THIS AGREEMENT, made and dated this 1st day of September, 1966, by and
between the County of Frederick, Virginia, party of the first part, and Sternheimer Bros,
Incorporated, of Richmond, Virginia, party of the second part.
WHEREAS, the parties hereto entered into an agreement on January 19 „ 1966,
for rental of certain store property on North Loudoun Street in the City of Winchester,
and
WHEREAS, it is the desire of the parties hereto to include additional
property under said lease for additional rent, the said additional property to be under the
same terms and conditions of the original instrument of January 19, 1966.
NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That for and in consideration
of the sum of Ninety Dollars ($90.00) per month, the party of the first part does hereby leas
to the party of the second part and the party of the second part does hereby lease from the
party of the first part, all of that certain store room adjacent to and North of the present
store room leased by the party of the second part, this additional store room fronting on
North Loudoun Street and extending back to a masonry supporting wall and being the front room
of said premises.
The party of the second part agrees to pay a rental of Ninety Dollars ($90
per month in addition to the rental paid for the adjacent premises on the South side of the
same, begi October 1, 1966.
It is understood and agreed between parties hereto that this is an addi
of the premises leased by the agreement of January 19, 1966 and shall be incorporated herein
by reference and subject to all of the terms and conditions of said agreement of January 19,
1966, and the references therein contained.
Further, as provided for in the original lease dated January 30, 1959, the
Lessee shall have the right to install its own heating and air conditioning systems, ceiling
light fixtures, and fixtures and equipment as may be necessary and desirable for the conduct
of its business. All of the above items installed may be removed from the leased premises
by the Lessee at any time, or at the expiration of the lease.
The Lessee shall have the right to change or alter the front and th= wind
on the North side of the Building.
Further, the Lessee shall have the right to remove the radiators and air
conditioning ducts., and shall cap the pipes and ducts, after same are removed. The above
radiators, if removed, will be delivered to the vacant storeroom area in the rear of this
leased portion of the Building.
IN WITNESS WHEREOF, both parties undersigned, agree to and accept the
foregoing terms and conditions set forth herein and each by proper resolution, first by the
Board of Supervisors of Frederick County and second by the Board of Directors of the party of
the second part, have executed the same by their proper officers.

'Be it resolved that the Board of Supervisor's of Frederick County, Virginia
hereby supports the creation of Northwestern Virginia Community Action, Inc. by the Counties
of Frederick, Clarke, Warren and the City of Winchester, for the purposes initially of
dete rmining whether there is a need for the Office of Economic Opportunity and its activities
in the said political subdivisions.
Be it further resolved, that Thelma T. Clore be and she is hereby elected
to the Board of Directors of said Corporation in accordance with its Articles of Incorporation
and By -laws.

DOG ORDINANCE
Upon motion duly made and seconded,
Be it resolved that there having been held a public hearing on a Dog Ord
for vicious and destructive dogs, and there being no objections, it is therefore adopted on
final reading as follows:
DOG ORDINANCE
ARTICLE ONE
1. Any dog that has been known to attack or to attempt to attack or inju !
any person shall be deemed a dangerous or vicious dog.
2. It shall be unlawful for any owner or custodian, to permit or suffer
a dangerous or vicious dog to go at large within the County.
3. Any dangerous or vicious dog shall be kept securely confined upon the
premises of the owner or custodian, and, if removed from such premises, shall be muzzled and
secured by a leash in the hands of a person able to control such dog, or shall be confined in
side a vehicle or cage.
4. Upon the complaint of any person and the issuance of a warrant by the
County Court or any Justice -of the Peace, any such dog so complained of shall be taken and he
in custody by the Sheriff, his deputies or any police officer having Jurisdiction, from'the
moment of the execution of any such warrant, and shall be so held until such warrant has been
finally disposed of. Should the owner or custodian thereof be convicted of violating this
section, the Court shall, in addition to imposing a fine, or sentence, or both, as provided
by law, upon such owner or custodian as hereinafter specified, order such owner or custodian,
to pay to the Treasurer of 'Frederick County, Virginia, the sum of Two Dollars and Fifty Cents
($2.50) per day for each day that said dog is held in custody, and upon a second conviction,
shall order the destruction of said dog by the Dog Warden of Frederick County.
5. Should such owner or custodian be found not guilty, then such dog shall,
be forthwith released to the owner without cost to the owner or custodian.
ARTICLE II - DESTRUCTIVE DOGS
1. It shall be unlawful for the owner or custodian of any dog to;allow
or permit such dog continuously to go upon the premises of some other person and commit acts
of destruction, such as destroying or injuring vegetables, shrubbery, flowers or any other
property of such other person, after�hoticeriniwritingyfrom the aggrieved party has been duly
, upon the owner or custodian of such dog.
2. The owner or custodian of any dog in violation of this provision, shalt
upon conviction thereof, be punished as hereinafter provided. Upon a conviction for a second
offense of this ordinance, the court may order said dog to be destroyed and disposed of by th
Dog Warden of Frederick'-County, ins :addtion to any other penalties that may be imposed as here
provided.
ARTICLE III
If the owner or custodian of any of the dogs hereinabove specified shall
conceal it or otherwise hinder the Sheriff or any of his deputies, or any member of the polic
executing the order of the Court, such person shall be punished as Hereinafter set forth.
- ARTICLE IV - PENALTY
Upon the conviction of any person or persons for violation of any of the
sections of this ordinance, the punishment shall be fixed by the court or Jury trying the ca.

Mr. Melton Wright appeared before the board requesting the transfer of
additional funds to be used for remodeling Miller School for accommodations for School Board
offices.
The board passed a resolution to approve the School Board's request for

Industrial Access or other funds to improve the service road leading north 0.40 mile from the
Kernstown Interchange on Route 81 serving the new plat of the Shenandaoh Gas Company.

Upon motion duly made and seconded,
Be it resolved that the clerk order street signs for subdivisions approved

by the Department of Highways and now in the highway system.
R. C. King of the highway department was to check on the type and size of
signs tol.be erected.
MILLER SCHOOL - REMODELING
Mr. Melton Wright appeared before the board requesting the transfer of
additional funds to be used for remodeling Miller School for accommodations for School Board
offices.
The board passed a resolution to approve the School Board's request for
use of additional funds for remodeling.
ANNEXATION MEETING - CITY AND COUNTY
There will be a meeting of the Frederick County Board of Supervisor's and
the City of inchester in the Board Room on November 29 1966 at 7:30 P. M. on the annexatio:
of the County of Frederick by the City of Winchester.
COUNTY DUMP - IMPROPER USE -
Upon motion duly made and seconded,
Be it resolved, that the Sheriff check on the Frederick County Dump for
' II improper use.
The Above resolution was passed.
ZONING ORDINANCE - COMMITTEE ,
Joseph A. Massie, Jr., Donald L. Baughman, and W. Hurl Himelright, were
appointed a committee to examine the zging ordinance.
THISTLE ORDINANCE - SECOND READING
Upon motion duly made and seconded,
Be it resolved that the Thistle Ordinance be and the same is hereby
approved on the second reading and be it further resolved that there be a.patlic; hearing
on said ordinance on Monday, December 12, 1966 at 11:00 A. M.

The Board of Supervisors of Frederick County will hold a Public Hearing
on the proposed Thistle Ordinance at 11:00 A.M. Monday, December 12, 1966, which ordinance is
set forth in Title 3, Chapter 13, Article 4 of the Code of Virginia for 1950 as amended, whit.
Ordinance requires land owners, upon request by the Commissioner of Agriculture or his agent
and employees, to spray for musk and curled thistle, penalties for refusing to do so, and civ
penalties if spraying done by Agriculture authorities.

The following is approval by the State Highway Department:
In accordance with resolutions passed by your Board on August 8, 1966,
changes in the Primary and Secondary Systems, made necessary by relocation and construction
on Route 522 in Frederick County were confirmed by the Highway Commission on October 13, 1966;
as shown on the attached sketch and described as follows:
SECTION DISCONTINUED AS PROVIDED UNDER SECTION 33-7 OF THE CODE OF VIRGINIA:
Section 1 - Old location of Route 522, south of the new location, from
the new location at Station 102 } 00 west 0.04 mile to the
new connection opposite Station 104 + 40.
SECTIONS TRANSFERRED TO THE SECONDARY SYSTEM AS PROVIDED UNDER SECTION 33-27 OF THE 1950

An unrestricted right of way of 56 feet in width is guaranteed, This right of
' I way is recorded in the Clerk's Office of Frederick County in Deed Book 302, Page 656, dated
September 1, 1964.
This street has been constructed by the subdivider in accordance with the Coun
ordinance and the Highway Department Policy for subdivision streets. It has been graded to
a roadway width of 28 feet, exclusive of ditches and has a base of 6 inches of crushed
aggregate and2 inches of S -5 bituminous concrete surface 20 feet in width.
ACCOUNTS PAYABLE
Accounts totaling #17,400.37 were read and approved and ordered to be paid
from the General County Funds by Warrants 1734 -1935 inclusive: Livestock, Fowl Claim and
