A special Meeting of a Committee composed of all members of the Board

1964 at 7:30 P. M. for further study and consideration of Trailer Units.
Upon motion duly made and seconded the following was unanimously passed:
BE IT RESOLVED that thAputure Land Use Map of Frederick County and the
ten reports filed with the lerk of the Board of Supervisors with the recommendations of the
County Planning Commission for its adoption by the Board of Supervisors as the Master Plan for
the future Development of Frederick County be and the same is hereby adopted as the Master
Plan for the Future Development of Frederick County, including the addition thereto of the
Robinson Industrial Park south of Kernstown, and the elimination of the public school area
shown on Virginia Secondary Road 656 and the proposed road from U. S. Route 50 South to Cedar
Creed Grade Virginia Secondary Route 622 next to the Western City Limits of Winchester and
the proper indication of public school areas on the North side of Virginia Secondary Road
657 and to the west of Virginia Secondary Road 739 at the end of Virginia Secondary Road 736.

Upon motion duly made and seconded the following Resolution was

MIDDLETOWN PETITION - WAYSIDE INN - SEWER LINE
To the Honorable Members of the Board: The following Petition was
presented to the Board to -wit:
I
PETITION
Your Petitioner, Wayside Inn Since 1797, Inc., respectfully shows
unto the Board the following:
1. That among other realty, the Corporation owns the realty situate
on the West side of U. S. Highway No. 11 in the Town of Middletown, Virginia, portions of
which realty are contiguous to Capon Avenue and Senseny Avenue, as shown on the plat of the
Addition to Middletown.
2. That your Petitioner desires to construct a sewer disposal
system by means of a lagoon and desires to transfer the affluent over Senseney Avenue and
Capon Avenue to Mill Brook.
3. Your Petitioner alleges that said streets are not at this time
open to the public and may perhaps be abandoned but feelsit is in the best interest of itself

to secure permission from the Board to lay said line. The affluent to be transported through
said pipe line to the Town Run has been approved by the Winchester- Frederick County Health
Department, and the line would be laid below the surface of the gm und'approximately three
feet and would not exceed ten inches in diameter.
And upon motion duly made and seconded the Board agreed that they h
no objection to constructing said sewer lines as requested in said petition.
ADDITIONAL SALARY OF COMMISSIONER OF REVENUE
Upon motion duly made and seconded the Board approves the additional
salary of Earl S. Bailey, Commissioner of the Revenue as fixed by the Compensation Board as
follows:
The General Assembly, by Chapter 386 of the Acts of 1964, fixed

the minimum salary of the Commissioner of the Revenue of Frederick County at $6,100.00 per
annum, effective July 1 1964. This means that the present salary of $6,000.00 per annum
1 ,
must be increased to the legal minimum as of July 1, 1964. Thus the prelisted payroll for Jul
1964, and succeeding months, will show monthly salary of $508.33•

HOUSE AT FREDERICK COUNTY GARBAGE DUMP
Upon motion duly made and seconded it is ordered that Mr. Alonzo Smith be
the use of the House which is located on the Frederick County Garbage Dump for one year
provided, however, that he paints the building, repairs lights and grade the ground
the said House.
NORTHERN VIRGINIA POWER COMPANY OF WINCHESTER, VA.
The Northern Virginia Power Company of Winchester, Virginia requested that they
be given permission to install a night deposit unit on the sidewalk at the north western

Upon motion duly made and seconded the following resolution was passed.
Be'.it resolved that the Bond of Russell Patterson for the construction of Went-
, worth Drive which was filed on the 9th day of October, 1962, in the sum of $5,000.00 be de-
clared forfeited on the grounds that Russell Patterson, the obligor, has violated the terms
of said bond and not constructed said street as required, and be it further resolved that
the Clerk forthwith notify in writing the surety, Indemnity Insurance Company of North America
by Marvin E. Gore, upon said bond for payment of the same to the County due to said forfeiture
FREDERICK COUNTY AND WINCHESTER HEALTH DEPARTMENT
Dr. L. 0. Fears, Director of the Frederick County Winchester Health Department
appeared before the Board and requested that an additional amount of ,$388.88 be allocated to
the said Department for the fiscal year of 1964 -1965 and after due consideration and on motion
by Grover Teets and seconded by Donald L. Baughman the request was allowed.
Voting for request: Grover Teets, Donald Baughman and B. 0. Brumback.
Voting against said request was Paul Luttrell and W. Hurl Himelright.

Robert E. Aylor, Superintendent of the Frederick County Schools,
with School Board members Huyett G. Light and Clyde Logan appeared before the Board and
that the City of Winchester had condemned the old repair and storage shop located
the Miller School property on Whitlock Avenue in the City of Winchester. It was stated
t the School Board plans to build a new shop on the Robinson School lot facing the Paper
1 Road but that the School Board had not included the cost of this construction in the
4 -1965 school budget.
The Board of Supervisors on motion of Grover Teets and seconded by
. Hurl Himelright unanimously approved the project and voted to e armar k any re maining balance
f the 1963 -1964 county appropriation of $543,360.00 for this project. The amount so ear-

On the 4th day of August, 1964, all five members of the Board of Supervisor
met at the County Office - Building and thereupon all five members requested in writing address
' to the Clerk of the Board, Loe N. Whitacre, that he thereupon notify all the members of the
Board and the Commonwealth's Attorney that the Board of Supervisors desired a special meeting
of the Board to be held at 7:30 P. M. Eastern Daylight Savings Time August 4, 1964 in said
County Office Building to consider a request of the Frederick_ County School Board to act upon
a proposed resolution to authorize the Frederick County School act upon the resolution of
the Treasury Board of the State of Virginia to purchase 850 Bonds of said School Board each
in the sum of 1,000.00 bearing 3 1/8% interest as set forth in said resolution and to also
authorize the issuance of said Bonds by said School Board by approving a resolution of the Fn4
rick County School Board duly adopted July 20, 1964 a copy of each resolution being attached

hereto and made a part of these minutes.
Whereupon each member of the Board of Supervisors and the Common-
wealths Attorney thereupon in writing by signing these minutes duly waived 5 days notice in
writing from the Clerk of said Board of said special meeting.
On motion duly made by Grover Teets, seconded by Paul L. Luttrell,
the Board of Supervisors, did thereupon all members being present, as well as the
Attorney unanimo adopt, ratify and confirm the resolution of the Treasury Board of the
State of Virginia and the resolution of the Frederick County School Board, copies of which a
attached hereto, -which resolutions provides for the issuance and sale of 850 $1,000.00 bonds
of the Frederick County School Board.

endorse the recommendttion of the Northern Valley Recreational Development

There is a constantly increasing demand for outdoor recreation facilities
and constantly decreasing open space for providing these facilities; and
Whereas:
Virginia's population is increasing rapidly and becoming overcrowded in
urban and suburban areas; and
Whereas:
Whereas the Commonwealth has co'comprehensive policy or plan for meeting
the present and anticipating the needs for outdoor recreation; and
Whereas:
The General Assembly has created a Virginia Outdoor Recreation Study
Commission to specifically deal with these needs; and
Whereas:
It is the provim a of the Virginia Outdoor Recreation Study Commission to
inventory and appraise the federal state and local outdoor recreation
facilities in Virginia in relation to its estimate of present and projected
needs, and to make recommendations; now therefore
Be it Resolved
By the Shenandoah Valley Motel Association that these needs are real; that
additional STATE PARKS must and should be established to meet these needs;
that the Virginia Outdoor Recreation Study Commission is hereby petitioned
and respectfully requested to favorabl6i consider the establishment of one of
these STATE PARKS in the Northern Shenandoah Valley Area.

the same is hereby recinded, inasmuch as the street has been built according to
of the Highway Department.
BUILDING PERMIT - WILLIAM H. NAGLEY
The following request of William H. Nagley was presented to the Board
for a permit as follows, to -wit:
The roof of this building, which has been constructed for a number of
years, is in dire need of repair. However, I do realize the Zoning requires a $10,000.00
building, but ince most of this work will be done by me, I can keep the cost down to a minima
of $7,000.00. This building will be block, brick, and frame. If permission for construction
will be granted, it would certainly improve the property appearance.
If I am allowed to build a roof only, the price involved would be
approximately one - fourth of the structure of the building.
Upon motion duly made and seconded the above request was referred to
the Planning Commission.

The County Treasurer, Harry L. McCann presented to the Board a list
of Delinquent Personal Property Tax for the year of 1963 as of June 30, 1964 in the amount of
$14,781.40; and also the Delinquent Real Estate Tax for the July 1, 1963 year to June 30,
1964, in the amount of $17,033.95 the total being $31,815.35•
Upon motion duly made and seconded it was unanimously approved as
presented.

PLANNING COMMISSION
A report of the Frederick County Planning Commission given by William
H. Nagley, who requested the Board of Supervisors for a Variance in the restrictions of

This Special Meeting was ordered by the Board of Supervisors at their
Regular Meeting, which was had on the 9th day of November, 1964 All members were present,
also present were the Honorable Elliot Marshall, Judge; Joseph A. Massie, Jr., Commonwealth's
Attorney; J. Sloan Kuykendall, a member of a Special Court House Committee, also present
was Henry Boynton of the firm of Smithney and Boynton, Architects, Roanoke, Virginia.
Judge Marshall requested that the plans for renovating and remodeling the old Court House be
abandoned and instead that the Circuit Court be returned to the old Court House, providing
exterior and
the Board would repaint the /interior of the building, put in rest rooms, a fury room and a
new Court Room and office for W. E. Edwards, County Judge. General discussion was had on the

annex to the Old Court House and also plans were presented by Mr. Boynton to build a Circuit
Court Room, County Judge Court Room and a three story office building on the land located
south of and adjo County Clerk's Office and west of the J. C. Penny Store.

The undersigned, Glaize Developments, Inc. and H. W. butler & Bro.
both Virginia Corporations, by counsel, respectfully petition the Board of Supervisors as

1. Glaize Developments, Inc. is owner of that certain tract or
parcel of land containing approximately one and three - fourths (1 3/4) acres, lying and being
situate in Stonewall Magisterial District, Frederick County, Virginia, at the Southwest
corner of the intersection of U. S. Highway No. 11 and Virginia State Secondary Road No. 661
(the Welltown Pike),being all the land, originally containing two (2) acres acquired by
Glaize Developments, Inc. by deed from Roy W. Webber dated April 30 1959, and duly recorded

parcel of land containing 1.54 acres lying WEst of and adjoining the land described in
Paragraph 1 above, being a portion of the land conveyed to H. W. Butler & Bro., Inc.by deed
and duly recorded in the aforesaid Clerk's Office in Deed Book 223,
from Harry W. Butler, at ux, dated March 10, 1952, /at Page 147.
3. Attached hereto marked Exhibit A is a plat which shows genera]
the location of the land described in Paragraphs 1 and 2 above, the said land being outlined
in red. The attached plat does not show the effects of land acquired by the Commonwealth of
Virginia in connection with the construction of Route 81 and connecting facilities.
4. Most, if not all, of the aforesaid land is zoned residential
under existing Frederick County Zoning Ordinances.
5. Petitioners believe and therefore allege that the development
of land in the area in question, and particularly the influence and impact of construction
of U. S. Highway No. 81, renders the subject land unsuitable for residential purposes but
highly desirable and suitable for use as an automobile service station (commonly called
filling station), motel or restaurant.
WHEREFORE, your petitioners respectfully petition the Board for
a variance from and amendment to existing Zoning Ordinances which would remove the existing

WHEREAS, the Frederick County School Board has petitioned the Board of
' Supervisors to request the Department of Highways to add to the Secondary System of Highways
Linden Avenues leading to The Frederick County Junior High School which is nearing completion
in Stonewall Magisterial District.
BE IT RESOLVED That Linden Avenue from Route 736 (Linden Avenue) to
Caroline Street, a distance of .50 miles be added to the Secondary System of State Highways
