PROVIDING FOR THE LEASING AND INSTALLATION OF PARKING METERS BE IT RESOLVED,, THAT THE PROPER OFFICERS OF THE County of Frederick State of Virginia are hereby authorized and directed to enter into a contract with DUNCAN METER CORPORATION, through their Distributor, t he KOONTZ EQUIPMENT CORP., for the leasing and installation of 50 more or less MILLER MULTIPLE -COIN PARKING METERS on a 9 month trial lease basis, Rental payments on said meters to be provided for solely from the receipts, funds and revenues obtained by the County from the operation of said Parking Meters, without in any manner obligating.the County to pay for same from any other source. Said rental payments to be 50% of the receipts received from the operation of the meters. The Ordinance on Parking Meters that are to be placed on the Court House I Square, passed its first and second reading. It is ordered that a notice of said passage be published in the Winchester Evening Star. I SCHOOL CONSTRUCTION At a Meetinr of the of Supervisors for the County of Frederick held in said - .County - 16n. - the 9th 4ay.of July:, Whereas, The School Board for the County of Frederick, on the 9th day of July, 1951, presented to this Board an application addressed to the State Board of Education of Virginia for the purpose of securing State School Construction Funds in the amount of $6 for the new school building (or for adding to or improving the present school building) at Gore, Virginia. Resolved, that the application of the County School Board to the State Board of Education of Virginia for $6000.00 from the School Construction Fund is hereby i approved. The Board of Supervisors for said County has, or will provide sufficient funds through cash appropriations and /or levy, to complete this project. If the School Board J! has sufficient funds dn_hand;to,complete the project, permi"ssiow is hereby granted for the use of said funds, for the purpose designated in the application. Brumback and seconded by Grover Teets the I Welfare Budget estimates for the Denartment of Public Welfare for this County as tentatively adopted by the Board of Supervisors as required by chapter I40 of the 1950 acts of Assembly.l9JI" i SCHOOL BOARD APPROPRIATION ` Upon motion duly seconded it is ordered that the Treasurer transfer $76,559.I8 from the General County Fund to the School Fund as the money becomes available. SCHOOL FUND Upon motion duly seconded it is ordered that the School Fund and School Building Fund, shall receive during the current year the full amount of the School Levy. This will be accomplished by paying from the General County Fund to the School Fund the amount of the School Levy and placing the total tax income to the credit of the General Fund and the County Treasurer is ordered to transfer these funds as the money becomes available. GARBAGE DUMP S Whereas the County of Frederick desire to purchase a certain tract of land from Philip Williams and Mary Williams, his wife and Andrew Whales and the said parties agree to sell to the Frederick County Board of Supervisors said tract of land. Said tract lying and being situate in Shawnee Magisterial District in Frederick County Virginia and on I the South side of the Sulphur Springs Road and was particularly described by a survey and Plat i attached and made a part of a Deed made and executed by Philip Williams and Vary Williams an Andrew Whales to the Frederick County Board of Supervisors and recorded on this day in the Frederick County Clerk's Office in Deed Book Number 220 at page - Now, therefore be it Resolved that the County of Frederick purchase the above parcel of land and upon motion of Ellsworth Dodson and seconded by C. E. Garber the 21 resolution-was unanimously passed. PURCHASE OF LAND FROM PHILIP WILLIAMS AIID ANDREW WHALES Upon motion duly seconded, it is ordered that the Treasurer of Frederick County pay to Philip Williams the sum of Two Hundred and Fifty Dollars and to Andrew Uhales the sum of -Three Hundred and Twenty Dollars in payment for the land purchased from them for a public Garbage Dump as described. Upon motion duly seconded this Board gives the State Highway partment of Virginia permission to use the Frederick County Garbage Dump for Dumping e. Upon motion duly seconded the following resolution was adopted: it resolved, that it is the opinion of this Board that since the Highway Department has een given permission to dump refuse on the Frederick County Garbage Dumping grounds ocated approximately two miles east of Winchester off route 655, that they should maintain he road from route 655 to the dump a distance of approximately 1000 feet. This request is Bing made, since the County has no road equipment to take care of work of this nature. Upon motion duly seconded it is ordered that the sum of Fifteen undred Dollars be paid by the Treasurer of Fredericl County to the Gore Five Company, Gore, Virginia. 22 i DRINKING FOUNTAIN Upon motion duly seconded it is ordered that a Kelvinator Electric Water Cooler be purchased as per the bid of 0. ( ,Chairman September 26, I951 Special fleeting of the Board of Supervisors called for the purpose of final action in preparation for operation of Parking Meters on the County Court House Plaza.; Present: Chairman, L. Massie, Jr. The Board considered the Ordinance for Parking Meters on the County Court House Plaza and on motion by Ellsworth Dodson and seconded by C. E. Garber the Board approved the final wording of the Ordinance and directed that the procedure for public hearing and due publication thereof be commenced. Motion was duly passed. Resolution: Upon motion made by Ellsworth Dodson and seconded by C. E. Garber the following Resolution was duly presented to the Board of Supervisors of Frederick County, Virginia: Be it Resolved that the Board of Supervisors employ a male citizen i over the age of Twenty -one years to be known as Superintendent of the County Court House Plaza, whose duties are as follows: To le printed appropriate summonses to be issued by him to persons violating the Ordinance for regulating the parking on the County Court House Plaza; to collect j all funds deposited in the Parking Peter boxes; to collect all payments hereinafter provided for after the issuing of summonses when said funds are paid in lieu of court fines and court costs; to pay all funds and collections to the Treasurer of Frederick County, Virginia between the hours of 9:00 A. L. and 5:00 P. Y. each day, and keep records of all funds collected from Meters and violations for the Ordinance; to report to the Board of Supervisors his activities and collections at each monthly meeting. The Superintendent of the County Court House Plaza must be bonded in the sum of Two Thousand Lollars ($2.,000.00) If a summons for violation is not paid to the Office of the County Court House Superintendent within 24 hours from the date of the violation and said non - payment for said violation continues for a period of 30 days from the date thereof, the said Superintendent is to obtain a warrant from the Trial Justice Office of Frederick County,Virginia for the violation of the said Ordinance and proceed with the trial of the said offender. Any violater of aforesaid " A 23 Ordinance upon receiving a summons may pay to the County Court House Superintendent in his Office the sum of One Dollar ($I.00) in lieu of court trial for said violation within the time previously set forth. All summonses to be placed between the windshield wiper and windshield of all moter vehicles. If impractical to so place said summons, then said summons is to be placed in a conspicuous location�n the drivers seat of any vehicle. The said motion was duly passed. AN ORDINANCE PROVIDING FOR THE LEASING AND INSTALLATION OF PARKING I.LTERS: PROVIDING FOR AND REGULATING THE PARKING ON THE PIdZA OF THE COUNTY COURT HOUSE: AUTHORIZING THE USE OF PARKING PETERS THEREFOR: AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF1 Be it ordained and enacted by the Board of Supervisors of the County of Frederick, State of Virginia, and it is hereby ordained and enacted by the authority of the same: SECTION I: The Chairman of the Board of Supervisors, the Clerk of the Board of Supervisors and the Commonwealth Attorney of the County of Frederick are hereby authorized and directed to enter into a contract for the leasing and installation of Parking Meters, said contract to be made subject to the conditions and in the manner provided by law, h the payment of such meters and the installation thereof to be provided for solely from the operation of said Parking Meters, without in any manner obligating the County of Frederick to pay for same from any other source. SECTION 2: After the installation of said Parking Meters, it shall be unlawful for the owner or operator -of alny motor vehicle or other vehicle to park said vehicle upon the County Court House Plaza between the Hours of 9:00 A. M. and 5:00 P. M. on any day except Sundays unless he has deposited poins in the said Parking Meters and the marker on said i Meter does not show that the said vehicle is parked in violation of the period of time paid for by the owner or driver of said vehicle;1it shall likewise be unlawful to park on the County Court House Plaza on Saturdays between the hoiurs of 9:00 A. M. and 9:00 P. L. any motor vehicle or other vehicle without depositing coins in the said Parking Yeter, and if the Meter shows that there is a violation; this ordinance will not be observed on the following Holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas: parking time may be purchased for not more than two hours at any one time upon the same position on the County Court House Plaza. SECTION 3: On streets so designated, the proper Officer shall mark parking spaces on the curb or pavements;, or by other appropriate means and, in each space so I I marked, shall erect or cause to be erected a parking meter which, upon the deposit of a coin or combination of coins of the United States, will indicate to the party parking his car the period of time which the coin or combination of coins establishes as his legal parking period and the i time when such period has elapsed. PARKING METER ORDINANCE According to an advertisement published in the Viinchester Evening Star I on Sept. 28, I951 and October 5, 1951 for a Public hearing of taxpayers to express their views for and against the installation and operation of Parking Yeters. I There being no taxpayers appearing the following ordinance passed its third and final reading and upon motion by C: E. Garber and seconded by Byron Brumback was unanimously • I adopted. I 25 SECTION 4: In order that the Police Officers may properly compute the time during which a vehicle is parked, the owner or operation of said vehicle shall , upon entering such parking space during the time of limited parking, immediately deposit a coin or combination of coins of the United States in the Parking Yeter situated at the side of said parking space, and operate same according to instructions thereon. Failure to do so shall constitute a violation of this Ordinance. Upon the deposit of such One -cent or five -cent coin and placing the meter in operation^y the parking space may be lawfully occupied by such vehicle during the period of parking time which has been prescribed for the particular amount deposited. The parking meters, when installed and properly operated, shall be so adjusted that one -cent coins and five -cent coins may be deposited at any time throughout the two -hour range of the meters, each one -cent coin permitting the vehicle to be parked for a period of twelve minutes and each five -cent coin permitting the vehicle to be parked for a period of sixty minutes. If such vehicle shall remain parked in any such parking space for such length of time that the meter shall indicate by a proper signal that the lawful parking period has expired, such vehicle shall be considered as parking over -time, and'the parking of a vehicle over -time shall e a violation of this Ordinance. SECTION 5: It shall be unlawful to park any vehicle across any line or ing which designates a parking space, or to park said vehicle in any way that the same shall be wholly within a parking space as designated by said lines or markings. SECTION 6: It shall be unlawful to deposit, or cause to be deposited in any parking meter, a slug, device or metallic substitute for a coin of the United States. SECTION 7: It shall be unlawful for any person to deface, tamper with, damage, open or wilfully break, destroy or impair the usefulness of any parking meter installed under the terms of this.Ordinance. SECTION 8: Any person, firm or corporation violating the provisions of this Ordinance, or aiding, abetting or assisting in the violation of said provisions, shall, upon :onviction before the proper officials of the County of Frederick, be sentenced to nay a fine not less than One Dollar ($I.00) and not more than Fifty Dollars ($50.00) and costs of osecution for each offense, or imprisonment for not more than five days. SECTION 9: If any section, provision or part of this Ordinance shall be judged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall t affect the validity of the Ordinance as a whole, or of any section, provision or part hereof, not adjudged invalid or unconstitutional.
