Rosenberger, Chairman, J. Robert Russell, Donald L. and Raymond C. Sandy. The minutes of the last meeting held on the 11th day of August, 1969 were and approved. REPORTS: UPON MOTION DULY made and seconded the reports of Harry L. McCann, ; Esten 0. Rudolph, Commissioner of Revenue; Lacy H. Anderson, Sheriff of Frederick , E. Eugene Gunter, Commonwealth Attorney; Roberta A. James, Department of Welfare, Shirley, Home Demonstration Agent; John Wolfe, County Agent and H. C. Crowder, Road were read and approved. Harold Whitacre, Acting Dog Warden, appeared before the Board an gave a report the calls made since the resignation of Henry Bursey former Dog Warden. Upon motion duly made and seconded, Be it Resolved, that Richard E. Boyd be employed as a part -time Dog Warden, at IJ Salary of $2,400.00 plus car and expenses furnished, effective September 15, 1969. Upon motion of Raymond Sandy and seconded by Donald Baughman, Be Resolved, that the Board does hereby approve the application of Company to amend the Zoning Ordinance of Frederick County, Virginia, in approximately 200 acres on the East side and approximately 9 acres and 5 lots on the West of Virginia Route 647, in Opequon Magisterial District, more particularly described in a ( plat attached to the Petition in this instance. The foregoing Applicant asks that the above - described property be rezoned from Agricultural to R -2 and to`B -Z.as shown by the solid 350 coloration and hatched lines as designated on the aforesaid plat. After duly advertised Public Hearing the above amendment to-the Zoning Ordinance is hereby enacted, except that the area asked to be rezoned to. B-2 is rezoned to The above resolution was passed.. Upon motion duly made and seconded, Be it Resolved, that the Deed of Dedication and Declaration of Plat which now accompanies the plats of Fredericktowne shall supersede the resolution concerning the Subdivision in the August minutes of the Board of Supervisors. The above resolution was passed. STICKLEY. ROBERT K. REZONING Upon motion of Raymond Sandy and seconded by Donald Baughman, Be it Resolved, that the application of Robert K. Stickley et al to amend the Zoning Ordinance of Frederick County, Virginia in reference to a parcel of land in Opequon Magisterial District, fronting '1,145 feet, more or less, on State Route 277 and 975 feet, more or less, on State Route 647, containing 38 acres, more or less, more particularly described 1n,a plat attached to the Petition in this instance. The foregoing applicant asks that, that portion of the 38 acres platted into residential lots be rezoned from A -1, Agricultural Limited, to R -2, Residential General, and that the four lots designated as A Commercial/B, C, and D on said plat be rezoned from A -1, Agricultural Limited, to B-2, Business General, . After duly advertised Public Hearing - the above amendment to the Zoning Ordinance is hereby enacted, except that the lot designated as Commerical A is rezoned to DUMP ORDINANCE - ENACTED Upon motion of Donald L. The Garbage Dump shall be closed on Sunday and all legal holidays. 2. No substance shall be burned on the property on which the Frederick- County - Winchester land Fill Garbage Dump is located except under the specific supervision of the contractor or one of his employees. Any burning by the contractor or one of his employees shall be conducted according to the law and in co- operation with the local Chief Forest Warden. 3. The contractor and his employees must turn away unacceptable refuge and garbage. No hazardous materials, automobiles, or parts thereof, refrigerators, stoves, water heaters, or other bulky appliances will be accepted for disposal. Hazardous materials are defined as cleaning fluids, gasoline, crank case oil, paints, poisons, caustics, explosi and radioactive materials. No dead animals or any other items unacceptable for reasons of health, appearance or safety may')be deposited at the Garbage Dump. 351 4. The contractor - and his employees have the.right and duty to control all traffic at the Frederick County - Winchester Land Fill Garbage Dump. The aforesaid individua are authorized to supervise the dumping.operation and the independent, private, public, and commercial haulers must dump their loads according to the of such individuals. 5. Any company or persons violating the foregoing provisions may be barred from using the Garbage Dump by the contractor or his employees for a specified period of time The violation of any of the aforesaid provisions shall likewise constitute a misdemeanor punishable by a fine not to exceed One Hundred Dollars ($100.00). 6. Firms, businesses, and corporations located within the County of Frederic ' or the'City of Winchester shall be permitted to use the Frederick County - Winchester Land Fill Garbage Dump on a fee per load basis as follows: a. $5.00 per load for packer unit of over 8 cubic yards. b. $4.00 per load for packer unit up to 8 cubic yards. c. $4.00 per load for tractor trailer d. $3.00 per load for dump truck with a capacity from 2 to 5 tons e. $2.00 per load froadump truck with a capacity from 172 to 2 tons. f. $1.00 per load for pickup truck 7. The operator of any vehicle who is required to pay a fee according to the foregoing schedule shall obtain a permit from the contractor or his employees upon reaching the entrance to the Garbage Dump. The driver shall sign the said permit and the contractor ' or one of his employees shall provide the driver with a copy of the said permit. The contractor shall provide the Commissioner of Revenue with a copy of each of the permits issued as aforesaid and shall also provide the Commissioner of Revenue with a summary sheet at the end of each month. The Commissioner of Revenue shall dispatch a bill on or before the tenth of each month for the preceding month's charges. The said bills shall be paid on or before the first day of the following month or the party in default of the bill shall not be allowed to use the said Frederick County - Winchester Land Fill Garbage Dump after that date. 8. All residents Frederick County and the City of Winchester hauling own garbage from their own homes will not be required to pay any of the aforesaid fees, but all other users of the dump will be subject to the said fee schedule. DUMP ENTRANCE & ROAD Upon motion duly made and seconded, Be it Resolved, that H. C. Christianson is given approval to improve both the entrance and the road into the Dump, such cost to be paid by the County. The above resolution was passed. PAPERMILL ROAD - PLANNING COMMISSION REZONING - DENIED Upon motion duly made and seconded, Be it Resolved, that the Board does hereby denytthe re- zoning of Papermill Road, and refer it back to the Planning Commission, for proper initiation if further are desired by said commission. The above resolution was passed. PLANNING COMMISSION & BOARD OF SUPERVISORS - JOINT MEETING Upon motion duly made and seconded, Be it Resolved, that the Board of Supervisors arrange a joint meeting with 352 the Planning Commission to be held September 22, 1969 at 7:30 P.M. The Board request that County Attorney E. Eugene Gunter and Planning Commission Secretary, Joseph A. Massie, Jr., be ex- cluded from this meeting. The above resolution Was passed. The Board received the Operational and Fiscal Summary for Frederick County Covering Fiscal Year 1968 -69 from the Resident Engineer, H. C. Crowder. Upon motion duly made and seconded, The County Treasurer, Harry L. McCann, presented to the Board a list of De Personal Property Tax for the year 1968. as. of June, 1969, in the amount of $23,720.32 and also the Delinquent Real Estate Tax for the year July 1, 1968, to June 30.. 1969, in the amount of $27,386.16, the total being $51,106.48. JUDGE ROBERT WOLTZ - MAINTENANCE TYPEWRITER CONTRACT Upon motion duly made and seconded, Be it Resolved, the Board does hereby approve the addition of Judge Woltz's machines to the existing maintenance contract. The above resolution was passed. Upon motion of Donald L. Baughman and seconded by J. Robert Russell. Be it Resolved, that the Board refer the rezoning petition of Buel C. Kincheloe to the Planning Commission after receiving copies of plats. The above resolution was passed. REZONING OF PART OF ROUTE 11 NORTH - PLANNING COMMISSION The Board does hereby recommend to the Planning Commission the rezoning of both sides of Route 11 North from the Interstate 81 interchange North to the Old Charles Town Road from Agricultural to Residential. SHAWNEELAND - APPROVAL OF PLATS Upon motion duly made and seconded, Be it Resolved, that-the Board approve the Plats of Shawneeland 196 lots subject to the approval of the Frederick County Health Dept. F. ET AL REZONING Upon motion of Donald L. Baughman and seconded by Raymond Sandy, Be it Resolved, that the application of Clarence F. Schenck et al, to amend the Zoning Ordinance of Frederick County, Virginia, in reference to 32,683.2 square feet of ' real estate lying between.Commerce Street and Glaize Avenue on the Virginia State Route 644 (Paper Mill Road), -more particularly described in a plat and deed attached to the Petition in this instance. The foregoing applicant asks that the above - described property be rezoned from Residential General, District R -2 to Industrial Limited, District M -1. After duly advertised Public Hearing, the above amendment to the Zoning Ordinance is hereby enacted. The above resolution was passed. I r � The Sheriff was directed to proceed with a Sheriff's Sale of the cars in front of the County Courthouse. SHERIFF - ADDITIONAL DEPUTY - APPROVED Upon motion duly made and seconded, Be it Resolved, that the Board does hereby approve the addition of a Deputy. The appropriation from the School Board will be-$1,400.00, County Cost $600.00, -plus share of State. The Deputy will patrol the area at James Wood High School. The above resolution was passed. Upon motion duly made and seconded, Be it Resolved, that after the opening of sealed bids for 3 Sheriff's Cars .('2 -1967 Ford's and 1 -1967 Plymouth);.the Board rejected all bids as too low. 354 JENNINGS. T. ROY - REPAIR OF CAR Upon motion duly made and seconded, Be it Resolved, the Board does approve the request of Roy Jennings to repaint the County Car used by him for official business. At a Regular Meeting of the Board of Supervisors of Frederick County, Virginia, on Monday, September 8, 1969, the following resolution was made, seconded, and passed unanimously: ".Be it Resolved, that the Frederick County Board of Supervisors does hereby recognize and congratulate Charles E. Bass, Chairman of the Frederick County School Board, for his outstanding accomplishments in that position during the preceding year as well as in many past years. This governing body, along with the parents and taxpayers of Frederick County, recognize and commend the said Charles E. Bass for his leadership of the Frederick County School Board in creating and maintaining an excellent relationship between the Frederi County School Board and the teachers, between the said school board and the governing body of this County, and between the said school board and every organization and person with whom it comes in contact. It is further noted that Mr. Bass' leadership of the School Board of Frederick County was accomplished at the same time that he was also serving as Zoning Administrator of Frederick County and Subdivision Administrator of Frederick County. In view of the above and many, many other reasons apparent to his many admirers it is the extreme pleasure of the Frederick County Board of Supervisors to nominate Charles E. Bass as a candidate for the School Board member of the year. The Clerk of the Frederick County Board of Supervisors is hereby directed to send an attested copy of this resolution to Melton Wright, Division Superintendent; to the said Charles E.
