HomeMy WebLinkAboutDecember 15, 1992 Special Meeting 174 A special meeting of the Frederick County Board of Supervi- sors was held on Tuesday, December 15, at 12: 00 noon, in the Winchester Regional Airport Conference Room, 491 Airport Road, Winchester, Virginia. PRESENT: Chairman Richard G. Dick; Vice-Chairman W. Harrington Smith, Jr.; James L. Longerbeam; Robert M. Sager; Beverly J. Sherwood; and Charles W. Orndoff, Sr. (Supervisor smith arrived during the Executive Session.) CALL TO ORDER The Chairman called the meeting to order. DECLARATION OF EMERGENCY SERVICES - APPROVED Director of Fire and Rescue Services Tom Owens briefed the Board of Supervisors on the snow storm of Friday, December 11, 1992 through Saturday, December 12, 1992, and excellent volun- teer response thereto. Chairman Dick praised Tom's professional response. Upon motion made by Beverly J. Sherwood, seconded by Charles W. Orndoff, Sr., to approve the Declaration of Emergency as follows: DECLARATION OF A LOCAL EMERGENCY WHEREAS, the Board of Supervisors of the County of Frederick does hereby find that: 1. Due to heavy snowfall, the County of Frederick is facing dangerous conditions; 2. Conditions exist which can create extreme peril and undue hardship for the citizens of Frederick County and necessitates the proclamation of a State of Emergency; NOW, THEREFORE, it is hereby proclaimed that an emergency now exists throughout Frederick County; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said emergency, the powers, functions, and duties of the Director of Emergency Services and the Emergency Service Organizations of the County of Frederick shall be those prescribed by State Law and the ordinances, resolutions, and approved plans of the County of Frederick in order to mitigate the effects of said emergency. Orndoff, Sr. - Aye 175 RESOLUTION URGING CONGRESS TO RESTORE THE LOCAL GOVERNMENT EXEMPTION FOR DEMONSTRATING FINANCIAL ASSURANCE ON LANDFILL CLOSURE - APPROVED John Riley presented a resolution requested by the Virginia Association of Counties requesting Congress to restore the local government exemption for demonstrating financial assurance on landfill closure projects. Upon motion made by Robert M. Sager, seconded by James L. Longerbeam, the following resolution was approved: WHEREAS, on October 9, 1991, the U.S. Environmental Protection Agency promulgated new regulations pursuant to subtitle D of the federal Resource Conservation and Recov- ery Act which establish stringent standards for the loca- tion, design, and operation of solid waste landfills; and WHEREAS, most of the federal Subtitle D regulations, which were developed over a period of seven years, become effective on October 9, 1993; and WHEREAS, these regulations will remove the exemption which now applies to Frederick County in being required to demonstrate financial assurance; and WHEREAS, financial assurance requirements will require Frederick County to demonstrate the ability to meet the financial costs of closure, 30 year post-closure monitor- ing, and corrective; and WHEREAS, financial assurance requirements are expected to impose upon Frederick County extreme and unnecessary financial burdens; and WHEREAS, Frederick to develop strategies requirements; County will require additional time for meeting financial assurance NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of supervisors urges Congress to direct the Uni ted States Environmental Protection Agency to restore the exemption to Frederick County and all other local governments in demonstrating financial assurance. Sager, seconded by Beverly J. Sherwood, an additional supplemental appropriation of $4,000 for Christmas bonuses for a total of $44,000 was approved. Orndoff, Sr., the board retired into Executive Session in accordance with Virginia Code, 1950, as amended, Section 2.1-344, Subsection A, (5) and (7) to discuss a perspective new business and legal matters. Orndoff, Sr., seconded by Beverly J. Sherwood, the board withdrew from Executive Session. The above motion was approved by the following recorded vote: Richard G. Dick - Aye W. Orndoff, Sr., the board reconvened into regular sess~on and certified that they only discussed a perspective new business and legal matters during the Executive Session. J I '1 i I 178 A Regular Meeting of the Frederick County Board of Super- visors was held on January 13, 1993, at 7:15 P.M., in the Board of supervisor's Meeting Room, Frederick County Courthouse, Loudoun street Mall, Winchester, Virginia. PRESENT: Richard G. Dick, Chairman; W. Harrington Smith, Jr., Vice-Chairman; James L. Longerbeam; Robert M. Sager; Beverly J. Sherwood and Charles W. Orndoff, Sr. CALL TO ORDER The Chairman called the meeting to order. INVOCATION The invocation was delivered by Reverend Jeff Cannon of the Mt. Pleasant United Methodist Church. AGENDA ADOPTED AS AMENDED Mrs. Sherwood requested time under county officials for discussion of adding an additional at-large member to the Planning Commission. Mr. Riley asked that a request from the EDC be pulled from the County Finance Committee report. Upon motion made by Robert M.
