rhodes, Vice - Chairman, called the meeting to order.
INVOCATION
The invocation was delivered by the Reverend Paul Phillips
of the Burnt Factory United Methodist Church.
ADOPTION OF AGENDA
Mr. Riley requested the following amendments to the Agenda:
1. Resolution honoring Mr. Alfred L. Snapp, Sr. by the
Electoral Board.
2. Request for amendment to County's Personnel policies.
3. Approval of architectural firm for County Office
Building.
Upon motion made by Roger L. Crosen, seconded by Dudley H.
Rinker and passed unanimously, the Agenda was adopted as amend-
ed.
CONSENT AGENDA
There were no items for the Consent Agenda.
APPROVAL OF MINUTES
Mr. Crosen stated that in the minutes of January 10, 1990,
Page 10, under number 3, to take out the last sentence.
Upon motion made by Dudley H. Rinker, seconded by Roger L.
Crosen and passed unanimously, the minutes of the Regular Meet-
ing of January 10, 1990 were approved as amended.
Mr. Crosen stated that in the minutes of January 24, 1990,
Page 4, second paragraph, the sentence should read "....to send
student enrollment projections out to Board members as soon as
possible ". He stated that in the fourth paragraph, to take out
the words "certain legislature ".

Upon motion made by Roger L. Crosen, seconded by Dudley H.
Rinker and passed unanimously, the minutes of the Regular Meet-
ing of January 24, 1990 were approved as amended.

APPOINTMENT TO NORTHWESTERN VIRGINIA HEALTH
IL -
JOHN E. VENSKOSKE REAPPOINTED TO THE HISTORIC RESOURCES
BOARD
Upon motion made by Roger L. Crosen, seconded by Dudley H.
Rinker and passed unanimously, John E. Venskoske was reappointed
to serve on the Historic Resources Board, said term to commence
April 12, 1990 and expire April 12, 1991.
D RESOLUTION BY ELECTORAL BOARD
'RED LEE SNAPP, SR.
Mr. Riley read the following resolution:
WHEREAS, Alfred Lee Snapp, Sr. served as a member of
the Electoral Board of the County of Frederick from March, 1968
to February, 1980; and
WHEREAS, he also served on various State and County
agriculturally related Boards and Committees; and
WHEREAS, he contributed his time and energies to local
civic and community organizations; and
WHEREAS, his dedication and performance on behalf of
Frederick County brought honor to himself and to Frederick
County.
NOW, THEREFORE, BE IT RESOLVED, that the Electoral
Board of the County of Frederick does hereby express its sincere
appreciation to Alfred Lee Snapp, Sr. for his unselfish and out
standing service to Frederick County.
BE IT FURTHER RESOLVED, that a true copy of this resolu-
tion be delivered to the family of Alfred Lee Snapp, Sr..
RESOLVED this 6th day of March, 1990.

REQUEST TO ADVERTISE FOR SALE CERTAIN LOTS IN SHAWNEE-
LAND - APPROVED
Upon motion made by Robert M. Rhodes, seconded by Dudley H.
Rinker and passed unanimously, the request to advertise "For
Sale" certain lots in Shawneeland was approved as presented.

CHRISTIAN CENTER ASSEMBLY OF GOD - APPROVED

Reverend Malcolm Van de Riet appeared before the Board on
behalf of this request.
Upon motion made by Dudley H. Rinker, seconded by Roger L.
Crosen and passed unanimously, the request for an outdoor
festival permit of Abundant Life Christian Center Assembly of
God was approved with the understanding that the services are
concluded by 10:00 P.M.
PUBLIC HEARING
AN ORDINANCE TO AMEND THE FREDERICK COUNTY CODE, CHAPTER
9, FINANCE AND TAXATION AND CHAPTER 11, GARBAGE, REFUSE
Mr. Stephen F. Owen, Assistant County Administrator, pre-
sented this ordinance amendment.
There was no public input.
Upon motion made by Charles W. Orndoff, Sr., seconded by
Robert M. Rhodes and passed unanimously, the following ordinance
amendment was approved:
BE IT ORDAINED, that Chapter 9; Article I, Section 1 -7
and Chapter 11; Article III; Section 3 -5 -20.1 are hereby adopted
as follows:

DELINQUENT LANDFILL ACCOUNTS

PLANNING COMMISSION BUSINESS
PUBLIC HEARING
REZONING APPLICATION #001 -90 OF JAMES H. CARROLL -
SHAWNEE MAGISTERIAL DISTRICT - DENIED
Mr. Watkins, Director of Planning and Development, present-
ed this rezoning application request and stated that the Plan-
ning Commission recommended denial.
Mr. Robert Mitchell, local Attorney, appeared before the
Board on behalf of the Petitioner.

Mr. Chuck Maddox, of G. W. Clifford Associates, appeared
before the Board and presented slides showing what was proposed
for this area.
The Board discussed at length proffers and all the various
uses this land could be used for under the requested rezoning.
Mr. Dick Martin, area resident, appeared before the Board
on behalf of some of the area residents to oppose this request
as they did not feel this was the area for any type of business.
Mr. Jim Gibbons, area resident, also opposed this request.
Upon motion made by Roger L. Crosen and seconded by Dudley
H. Rinker, to deny rezoning application number 001 -90 of James
H. Carroll, c/o Robert T. Mitchell, Jr., Esq., P. 0. Box 848,
Winchester, Virginia, to rezone 2.8132 acres from RP (Residen-
tial Performance) to B -2 (Business General). This property is
located North and adjacent to State Route 781 and Old Route 50,
approximately .75 miles East of the City of Winchester and iden-
tified as Parcel 20 -A on Tax Map 64A M in the Shawnee Magister-
ial District.

plan of Georgetown Court was approved.
PRELIMINARY MASTER DEVELOPMENT PLAN - GREENBRI
NORTH -- APPROVED
Mr. Watkins presented this request and stated that the Plan-
ning Commission recommended approval.
Mr. Maddox appeared before the Board and presented slides
of what was proposed for this project.
Mr. B. J. Tisinger, Attorney, addressed the Board on behalf
of the Petitioner.
Mr. Rinker stated that he was concerned about access and
noted that he would like to see one main entrance.
There was no opposition to this request.

MEMORANDUM RE: SCHEDULING OF PUBLIC HEARING DATE FOR
REZONING APPLICATION
It was the consensus of the Board to hold the public hear-
ing for the rezoning request of Richard A. Graber /Creekside
Village on April 11, 1990.
COMMITTEE REPORTS
PUBLIC WORKS COMMITTEE REPORT
Mr. Orndoff, Chairman of the Public Works Committee, pre-
sented the following report:
The Public Works Committee met on Tuesday, March 6, 1990,
at 7:30 A.M. Present were Board member Charles W. Orndoff, Sr.;
Committee members Keith A. Tubandt and Chester A. Renner; County
Administrator John R. Riley, Jr.; Assistant County Administrator
Stephen F. Owen; and Shawneeland Manager Billy G. Jones.
The following items were discussed:
Items Requiring Action
Shawneeland Lodge - Approved
A request from the Shawneeland Sanitary District Advisory
Committee to hire a professional engineer to evaluate the struc-
tural soundness of the lodge was discussed. A local engineering
firm can provide this work for $300. The Committee recommends
approval, with the cost to be paid out of Sanitary District fees
(see Attachment 1).
Upon motion made by Charles W. Orndoff, Sr., seconded by
Robert M. Rhodes and passed unanimously, the above recommenda-
tion was approved.

Insurance on Tiller Fire Truck - Denied
The tiller truck recently donated to Greenwood Fire Company
by Fairfax County is costing Greenwood $80 per month for vandal-
ism /storage insurance. Greenwood has requested that the County
temporarily pay this insurance until a decision on refurbishing
the truck can be made. The Committee recommends approval, pro-
vided that the truck can be added to the County's policy at no
additional cost.
This request was denied as the truck could not be added to
the County's insurance at no additional cost.
Architectural Proposals for New County Office Building -
Architectural Firm Hired and Appraisal of Existing Count
Office Building - Approved
The Committee scheduled presentations and interviews with
the top three ranked architectural firms for Monday, March 12,
1990. The Committee hopes to be able to recommend a firm by
Wednesday's Board meeting.
Upon motion made by Charles W. Orndoff, Sr. and seconded by
Dudley H. Rinker, to hire The Mosley Group as the Architectural
firm to design the New County Office Building and to hire an
appraisal firm, not to exceed $40,000, to give an appraisal of
the County Office Buidling downtown.
The above motion was passed by the following recorded vote:

Charles W. Orndoff, Sr. Nay - Roger L. Crosen.
Mr. Crosen stated that he did not feel the appraisal was
necessary.
Items For Information Only
Recycling Proposals
The Committee reviewed recycling proposals submitted by six
different vendors and directed Steve Owen to proceed with one
year pilot program contracts with as many firms as necessary to
cover the County. Costs for this program will be paid for out
of the Landfill Fund.

Mr. Rhodes, Chairman of the Personnel Committee, presented
the following report:
The Personnel Committee met on Wednesday, March 7, 1990
with all members present and submits the following report to the
Board of Supervisors for consideration.
Special Benefits (LEOS) for Law Enforcement Officers - No
Action Taken
The Committee reviewed the attached information regarding
LEOS coverage for law enforcement personnel and tabled same for
review at a later date. (See Attachment)

request from the Regional Jail Administrator for a salary
increase for the Administrative Staff Specialist and recommends
approval of same contingent upon approval by the Clarke -

Mr. Rhodes, Chairman of the Finance Committee, presented
the following report:
The Finance Committee met on March 7, 1990 in the
Conference Room of the County Courthouse. All members were
present.
The following items require Board action:
Request from the Planning Director for a General Fund
Supplemental Appropriation Transfer from Contin enc
in the Am ount of $30,000.00 - Approved
The Planning Director requests a General Fund Supplemental
Appropriation Transfer from Contingency of $30,000.00 for
Profession Services. Fees from the applicants in excess of
$30,000 have been collected to date. See attached memo. The
Committee recommends approval.

Request from the Parks and Recreation Director for a
General Fund Supplemental A ro riation in the Amount
of $2,000.00 - Approved
The Director of Parks and Recreation requests a General
Fund Supplemental Appropriation of $2,000.00 for the Spring
Fever Biathlon. No additional local funds are needed. See
attached memo. The Committee recommends approval.

The Commissioner of the Revenue requests a refund of
$42,500.01 to a local industry for a personal property
assessment error. See attached memo. The Committee recommends
approval.

Request from the Sanitary District Manager for a Sanitar
District Fund Transfer in the Amount of 8,898.50 -
Approved
The Sanitary District Manager requests a Sanitary District
Fund transfer of $8,898.50 for construction equipment and
related costs. See attached memo. The Committee recommends
approval.

Upon motion made by Robert M. Rhodes, seconded by Dudley H.
Rinker and passed unanimously, the above recommendation was
approved.
The following are for your information only.
1. See attached information from the Assistant County
Administrator regarding Cable TV. The Committee recommends this
issue be pursued.
2. See attached information from the Chairman of CLEAN
regarding additional money needed for the First Step Program.
He has applied for a grant to cover these expenses. No action
is required by the County at this time.
3. A house trailer near the dog pound is for sale for
$5,000. The Committee recommends the trailer be appraised
before a decision is made.
4. See attached information from The Chamber of Commerce
regarding advertising rates in the Chamber's promotional
magazine.
5. See attached information from Dennis J. McLoughlin
regarding the Handley Library's Slurpee program.
6. At the February 1990 Finance Committee meeting HALOAS
requested reimbursement of legal fees. This request was
forwarded to the Commonwealth's Attorney. See attached memo
documenting his comments on the matter.
AMENDMENT TO THE COUNTY PERSONNEL POLICIES - APPROVED
Upon motion made by Robert M. Rhodes, seconded by Roger L.
Crosen and passed unanimously, the following amendment to the
Personnel Policies was approved:
Section XI Disciplinary Policy, Subsection 11.8,
Unsatisfactory Work Performance or Misconduct
q. Refusal to cooperate in any internal or criminal
investigation conducted by any law enforcement
agency including, but not limited to, taking a
polygraph examination when directed by his /her
immediate supervisor. This provision shall not
require any employee to surrender any guaranteed
constitutional rights.
