PRESENT: T. B. Rosenberger, Chairman, Raymond C. Sandy, Donald L. Baughman, Thomas B. Brumback, and J. Robert Russell. HUGHES JOSEPH F. - PETITION FOR RE- ZONING - REFERRED TO PLANNING COMMISSION J. Frederick Larrick, Attorney, representing Joseph F. Hughes, presented a plat and petition to rezone a tract of land located North of Rt. #7 opposite Denny's Auction from R -2 to M -2. The above petition was referred to the Frederick County Planning Commission. LAKE - LOCATED IN FREDERICK COUNTY - COMMITTEE The appointment of a committee in reference to securing an option on a lake to be located in Frederick,:County was continued to the next regular board meeting. FREDERICK COUNTY DUMP - KEY Marshall Williams asked the Board of Supervisors for a key to the Frederick Dump to be used during closed hours, but no action was taken pending final letting of the contract for operation and management of the dump. NATIONAL CHAMBER OF COMMERCE WEEK Upon motion duly made and seconded, Be it Resolved, that the Board of Supervisors proclaim the week of March 24, as National Chamber of Commerce Week. The above resolution was passed. LEVY_ `'(CODE SECTION 15 -582) Upon motion of Thomas B. Brumback and seconded by Donald L. Baughman, BE IT RESOLVED, that the proposed total County Levy, be, a total of three I and thirty -cents (0.30) on each $100.00 on the valuation of Personal Property, Machinery, 255 Tools, and Merchants Capital, and a total•of two dollars and fifty cents ($2.50) on each $100.00 on the valuation of Real Estate. ROAD VIEWERS - DATE SET Upon motion duly made and seconded, Be it Resolved, that the date for the Road Viewers for Frederick County, be set for Tuesday, April 23, 1968 at 8:45 A. M. The Clerk is to notify the Road Viewers of the date. (Notified 4- 10 -68) USE`TAX - LOCAL Upon motion duly made and seconded, To impose a local county use tax in Frederick County, Virginia, pursuant to S 58- 441.49:1 of the Code of Virginia (Chapter 191, Acts of Assembly, 1968), at the rate of one per cent to provide revenue for the general Hand of the county. Whereas, the county of Frederick has heretofore imposed the local sales tax authorized by S 58- 441.49 of the Code of Virginia; and Whereas, S 58- 441.49:1 of the Code of Virginia (Chapter 191, Acts of Assembly, 1968), provides that a county which has previously imposed the local sales tax authorized by S 58- 441.49 of the Code of Virginia may impose a local use tax by the adoption of a resolutio by the governing body of the county by a majority of all the members thereof, by a recorded yea and nay vote, stating its purpose and referring to S 58- 441.49:1 of the Code of Virginia; and Whereas, the said S 58- 441.49:1 further provides that the local use tax shall become effective on the first day of a month at least 60 days after the adoption of the d� 256 resolution, but not earlier than July 1, 1968; and Whereas, the said S 58- 441.49:1 also provides that the resolution authorized thereby may be adopted in the manner stated notwithstanding any other provision of law; now, therefore, follows: Resolved, by the Board of Supervisors of the county of Frederick Virginia, as 1. Pursuant to S 58- 441.49:1 of the Code of Virginia (Chapter 191, Acts of Assembly, 1968), there is hereby imposed in the county of Frederick a local County use tax at the rate of one per cent to provide revenue for the general fund of the county. The said county use tax shall be added to the rate of the State use tax imposed by Chapter 8.1, Title 58, of the Code of Virginia, and shall be subject to all the provisions of that chapter, and all amendments thereof, and the rules and regulations published with respect thereto. Therefore, the purpose of this resolution is to impose the local use tax authorized by S 58- 441.49:1 of the Code of Virginia. 2. The effective date,of the use tax imposed by this resolution shall be the first day of July, 1968, and the same shall be in force on and after that date. 3. The Clerk of the Board of Supervisors of the county of Frederick shall forthwith forward to the State Tax Commissioner of the Commonwealth of Virginia a certified copy of this resolution so that it will be received within five days after its adoption. The foregoing resolution was adopted at a meeting of the Board of Supervisors of the county of Frederick, Virginia, on April 8, 1968, by a majority of all the members thereo by a recorded yea and nay vote, as follows: Yeas (number) 4 (Names) Thomas B. CRAWFORD LAND ALONG ROUTE 690 & ROUTE 671 - CONDEMNATION Upon motion duly made and seconded, Be it Resolved, that the County Attorney, E. Eugene Gunter proceed to institute and proceed with condemnation proceedings in reference to a 40' right of way for State Route 690 and State Route 671 along and over the land of Ethel.L. Crawford in Gainesboro District, of Frederick County, Virginia. TRAFFIC AND PLANNING - DISCUSSION Harold H. Ralston, of Virginia Department of Highways, discussed the future plan of the highway system in and around Winchester, Virginia. CENTRAL REGISTRAR AND TAX INCREASE Frank Fout appeared before the Board and asked that the Board pass a resolution providing for a Central Registrar of voting records. He also asked that the entire tax increase be put on land rather than part on personal property. No action was taken. IJ 257 CLOVERDALE FARMS. INC. - PETITION FOR AMENIMENT OF _ZONING ORDINANCE Upon motion duly made and seconded, Be it Resolved, that the petition of Cloverdale Farms, Inc. for Amendment of Zoning Ordinance, presented by W. A. Johnston, Attorney, be referred to the Frederick County Planning Commission. The above resolution was passed: - CIVIL DEFENSE - THOMAS B. ROSENBERGER - DIRECTOR Upon motion duly made and seconded, ' Be it Resolved, that Thomas B. Rosenberger, Chairman of the Frederick County Board of Supervisors be and hereby is appointed Director for Civil Defense for Frederick County, Virginia. The above resolution was passed. DISPLAY OF FIREWORKS - PERMITS Upon motion duly made and seconded, The following resolution was passed: Whereas, the persons listed below have petitioned the Board of Supervisors for a permit as provided for in Section 59 -215 of the Code of Virginia for 1950 for a display of fireworks at the locations listed below and on the following dates, under his discretion and supervision and by his employees only: ' W. LAKE COMMITTEE APPOINTED Upon motion duly made and seconded, Be it Resolved, that Raymond Sandy, Archie Manuel, Malcolm Brumback, William Duncan, J. J. Pickeral, Wilson Borden, and George Scheder be appointed a committee to secure an option for a lake to be located in Frederick County, Virginia. The above resolution was passed. JUVENILE ROOM - COURT HOUSE Upon motion duly made and seconded, The Board approved a request to buy a new table for the Juvenile Room in the Court House. The above resolution was passed. TRI- COUNTY REFUSE SERVICE Upon motion duly made and seconded, Be it Resolved, that the Board extend the contract of Tri- County Refuse Service at the County Dump for 8 additional weeks. The above resolution was passed. INDUSTRIAL DEVELOPMENT AUTHORITY - MEETING DATE SET Upon motion duly made and seconded, A meeting of Industrial Development Authority of Frederick County, Virginia will be held May 8, 1968, at 7 :30 P.M. in the Board Room of the Frederick County Board of Supervisors. (The Clerk notified the members of the authority on April 11, 1968•) ill 25.9 DISCONTINUANCE OF PART OF ROUTE 628 AND ROUTE 622 The following is approved by the State Highway Department. As requested in resolution by your Board on January 8, 1968, the following sec of road is hereby discontinued as a part of the Secondary System of Frederick County. This was confirmed by the Highway Commission at its meeting on February 15, 1968. DISCONTINUANCE LENGTH Section 1 of old location of Route 628 and Section 2 of old location of Route 622 from Station 150+50 to Station 160+00, Project 0628- 034- 105,C4501. 0.18 Mi. ACCOUNTS PAYABLE Accounts totaling $23,906.23 were read and approved and ordered to be paid from the General County Funds by Warrants 3401 and 3504 inclusive: Livestock, Fowl Claim and Henry Bursey's Salary totaling $558.26 were read and ordered to be paid from the Dog Fund by Warrants 93 and 98 inclusive. TAX RATE - PUBLIC HEARING - PASSED A delegation of 30 people appeared before the Board on the public hearing on the tax rate. Ed Lord appeared before the Board representing the Frederick County Taxpayer's Association. Two requests were amount paid to the County employees, and amount paid to the County Welfare. Upon motion duly made and seconded, Be it Resolved, that the tax rate of $3.30 per One Hundred Dollars of fair market value on all Tangible Personal Property, Machinery, and Tools, and Merchants Capital, exempting household property for the fiscal year of 1968 -1969, be accepted by the Board. The above resolution was passed. Upon motion duly made and seconded, Be it Resolved, that the tax rate of $2.50 per One Hundred Dollars on all Real Estate for the tax year of 1968 -1969, be accepted by the Board. The,above resolution was passed. E COURT HOUSE - RE- DEDICATION Upon motion duly made and seconded, Be it Resolved, that Joseph A. Massie, Jr. make the necessary arrangements for Thursday, June 6, 1968 at 11:00 A.M. re- dedication of the Frederick County Court House. This will include a Luncheon at the Winchester Golf Club after the dedication. The above resolution was passed. 260 AREA VOCATIONAL AGRICULTURAL SCHOOL - BUYING? LAND Mr. Robert Aylor gave a report on the progress-of buying land for the new area Vocational Agricultural.School': A 20.acre site on Route 7 (Haven Wolf Property) at $1,500.00 per acre for a total ^df $30,000.00, $15,000.00 of which is the County's share. Upon motion duly made and seconded, ' Be it Resolved, that the Frederick County School Board is hereby given permission to transfer the necessary amount of school funds to meet the needs of purchasing land for the area Vocational Agricultural School. Be it Resolved, that the Board of Supervisors pay David Simpson $120.00 per month additional for /office space to be used as Judge of 17th Judicial Circuit. The above resolution was passed. , REAL ESTATE - PERCENTAGE VALUE Upon motion duly made and seconded, Be it Resolved, that Earl S. Bailey be appointed to study the percentage ratio on Real Estate transferred in Frederick County. The above resolution was passed. MEETING DATE - CHANGED Upon motion duly made and seconded, Be it Resolved, that the 2nd regular meeting of the month be changed to the 4th Monday at 7:30 P.M. instead of Wednesday. The above resolution was passed. , Upon motion duly made and seconded, Be it Resolved, that the Frederick County Board of Supervisors on behalf of itself, the public office holders of Frederick County, and the citizens of Frederick County, do hereby ' congratulate, commend, and thank Robert E. Aylor for his many years of dedicated service as Superintendent of Schools for Frederick County, His service has been, is, and will be greatly appreciated by all of the students, parents, and other people with whom he came in contact during his days of public service.
