A Special Meeting of the Frederick County Board of Super-
visors was held on August 27, 1990, 12:00 Noon, in the Board of
Supervisors' Meeting Room, Frederick County Courthouse, Loudoun
Street Mall, Winchester, Virginia.
PRESENT Kenneth Y. Stiles, Chairman; Roger L. Crosen; W.
Harrington Smith, Jr. and Charles W. Orndoff, Sr. ABSENT
Dudley H. Rinker and Robert M. Rhodes.
CALL TO ORDER
The Chairman called the meeting to order.
ADOPTION OF AGENDA
Mr. Riley, County Administrator, stated that he had a
request from the Sanitation Authority for a public hearing.
Upon motion made by Roger L. Crosen, seconded by W.
Harrington Smith, Jr. and passed unanimously, the Agenda was
adopted as amended.
VPSA RESOLUTION RATIFYING CERTAIN TERMS OF GENERAL
OBLIGATION SCHOOL BONDS - APPROVED
Upon motion made by W. Harrington Smith, Jr., seconded by
Roger L. Crosen and passed unanimously, the following resolution
was approved:
WHEREAS, this Board a resolution on June 25, 1990
( "Resolution "), authorizing the issuance and sale of not to
exceed $2,500,000 General Obligation School Bonds, Series 1990,
of the County of Frederick, Virginia, ( "Bonds ") setting forth
the form and details thereof and directing the County Admini-
strator to accept the maturities, interest rates and aggregate
principal amount of the Bonds established by the Virginia Public
School Authority;
NOW, THEREFORE, BE IT RESOLVED:
1. The maturities, interest rates and aggregate
principal amount of the Bonds established by the County Admini-
strator in the attached Certificate as to Interest Rates are
hereby approved and ratified.
2. Notwithstanding anything in the Resolution to the
contrary, the Bonds shall mature on July 15 in the year shown in
the attached Certificate as to Interest Rates and shall bear
interest payable on January 15 and July 15, beginning January
15, 1991. In addition, the prepayment provisions set forth in
paragraph 7 of the resolution shall be amended to conform to the
July 15 maturity dates.

Upon motion made by Roger L. Crosen, seconded by W.
Harrington Smith, Jr. and passed unanimously, Ned M. Cleland was
appointed to serve as a County representative on the Frederick -
Winchester Service Authority, to fill the unexpired term of
Lloyd A. "Steve" Putnam, said term to expire August 26, 1992.
C. ROBERT SOLENBERGER REAPPOINTED TO THE FREDERICR-
WINCHESTER SERVICE AUTHORITY
Upon motion made by W. Harrington Smith, Jr., seconded by
Charles W. Orndoff, Sr. and passed unanimously, C. Robert
Solenberger was reappointed as a County representative on the
Frederick - Winchester Service Authority for a three year term,
said term to expire August 31, 1993.
ROAD RESOLUTIONS - FREDERICRTOWNE. SECTION III AND
BROORLAND HEIGHTS - APPROVED
Mr. Wayne Miller, Zoning Administrator, presented the
following road resolutions:
BE IT RESOLVED, that the Virginia Department of Transporta-
tion is hereby requested to add the following roads to the
Secondary System of Frederick County, pursuant to Section
33.1 -299 of the Code of Virginia, 1950, as amended:
Essex Court (60 Fredericktowne, Section III
From: Intersection with Route 1055
To: 245.00' or 0.05 mile North (cul -de -sac)
Length: 245.00' or 0.05 mile and as described in Deed
Book 443, Page 303 dated April 29, 1975.
BE IT FURTHER RESOLVED, that the Board does guarantee the
Commonwealth of Virginia an unrestricted right -of -way of 60 feet
as described in the above Deed Book and page number with neces-
sary easements for cuts, fills and drainage.
Upon motion made by W. Harrington Smith, Jr., seconded by
Charles W. Orndoff, Sr. and passed unanimously, the following
resolution was approved:
BE IT RESOLVED, that the Virginia Department of Transporta-
tion is hereby requested to add the following roads to the
secondary system of Frederick County, pursuant to Section
33.1 -229 of the Code of Virginia, 1950, as amended:
Hunter Run Road (50 Sections I, II and III
From: Intersection with Route 659
To: 1170 feet or 0.22 mile South to Dead End
Length: 1170 feet or 0.22 mile and as described in Deed
Book 688, Page 305, dated July 29, 1988.
Little River Drive (60 Sections II and III
From: Intersection with Hunter Run Road
To: 739.47 feet or 0.14 mile West to Dead End
Length: 739.47 feet or 0.14 mile and as described in
Deed Book 688, Page 310, dated July 29, 1988.
AND BE IT FURTHER RESOLVED, that the Board does guarantee
the Commonwealth of Virginia an unrestricted right -of -way of 50

STORMWATER RETENTION FACILITY AGREEKENT - TABLED
This was tabled as the Board felt they needed more time to
review this.
RESOLUTION FROM THE VIRGINIA COOPERATIVE EXTENSION SERVICE
REQUESTING DISASTROUS STATUS FOR PEACH AND APPLE CROPS -
APPROVED
Upon motion made by Charles W. Orndoff, Sr., seconded by
Roger L. Crosen and passed unanimously, the following resolution
was approved:
WHEREAS, Frederick County, Virginia is Virginia's largest
commercial fruit producing County with 9,500 acres of apple,
peach, nectarine, pear, apricot and plum orchards providing an
annual income of approximately $20,000,000; and
WHEREAS, during the months of January, 1990 and February,
1990 abnormally warm weather initiated tree growth; and
WHEREAS, this period was followed by severe cold tempera-
tures and freezing conditions on March 27 and 28, 1990, followed
by several additional nights with temperatures significantly
below freezing resulting in a 50% loss to the apple crop, with
heaviest damage done to the three varieties that represent the
largest percentage of the apple crop and those varieties that
generate the greatest revenue, those being Red Delicious (80%
loss), York (60% loss) and Stayman (40% loss); and
WHEREAS, the freeze also resulted in a 95% loss to the
County's peach crop and 100% loss of nectarines, pears, plums
and apricots; and
WHEREAS, approximately 95 producers depend on the fruit
crop as a substantial portion of their income and the monetary
loss inflicted upon them severely limits their capabilities to
administer viable agricultural enterprises.
NOW, THEREFORE, BE IT RESOLVED, that the Frederick County
Board of Supervisors formally request the Governor of the
Commonwealth of Virginia to officially declare the 1990 fruit
crop in Frederick County, Virginia a disaster and request the
Federal Government to make available financial assistance to the
affected producers.
REQUEST FROM THE FREDERICK COUNTY SANITATION AUTHORITY FOR
PUBLIC HEARING TO REPEAL THE FREDERICK COUNTY CODE, CHAPTER
20, WATER AND SEWERS: TO REPEAL ARTICLES III AND IV AND TO
READOPT ARTICLE III. WASTEWATER DISCHARGE - APPROVED
Mr. Riley presented this request.
Upon motion made by W. Harrington Smith, Jr., seconded by
Roger L. Crosen and passed unanimously, to advertise for public
hearing in order to repeal Articles III and IV and to readopt
Article III, Wastewater Discharge, of Chapter 20, Water and
Sewers, of the Frederick County Code.
UPON NOTION DULY MADE, SECONDED AND PASSED UNANIMOUSLY, IT
WAS ORDERED THAT THE BOARD OF SUPERVISORS ADJOURN.
