Brumback, Chairman; Grover Teets, W. Hurl Himelright, Paul Luttrell and Donald L. Baughman. The minutes of the last meeting held on the 8th day of February, 1965, ' were read and approved. REPORTS: UPON MOTION DULY MADE AND SECONDED The reports of Harpy L. McCann, Treasurer; Earl S. Bailey, Commissioner of Revenue; Robert L. DeHaven, Sheriff of Frederick County, Joseph A. Massie, Jr., Commonwealth Attorney; Roberta. A. James, Department ' of Welfare; Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and D. H. Road Engineer were read and approved. APPLE BLOSSOM COMMITTEE - PLAZA Upon request of J. P. Arthur of the Apple Blossom Committee that they be granted permission to use the plaza for Amusements Thursday, Friday, and Saturday, April 29, 30 and May 1, 1965, to be used as in former years. All equipment to be removed by early Saturday morning. Upon motion duly made and seconded, it was unanimously decided to grant the above requested permission; subject however, to the following restrictions; that no br be damaged, all damage to meters to be paid, no stakes to be driven, no wires to be used; and further it is not to be used for living quarters. Bond is to be posted if declared necessary by said Board. ROAD REPAIRS - ROUTE 671 Mrs. Eula Lutzenhiser of Gain$sboro District appeared requesting to Route 671. The request was referred to Mr. R. C. King, Resident Road Engineer. LARD FAIRFAX SOIL CONSERVATION - CONTRIBUTION Roy Bageant appeared before the Board and requested a contribution to the Lord Fairfax Soil Conservation District. No Action was taken. LINDEN HEIGHTS ADDITION - SECTION 1 lee A. Ebert appeared before the Board with the plat of Linden Heights Addition - Section 1. Upon motion duly made and seconded Section 1 of Linden Heights Addition was accepted, subject however to approval of City of Winchester. LINDEN AVENUE - ADDITION TO SECONDARY SYSTEM The following addition to the Secondary Road System of Frederick County ' has been approved by the Department of Highways effective February 25, 1965. ADDITION LENGTH Linden Avenue - from Route 736 0.50 Mi. (Linden Avenue) to Caroline Street EQUALIZATION BOARD - COMPENSATION Upon motion made by W. Hurl Himelright and seconded by Donald L. it was unanimously ordered and agreed that the Compensation of each member of the Frederick County Equalization Board be and hereby is fixed at $25.00 per day, plus mileage. a PARKING METERS - FREDERICK COUNTY HITCHING YARD Mr. Jesse D. Jones, Sales Representative of Koontz Equipment appeared before the Board explaining types and prices of parking meters for County Hitching Yard.. No Action was taken. FOREST FIRE CONTROL EXPENSE REPORT Upon motion duly made and seconded the Board decided to have the Virg4ia Division of Forestry continue to.send Form 12 (Forest Fire Control Expense Report) with Forestry Statement. I ORDINANCE - AMENDED PARKING METER- NOTICE Upon motion duly made and seconded the Clerk is ordered to have pub in the Winchester Evening Star once a week for two successive weeks , the following notice, to -wit: The Board of Supervisor's of Frederick County, Virginia, at the regula meeting on April 12, 1965, proposes to adopt an Amended Parking Meter Ordinance. All persons interested in the same should appear before the Board at said Meeting between the hours of 10:00 A. M. and 4:00 P. M. in the Board Room in the County Office Building on said date for ` its third and final reading and adoption. ORDINANCE - AMENDED PARKING METER ORDINANCE - FREDERICK COUNTY HITCHING YARD Upon motion duly made and seconded the following Ordinance 'Unanimo ' passed its first and second reading to -wit: AMENDMENT TO AN ORDINANCE PROVIDING FOR THE REGULATION OF TRAFFIC ON COUNTY PROPERTY KNOWN AS THE PLAZA ADJOINING THE COURTHOUSE IN THE CITY OF WINCHESTER VIRGINIA, PROVIDING FOR PARKING ME'T'ERS THEREFOR, POLICING THEREOF AND PENALTIES FOR THE VIOLATION THEREOF: BY ADDING TO SAID PLAZA AREA THE COUNTY PARKING LOT ON THE SOUTH SIDE OF EAST BOSCAWEN STREET BOUNDED ON THE WEST BY THE CITY SERVICE OIL CORPORATION LEASE, ON THE SOUTH BY THE TOWN RUN AND ON THE EAST BY A CITY OF WINCHESTER PARKING LOT BE IT ORDAINED AND ENACTED by the Board of Supervisors of the County of Frederick, State of Virginia, and it is hereby ordained and enacted by the authority of the same: THAT all of the terms and conditions of that certain ordinance provid for regulation of traffic on the county property known as The Plaza, set forth in this title, ' be enlarged to take into and apply to the county parking lot lying and being situate in the City of Winchester,Virginia, on the South side of East Boscawen Street and bounded on the West by the City Service 011 Corporation lease, on the South by the Town Run, and on the East by a parking lot of the City of Winchester, and that to all intents and purposes the original ordinance which was adopted on the 1st day of July, 1962, by the Board of Supervisors apply ' to the additional area hereinabove set forth. Approved by the Board of Supervisors at its regular March meeting, he l on the 8th day of March, 1965, after due notification and public hearing. ORDINANCE - EXEMPTING FROM TAXATION CERTAIN HOUSEHOLD PERSONAL PROPERTY - NOTICE Upon motion duly made and seconded the Clerk is ordered to have published in the Winchester Evening Star once a week for two successive weeks, the follow- ing notice, to -wit: The Board of Supervisor's of Frederick County, Virginia at the regular 91 meeting on April 12, 1965, proposes to adopt an Ordinance exempting from taxation certain Household Personal Property. All persons interested in the same should appear before the Board at said Meeting between the hours of 10:00 A.M. and 4:00 P.M. in the Board room in the County Office Building on said date for its third and final reading and adoption. ORDINANCE - EXEMPTING FROM TAXATION CERTAIN HOUSEHOLD PERSONAL PROPERTY Upon motion-duly made by Grover Teets and seconded by Donald L. the following Ordinance unanimously passed its first and.3and_sec. nd reading to -wit: AN ORDINANCE EXEMPTING RROM TAXATION CERTAIN HOUSEHOLD ' PERSONAL PROPERTY IN FREDERICK COUNTY, VIRGINIA BE IT ORDAINED, pursuant to Section 58 -829.1 of the Code of Virginia for 1950, as amended, that the following listed personal property shall be exempt in whole from taxation as tangible personal property provided that said property is owned, used or kept by an individual at his residence or by a family or household incident to maintaining an abode, to -Wit: 1. Bicycles. 2. Household and kitchen furniture, including gold and and silver plates, plated ware, watches and clocks, sewing machines, refrigerators, automatic machinery of any type, vacuum cleaners and all other household machinery, books, firearms and weapons of all kinds. 3. Pianos, orgains, phonographs and records players, and records to be used therewith and all other musical instruments of whatever kind, radio and television _ . and equipment. 4. Oil paintings, pictures, statuary, curios, articles of virtue and works of art. 5. Diamonds, cameos or other precious stones and all precious metals used as ornaments of jewelry. 6. Sporting and photographic equipment. 7. Clothing and objects of apparel. 8. All other tangible personal property used by an individual or a family or household incident to maintaining an abode. BE IT FURTHER ORDAINED AND ENACTED that this ordinance shall become effective as of January 1, 1965. Approved by the Board of Supervisors at its regular meeting, held on I the 8th day of March, 1965, after due notification and public hearing. ROADS - WILLIAMS ROAD - ADDITION TO SECONDARY SYSTEM Upon motion made by Grover Teets and seconded by W. Hurl Himelright the following resolution was adopted: ' BE IT RESOLVED That the Highway Department is hereby requested to add the following section of road to the Secondary System of Frederick County, Virginia. The road known as Williams Road, Between Route 522 and .45 Mile North, along, through or over the lands of Opal R. Solenberger, et vir, as follows: Centerline beginning 90 feet East of Foreman Drive being forty(40) feet in width. The right of way was recorded in the Clerk's Office of Frederick County in Deed Book.-308, Page 357 on March 10 1965. 92 VARIANCE - CHARLES A. PINE, ET AL, LAND Upon motion duly made and seconded, it was resolved that a copy of the following application for a Variance be and hereby is referred to the Planning Commission, said Board to investigate and report to the Board of Supervisors on or before -the meeting, which will be held on the 12th day of April, 1965. APPLICATION FOR SPECIAL ECCEPTION OR AMENDMENT TO ZONING The undersigned, Charles A. Pine, Sr., Alfred and Jeanne de Mazzon, respectfully peition the Board of Supervisors, Planning Commission-and/or Zoning Adminis as follows: 1. Petitioners are owners of a certain tract or parcel of land si in Stonewall Magisterial District, Frederick County, Virginia, fronting on the East side of U. S. Highway No. 11 and on the South side of Virginia State Secondary Road No. 661, commonly called Red Bud Road, containing three and one - fourth (3J) acres, more or less, being the same land acquired by the said Alfred de Mazzon, by deed dated August 1, 1944, and duly recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia, in Deed Book 190, at Page 56, said land being the property formerly known as "York Inn ", and being as appears on the sketch attached hereto and incorporated herein by this reference. 2. Charles A. Pine, Sr. believes that the aforesaid land is zoned residential, said land falling within Zone B. At the time of the enactment of the existing Zoning Law the subject land was a nonconforming use inasmuch as it was then improved by York Inn, a restaurant /motel business. The improvements were destroyed by fire more than two (2) years ago. 3. Your Petitioners believe and therefore allege that the developme. of the land in the neighborhood of the subject property during the years since enactment of the Zoning Ordinances, and particularly the influence and impact of construction of U. S. Interstate Highway No. 81, has rendered the subject land unsuitable for residential purposes but highly desirable and suitable for commercial purposes, including use as a motel, restaur and /or automobile service station, and /or used car and /or mobile homes sales lot. WHEREFORE, your Petitioners respectfully apply for a special from and /or amendment to the existing Zoning Ordinances which would remove the existing res zoning:restrictions ' on'the subject three and one - fourth (3k) acre tract and permit the land be used for commercial purposes as a motel, restaurant and /or automobile service station, a or used car and /or mobile home sales lot. WESTWOOD SUBDIVISION - FINAL PLAT - SECTION B Upon motion duly made and seconded, Section B of the Final Plat of ( Westwood Subdivision was accepted, subject however, to the approval of Frederick County Hea 1 . Department and State Highway Department. 4 It appearing to the Board that it is necessary to have Road Viewers, upon motion duly made and seconded, it is ordered that E. W. Adams, Jr. - Gainesboro District, Grant Wilkins, Back Creek District, D. K. Russell, Stonewall District, Carroll Solenberger, Shawnee District, Ray Rinker, Opequon District, be, and hereby are appointed Road Viewers. No Date was set for viewing certain roads. a INC. - SHAWNEE LAND - SECTION III of Shawnee Land, Section III was approved subject,however to the approval of the Frederick On motion of Grover Teets and seconded by W. Hurl Himelright the plat County Health Department. a David G. Simpson, on behalf of W.D Corporation, appeared before the asking for proposed changes to the present subdivision ordinance as follows: The amendment provides for certain exceptions to said ordinances and the requirements for minimum lot sizes in subdivision areas designated and defined as town or multi - family dwelling areas and excepting therefrom certain requirements of the afore said ordinance. Upon motion duly made and seconded the above amendment was continued further study and consideration. - SUBDMSION Upon motion of Donald L. Baughman and seconded by Paul Luttrell, the County Planning Commission is instructed to proceed with further study on Frederick Subdivisions and Ordinances. Upon motion duly made and seconded, it is ordered that a Special Meeting on the preparation of the 1965 and 1966 Frederick County Budget, be held, Wednesday, March 24, 1965 at 7:00 P. M. ACCOUNTS PAYABLE Accounts totaling $10,914.88 were approved and ordered to be paid from) General County Funds by Warrants 23990 -24000 and 1 -47 inclusive; Livestock, fowl claims Henry Bursey's salary totaling $533.62 were read and ordered to be paid from.the Dog Fund Warrants 2274 and 2284 inclusive. The Board agreed on a Special Meeting to discuss the School Budget to be held on March 31, 1965, at 7:00 P. M.
