August 11, 1969345 At the Regular Meeting of the Board of Supervisors of Frederick County, Virginia, held in the Supervisors Room on the 11th day of August, 1969. PRESENT: Thomas ;P. Rosenberger, Chairman; J. Robert Russell, Donald L. Thomas B. Brumback, and Raymond C. Sandy. and approved. The minutes of the last meeting held on the 14th day of July, 1969, were read REPORTS: UPON MOTION duly made and seconded the reports of Harry-L. McCann, Treasurer; Esten 0. Rudolph, Commissioner of Revenue; Lacy H. Anderson, Sheriff of Yrederi County, E. Eugene Gunter, Commonwealth Attorney;, Roberta A. James, Department of Welfare, Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and H. C. Crowder, Road Engineer were read and approved. �• S s Henry Bursey, Dog Warden for Frederick County resigned effective August 11, Upon motion duly made and seconded, Be it resolved, that the Board does accept the resignation of Henry S. Bursey Dog Warden, with regret. It is ordered that he be paid for the 11 days in August at this Meeting. The above resolution was passed. FOX TRAPPING - REPORT Danny Boone, Fox Trapper for Frederick County gave a report as to the number of foxes trapped and explained how his work was progressing. ROSENBERGER, T. B. -LAND - VARIANCE TO LOT Upon motion duly made and seconded, Be it resolved, that the Board does hereby grant a variance to the Subdivision Ordinance on the 0.711 acre of conveyed to the Trustees of St. John's Lutheran Church in Back Creek District, owned by T. B. Rosenberger. The above resolution was passed. TEETS - MILLER LAND - LOTS SUBDIVISON - FINAL APPROVAL Upon motion duly made and seconded, Be it Resolved, that the Final Plat of the Teets - Miller Lots, Section 2 in Stonewall District, be accepted for final approval by the Board. The above resolution was passed. PERRY TATS FINAL APPROVAL Upon motion duly made and seconded, Be it Resolved, that the Board does hereby approve the Perry Lots Subdivision . in Gainesboro District, for Final Approval. The above resolution was passed. 346 LAKE SERENE FINAL APPROVAL Upon motion duly made and seconded, Be it Resolved, that the Board does hereby approve the Plat of Lake Serene, in Gainesboro District, for Final Approval and recordation. The above resolution was passed. CARNIVAL - HITCHING LOT The Fraternal Order of Police is granted the use of the Parking Lot known as "The Hitching Lot" on the days of their sponsored carnival. NIGHT MEETING - INTERVIEW DOG WARDEN APPLICANTS The Board will hold a Night Meeting this month on August 25, 1969, at 7:30 P. at which time applicants interested in the fob of Dog Warden will appear before the Board for Interviews. M N s ,a- � Upon motion duly made and seconded, Be it Resolved, that for the fiscal year beginning on the 1st day of July, 1969 and ending on the 30th day of June, 1970, the Treasurer is directed to transfer to the various funds the amounts as set for in the 1969 -1970 Budget for those funds as the money is available, and needed. The above resolution was passed. REGULAR MEETING - SET 9:00 A.M. IN SEPTEMBER The September regular Meeting will begin at 9:00 A. M. HOSPITAL CONTRACTS APPROVED - SHENANDOAH COUNTY - WINCHESTER MEMORIAL - UNIVERSITY OF VA. Upon motion duly made and seconded, The Board approved and entered into a contract for the hospitalization of Persons, with the Shenandoah County Memorial, Winchester Memorial, and University of Va. Hospital for a term beginning on the 1st day of July, 1969, and expiring on the 30th day of June, 1970, at a rate of $41.06, $ , $38.30, respectively. The above resolution was passed. INTERSTATE ORCHARD, INC. REFERRED TO PLANNING COMMISSION Upon motion duly made and seconded, Be it Resolved, that the Plat and Petition of Interstate Orchards be referred to the Planning Commission for study. ROY BOYCE LAND PUBLIC HEARINGS - RE-SET FOR REZONING OF C. F. SCHENCK LAND, PAUL ENSOGNA LAND,/C. D. HYLTON (PAPER MILL ROAD, REZONING BY PLANNING COMMISSION) DUMP ORDINANCE Upon motion duly made and seconded, Be it Resolved, that all the Public Hearings originally set at the July Meet L� has been re -set for September at the following times: 347 C. By Planning Commission the above resolution was passed. COUNTY ATTORNEY - REMAIN IN OFFICE Upon motion duly made and seconded, Be it Resolved, that E. Eugene Gunter remain County Attorney for the Board by a unanimous vote of confidence from the Board. The above resolution was passed. FREDERICKTOWNE COMPANY - REZONING Upon motion duly made and seconded, Be it Resolved, that the Board approve the Subdivision of Fredericktowne subject to approval by the Highway and Health Department, also the Board approve the rezoning petition, subject to Public Hearing on September 8, at 10:00 A. M. with the I. express stipulations that it is for single family dwellings, Price of House to be at least $16,000.00 (Contract Price') and there be no 235 or 236 Housing in this area. The above resolution was passed. WATER FLOOD STUDY Upon motion duly made and seconded, Be it Resolved, that the Board request the Highway Department to study a 25 year Flood Frequency in the area of Fox Drive and also include a cost estimate of the project. The above resolution was passed. LAKESIDE WATER & SEWER COMPANY - APPROVED APPLICATION FOR CERTIFICATE OF CONVENIENCE & Upon motion duly made and seconded, WHEREAS, S. Herbert Shackelford and Madge H. Shackelford are the owners of a certain tract of land containing 360 acres in Opequon Magisterial District; located about one and one -half (11) miles East of U. S. Highway 11, and about two and one -half (21) miles to three (3) miles Northeast of the Town of Stephens City, Virginia; and, WHEREAS, the said persons desire to subdivide and develop their land and to that end have obtained the approval of the Subdivision Administrator and the Board of Supervisors of Frederick County; and, WHEREAS, it is desirable and necessary that central.water and sewer system be constructed and maintained for the said subdivision, and none other is available, or' I� likely to be available in the foreseeable future; and, WHEREAS, the State Water Control Board has approved the design and construction to date of a central sewer system for said land, and the State and Local Health Departments have approved the design and construction of a central water system for said land; and WHEREAS. Section 56 -265 requires the Board of Supervisors to approve the application of the.Lake Side Water and Sewer Company for a certificate of Convenience and • Necessity pursuant to the total requirement of Chapter 10.1 of the Code of Virginia entitled "Utility Facilities Act "; NOW, THEREFORE, BE IT RESOLVED, that upon examination of the application of Lake Side Water and Sewer Company to the State Corporation Commission for a certificate of Public Convenience and Necessity in the area designated therein, the Board of Supervisors of Frederick County does hereby grant approval for the said petitiom COMMUNITY COLLEGE - ADDITIONAL APPROPRIATION APPROVED Upon motion duly made and seconded, Be it Resolved, that the Board give full support of additional appropriation needed for the building of the Community College. The above resolution was passed. ROBERT K. STICKLEY - REZONING PUBLIC HEARING Upon motion duly made and seconded, Be it Resolved, that the Board accept the report of the Planning Commission of the rezoning of the Robert K. Stickley, et al, and approves the said plat and petition and it is set for Public Hearing on September 8, 1969 at 10:30 A. M. � •���� a •� i — �� At a regular meeting of the Frederick County Board of Supervisors on Monday, August 11, 1969 the following resolution was moved, seconded, and unanimously passed: Be it Resolved, that the Frederick County Board of Supervisors is strongly opposed to the procedure commonly known as cloud seeding. The said Board, therefore, encourages all of the elected state.and federal officials, who serve this area, to support legislation making cloud seeding a felony. The Board further requests our representatives to co- operate with the representatives of other states in reference to prohibiting cloud seeding on a national basis. The Board of Supery further calls upon the adjoining counties in Virginia to enact Resolutions similar to this Resolution. The Clerk is directed to send an attested copy of this Resolution to the J. ACCOUNTS PAYABLE Accounts totaling $22,208.93 were read and approved and ordered to be paid from the General County Fund by Warrants No. 5044 and 5213 inclusive: Livestock, Fowl Claims and Henry'Bursey':s SalaYy totaling $1,520.99 were read and ordered to be paid from the Dog Fund by Warrants No. 225 and 235 inclusive.
