I ANNEXATION PROCEEDINGS - DISCUSSED - ATTORNEY'S EMPLOYED The Board of- Supervisors after discussion with John Thornton and J. Sloan Kuykendall, Upon motion duly made and seconded, I ' Be it resolved, that the Board of Supervisors employ John Thornton, Attornel at Law and J. Sloan Kuykendall, Attorney at Law, to be Special Attorneys for the Board of Supervisors in the Annexation Case with the City of Winchester, and authorize them to employ financial and engineering experts to gather data and testify on behalf of the County. REPORTS: UPON MOTION duly made and seconded the reports of Harry L. Treasurer; Earl S. Bailey, Commissioner of Revenue; Robert L. DeHaven, Sheriff of Frederick County, Joseph A. Massie, Jr., Commonwealth Attorney; Roberta A. James, Department of Welfa Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and H. C. Crowder, Road Engineer were read and approved. Mr. Claude Neff appeared before the board and explained the reassessment of Rial Estate. A Board of Assessors was recommended by the Board of Supervisors, one from each District or not less than three. Upon motion duly made and seconded, Be it Resolved, Earl Bailey was given permission to order cards and employ a Secretary for Re- assessment by October lat. The above resolution was passed. PARK AUTHORITY - PUBLIC HEARING Upon motion duly made and seconded Be it resolved, that the Board of Supervisors on the first and second read . does herebyY adopt an Ordinance for the creation of a Park Authority and direct that the Clerk o this Board cause notice of public hearing to be held on October 9 1967, at 11:00 A.M. in Board of Supervisor's Room, County Office Building, Winchester, Virginia. F. Artrip and a delegation appeared on behalf of the citizens of Armel Community protesting the closing of Armel School. A petition was presented. Mr. Buel Kincheloe agreed to donate three acres of land for addition to I Armel School with restrictions. NORTHWESTERN VA. COMMUNITY ACTION, INC. - REPORT Mrs. Thelma Clore, representing the Board and Northwestern Virginia 'Community Action, Inc., gave a report on the work of the program. VACCINATION OF DOGS - SCHEDULE Upon motion duly made and seconded, Be it resolved, Henry Bursey and R. W. Williams to have permission to set up:)schedule with Veterinarians for Vaccination of Dogs. The above resolution was passed. CITY DUMP - PETITION OPPOSING Mr. Robert H. Frey appeared before the Board with a petition opposing to the City Dump and asking for the Board to do what is necessary to eliminate the City Dump. ' SHERIFF - REQUEST OF ADDITIONAL DEPUTY - APPROVED Robert L. DeHaven, Sheriff appeared before the Board and requested an additional Deputy at a Salary of $4,800.00 per year, a filing cabinet, book shelf, and two chairs for the office, Upon motion duly made and seconded, Be it resolved, That the Board approved all of the above request of Sheriff, Robert L. DeHaven. BUDGET IN JULY, 1968, - STAY WITHIN ALLOCATION Upon motion duly made and seconded, Be it resolved, That each County Official to stay withiiLthe amount ' of his Budget unless the case of Emergency beginning the fiscal year of July 1, 1968 to June 30, 1969. The Clerk is to notify all agencies to submit their Budget by March 1, 196$. I ANNEXATION - RETAINER FEES Upon motion duly made and seconded, Be it resolved, That the Board agrees to pay the retainer fees of $1,500.00 each to the law firms of Kuykendall and Thornton for representing County in the Annexation proceedings. Be it Resolved, that the Board of.Supervisors hold a Special Meeting concerning the Frederick County Dump to be held on the 26 day of September , 1967 at P.M. :•t I:i:y t • • Upon motion duly made and seconded, Be it Resolved, that the Board of Supervisors does hereby declare that there shall be a second regular meeting of the Board at 7:00 P.M. on the fourth Tuesday of every month. The above resolution was passed. Upon motion dulyindde and seconded, Be it Resolved, that the Board of Supervisors does hereby rescind all prior action taken in the adoption of a concurrent resolution for the establishment of a Regional Park Authority for the Lower Shenandoah Valley. The above resolution was passed. Upon motion duly made and seconded, Be it Resolved, that the Board of Supervisors does hereby create the 221 office of Executive Secretary for the Board of Supervisors, to become effective January 1, 1968; and, Be it further Resolved, that the Board of Supervisors through its Chairman, appoint a committee to receive applications and interview persons for the said office and make recommendations to the Board. Upon motion duly made and seconded, Be it Resolved, that the Board does hereby approve the Hospital Contract of Medical College df Virginia, for July 1, 1967 to 1, 1968 at the rate of $37.46. The above resolution was passed. Upon motion duly made and seconded, Whereas, legislation has been introduced into the United States Congress (S 927, HR 3210 ER 6547 and HR 7205) which deals with the assessment of transportation pro of common carriers, and more particularly the ratio of assessments of such property to the true market value of the property as compared to other property, and the tax rate applied to such properties as compared to the tax rates of other properties, and Whereas, the Commonwealth of Virginia has taken effective steps towards the equalization of property tax assessments of common carriers and other types of property, M. Whereas, the Board of Supervisors of Frederick County has carefully these bills and is concerned with these.proposals of,their impact, upon state and local administration of property taxes, and has concluded that such proposals,if enacted, would seriously jeopardize state and local authority to resolve tax problems at the local level, state and local authority to classify property within the state, Now , Therefore, Be it Resolved, That the Board of Supervisors of Frederick County at its meeting in Frederick County, Virginia, held September 11, 1967, does hereby adopt a policy in opposition to the federal legislation typified by S 927, HR 321 HR 6547 and HR.7205; and, Be it further Resolved, That the Clerk of the Board of Supervisors of Frederick County be directed to inform congressional representatives in Congress of Frederick County the position of the Board of Supervisors relating such proposed legislation. Smith, Caretaker of the Dump, stop Burning of Trash at the County Dump, effective as of this date. The above resolution..was passed., 2.2 2 V Upon motion duly made and seconded, Be it resolved, to improve Woodland and Brown Street off Woodstock Lane providing it does not interfere with the appropriation on Roads approved by the Road Viewers, provided Funds are available after the Road Viewers Priority One, Two and Three. - The above resolution was passed. ACCOUNTS PAYABLE Accounts totaling $15 were read and approved and ordered to be paid from the General County Funds by Warrants 2649 and 2729 inclusive; Livestock, Fowl Claim and Henry Bursey;s Salary totaling $561.70 were read and ordered to be paid from the Dog Fund by Warrants 34 and 40 inclusive. Dickerson, of the Frederick County Health Department, Dr. Grimm, Dr. Fish and Dr. Arthur,'Tetebinarians, appeared before the Board to discuss the Dog Vaccination Clinic. Actiolby the Board was continued'to the October meeting for a decision. •i r A. M. Gooden, Jr., an interested citizen appeared before the Board and talked about the present situation at the County Dump.
