At the Regular Meeting of the Board of Supervisors of Frederick County, Virginia,
held in the Supervisors Room on the 12th day of June, 1967.
PRESENT: B. 0. Brumback, Chairman; Thomas B.Brumback, W. Hurl Himelright, Paul

The minutes of the last meeting held on the 8th day of May, 1967, were read and
' approved.
REPORTS: UPON MOTION duly made and seconded the reports of Harry L. McCann, Treasu er;
Earl S. Bailey, Commissioner of Revenue; Robert L. DeHaven, Sheriff of Frederick County,
Joseph A. Massie, Jr., Commonwealth Attorney; Roberta A. James, Department of Welfare,
' Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and H. C. Crowder, Road
Engineer were read and approved.
SMUDGE POTS - SMOKE
C. C. Mayes and a delegation of Frederick County Citizens appeared before the Board
with a petition objecting to the burning of Smudge Pots in Frederick County, Virginia.
Action by the Board was continued to the July meeting.
DISPLAY OF FIREWORKS - PERMITS
Upon motion duly made and seconded, the following resolution was passed:
Whereas, the persons listed below have petitioned the Board of Supervisors for a
permit as provided for in Section 59 -215 of the Code of Virginia for 1950 for a display of
fireworks at the locations listed below and on the following dates, under his discretion and
supervision and by his employees only:
Raymond Clay, Wonderland Gift Shop, Tom Rosenberger, Shawnee -land; Neil Blum,
Wards Plaza; William E. Sine, Winchester Drive -In Theater; William Dalke,',Dalke's Drive -In
Theater, John Goodwin, Lake St. Clair and J. G. Place, J. G. Place Manufacturing Co., Carpers
Valley Golf Club, Winchester, Virginia, and North -South Skirmish Association by George T.
Hocker.
Now, Therefore, Be it Resolved,
That the above named people and they hereby are granted permission for a display
of fireworks on Tuesday, July 4, 1967 at approximately 8:00 P.M. Frederick County, Virginia
under their control and discretion, and by their employees only and provided further that
their customers and guest be no closer than 200 feet to said display of fireworks.
And be it further resolved that the Chairman of the Board of Supervisors by signing
' a copy of this resolution may grant the required permit.
WESTWOOD SUBDIVISION - WESTWOOD CIRCLE HIGHWAY ADDED TO SYSTEM
WHEREAS, Westwood Circle in the Westwood Subdivision has been constructed in
accordance with the Frederick County Subdivision Ordinance and the Virginia Department of
Highways Standards for subdivision streets and now renders a public service and
NOW, THEREFORE, BE IT RESOLVED that Westwood Circle in the Westwood Subdivision from
Route 822 north .06 mile to a cul -de -sac be added to the Secondary Highway System of Frederic
County.
An unrestricted right of way 56' in width is guaranteed. This right.of way is
recorded in the Clerk's Office of Frederick County in Deed Book No. 286, Page 9, dated
February 11, 1963.
This street has been graded to a roadway width of 28' exclusive of ditches and
has a crushed stone base 5'•' in depth and is bituminous surface treated 20' in width.
The above motion was carried.

WILSON AVENUE - ACCEPTED AS IST PRIORITY
Route b35 to 634 Buckhorn Lane, Woodchuck Lane
Upon motion duly made and seconded,
Be it Resolved, that the Board rescinded the No. 1 Priority (Kent Street Ext.) due
to fact that a right of way is not obtainable at this time.
The Board accepted Wilson Avenue as No. 1 Priority; Buckhorn Lane; No. 2 Priority;
Extension of•Route 635 to Route 634, No. 3 Priority; and Woodchuck Lane, NO. 4 Priority. '
TRI- COUNTY REFUSE SERVICE
Mr. Dellinger appeared before the Board to explain the land fill system of garbage
at the county dump. '
A committee was appointed to study and consider the problem:
Roy W. Williams, Arthur Gooden, Donald Baughman, Thomas Brumback.
SCHOOL BOARD - TRANSFER OF FUNDS
Upon motion duly made and seconded,
Be it resolved, that the Board of Supervisors grant permission to the Frederick
County School Board for transfers within the 1966 - school budget to provide for additional
needed expenditures in administration; Evening, Part Time, Summer School; Other Instructional
Costs; Auxiliary Agencies; Operational of School Plant; Maintenance of School Plant; Capital
Outlay and Building Fund. The request is made on condition that the School Board's expendituies
for the year from count/ tax funds do not exceed the 1966 -67 appropriation of $950,757.00 for
Operation and Capital Outlay, will permit the School Board to use any additional funds
allocated from the state for operation and /or Capital Outlay as well as funds from the approv d '
Literary Loan Fund for School Construction.
SALES TAX - RESCIND INCREASE EFFECTIVE JULY 1, 1968
Upon motion made by Paul Luttrell and seconded by Donald L. Baughman;
Be it Resolved, that the Board of Supervisors of Frederick County, Virginia, reques
the General Assembly to rescind the Acts providing for a 1% sales tax increase effective July
1, 1968, on the grounds that it does not now appear to be needed in the light of reports,that
the State Department of Taxation expect a surplus at the end of the present biennium.
The above resolution was passed.
CATHER LAND - PUBLIC HEARING
The following is a resolution that was passed at the June 7, 1967 Planning Commission '
Meeting.
Be it Resolved, that the petition of J. Bentley Cather, Admr. of the estate of Jame
A. Cather and Rosa C. Hook, admr. of the estate of Carrie M. Cather for an amendment to the
Zoning Ordinance'to change the within described land from use as R -1 to R -2 to permit the
Construction of Physician and Dental Offices, be and the same is hereby approved, and '
It is further resolved that this P etition be favorably recommended to the Board of
Supervisors.
After due consideration and upon motion duly made and seconded,
The Board accepted the petition of J. Ben Cather, et al on the Cather Land as
presented by the Planning Commission.
The motion was carried.
RAILROAD CROSSINGS - REPAIR AND IMPROVEMENTS
Upon motion duly made and seconded, Joseph A. Mas$ie, Jr. was instructed by the
bard of Supervisor's to contact the officials of Pennsylvania Rai�lrol and B & 0 Railroad for
.he repair and improvements of the various railroad trabks locat9 at elltown Pike, Route
i27, at Middletown, Virginia, and Featherbed Lane Railroad Crossings.

BROWN MARSHALL and RALPH - CONDEMNATION OF LAND ALONG'ROUTE 664
Upon Motion duly made and seconded,
' Be it resolved, that the Board of Supervisors do hereby authorize the Commonwealt
Attorney to offer the sum of One Dollar ($1.00) to Ralph Brown and Marshall Brown, the same
being the value of the land -taken along State Secondary Route /664, less the value of
appreciation, the same to be in effect to July 7, 1967.
The above motion was passed.
ANNEXATION OF CITY OF WINCHESTER
Upon motion duly made and seconded,
Be it Resolved, that the Board do hereby authorize the Commonwealth Attorney to
immediately proceed to,-gather information and plan and build the defense to the proposed
annexation suit by the City of Winchester, and to employ counsel and technical experts to
expedite the same.
The above resolution was passed.
GENERAL FUND - TRANSFER OF FUNDS
Upon motion duly made and seconded,
Be it resolved,that for the fiscal year beginning July 1st, 1967, and ending
June 30, 1968, the Treasurer is directed to transfer.to the various funds the amounts as
forth in the 1967 -1968 Budget for those funds as the money is available, and needed.
The resolution was passed.
E. L. PETERS SUBDIVISION - ORDINANCE TO AMEND ZONING ORDINANCE
AN ORDINANCE TO AMEND THE ZONING ORDINANCE
OF FREDERICK COUNTY, VIRGINIA, WHICH WAS
WHEREAS E. L. Peters and Ruth Peters, his wife, own a certain tract of land in
Frederick County, Virginia, fronting on the North side of Senseny Road and adjoining the le
of Christ Episcopal Church on the West and the other lands of Peters on the East and North;
and,
WHEREAS, the Senseny Road Elementary School is located just West of said Church
prepeMy; and,
WHEREAS, the surrounding area is developing into a residential area and there is
need for a shopping area.
NOW, THEREFORE, BE IT RESOLVED that the petition of E. L.Peters and Ruth Peters
the rezoning of Parcel "A" containing 6 acres, more or less, and Parcell "B" containing
14,950 square feet, more or less, as shown on the plat and plan of Quentin R. Shortt, C
Land Surveyor, with the approval of the Frederick County Planning Commission be and the same)
is hereby ratified and approved, whereby Parcels VA" and "B" are rezoned from R -1 to B-1.
And BE IT FUTHER RESOLVED that the petition of E. L. Peters and Ruth Peters for
the rezoning of Parcel "C" containing 42,000 square feet, more or less, and Parcel "D"
containing 3.5 acres, more or less, as shown on the plat and plan of Quentin R. Shortt,
Certified Land Surveyor, with approval of the Frederick County Planning Commission be and
the same is hereby ratified and approved whereby Parcels "C" and "D" are rezoned from
R -1 to R -2.
This Ordinance is hereby duly adoptedfafter due notice and the holding of a
hearing, this 12th day of June, 1967.

Accounts totaling $25,293.31 were read add approved and ordered to be paid from
General County Funds by Warrants 2341 and 2416 inclusive: Livestock, Fowl Claim and Henry
Bursey's Salary totaling $528.28 were read and ordered to be paid from the Dog Fund by
Warrants 8 and 15 inclusive.
UPON MOTION DULY MADE AND SECONDED, IT IS ORDERED THAT THE BOARD DO NOW ADJOURN.
Upon motion duly made and seconded the Frederick County Budget for the fiscal
year from July 1, 1967 to June 30, 1968, be and hereby is approved.
The Budget was advertised on June 9, 1967, in the Winchester Evening Star.
