FREDERICK COUNTY HITCHING YARD -- METERS
Upon motion duly made and seconded a resolution was passed to fix
parking rate for meters on Boscawen Parking Lot at .05 cents for one hour and .10 cents for
three hours.
Upon motion duly made and seconded a resolution was passed to
purchase necessary meters for Boscawen Street parking lot to be paid by one -half of the
collection of fees derived from the use of parking meters on this lot.
Said sum to be paid every six months until paid in full.
' DUMP - JOINT CITY AND COUNTY
Upon motion by Donald Baughman and seconded by Grover Teets that
the Board appoint a committee to meet with the City of Winchester Dump committee to discuss
a ,joint City and Ccunty Dump. The committee will compose of Joseph A. Massie, Grover Teets

Upon motion of Donald L. Baughman and seconded by W. Hurl Himelrigh
the Board agreed to enter into a contract with the Michie City Publishing Company to prepare

ROUTE 622 and 625 W. F. SHIPE, ET ALS -ALTER AND WIDEN ROAD
WHEREAS The Board of Supervisors at at meeting Spetember. 14, 1964
expressed its opinion that it was necessary to widen, alter and possibly relocate Virginia
Secondary Routes 622 and 625 and to take a small amount of land of W. F. and Neva Shipe and
George & Zettie Funkhouser to accomplishssid purposes; and,
WHEREAS The said W. F. Shipe and Neva Shipe, his wife and George
Funkhouser and Zettie Funkhouser, his wife have refused to convey the necessary land for

the widening of said roads; and,
WHEREAS The Board of Supervisors has by resolution passed at its
Regular Meeting on November 9, 1964, appointed two appraiser to appraise the land of W. F.
Shipe and Neva Shipe, his wife and the land of George Funkhouser and Zettie Funkhouser, his
wife; and,
WHEREAS The appraisers have made their appraisal and report and
recommend the payment of $1.00 dollar to eacbbf said two property owners, the report showing
that the re maining land of each of said property owners will be enhanced in an amount at
least equal to the value of the take.
Now therefore, Be It Resolved that the Clerk of this Board cause
a summons to be served on W. F. Ships and Neva Shipe, his wife, and George Funkhouser and
Zettie Funkhouser, his wife, returnable to the next regular meeting of the Board of Supervise

Mr. Richard Dynes will meet with the respective boards to further
discuss the comprehensive plan of Frederick County.
TREASURER - BANKRUPTCY TAX ,
Upon motion duly made and seconded the Treasurer is ordered to
exonerate a chargeof $1.65, being the amount.of penalty due on a a base tax paid by the
referee in Bankruptcy for Blair Combs for the taxes in year of 1963. '
ORDINANCE - EXEMPTING FROM TAXATION CERTAIN HOUSEHOLD PROPERTY - REJECTED
Upon motion of Donald L. Baughman and seconded by Paul L. Luttrell
the Board rejects the ordinance exempting from taxation certain household property.
A delegation appeared before the Board and object to the exemption
of tax from certain household personal property.
LEVY -T" RATE
Upon motion of W. Hurl Himelright and seconded by Donald L. Baughman
a resolution was passed that there be a tax rate of $3.00 per One Hundred Dollars on all
personal property, machinery, public utilities, merchants capital, and tools for the tax
year of 1965 -1966, and from said levy there shall be deducted a special levy of .45 cents per
Hundred Dollars for School Building Fund. '
Upon motion duly made and seconded by that there be a tax rate of
$2.20 per One Hundred Dollars on all Real Estate for the tax year of 1965 -1966, and from
said levy there shall be deducted a special levy of .45 cents per One Hundred Dollars for
School Building Fund.
VARIANCE - CHARLES A. PINE, ET ALS - DELEGATION
A delegation appeared before the Board and opposed the Variance of
Charles A. Pine, Sr., et als as to the use of a used car lot and mobile home sales lot on
zoned Area B on Route 11 north.
The board accepted the Variance as presented by the Planning CommissioP.
SCHOOL BUDGET - JAMES WOOD SCHOOL BAND UNIFORMS '
Tom Rosenberger appeared before the Board in regards to purchase
of James Wood Band Uniforms and requested that $3,000.00 be left in the School Budget for
the above purpose.
No action was taken.
RE- ASSESSMENT OF REAL ESTATE - DELEGATION
A delegation of three people appeared before the Board and presented
an unsigned.petition declaring the re- assessment of Real Estate in Frederick County, Virginia
during the year of 1964 -1965 be declared null, void and of no effect.
No action was taken.

Accounts totaling $10,837.16 were read and approved and ordered to be

RE- ASSESSMENT OF REAL ESTATE - DELEGATION
A delegation of Frederick County Taxpayers appeared before the
Board and requested.the Board to nullify the recent reassessment of county real estate.
No action was taken.
JUSTICE OF PEACE - USE OF COURT ROOM
Bennie H. Jones, Jr. appeared before the Board and requested that
the County Justices of the Peace be allowed to use the County Court House for their sessions.
Upon motion duly made and seconded permission was granted by the
Board for use of the County Court Room providing it does not conflict with Court proceedings.
SHIPE AND FUNKHOUSER - ROUTE 0 622 and ROUTE 625 - ALTER AND WIDEN ROAD
Mr. and Mrs. George Funkhouser appeared before the Board and
the Board that they were willing to convey the necessary land to the County of Frederick for
the widening of secondary Route 622 as set forth in the plat filed by Highway Department
filed with the Clerk of the Circuit Court providing the Highway Department move the fence
and shrubbery.
The Board requested Mr. King of,the State Highway Department to
work out negotiation with Mr. Funkhouser.
On motion duly made and seconded the following resolution was
unanimo approved:
Be it resolved that the Treasurer of Frederick County deposit with
the Clerk of the Circuit Court of said County the sum of $1.00, the same being the appraised
value of all the property of W. F. Ships and Anita Ships his wife situate on Secondary Road
#625 which the Board of Supervisors of Frederick County deems to the public interest to be
needed to regrade, repair, widen and relocate said roadway.
And be it further resolved that the County by the Commonwealth's
Attorney proceed to institute Condemnation proceedings to acquire the legal title to all
of that land of the said W. F. Shipe and Anita Shipe, his wife as set forth in the plat
and plan of the State Department of Highways filed with said Clerk.

Upon motion duly made and seconded the Planning Commission accepted the
application requesting for an amendment or special exception permitting the said land of
Wilie W. Hunt to be used for commercial purposes as a motel, restaurant and or automobile
service station. The motion was carried.
After due consideration and on motion of Grover Teets and seconded by
Donald Baughman the Board accepted the Wilkie W. Hunt variance as presented by Planning
Commission.

a proposed ordinance to amend Paragraph 6 of the County Subdivision Ordinance by excepting
from the requirements for frontage of lots the 7.3 acres of land more or less now owned by
Brownie Kern Sutton and under option to W -D Company, Inc. and requiring the dwellings to be
awnnected to-municipal water and sewer lines, in order to construct town houses on said proper

Joseph A. Massie, Jr., presented an ordinance to the Board asking such
portion of the plat of the subdivision named Subdivision No. 2 Orchard Terrace Plumly Devel
as is located in Frederick County, Virginia, be and it is hereby vacated.
On motion of Donald L. Baughman and seconded by Grover Teets the Ordinance
passed its first and second reading and is ordered to be advertised.
ORCHARD TERRACE - P. D. PLUMLY LAND - NOTICE - VACATION OF PLAT
N O T I C E
On Monday, June 14 1965 at 11:30 o'clock A. M. in the Board Room of the
Supervisors of Frederick County, in the County Building, there will be a public hearing
concerning a proposed ordinance to vacate a portion of the land in Frederic*ounty, Virginia,
of Subdivision No. 2, Orchard Terrace Plumly Development. The land is located on the east
side of Kent Street and extending east to Smithfield Avenue, and will be used for lumber
storage.
NORTHERN VIRGINIA POWER COMPANY - MOVE SAFE
The board agreed to grant permission to Northern Virginia Power Company to
remove the safe from their building across the County property.
The Power Company to incur any and all property damage.

Mr. Robert Aylor and Charles E. Bass appeared before the Board with a
resolution from the School Board as follows:
WHEREAS, the Frederick County School Board uses a freedom -of- choice plan in
11 the assignment of pupils to the schools of the county; and

services of the State Pupil Placement Board in the assignment of said pupils.
THEREFORE, NOW BE IT RESOLVED: That the Frederick County
Board hereby requests the Frederick County Board of Supervisors to take the necessary steps
leading to the enactment of an ordinance which will remove the School Board from the jurisdic
of the State Pupil Placement Board as an instrument for the Assignment of school pupils to
the schools of Frederick County.
Upon motion duly made and seconded the board accepted the

above resolution and notice is ordered to be advertised.

FOREST RESERVE FUND - APPROPRIATION
Upon motion duly ( made and seconded the Board agreed not to sign
the request of Sidney C. Day, Comptroller to execute a form agreeing to expend the Forest
Reserve Fund money only for operations in which there is absolutely no discrimination on
the basis of race, color and national origin.
COURT HOUSE
The Frederick County Tax Payers Association request permission
to use the Frederick County Courtroom on the third Monday of each month at 7:30 P. M. for
the purpose of holding meetings and conducting the business of the association.
Upon motion duly made and seconded was granted
by the board for use of the County Court Room, ( providing it did not conflict with court
proceedings.

MENDS RESTROOM - CLOSED
Upon motion duly made and seconded, it is ordered that the
Men's Restroom in the basement of the County Court House be temporailly closed as of May 10,
1965.

been approved by the Department of Highways effective April 20, 1965.

The following addition to the Secondary Road System of Frederick
County has been approved by the Department of Highways effective April 27, 1965.

Williams Road - beginning at Route 522 and extending 0.45 Mi.
0.45 mile north.
FREDERICK COUNTY BUDGET - APPROVED
On motion duly made and seconded the Frederick County Budget for the
' Fiscal year beginning on the first day of July, 1965, and ending on the 30th day of June,
1966 was approved as presented.
The Clerk is ordered and authorized to have the same published in
the Winchester Evening Star as required by law and the public hearing thereof shall be held
on the 14th day of June, 1965, at 2:00 P. M.
ACCOUNTS PAYABLE
Accounts totaling $10,174.53 were read and approved and ordered to
be paid from the General County Funds by Warrants 117 to 188 inclusive: Livestock, Fowl
Claim and Henry Bursey's Salary totaling $430.54 were read and ordered to be paid from the
Dog Fund by Warrants 2298 to 2302 inclusive.
