A public hearing was heldlin the Supervisor's Room on the 14th day of
June, 1965 at 11:00 A. M., following which, on motion duly made by Grover Teets and seconded
by W. Hurl Himelright the following was unanimously adopted:
BE IT RESOLVED: That it being in keeping with good zoning practice
and in the public interest, the existing County Zoning Ordinance is hereby amended for
commercial purposes as a motel, restaurant, and /or automobile service station on the followin4
tract of land:
That certain triangular tract or parcel of land situate in Stonewall
District, Frederick County, Virginia, about three miles north of the City of Winchester,

lying north of the City of Winchester, lying to the North of Red Bud Road, to the east of
Route 11 North, and to the south and west of U. S. Interstate Highway No. 81 and the Interstat
81 interchange entranca, and containing 7.2 acres, more or less.

A public hearing was heldlin the Supervisor's Room on the 14th day of
June, 1965 at 11:00 A. M., following which, of motion of Paul Luttrell and seconded by
Donald L. Baughman the following was unanimously adopted:
NOW, THEREFORE, BE IT ENACTED:
There is hereby excepted from Paragraph Six of the Frederick County
Subdivision Ordinance all that lot or parcel of land lying and being sutuate on the north
side of State Secondary Road 657 (Senseny Road) in Shawnee Magisterial District, containing
7.3 acres, more or less, being the same realty,owned by Brownie Kern Sutton and under option
between Brownie Kern Sutton and W -D Company, Inc., provided however that water and sewer
(Municipal) shall be provided and attached to �ach dwelling.
Be it resolved that the above amendment to the Frederick County Subdi
Ordinance passed its third and final reading and is enacted.
ORCHARD 'TERRACE - P. D. PLUMLY LAND - VACATIONIOF PLAT
A public hearing was heldjin the Supervisor's Room on the 14th day of
June, 1965 at 11:30 A. M., following which, o motion of Grover Teets and seconded by W.
Himelright the following was unanimlusly adopted:
WHEREAS, by and with an i.nsturment dated January 2, 1948 P. W. Plumly
recorded in the Clerk's Office of the Circuit Court of Frederick County, Virginia.. in Deed
Book 203, page 579 the plat of a subdivision o� i his property to be called Subdivision No. 2,
Orchard Terrace Plumly Development and located partly in Frederick County and partly in the
City of Winchester, and

WHEREAS, of the 179 lot in this subdivision only six have been sold, none
since 1949, and of the six sold, only four located in Frederick County, and
WHEREAS, none of the streets in the subdivision in Frederick County have
ever been opened to public use, and
WHEREAS, Paul D. Plumly desires to use this land for the storage of lumber

in connection with the operation of P. W. Plumly Lumber Corporation and such use is not
inconsistent with the public welfare or best interests of the property owners in the subdivis]
and
WHEREAS, Section 15.1 - 482 of the Code of Virginia, as amended, gives
the governing body of the county in which the land shown on the plat to be vacated lies, the
authority to vacate such plat:
Now therefore, be it resolved that such portion of the plat of the
subdivision named Subdivision No. 2 Orchard Terrace Plumly Development as is located in
Frederick County, Virginia, be and it hereby is vacated, except for lots 104, 105, 106 and

I RE- ASSESSMENT OF REAL ESTATE - FREDERICK COUNTY TAXPA7M'S ASSOCIATION INC.
Joshua G. Place, President of the Frederick County Taxpayers Association
appeared before the board and requested the board to vote on repeal of the 1964 Re- Assessment
of Real Estate.
On ruling of Attorney General the Board could not take any legal action.
ZUCKERMAN COMPANY, INC. - PROPERTY- ROUTE 11 NORTH
Winifred Beckner, spokesman for a delegation, appeared before the board
land requested that they take action to prevent the use of property on Route # 11 North of
Zuckerman Co., Inc., as a Junk Yard.
Petitions were presented signed by persons objecting to the Junk Yard.
Mr. Joseph Zuckerman and his attorney J. R. Larrick appeared before the
Board on application for merchants license on the property purchased between the Pennsylvania
R. R. and U. S. Highway # 11, which bad been referred to the Board by the Commissioner of
Revenue.
The Board agreed to refer the requests to the Planning Commission for
study and consideration.
The report of the Road Viewers, who were appointed by the Board of
Supervisors on the 14th day of September, 1964, to examine roads or Routes hereinafter

Merriman's Lane from end of Maintenance on Rt. 621 to Rt. 622, 1.10 Miles,
mintrmim Fifty Foot (50) Right of Way. Cost $12,000.00. The road is traveled by school busses

On Monday, July 12, 1965 at 11:00 A. M. in the Board Room of the Superv:
of Frederick County, Virginia in the County Office Building, there will be a public hearing
concerning an ordinance for the purpose of adopting Article II, containing Sections 15 -779
through 15- 794 .3, Title 15 of the Code of Virginia for 1950 and as amended, providing certain
local requirements for Subdivisions and approv penalties for violations thereof.
This ordinance to replace the ordinance now in effect and which ordinan
provides for penalities for the violation thereof. A copy of same is on file with the Clerk
of the Board and the Clerk of the Circuit Court of Frederick Co., Va.

FREDERICK COUNTY SCHOOL BOARD - REQUEST
The board approved a request from the Frederick County School Board
its Superintendent, Robert E. Aylor, for transfers within the 1964 -1965 School Budget to
provide for additional needed expenditures in the following budget items: Administration;
Evening, Part Time and Summer School; Maintenance of School Plant; Fixed Charges and Capital
Outlay. The approval was granted on condition that the School Board's exepnditures for the
year from ccu my tax funds not exceed the 1964 -1965 appropriation of $644,685.00 for operatio.
and capital outlay plus an additional expenditure of $11,454.88 used for the Maintenance Shop
and for which earlier approval had been given.
NORTHWESTERN PSYCHIATRIC CLINIC
Dr. Bruce Gray appeared before the Board and explained the purpose of the
Northwestern Psychiatric Clinic.
A general discussion was had and no action was taken.
BENSON - LOTS - SECTION ONE
Upon motion duly made and seconded the Deed of Dedication of the Benson
Lots, Section One was received and accepted for final approval.
FREDERICK COUNTY HEALTH DEPARTMENT - REQUEST
Dr. L. 0. Fears and Dr. J. D. Hornner appeared before the board on behalf
of the Frederick County Health Department requesting the board to raise their appropriation
up to $10,554.17 for the 1965 -1966 Fiscal Year. Which would be an increase of $1,683.75.
The board took no action on the request.
Be it ordained that the School Board for the County of Frederick shall
not be required to be bound by Sections 22 -232.1 through 22- 232.17 of the Code of Virginia
for 1950 as amended, which Sections deal with the Pupil Placement Board of the Commonwealth
of Virginia, and
BE IT FURTHER ORDAINED That said School Board shall be bound by Article
1,2 and all of its sections of the Code of Virginia for 1950 as Amended being sections 22-
232.18 through 22- 232.31 for the placement and assignment of the pupils attending the
County Schools.
ACCOUNTS PAYABLE
Accounts totaling $16,683.94 were read and approved and ordered to be
paid from the General County Funds by Warrants 189 and 257 inclusive: Livestock, Fowl Claim
and Henry Bursey's Salary totaling $566.01 were read and ordered to be paid from the Dog Fund
by Warrants 2303 and 2309 inclusive.
UPON MOTION DULY MADE AND SECONDED, IT IS ORDERED THAT THE BOARD DO NOW
ADJOURN.
