February 08, 1965am At the Regular Meeting of the Board of Supervisors of Frederick County, Virginia,held in the Supervisors Room on the 8th day of February, 1965. PRESENT: B. 0. Brumback, C hairman ; Grover Teets, W. Hurl Himelright, Paul Luttrell and Donald L. Baughman. The minutes of the last meeting held on the 11th day of January, 1965, were read and approved. REPORTS: UPON MOTION DULY MADE AND SECONDED The reports of Harry L. McCann, Treasurer; Earl S. Bailey, Commissioner of Revenue;-Robert L. DeHaven, Sheriff of erick County; Joseph A. Massie, Jr., Commonwealth Attorney; Roberta A. James, Department of Welfare, Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and D. H. Gaulden, Road Engineer were read and approved. SHAWNEE LAND - LOTS 68 -83 - SECTION 3 Upon motion duly made and seconded the plat of Shawnee Land located in that tract of land conveyed by John and Tillie Komsa to Marjec, Inc., Back Creek District -lots 68 through 83, Section 3 being part of/ as recorded in Deed Book 275 page 377 was approved subject, however, for further study and consideration. C. D. HYLIPON ENTERPRISERS - SEWAGE TREATMENT PLANT In reply to the following request of C. D. Hylton, Enterprises- Sewage Treatment Plant located near Route number 522 in Stonewall District Frederick County, In furtherance of .our discussion at the Board meeting of November 9th, we respectfully request that the Board take an affirmative position if and when contacted by the State Water Control Board or any other agency having jurisdiction over the captioned We-would be pleased if the Board would notify us of its position so that we will feel justified in entering into engineering contracts perta to the plants. And on Motion Duly Made and Seconded the Board unanimously approves the . location of the said named Plant in Frederick County, Stonewall District, subject, however, the approval of the State Control Board. GLAIZE DEVELOPMENTS, INC. AND H. W. BUTLER & BRO.. INC. AMENDMENT TO ZONING ORDINANCE WHEREAS, Glaize Developments, Inc. and H. W. Butler & Bro., Inc., hereinafter called Petitioners, have heretofore filed a petition requesting amendment of the existing zoning ordinance to permit the construction and operation of an automobile service station (commonly called filling station), motel and /or restaurant on land owned by Petitioners conta approximately 3.29 Acres, more or less, situate at the Southwest corner of the intersection of U. S. Highway No. 11 and Virginia State Secondary Road No. 661 (the Welltown Pike) in Stonewall Magisterial District, Frederick County, Virginia, being all the land acquired by Glaize Developments, Inc. by deed from Roy E. Webber dated April 30, 1959, an duly. in the Office of the Clerk of the Circuit Court of Frederick County, Virginia, in Deed Book 257, at Page 467 (LESS 0.28 Acre acquired by the Commonwealth of Virginia in connection with Interstate Route 81) and "LotW' which is a portion of the land conveyed to H. W Butler & Bro., Inc. by deed from Harry W. Butler, et ux, dated March 10, 1952, and duly re- corded in the aforesaid Clerk's Office in Deed Book 223, at Page 147; and WHEREAS, the matter was thereafter in due course referred to the Commission and a public notice and advertisement was had as required by law and a public hear- ing was held February 3, 1965, pursuant to notice published in accordance with 915.1 -431, Code of Virginia; and WHEREAS, the Planning Commission thereafter reported to the Board of- Supervisors its approval of the proposed amendment as being in keeping with good zoning practice: NOW, THEREFORE, BE IT RESOLVED: That, it being in keeping with good zoning practice and in the public interest, the existing zoning ordinance is hereby amended to permit the construction and operation of an automobile service station (commonly called fillirl ' station), motel and/or restaurant upon all that certain tract or parcel of land owned by partly by Glaize Developments, Inc. and partly by H. W. Butler & Bro., Inc. conta 3.29 Acres, more or less, situate at the Southwest corner of the.intersection of U. S. HENRY BURSEY - APPOINTED A SPECIAL POLICEMAN Upon motion duly made and seconded and on the request of Henry Bursey the Boated recommends and requests that the Judge of the Circuit Court of Frederick County, Virginia, appoint him a Special Policeman for Frederick County. ROADS - ADDITIONS - WHITTIER ACRES Upon motion duly made and seconded the Board approves the following additions to the Secondary Road.System of Frederick County. ADDITIONS LENGTH WHITTIER ACRES SUBDIVISION. SECTION II: ' Branner Circle - from Branner Avenue east 0.03 mile including cul-de -sac. 0.03 Mi. Isaac Street - from Route 1307 to Branner Avenue. 0.04 Mi. Branner "Avenue - from Whittier Avenue to 0.02 Mile north of Ridge Avenue. 0;28 Mi. KOONTz EQUIPMENT CORPORATION - PARKING METERS Upon motion duly made and seconded, it was ordered that the Clerk correspond with the Koontz Equipment Corporation in regard to installing Parking Meters on the lot known as the(Frederick County Hitching Lot), located on the east side of Cameron Street. LOCKHART SUBDIVISION - DEED - IMPROVEMENT TO BROAD STREET ' Upon motion duly made and seconded the deed between Edwin S. Mason and others to the Commonwealth of Virginia located on Broad Street from Route 657 to 0.45 miles South was approved and accepted by the Board and the Clerk is ordered to record the same in the Deed Book of Frederick County. ' ADDITION - LOCKHART SUBDIVISION - BROAD STREET Upon motion duly made and seconded the following Resolution was passed: BE IT RESOLVED That the Virginia Department of Highways is hereby requested to add the following section of road to the Secondary Road System of Frederick County,., Virginia. The estimated cost being ($4,800.00). These residents have collected 75% of the estimated cost which is their share of the cost.
