REGIONAL LIBRARY COMMITTEE - REPORT
Mrs. Thelma Clore appeared before the Board an gave a report of the meeting of
the Regional Library Committee held in April.
TAX RATE - LEVY
Upon motion of Thomas B. Brumback and seconded by Donald Baughman,
Be it Resolved, that the County Levy be a total of three dollars and thirty cents
($3.30) on each $100.00 on the valuation of Personal Property, Machinery Tools, and Merchants
Capital, and a total of two dollars and fifty cents ($2.50) on each $100.00 on the valuation
of Real Estate.

On motion duly made and seconded,
Be it Resolved, that the Frederick County Budget for the fiscal year beginning
on the first day of July, 1969, and ending on the 30th day of June, 1970, was approved as
presented.
The Clerk is ordered and authorized to have the same published in the Winchester
Evening Star as required by law and the Public Hearing thereof shall be on the 12th day of
May, 1 9 6 9, at 3:00 P. M.

Be it Resolved, that after duly advertised Public Hearing and no objection, the

following Ordinance is adopted.
ORDINANCE SECTION 5-4. TRESPASSING UPON COUNTY DUMP OR OTHER COUNTY OWNED PROPERTY
It shall be unlawful for any person to trespass-upon the county dump or any other
property owned by the County of Frederick. For the purposes of this Section, any person
going upon the county dump or any other county owned property without specific authorization
or permission from an authorized official during hours other than the hours during which the
county dump and other county owned property are open to the public shall be considered a
trespasser.
Any person violating.this Section shall be punished according to provisions of
Section 9 -1.

LITERARY FUND - APPLICATION - SCHOOL BOARD
Upon motion duly made and seconded,
Be it Resolved, that the application of the County School Board to the State
Board of Education of Virginia for aloan of $300,000.00 from the Literary Fund is hereby
approved, and authority is hereby granted the said County School Board to borrow the said
amount for the purpose set out in said application.
The Board of Supervisors for said County will each year during the life of this
loan, at the time they fix the regular levies, fix a rate of levy for schools or make a
cash appropriation sufficient for operation expenses and to pay this loan in annual

installments and the interest thereon, as required by law regulating]oans from the Literary
Fund.

SECTION 20 -19. Procedure upon filing of an application.
The Commissioner of Revenue shall consider each application, filed as provided in
Section 20 -18, and must, before acting, refer such an application to the Board of
Supervisors, which may require a public hearing thereon, after first publishing notice of
such hearing two times in a newspaper having a general circulation in the County. The Bo
of Supervisors will approve or disapprove the application and the Commissioner of Revenue
shall not issue a certificate of approval if the Board of Supervisors disapproves the
application.

INDUSTRIAL ACCESS FUNDS - GULFSTREAM PLASTICS DIVISION

Be it Resolved, that Industrial access funds be utilized to provide access to the
proposed plant of the Gulfstream Plastics Division of O'Sullivan Rubber Corporation to be
located approximately .15 mile north of Route 622.
It is requested that upon completion of the above road the same be added to the
Secondary Highway System.
ACCOUNTS PAYABLE '
Accounts totaling $23,117.42 were read and approved and ordered to be paid from
the General County Funds by Warrants 4698 and 4803 inclusive: Livestock, Fowl Claim and
Henry Bursey's Salary totaling $766.80 were read and ordered to be paid from the Dog Fund I

FOX TRAPPING
Eugene Gunter read a report of possible fox trapping in the County. Eugene
to write Dr. Paul C. White, on the possibility of employing a state trapper for Frederick
County.

Be it Resolved, the Board does accept with appreciation the United States Flag '
and Virginia State Flag presented by the Winchester V. F. W. Post 2123 to stand in the
Board of Supervisors Room.

ROBINSON LAND - AMENDMENT TO ZONING ORDINANCE - MUMAY - ADOPTED '

Be it resolved, that after duly advertised Public Hearing, the Board does hereby
approve the recommendation of the Planning Commission for rezoning of 1.1008 acres of land
located in Gainesboro District, situate on the Southwest corner -of the intersection of
Virginia Secondary Highway No. 739 and U. S. Route No. 522 be rezoned from Agricultural
Limited A -1 to Business Limited B-2. .

FOX TRAPPING '
Dr. Dickerson and Dr. White appeared before the Board and explained control of
rabies and fox trapping.

Be it Resolved, that the County employ Danny Boyd Boone at -a salary of $300.00 a
month, plus mileage for three months to trap foxes in Frederick County. This shall be paid
from Dog Fund.

PARKING LOTS
Richard Martin, Chairman of the Winchester Parking Authority appeared before the
Board explaining landscaping for Parking Lots. A recommendation was made to combine the
County and City lot.
Thomas Brumback and J. Robert Russell were appointed a committee to meet with
Mr. Martin to study the project.
COMMUNITY COLLEGE LAND '
Upon motion of Raymond Sandy and seconded by Robert Russell,
Be it Resolved, that the Board write a letter to Mr. Dana Hamel inquiring about a
date for committee meeting in reference to purchase ofAand for the Community College.

On motion duly made and seconded,
Be it Resolved, that the Frederick County Budget for the fiscal year beginning
on the first day of July, 1969, and ending on the 30th day of June, 1970, was approved as

Be it Resolved, that the Board does approve the purchase of land from Garland

The Board request that Eugene Gunter correspond with other counties involved,
to send their share of cost to Frederick and City of Winchester.

COMMUNITY COLLWE - PERCENTAGE - RESOLUTION
The Board of Supervisors of the County of Frederick, meeting in regular session
on June 9, 1969, does hereby approve the following Resolution:
WHEREAS, the Ad Hoc Committee for the Region 15 Community College, a member of
which was a duly appointed representative ofL:this County, has recommended that the County
Frederick appoint 2 persons from the County to the Local Board of the Region 15 Community
College; and
WHEREAS, the Ad Hoc Committee has further recommended that site and site deve
costs for the community college be apportioned among the Region 15 political subdivisions
according to the formula S = a +— � 2c , where "S" is the percentage of each $100,000
- of such costs to be supplied by each political subdivision, "a" is the percentage the
population ( as of July 1, 1968) of each political subdivision is of total Region 15
population, "b" is the percentage the true value of locally taxed property and public se
corporations (1968) of each political subdivision is of Region 15 true value, and "c" is
percentage the school age population (1967) of each political subdivision is of total Re
15 school age population; and
WHEREAS, the Ad Hoc Committee further recommended that, as Fauquier County will
supporting the community colleges in both Region 15 and Region 16, its percentage of site
and site development costs be divided in half, with one half to be distributed proportion
amond the remaining political subdivisions of Region 15;
NOW, THEREFORE, BE IT RESOLVED, that the County of Frederick does agree to the
recommendations of the Ad Hoc Committee and does hereby agree to commit and does commit
itself to provide 21.7 per cent of each $100,000 of site and site development costs for the
Region 15 Community College as determined under thb - and
BE IT FURTHER RESOLVED, that the Board of Supervisors of the County of Frederick
does hereby appoint C. Robert Solenberger and Dr. Melton Wright to the Local Board of the
Region 15 Community College, in accordance with the "Policies, Procedures, and Regulations"
of the State Board for Community Colleges.

Minutes of this Board of Supervisors and that a true copy shall be sent to the State Board

relocation of the entrance of Route 739 to Route 522 North due to the dangerous condition
the present location that now prevails at this entrance.
The Board had taken previous action by resolutions to officials of Highway Dept.
' and various public officials of the State.
SOIL SURVEY REQUEST RENEWED
At a regular meeting of the Frederick County Board of Supervisors On October 14,
1968 the Board passed a resolution to request that a soil survey be conducted in Frederick
County.
We request that Frederick County be placed on the County Soil Survey request list.
It is the understanding of the Board that when the time comes for the survey work to begin,
if the situation has changed in any way making it not feasible at the time, the Board has
privilege of extending or withdrawing this request.
The above request was renewed by the Board.
Upon motion of Robert Russell and seconded by Raymond Sandy,
Be it Resolved, that the Frederick County Board of Supervisors hereby grants the
request of the Frederick County School Board to make transfers within the 1968 -69 school
'
budget to provide for additional needed expenditures in the categories of Administration,
Transportaion, Fixed Charges, Maintenance, Operation of School Plant, Capital Outlay,
Building Fund and so forth;
Be it further resolved that the request is made on condition that the Frederick
County School Board's expenditures for the year from county tax funds will not exceed the
1968 -69 appropriation of $1,403,844 for Operation and Capital Outlay;
Be it further resolved that the Frederick County School Board is hereby granted
permission to use any additional funds allocated from 9ie state as well as funds within the
limits of the approved Literary Loan Fund and the Virginia Supplemental Retirement loan for
school construction.

HARRISON AVENUE ADDITION
At a regular meeting of the Board of Supervisors of Frederick County held at
Winchester, Virginia on June 9, 1969, the following resolution was adopted.
BE IT RESOLVED, that Harrison Avenue in Haldeman Land Lots, be added to the
secondary highways system of Frederick County, as follows:
Harrison Avenue: From Rt. 644 to .14 Mile west of Route 644, length 0.14 Mile
An unrestricted right of way of 50 feet is guaranteed. This right of way is
recorded in the Clerk's Office of Frederick County in Deed Book 230 Page 411 dated February
16, 1954. The drainage easement is recorded in Deed Book 351 page 282, dated March 12, 1969
' II This street was constructed by the subdivider in accordance with the County
Ordinance and the Highways Department Policy for subdivision streets. It was graded to a
roadway width of 28 feet, exclusive of ditches and has a crushed stone base 5" in depth and
is bituminous surface treated 20 feet in width.
II BUCKHORN LANE - ADDITION
At a regular meeting of the Frederick County Board of Supervisors held at
Winchester, Virginia on June 9, 1969 the following resolution was adopted.
BE IT RESOLVED: That a section of road known as Buckhorn Lane from the Warren
II County line North .21 Mile to the entrance to the M. C. Schurtz property be added to the
Secondary Highway system pursuant to Section 33 -141 of the 1950 Code of Virginia as amended.

Be it Resolved, that the Board dispense with the night meeting for June.
The above resolution was passed.
HARRISON AVENUE ADDITION
At a regular meeting of the Board of Supervisors of Frederick County held at
Winchester, Virginia on June 9, 1969, the following resolution was adopted.
BE IT RESOLVED, that Harrison Avenue in Haldeman Land Lots, be added to the
secondary highways system of Frederick County, as follows:
Harrison Avenue: From Rt. 644 to .14 Mile west of Route 644, length 0.14 Mile
An unrestricted right of way of 50 feet is guaranteed. This right of way is
recorded in the Clerk's Office of Frederick County in Deed Book 230 Page 411 dated February
16, 1954. The drainage easement is recorded in Deed Book 351 page 282, dated March 12, 1969
' II This street was constructed by the subdivider in accordance with the County
Ordinance and the Highways Department Policy for subdivision streets. It was graded to a
roadway width of 28 feet, exclusive of ditches and has a crushed stone base 5" in depth and
is bituminous surface treated 20 feet in width.
II BUCKHORN LANE - ADDITION
At a regular meeting of the Frederick County Board of Supervisors held at
Winchester, Virginia on June 9, 1969 the following resolution was adopted.
BE IT RESOLVED: That a section of road known as Buckhorn Lane from the Warren
II County line North .21 Mile to the entrance to the M. C. Schurtz property be added to the
Secondary Highway system pursuant to Section 33 -141 of the 1950 Code of Virginia as amended.
This addition to become effective immediately following the addition of .16 Mile of Buckhorn

Lane located in Warren County between Route 637 and the Warren County.Line. -
An unrestricted right of way of 40 feet in width is guaranteed, this right
of way is recorded in the Clerk's Office of Frederick County in Deed Book 354 page 141
and 143 dated June 10, 1969.
LEAGUE VIRGINIA COUNTY BONDS - RESOIUTION
'
WHEREAS, the U. S. Congress has under consideration legislation to revise and
reform the Federal Income Taxation statutes and
WHEREAS, the Ways and Means Committee of the U. S. House of Representatives
has entertained a proposal incorporating a minimum tax and a tax allocation of deductions
,
or a limited tax preference to be applied to local government bond interest as well as to
other types of deductions, and
WHEREAS, such a proposal would wholly or partially remove the tax exempt status
of local and state government, and
WHEREAS, such a change in the tax exempt status would cause (1) an increase
in the interest rates of state and local government bonds and thus materially increase
the cost of state and local government debt service charges; (2) an increase in state and
local government taxes to pay their increased rates; (3) an unsettling of the bond market
by causing greater competition for the investors monies thus, again increasing interest
rates on state and local government bond issues; and (4) would operate contrary to other
national policies aimed at containing inflation and improving Federal- State -Local relation -
ships.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of
Frederick, Virginia, does hereby oppose the proposal before the U. S. Congress, the U. S.
House of Representatives, and the U. S. Senate, respectively,to change the status of state
and local government bonds, duly issued, to permit the taxation by any government of the
interest earned on such bonds either partially or wholly.
BE IT FURTHER RESOLVED THAT, a copy of this Resolution be forwarded to both:.
U. S. Senators from Virginia and to the Congressman from the District of which this County

a part and Congressman Wilber Mills, Chairman, Ways and Means Committee, U. S. House of
Representatives.
