Mr. T. B. Rosenberger, appeared before the Board and requested the
Board to appropriate money in the 1951 and 1952 Budget for the purchase of a truck to be used for
fire control.

HOSPITAL
Mr. Alberti, Superintendent of Winchester Memorial Hospital and
deligation_appeared before the Board and requested that the Board donate $15000.00 each'fis.caj'Y.edr
for the next three (3) years a total of $45,000.00 to the Hospital Building Fund. No action was

HEALTH UNIT
Dr. Alvin Lindell, who succeeded Dr. Chapman as the Superintendent
of the Frederick County and Winchester Health Unit appeared before the Board and gave outline of
his duties and plans.
APPLE BLOSSOM FI ;STIVAL
Upon request of J. Pinkney Arthur,'of the Anple.Blossom Committee,
that they be given permission to use the Plaza for amusements for Wednesday through Thursday
(May 2, through Saturday morning, May 5)
and Friday! all to be removed by early Saturday Morning.
Upon motion it was unanimously decided to grant the requested
permission, subject, however, to the following restrictions: that no bricks be damaged, no stakes
be driven, no exposed wires to be used and further not to be used for living quarters and also tol

Upon motion, duly seconded the ordinance, which was certified on
the 17th day of February, 1951, to the Board of Supervisors by the Planning Board of Frederick
County, Virginia, providing for the Zoning of Route Eleven between Red Bud Road North to the Old
Charlestown Road, passed its first and second reading and it is ordered that the Public Hearing
be held at 10:00 A. ii. in the Supervisor's Room in the Frederick County Office Building, on the
8th day of Lurch, 1951, for the third reading and final consideration thereof.

The purpose of this meeting, which wa's advertised in the Winchester
Evening Star, was to hear citizens of Frederick County state their views for or against the
Zoning Ordinance as certified to the Board of Supervisors by the Planning Board on the 17th day
of February, 1951 for the third reading and final consideration thereof.
Upon motion of Grover Teets and seconded by B. 0. Brumback, the 'Zoning

Lot, and having a width of Four Hundred Feet (400) Eastward and Westward from the Eastern and
Western boundaries of the right of way of U. S. Highway #11.
The said area shall be declared residential area and the properties
therein shall not be used, owned, leased or occupied for any purposes except the following, then)
only upon the following reservations and restrictions and subject to the conditions of confirmation
hereafter set forth:
a. Single, detached dwelling.
b. Church or place of worship.
c. Public parks or playgrounds.
d. Hospital.
e. School, public or private.
f. Private garage for use with the dwelling.
g. Agricultural pursuits.
h. Accessory buildings and uses incident to any of the above
uses which are located in the same lot and not involved in any conduct of retail business, wholesale

business, manufacturing or processing business.
The following are uses in conformance with the above descriptions
1. Real estate signs advertising the sale, rental or lease of
only the premises on which they are maintained, not over 8 square feet in area.
2. The usual accessory of a residence located on the same lot

with that residence not involving the conduct of a business, but including an office of a physician,
surgeon, dentist, artist, musician, lawyer, architect, teacher, real estate broker, or other pro,
fessional persons residing on the premises, provided there is no display visible from the street)
or advertising except a small professional name plate, not to exceed 144 square inches in area.
3. Customary home occupations, such as millinery or dress making,
provided there is no display of goods visible from the street and no exterior advertisement j
except for a small annoDuncement sign, not to exceed 144 square inches in area, attached flat to
the wall of the building;'provided that such occupation shall be carried on by a person only
within the dwelling used as his private residence; and further provided that such occupation does
not occupy more than one -third of the area of the residence and shall not be carried on in an i
accessory building.
4. The renting of rooms or the furnishing of table board in a
dwelling occupied as a private residence, providing there is no display visible from the street it
sign boards attached to advertise such use, except for one small announcement sign, not to exceed
720 square inches in area and attached flat to the wall of such dwelling.

5. Any use existing on April 1 1951 may be continued on the same
premises including the erection of additional buildings thereon even though such use does not
conform with the provisions of this ordinance. However, in the event such non - conforming use is
discontinued for a period of Six (6) consecutive months, then such non - conforming use shall ter -I
minate and revert to the conforming use of this area, except for seasonal industrial pursuits
already in existence at the time of the passing of this ordinance such as canning plants, packing
houses for fruit and similar uses.
6. Any non - conforming structure destroying as much as 80% of the
appraisal value shall not be replaced. No storage tank, pump, machinery or filling station for
the delivery of gasoline or other fuel to motor vehicles for commercial, whole -sale or retail
purposes shall be erected, installed or operated upon the streets or sidewalks or in or upon any
property located within the area hereby described and zoned.

7. There shall be no outdoor advertising of any commercial or industrial

business or enterprise or of any of the products thereof, except for businesses already exempted
and in operation in this zone at the time of the passage hereof.
8. The minimum size of the residence to be constructed and erected from the j
date of the passage of this ordinance shall be 800 square feet in foundation area and shall cost
not less than Six Thousand Dollars ($6,000.00), exclusive of value of real estate upon which it
is located.
9. No building of any nature whatsoever shall be constructed, erected or

maintained from the date of the passage of this ordinance within Fifty (50) feet of the Eastern
boundary of U. S. Highway #11 or within Fifty (50) feet of the Western boundary of U. S., Highway
#11 or within.Fifty (50) feet of the Northern boundary of the right of way of Virginia State
Highway #661 or the Southern boundary of Virginia State Highway #274, or any other public roads
or streets in this area.
10. No dwelling within this area shall consist of any type of trailers, semi-
trailers, motor vehicles or other temporary shelter, nor shall there be permitted in this area any
motor court, auto court or other tourist accommodations; this does not effect persons renting
rooms in their dwelling to permanent or semi - permanent residents or overnight lodgers in private
dwellings as hereinabove provided.
11. No peddling, soliciting or other type of portable commercial selling shall
be permitted.in this area, except that which may be controlled by the School Board of Frederick
County, Virginia and the School Officials of the Stonewall Public School, and persons living in
this area raising their own produce.
12. All building permits of this area as previously provided for by an ordinanoe
of the Board of Supervisors of Frederick County shall be subject to the approval or disapproval of
the Planning Commission of Frederick.County, Virginia and will not be issued by the Commissioner of
Revenue of Frederick County until the same has been approved by-the Planning Commission and the
Board of Supervisors.
13. The Planning Commission and the Board of Supervisors reserve the right to
reconsider any or all parts of this ordinance at any time in the future and to make changes `therein
according to the statutes of Virginia, and this area shall be designated as Gone B.
14. Every person convicted of a violation of any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and each day that such violation exists,., will be
deemed to be a separate offense and for each violation thereof the maximum penalty shall be a fine
of Three Hundred Dollars ($300.00) or 30 days in jail.
15. If any part or parts of this ordinance is judicially declared to be il-
legal or void the remaining part or parts shall continue to remain in full force and effect.
Upon motion duly made by Grover Teets and seconded J. R. Cooper and unanimously
passed by the Planning Commission of Frederick County, Virginia, according to the statutes of
Virginia, and after public hearings thereon,, as part of a larger plan to be adopted by Frederick
County, Virginia, the above ordinance for Area B is hereby certified to the Board of Supervisors
of Frederick County, Virginia for their action.

PETITION - ZOINING LANDS NEHR JAMES WOOD HIGH SCHOOL
Herbert,S. Larrick, Attorney, presented to the Board a petition
signed by a mumber of citizens requesting the Board to reconsider that part of said Zoining
Ordinance which prohibits Miss Theis from leasing her said store,roox for business purposes and
that she be permitted to lease said Store room for business purposes.
ZOIN ING ORDINANCE
Upon motion made by Grover Teets and seconded - by
C. E. Garber the following resolution was unanimously passed by the Board and is as
follows:
Whereas, Miss Mary Theis owns a certain storeroom in zoned
Area "A" of Frederick County, and according to the terms of said ordinance, is unable to lease
said storeroom for business, purposes.
Now, therefore, be it resolved, that the Board of Supervisors
of Frederick County refer this matter to the Planning Commission of Frederick County, Virginia
for possible amendment of the ordinance, and for any other changes that the said Planning
Commission may consider desirable. in the zoning of Area "A" of Frederick County, the same to be
reported back to this Board according to statute provided.

resolution to the Secretary of the Planning Commission of Frederick County, Virginia.

passed.
WHEREAS, the Commonwealth of Virginia through the Department of Highways
has prepared and submitted plans to the Board for the construction or improvement of a section
of Route 600 of the State Secondary System, Project 1393 -E (new 1334 -02) in Frederick County,
from Int. of Rt. 522 (Gainesboro) to 0.112 11i. N. of Int. Rt. 685, approved March 9, 1951; and
WHEREAS, it is proposed to finance the cost of construction fifty percent
from Federal Aid Secondary funds and fifty percent from State funds allocated to Frederick
County; and
WHEREAS, it is the desire of this Board that said road be improved in
accordance with said plans.
NOW, THEREFORE, BE IT RESOLVED: That this Board hereby approves the plans
and requests the Department of Highways to proceed with construction in accordance with these
plans, and this Board hereby agrees to and does guarantee a 40 foot unrestricted right of way
as indicated or noted on said plans, together with the right and easement to use the additional
areas shown as being required for the proper execution and maintenance of the work as indicated
cn plans, it being understood that incidental costs such as moving and reeetting existing fences,
souses, structures, utilities, or other obstructions of such nature, are to be paid from

ROUTE 600 Upon motion of Grover Teets and /ET' a $y
p / ar er the following Resolution was unanimously
passed.
WHEREAS, the Commonwealth of Virginia through the Department of Highways
has prepared and submitted plans to the Board for the construction or improvement of a section
of Route 600 of the State Secondary System, Project 1393 -E (new 1334 -02) in Frederick County,
from Int. of Rt. 522 (Gainesboro) to 0.112 11i. N. of Int. Rt. 685, approved March 9, 1951; and
WHEREAS, it is proposed to finance the cost of construction fifty percent
from Federal Aid Secondary funds and fifty percent from State funds allocated to Frederick
County; and
WHEREAS, it is the desire of this Board that said road be improved in
accordance with said plans.
NOW, THEREFORE, BE IT RESOLVED: That this Board hereby approves the plans
and requests the Department of Highways to proceed with construction in accordance with these
plans, and this Board hereby agrees to and does guarantee a 40 foot unrestricted right of way
as indicated or noted on said plans, together with the right and easement to use the additional
areas shown as being required for the proper execution and maintenance of the work as indicated
cn plans, it being understood that incidental costs such as moving and reeetting existing fences,
souses, structures, utilities, or other obstructions of such nature, are to be paid from

Secondary Funds allocated or to be allocated to Frederick County.
It is further understood and agreed that in the event one or
more property owners refuse to execute a deed covering land required from their properties for
right of way purposes, this Board hereby authorizes the Commonwealth of Virginia, Department of
Highways, to institute condemnation proceedings and agrees to pay from funds allocated or to be
allocated to Frederick County all costs in connection therewith including awards of commissioners.

Upon the recomendation of the Committee, which was named at
March, 1951 meeting, it is ordered that Dr. James A. Miller, be, and he hereby is appointed Dir-
ector and Coordinator of the Office of Civilian Defense for Frederick County, Virginia. It is
further ordered that the Clerk notify Dr. Miller of his appointment.

WELFARE
Upon motion of B. 0. Brumback and seconded by Ellsworth Dodson
it is ordered that Two Hundred and Fifty Dollars be transferred from the General County Fund to
the Welfare Fund(for child Welfare purposes)of the Frederick County Welfare Department.
BILLS APPROVED
Accounts totaling $3988.01 were approved and ordered to be paid!
from the General County Fund by Warrants numbers 12991 to 13035 inclusive and Livestock claims,
Fowl Claims and Earl Cather's salary totaling $90.00 were approved and ordered to be paid from
the Dog Fund by Warrants numbers 1195 to 1198 inclusive.
Upon motion it is ordered that the Board do now adjourn.
