REPORTS. UPON MOTION duly made and seconded the reports of Harry L. McCann, Treasurer; Eaten 0. Rudolph, Commissioner of Revenue; Lacy H. Anderson, Sheriff of Frederick County, E. Upon motion duly made and seconded, Be it Resolved, The Board hereby approves the installation of a telephone in the Re- assessment Office, with an unlisted number. The above resolution was passed. BONDS - DESTRUCTION OF COUPONS - SCHOOL Upon motion duly made and seconded, Be it Resolved, That the chairman of this Board and the Treasurer of Frederick County are here by authorized to sign an agreement with the State Planters Bank of Commerce and Trusts where by the said bank agrees to destroy the bonds and coupons dated May 1, 1968 in the amount of $1,000 2 - 0 numbered from 1 -200 inclusive. For this service the said bank is to be paid ' at the.rate of 3¢ for each bond of $1,000.00 for smaller denominations and 4¢ for each bond for $5,000.00 denominations and 2¢ for each coupon pertaining to $1,000.00 or smaller denomination bonds and 3¢ for each coupon pertaining to $5,000.00 denomination bonds. ' COUNTY AND CITY DUMP Upon motion duly made and seconded, Be it Resolved, that City of Winchester has the privilege of using County Dump for one year at the rate of $800.00 per month. Frederick County shall have the privilege of using the City of Winchester Dump located in the county and any future Dumps. The above resolution was passed. 262 Upon motion duly made and seconded, Be it Resolved, that the Board authorized Thomas Brumback to work through E. E. Bayliss, Jr. to investigate and secure survey of the Arthur Roe land that the County has an option on for the Dump at the cost of $500.00 per acre. The above resolution was passed. Upon motion duly made and seconded, WHEREAS, Frederick County, Virginia recognizes a need for increased efforts to meet and overcome Juvenile and domestic relations problems, and, WHEREAS, Section 16.1 -143.1 of the Code of Virginia of 1950, as amended, authorized our County to participate with other governmental Jurisdictions in the area in establishing a Joint Regional Juvenile and Domestic Relations Court, which might do much to alleviate these problems. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors does hereby the establishment of a Joint Regional Juvenile and Domestic Relations Court to serve the County of Frederick, and the City of Winchester, and does respectfully request the'Honorable Elliott Marshall and the Honorable Robert K. TRI- COUNTY REFUSE SERVICE - PROPOSAL FOR FREDERICK COUNTY SANITARY LANDFILL OPERATION William W. Denlinger, representing the Tri- County Refuse Service presented a proposal for the operation of Frederick County Sanitary landfill operation. This proposal was to go into effect by July 1, 1968 if possible. No definite action was taken by the Board at this time. DUMP - MARSHALL WILLIAMS - KEY Marshall Williams appeared before the Board to make a request for a key to the Action was continued to June meeting. ARCHITECT - PROPOSAL ON NEW COURT HOUSE Keith Williams, Architect, appeared before the Board to discuss plans for the office building. Hubert Stratton, Architect appeared before the Board to discuss plans for the new office building. A committee of Thomas B. Rosenberger, J. Robert Russell and Raymond C. Sandy were appointed to meet with Architects and go over plans concerning the Building of a new County Office Building. 266 ARTHUR S. ROWLES -- CONTRACT - APPROVED Upon motion duly made and seconded, Be it Resolved, that the following Option Contract of Arthur S. Rowles to the County of Frederick is approved "in present form:. THIS OPTION CONTRACT made and date this 29th day of May, 1968, by and between ARTHUR S. ROWLES, party of the first part, hereinafter called Optionor, and the COUNTY OF FREDERICK, Virginia, party of the second part, hereinafter referred to as Optionee. WITNESSEPH: That in consideration of the payment of One Hundred Dollars ($100.00) cash in hand paid, the receipt of which is hereby acknowledged, the Optionor does hereby grant unto the Optionee An irrevocable option to purchase the hereinafter described property under the following terms, convenants and conditions, to -wit: 1. PERIOD OF OPTION: Two months from this date, to be exercised by a written notice directed to Optionor in Frederick County, Virginia. 2. DESCRIPTION OF PROPERTY: All of that western portion of Optionor's land lying west of a proposed new division line across Optionor's land, said new line to be approximately parallel to Optionor's western boundary line at a distance of 100 feet in a westerly direction from Optioner's dwelling, said portion being a part of that certain trac of land situate in Frederick County, Virginia about 2 miles east of the City of Winchester acquired by Optionor March 6, 1959 by deed recorded in Deed Book 256, Page 533 of the land records of said County; it being the intent that the exact boundaries of said portion be fixed by survey and that said portion include no part of the roadway leading from Virginia Highway Route 655 to Optionor's dwelling nor any of the land lying east of that roadway. 3. PURCHASE PRICE: Five Hundred Dollars ($500.00) per acre payable upon delivery of the deed, with credit for the $100.00 option payment. 4. DEED: THE Optinor shall prepare, acknowlege and deliver, with the requisit revenue stamps affixed thereto, a General Warranty deed with English convenants of title subject only to any duly recorded easement for utilities. 5. TITLE: Optionee shall have ten (10) days after its exercise of the Option to close and if the title shall be found to be defective and the Optionee's attorney and the Optionor cannot remedy the defect by the use of due diligence within three (3) months after notification thereof, the Optionee shall not be required to take the property and shall be entitled to a refund of all amounts paid hereunder and this Ehall constitute a full release of all liability of either party to the other arising out of this Option Contract. 6. PASSING OF INCIDENTS OF OWNERSHIP: All taxes, and utilities, the risk of loss and all risks of ownership shall be prorated and pass on the closing date when the deed is delivered. 7. AGENT'S COMMISSION: Optionor will pay in cash at closing the 6% real estat commission due on this transaction to E. E. Bayliss, Jr. 8. SURVEY: Optionee will bear . the cost of said survey. The above resolution was passed. 1 Upon motion duly made and seconded, WHEREAS, The present facilities of the Winchester Post Office were designed to serve a much smaller area than they are now required to serve, and to handle a much smaller volume of mail than at present, and WHEREAS, The present available space, arrangement of the Winchester postal facilities, and the physical separation of facilities constitute serious obstacles to attain ing optimum efficiency in providing postal services, and WHEREAS, The Winchester Post Office is now a sectional center (distribution point for thirty -eight other post offices, redistributing six hundred to seven hundred bags of mai: daily and sorting and delivering an additional one hundred thousand pieces of mail daily, ani WHEREAS, the Winchester postal service appears to need a minimum of two and one- half times the amount of present total floor space to meet present demands, with adequate provision to meet future increased requirements, NOW THEREFORE BE IT RESOLVED, That the Winchester - Frederick County Chamber of Commerce petition the Postmaster General of the United States to authorizelthe= earliest practicable provision of a one story building of a size sufficient to accommodate all necessary operation and personnel of Winchester, Virginia, post office under one roof, either by new Federal construction, by lease, or by lease - purchase arrangement, and BE IT FURTHER RESOLVED, That the petition hereinbefore referred to be personally presented to the Honorable John 0. The above resolution was passed. HUGHES. JOSEPH F. - PETITION - REFERRED BACK TO PLANNING COMMISSION A delegation appeared for and against the petition of Joseph F. Hughes. After much discussion and deliberation, the petition of Joseph F. Hughes was referred to the Frederick County Planning Commission for study. This was continued by unanimous consent of the Board of Supervisors. Petition, Plans, etc, were returned to Joseph A. Massie, Jr., Secretary, for the Planning Commission. HYLTON ENTERPRISES - CREATION OF PUBLIC WATER SUPPLY SYSTEM' Mr. Joseph A. Massie, Jr, and R. Wesley Williams approached the Board with plans for possibility of development of the Omps and Dye land into a Subdivision. A general discussion was had by the Board. Upon motion duly made and seconded, The Frederick County School Board hereby petitions the Frederick County Board of Supervisors to permit the Frederick County School Board to pay the Chairman of the Scho Board an additional salary not exceeding $100.00 per annum and to pay the two School Board members, Mr. Clyde Logan and Mr. Kenneth K. Kyre, who serve on the Committee for Control o the Dowell J. Howard Vocational School, a joint school operated by Clarle and Frederick Counties and the City of Winchester, an. additional amount not to exceed $90.00 per year.- The Board further petitions that the two School Board members who serve on the Committee for the Control of the joint School be paid mileage at the rate of seven cents per mile for travel to and from meetings. This is in accordance with permissive action of the General,Assembly of Virginia at its 1968 session at which time it passed an act tD amend and reenact Section 22 -67.2, as amended, of the Code of Virginia, relating to salaries of members of local school boards.
