The minutes of the last meeting held on the 9th day of May, 1966 were read
and approved.
REPORTS: Upon motion duly made-and seconded the reports of Harry L. McCann,
Treasurer; Earl S. Bailey, Commissioner of Revenue; Robert L. DeHaven, Sheriff of Frederick
County; Joseph A. Massie, Jr., Commonwealth Attorney; Roberta A. James, Department of Welfare,
' Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and H. C. Crowder, Road
Engineer were read and approved.
ORCHARD TERRACE - P. D. PLUMLY LAND - DEED OF VACATION
.Upon motion of Donald Baughman and seconded by W. Hurl Himelright, the
following resolution was adopted:
BE IT RESOLVED That the Clerk cause to be recorded in the proper Deed Book
and upon the face of the Deed of Dedication and in the indexes for Deed Books, a Deed of
Vacation of a portion of Subdivision No. 2, of Orchard Terrace, Plumly Development recorded
in Deed Book 203, Page 579•
The above resolution was passed. Due notice of public hearing and approval
of the Board was given on June 14, 1965 in Supervisor's Book No. 10, Page 106.
Upon motion of Donald Baughman and seconded by W. Hurl Himelright, the
following resolution was adopted:
BE IT RESOLVED That the minutes of the Board of Supervisor's dated May 9
1966 in regard to the report of the Road Viewers is hereby amended by deletion of the last
two words of the let paragraph, to -wit: "Hereinafter described" and the following words
be added place of said two words, to -wit: "As hereinafter set forth be and the same is
hereby accepted."
COURT HOUSE PROPERTY - POLITICAL. PURPOSES
Upon motion duly made and seconded,
BE IT RESOLVED That the use of the Court House Property for Political or any
' purposes, must first be approved by the Board of Supervisor's.
COURT HOUSE PLAZA - H. F. BYRD, JR. - POLITICAL RALLY
Upon motion of W. Hurl Himelright and seconded by Paul G. Luttrell.
' BE IT RESOLVED That U. S. Senator H. F. Byrd, Jr., may use the County Court
House Plaza from 9:00 P. M. Friday, July 8, 1966, to 9:00 E. M., Saturday July 9, 1966, for
the purpose of a political rally, without liability to the County.
SCHOOL FUNDS - BORROW MONEY" - TRANSFER OF FUNDS
Upon motion duly made and seconded,
BE IT RESOLVED That the following proposed resolution of the School Board
for Transfer of Funds within the 1965 -1966 Budget as well as use of anticipated further funds
to be received for Federal and State Agencies be and the same is hereby approved:
The Frederick County School Board hereby requests the Frederick County Board

of Supervisors to grant permission for transfers within the 1965_1966 school Budget to
for additional needed expenditures in Administration, Auxiliary Agencies, Operation of School
Plant, Capital Outlay and Building Fund. The request is made on condition that the School
Board's expenditures for the year from county tax funds do not exceed the 1965 -1966 approp
of $778,480.00 for Operation and Capital Outlay, and will also permit the School Board to
use any additional funds allocated from the State as well as funds within the limits of ap
Literary Loan Fund for School construction."
MASSIF AND WALNUT STREET - T. B. MASSIE SUBDIVISION
Upon motion duly made and seconded,
BE IT RESOLVED That Massie Street and Walnut Street in the T. B. Massie
Subdivision near Stephens City be taken into the highway system, said Massie Street to be
taken into the said Highway System extends from Route 641 to Walnut Street and Walnut Street
extends from Massie Street 154 feet, upon the payment of 75% of the estimated cost of
construction by the abutting property owners to the Highway Department.

BE IT RESOLVED, That the deed of dedication and plats of Shawnee -Land
for lots around Cherokee Lake be approved and the Chairman of the Board be and he is hereby
authorized to sign the approval of the Board upon the same, after the Treasurer has received
the proper funds (taxes) for processing the same.
ORDINANCE - FREDERICK COUNTY TAX ON PROBATE AND GRANTS OF ADMINISTRATION OF ESTATES
Ordinance for the imposition of a local tax on Probate of Wills or
of Administration of Estates as provided by Section 58 -67.1 of the Code of Virginia as
1. There is hereby imposed a county tax on the probate of every will or
grant of administration in an amount equal to one third of the amount of the state tax on
probate of a will or grant of administration.
2. The Clerk of the Circuit Court of the)ounty collecting the tax impos
under this Ordinance shall pay the saws into the Treasury of the County.
3. This Ordinance shall become effective July 1, 1966•
Upon motion duly made and seconded the above Ordinance was passed on its
third and final reading, the Ordinance.shall be published two times for two successive weeks
in full in the Winchester Evening Star.
SUBDIVISION ORDINANCE - ADM END TO ARTICLE V, SECTION 8
Upon motion duly made and seconded,
Section 8, Article V of the Subdivision Ordinance shall be and is hereby
amended by inserting the words "in a public right of way or Easement" after the word sub-
division and before the word "the ".
The above amendment was passed after public hearing held June 13, 1966,
and this amendment to be effective July 1, 1966•
WINCHESTER - FREDERICK COUNTY HEALTH CENTER BLDG. - SHARE OF COST OF BLDG.
Upon motion duly made and seconded,
BE IT RESOLVED That the Board of Supervisors approve the proportionate

share of the cost of Construction of the Winchester- Frederick County Health Center Building
which has been fixed at $95.00 per month, under the terms of the Contract between the County
and City.
STATE PARK - LOCATION IN NORTHERN SHENANDOAH VALLEY AREA
Upon motion duly made and seconded,

BE IT RESOLVED, by the Board of Supervisors of Frederick County, that
the Division of Parks of the State of Virginia is hereby requested to forthwith consider
' and establish a State Park in the Northern Shenandoah Valley Area.

Bolen, Commissioner of State Parks, Richmond, Virginia.
' � MERRIMAN'S LANE - CONSTRUCTION OF EXTENTION
Upon motion duly made and seconded,
BE IT RESOLVED That the Virginia Department of Highways carry forward
f rom the Budget for 1965 -1966 to the budget for 1966 -1967 the allocation set up for the
construction of the extension of Merriman's Lane.
The above resolution was passed.
Dr. Marks appeared before the board exp laining the trapping program
of Foxes, with request of $1,440.00 for Frederick County Share of expenses which is 45%
of the cost.
Upon motion duly made and seconded the board moved to discontinue state
trapping for one year.

Archie Manuel appeared before the board concerning the Town's share of
Sales Tax for Middletown, in the form of a request for an amount of money to be returned to
the Town's within the County.
A committee consistingof J. A. Massie and Mayor's Lynn Comer and Archie
Manuel to study the above request.

ECONOMICS OPPORTUNITIES PROGRAM
Mr. Grover Jenkins, representative from the Governor's Office, aakdd the
board to support the Economics Opportunities Program for disadvantaged people.
It was continued to the July meeting and would like further information
on the program.
EASTVIEW SUBDIVISION - ALLEN DRIVE - BOND RELEASED
' Upon motion duly made and seconded,
BE IT RESOLVED, That Eastview Subdivision post a bond with the County
to ensure the installation of Allen Drive, in August, 1964.
Inasmuch as the street has been built according to the specifications
of the Highway Department, the street has been installed and accepted into the State system.
The board hereby releases the bond on the installation of Allen Drive,
Eastview Subdivision.

Upon motion of W. Hurl Himelright and seconded by Paul L. Luttrell, it is
ordered that Henry Bursey, be, and hereby is appointed Dog Warden for Frederick County for
the term beginning on the first day of July 1966 for one year.
REPAIRING DEATH RECORD BOOK
Upon motion of Paul Luttrell and seconded by Donald L. Baughman, it is orde
that the Clerk have the two old Death Record Books be combined and made in to a new book.
KENT STREET E XTENDED - REPAIR AND RE-SURFACING
Upon motion duly made and seconded,
The board resolved to continue the repairs and resurfacing of Kent Street
Extended to a later date, pending the right -of -way easement from the rightful owners.
ROAD - BACK CREEK DISTRICT
Upon motion of W. Hurl Himelright and seconded by Paul Luttrell,
Be It Resolved, That W. Hurl Himelright see the proper parties in regard
to obtaining a right of way easement on a road in Back Creek District which is a Second
Priority in the Road Viewer's report for 1966 -1967.

I A. H. UNDERWOOD SUBDIVISION - ADDED TO HIGHWAY SYSTEM
Be it Resolved That the Board of Supervisors recommend to the Department of
Highways that Underwood Lane in A. H. Underwood Subdivision be taken into the Highway System
upon the condition that the property owners pay three- fourth the cost of grading and surfacing
the same and the granting to the said Department of Highways a drainage easement. It being
determined that three - fourth of the cost is $1500.00.
COMMUNITY COLLEGE TECHNICAL SCHOOL - LOCATION IN FREDERICK COUNTY AREA
Upon motion duly made and seconded,
"Be it resolved that the Board of Supervisors recommend to the State Board of
Community Colleges that it place the next such Community College Technical School in the
Frederick County Area because of the expanding population and industrial growth in the area
and that a copy of this resolution be sent to the State Board of Community Colleges."
The above resolution was passed unanimously.

Be it resolved, that the proposed Ordinances on Vicious Dogs and Thistle
be continued to the regular October meeting.

T. G. ADAMS - AMENDMENT TO SUBDIVISION ORDINANCE
Upon motion duly made and seconded,
Be it resolved that the Ordinance amending the Subdivision for Tract
A. Section 4, Echo Village Subdivision be adopted as set forth hereafter:
AN ORDINANCE FOR THE PURPOSE OF AMENDING THE FREDERICK COUNTY SUBDIVISION ORDINANCE ADOPTED '
JANUARY 10 1966 PROVIDING FOR THE SUBDIVISION OF TRACT A, SECTDN FOUR, ECHO VILLAGE SUB-
DIVISION INTO TOWN HOUSES-AND THUS AMENDING ARTICLE FIVE, SECTION FIVE. SUBSECTION (a)
WHEREAS, Tract A, Section Four of Echo Village Subdivision of T. G.
Adams and Rosalie F. Adams has been accepted and approved by the Board of Supervisors for '
multiple housing construction; and,
WHEREAS, it has been recommended by the Planning Commission of Frederic
County that the Subdivision Ordinance of Frederick County be amended to permit the subdivisi n
of said tract into town house lots, as set forth on the proposed plat filed with said
petition of T. G. Adams and Rosalie F. Adams;
NOW, THEREFORE, BE IT ENACTED: That Article Five, Section Five, in
Sub - section (a) of said Subdivision Ordinance be, and the same is hereby amended to provide
that Tract A. Section Four, Echo Village Subdivision of T. G. Adams and Rosalie F. Adams
in Shawnee Magisterial District, Frederick County, Virginia, be, and the same is hereby
amended to provide that residential lots in said Tract A, Section Four of said subdivision
may be a minimum of 16 feet in width and a minimum of 84 feet in length where public water
and Franchise sewer systems are available and the lots connected to the same.

RAILROAD CROSSINGS - PRESENTMENT TO THE GRAND JURY
After some discussion by the Members of the Board, the members each
concurred in a strong suggestion to the Commonwealth Attorney, that he consider presenting
to the Grand Jury for its consideration a presentment charging the B&0 R.R. with failing
and refusing to properly repair and keep in good condition the Railroad Crossings of the
public highways as follows:

Upon motion duly made and seconded,
It is moved that the Board of Supervisors does hereby reject the
proposed dedication to the County of Frederick of a park, being land now owned by Frederick '
Development Cu., in land known as Frederick Heights Subdivision.
The above motion was passed.
Mr. F. L. Glaize, III, informed the Board of Supervisors as an officer
of Frederick Development Company that in consideration of the adoption of the above motion
,just done by the Board of Supervisor's, that his Company will cause to be made a plat of the
proposed park area in Frederick Heights Subdivision and dedicate it to the County and deed
it to the proper authorities as directed by,the Board of Supervisor's.
UPON MOTION DULY MADE AND SECONDED, IT IS ORDERED THAT THE BOARD DO NOW
